My girlfriend and I are thinking about marriage. She is here on a student visa from Venezuela and she is also Canadian citizen. Were do i start and want is the best way to approach the process for her to be a perminent resident. Thanks

Ok, so let me get this straight:
You are a US-citizen and your fiance is from Canada. He is currently visiting you but he does not have a visa. He went through passport control when entering though which means he must have some sort of stamp or some sort of paperwork that allowed him to enter and stay for a certain amount of time. He plans on staying for another 5 months on whatever program allowed him to enter in the first place.

I know there's some special visa for Canadians, so the question is if your husband entered on that visa? The other question would be for how long is he allowed to stay under that visa? And finally if he can stay and adjust status on that visa should you get married?

I would be careful about him staying until August without any visa because he could be illegal during that time which would probably be worse than trying to adjust status after marrying now. You might want to consult with a lawyer on how to proceed, just to be on the safe side.

USCIS used to update their processing times online on the 5th and the 20th of every month, usually at night.
Whether or not someone got an NOA2 from their service center is independent of the processing time update. Also, note that the processing times are not always accurate but estimates.

To answer your question, I think you'd have to start over with the visa process. But, you could of course decide to get married spontaneously and file for a different visa (K3 or CR-1). Or should that spontaneous wedding happen in the US, you could adjust status there (but don't consider this a way to get around a regular visa; the burden on proof considering the spur-of-the-moment decision will be on you).

Processing times are updates around the 5th and the 20th of each month. Sometimes they're late, but they always update the site.

Sorry to be so pragmatic, but there's not use in getting to worked up about USCIS not updating their sites. For the most part, the processing dates are not exact anyway.

The 0190 number is total bullcrap. they have no idea, I tried to ask them several questions and the answer to each one was "I don't know. We do not have the answer to this question". And they questions were easy ones like "how long is the medical valid?" or "what which affidavit of support do I need for K3?" (that was long before I needed those answers of course)


Yup. The expensive line is the biggest waste of time. They told me I had to cancel my interview because I was lacking the police certificate :lol: And to top it, they said I had to write a letter to the consulate because they don't have a phone or a fax machine.

Calling the consulate on their non-existing phone solved the problem. :lol:

You can't just put any random number in an official document just because it's on another official document. An identification number is the same on any document and it is attached to your name for eternity. Neither the number on your driver's license nor the number on your perso meet those criteria.
By your standard, you could also put the number of a student ID in the field or the number on your vaccination pass.

That's bizarre given that there are 3 different driver's license formats, and the numbers change when you exchange or lose your license. As Natashabrenda pointed out, many Germans don't have a license and would thus not have a number which is somewhat weird considering the way in which the government here keeps track of things.

Also, since Germans and foreigners living in Germany are registered by birth date, place of birth, and name, rather than by numbers which change according to documentation consulted, that explanation sounds fishy. I just had my interview and I was not asked for any numbers by anyone, except for my phone number. My police certificate does not have a number attached to my name either.

As I've said before, Germans don't have national identification numbers except for a social security number which is used for that purpose exclusively.

Edit: I also called one of the numbers for the consulate (the 0900-number) and their information turned out to be wrong in any respect. No offense, but those people are not employed by the consulate but by some third company and except for having the power to grant interview dates they have no clue...

You actually send back DS 230 part 1, and you'll have to sign it. Check the consulate info for details on what is included in package 3 (it's a pretty specific overview).

DS 230 part 2 should be in package 4 and you take it to the interview not signed. The directions in the packages are pretty clear though.

A B1 is a business-travel visa and is only issued if you can show that you want to visit the US for business reasons. As such you would need an invitation from a company or a letter from a client indicating the purpose of your journey.

If you want to visit as a tourist, you need a B2-visa. I don't know what the procedures would be for someone from Korea or if you need an invitation. However, even if the visa were granted, you will need to be prepared to by denied at POE or that you will have to produce evidence of your intention to return to your home country.

So in summation... I can use the passport even though it has been valid for only 4 years 10 months? Also I forgot to mention that I have had a passport for only that time, its the 1st passport Ive ever had.
This statement below is still bothering me though "valid, unexpired U.S. passport that was issued for at least five years." My passport has only been issued for 4 years 10 months... I can wait another 2 months, but Im damn near ready to send this out now.

It has to be issued for at least five years not at least five years ago. That means that if your passport has an expiration date that is more than 5 years from the issue date, you are fine and they will be happy to accept your passport.

I assume the reason for this rule is that you could also have an emergency passport that is only valid for a year and lacks certain security features. Normal passports that are presumably difficult if not impossible to forge are valid for either 5 or 10 years. So don't worry about your birthcertificate, copy ALL pages of you passport and use those instead.

Added: The permanent address is the one they will use for all correspondence with your beneficiary (you fiancee). They just want the addresses to make sure that you submit the right police report later on in the process.

I agree the child will not have many problems. But if you want to help herr before coming over think about getting those books for language learners, like "My First 1000 English Words." These books have pictures with the English words next to them and it's a good way to build a basic vocabulary and practice some reading skills. Since your wife knows some English, she can help her daughter go over those books.

Emersion also works extremely well, so any movies/tv shows that they can access in English would be very helpful. However, sending American movies over might not be helpful since Russia has a different region code on DVDs and a different video system. But anything made in and produced for England should work.

Hiring a tutor would also help but I wouldn't do that unless your fiancee's daughter doesn't make any progress through the two methods described above. If you hire a tutor make sure it's a native speaker or someone who has some sort of certificate. Otherwise a tutor is not worth it because they might teach the child bad English which wouldn't ease the transition at all.

We had this discussion a few days ago in regards to Germany. Germans also have a Social Security number but it is only and exclusively used for social security claims not for identification purposes because it is too easy to steal (the system is logical for administration purposes). Every other number assigned, like on passport and other forms of ID, changes when you get a new document.

So, the question is would a British person use their National Insurance Number in any other context than the National Insurance system (e.g. when you open a bank account or apply for a driver's license)? If the answer is NO then there is no national ID-number and the answer on the form should be N/A.

If they give him a time limit, it usually means they're willing to discuss things; he needs to make sure to keep the deadline though. I wouldn't worry too much until then; as long as there is no conviction there shouldn't be a problem.

Wow, thanks for that news Fischkoepfin. I've just been kind of freaking out about this... So you don't think it's necessary to get a German lawyer? I would just rather err on the side of caution! And do you happen to know if everything gets worked out between him and the Finanzamt if anything will be on a permanent record? Thanks soo much again!

If the Finanzamt happens to be uncooperative and threatens to sue, he can still hire a lawyer. But from what I've observed from other people owing money to the Finanzamt, they are usually more interested in the money than in a lawsuit. And unless your fiance is convicted of tax evasion in front of a German criminal court, there's no need to worry because only criminal convictions go on the police certificate in Germany.

So, why don't you ask him to call the Finanzamt on Monday and ask them what they want and how they want him to rectify the problem. While he's at that he can ask them if this oversight on his part will have any consequences. But I'm sure everything will be ok.

The German government is doing all they can currently to track down people who didn't tax their income or tried to get around paying customs. It's not a good thing if you get caught, but it's not bad either unless he refuses to pay. Tax evasion is a crime but in order to actually go to court for it, it has to be worthwhile, and since a law suit would exceed the amount under consideration, it will be ok.

Tell him to contact the Finanzamt (the German IRS) and negotiate a settlement. It's best to be apololetic and to pretend that one didn't do it on purpose. They'll be happy to find out that he'll pay asap and things will be fine.

hey guys!! i need some help (thats nothin new) :P my fiance received a form in the mail today from Frankfurt in regards to his J1 visa. now he was not subject to the two year rule and this form does not say anything about him not being eligible for the K1. it was asking for a copy of the visa ( which he already gave with packet three) and asked if he was given any money for it by his government or the US government. he paid for the whole thing himself out of his pocket. i guess my question is if it standard that all people that were on a J1 receive this or should be worrying that there is a complication of some kind. he did have an issue while on the visa where he was missing a signature when he left for vacation and they gave him a 30 day grace period to get it corrected or he had to leave. he got it corrected and there were no problems. this actually happened twice. would this be an issue to receive a K1 or if since the visa was not revoked just revised i should not worry about this! i would really appreciate some advice!! If he didn't receive funding from the government, it is possible that they are checking to see if his area of study falls into any of those categories?

It's possible, but then again I totally understand ANYONE being confused about j-1 issues, since my wife (who has one) and I have had a real headache in dealing with the rules and regulations regarding hers. The State Department is very unclear and vague about many issues regarding J-1 questions, and I have often received a response from USCIS, only to have it contradicted by the State Department, only to have that contradicted by the consulate etc.....

It IS confusing.....

The information I copied below comes from the State Department website. He obviously doesn't fall into the first category, but perhaps one of the others?

I got that same letter from Frankfurt. They need to check if you're subject to the two-year rule before processing your visa. Tell them no and no and if provide them with all IAP-66/DS 2019s which contain the relevant information. It is at the discretion of the consulate to make the final decision (nothing to worry about in your case).

As to leaving without signatures, it happens but it is a problem because it means you raise a flag with immigration upon return to the US. He could be asked about that in the interview because it is a minor violation of his status. Again, nothing to be worried about, but good to know.

Finally, the good news. I received package 4 as soon as they had confirmation that I was eligble for a visa and had the interview about 10 days later. It won't be that fast for you, but you're almost there. Good luck! :thumbs:

Since you'll have to indicate that your fiance lives in the US on form DS-156, you will most likely have a hard time getting a student visa, because it will be hard to prove that you're not planning to marry and that you don't have immigration intent, especially if you plan on living far away from campus. In your situation getting a student visa is difficult, whether you filed I-129f or not.

That said, your best option would be filing the I-129f and wait for it to be processed before starting grad school. Most schools allow you to defer admission, especially when there is a visa issue that needs to be taken care off.

Regarding your last question, it is of course perfectly legal to get married on a student visa while in the US. You need to be able to convince USCIS, however, that you did not plan to get married when applying for the visa and that you intended to return to your home country when done. I've known many people to do that, and I haven't heard yet of a denial. So, your lawyer might not be the most educated in regard to immigration law, and if you're planning to use an immigration lawyer, start looking for a different one.

As to your visits under VWP, I hope you did not overstay because that can complicate things. VWP only allows you to stay in the US for a certain number of days (90, I think) per year.

Non Residents of the United Kingdom

Although we accept applications from anyone physically present in the United Kingdom, it is often difficult for applicants who are not permanent residents in the United Kingdom to demonstrate that they have sufficiently strong ties to a third country, as consular officers in London or Belfast have no way of verifying or evaluating information from other countries.

If you are a temporary resident of the United Kingdom, or are planning on traveling to the United Kingdom specifically to apply for a visa, you may wish to consider applying for a visa in your country of permanent residence where you will be best able to establish your qualifications for a visa.

Because the wait going through London is shorter (by 60 days on average) and it has a higher approval rate. As I've suggested before, apply now for the visa so that there is a chance that your fiancee can still interview in London. As a student, she should count as a resident and she would have sufficient reason to adjust in the UK. If she continued to be enrolled she would also have an easier time convincing the Immigrations Officer at her POE that she intended to return to the UK, making denial of entry on B2 less likely.

It's finally up to you, but I would be very careful in assuming that your fiancee will be admitted for 6 months and more. Even if she can show that she -not you- has the necessary funds, she will have to convince them that she as a young woman from China is not intending to stay in the US, i.e. intending to marry, intending to work, or intending to become an illegal alien. For that reason she will need to show ties to either China or the UK.

B2 visa-holders can stay for 6 months and extend their stay through USCIS. However, you will have to be able to proof that you have sufficient funds to maintain yourself in the US (the rates are incredible high; it's more than the poverty line since they are considered tourists). Also keep in mind that as your fiancee she will have to be able to present proof of her intention to return to her home country/ country of residence which makes things more difficult.

As to the consulate, it depends on the consulate whether they accept non-resident petitions. There is a chance that your petition will be approved in time for your fiancee to re-enter Britain as a resident, but May sounds like a very close call. Maybe you should apply now. You have a certain time frame to activate the visa (90 days, I think, after issuance) and then 90 days in the US to get married.

He was in ROTC and thought it was automatic (yes he is a dumba$$) .. anyhow... he decided to take some college courses this year and had a hard time because of this. However he was able to write an "excuse letter" of sorts and had it notarized and was "cleared". This might be possible if you run into problems. But if he is still eligible then I would have him sign up asap!!!

Exactly Missy!! Yes, it was 2 years in March. I am not trying to get out of AP at all. I know it is a common practice, especially in Nigeria so I figured if we are waiting anyway and can do the AOS over there and forego that extra step once he gets here that would be great. By going this route my husband would also be able to work much sooner and wouldn't have to wait for the EAD and he's receive his green card within a month or two. However, I do NOT want to screw anything up and have to wait an even longer time. So I'm just looking for some direction and to find out if others have done the same and how successful its been. Thanks for the info........Just because you file a K3 doesn't mean you automatically file for the CR1/IR1 as well. You have to request the approved I130 onto the embassy, which means you adjust your status in the SO's home country. Otherwise if you interview on the I129f (which we did) the I130 stays in the states to be later processed with adustment of status once the benificiary is here in the USA. You must specifically request the I130 to go to the embassy, which is what makes it the CR1/IR1.
