Hi: I was raised in canada but had no vaccination record - I too was a bit concerned but when I went to have the physical the panel physician asked me questions and based on the fact that I was born and raised here and based also on my year of birth he determined which vaccinations I needed to meet the requirements. I would assume that this would be the case with your wife also - its a good question to ask the physician's office when you set up the medical appointment but it should be nothing major - at the most I would think it may mean that your wife has to have a few extra immunizations. after reading this post I simply have to comment.......why would anyone who entered the U.S. illegally EXPECT at ANY point to be able to file some paperwork and be given the same rights as citizens who were born in the country or others who followed the law and its process and were subsequently granted either immigrant status or citizenship. The logical outcome for your actions should be expulsion or PROSECUTION.

This is a rather delayed response to your post but just wanted to tell you.....I am Cdn, husband is American - I cross the border every 10 days or so using only my Cdn drivers license - have never used my passport - date that they will be required has been pushed back til next summer and who knows it will no doubt be pushed back again then. Just wanted to post this upate - our case was completed on Nov 30/07 at the NVC.......just heard today via hubby's state rep's office who had inquired and received an email from the NVC - our interview is set for Feb 22 at 8:30 am! CanadaFeb 22/08 CR1 interview in Montreal
Arrived in Montreal Thursday afternoon, checked in to hotel (Le Square Phillips just around the corner, very overpriced but only a 3 minute walk) Took a walk over to make sure we knew the location of entrance to the consulate (could picture us wandering aimlessly Friday morning searching in vain for the doorway). After very little sleep we arrived at said doorway at 7am - already one other couple waiting. We huddled there until 7:30 when they opened the door - several other people arriving in the meantime. Guard checked letters before allowing entrance. Put everything in the basket, even hubby's belt - guard asked if his pants would fall down without it, hubby stated he hoped not! On through the metal detector, I beeped it so had to be checked front and back with the wand thingy. First couple were given tag with "a", we were given "b". Told to go downstairs and have a seat someone would be along within 10 mins or so to escort us up in the elevator to 19th floor. Guards were very firm but nice - one actually smiled. After a short wait the lucky holders of tags "a through d" were escorted into the elevator and in total silence we ascended to the next level. Couple one were told to go to window 9 and give the lady their tag. We were to wait as next in line......very shortly went to window 9 and she took our tag and appointment letter and told us to sit in the waiting room and we would be called back. After about 10 minutes we were called back to window 9 again this time by a friendly fellow who asked for my medical results and prepaid envelope (he did not want the xrays) He told us they were processing both our K-3 and CR1 applications at the same time and inquired why we didn't do the fiance thing and wait for K1 approval before getting married. We had been advised by an immigration officer at the local border crossing that we should just go ahead and get married then file, which we told him. He asked hubby a couple of questions about his income and did he have his w2's with him for 2007, which he did not. Hubby got confused and stated that income of a certain amount as showing on the affidavit of support was for a certain year when it was actually for another year. After getting me to sign part 2 of the DS230 and provide updated mailing address we were instructed to have a seat again, he had to work on the file a bit and would call us back up to take my fingerprints. Sat in waiting room again, my stomach in knots now. Called back again to window #9 and he took my fingerprints and told us to have a seat and they would call us one more time. Back to the waiting room. During this wait the couple who were first in line were called to room 8 and came back very shortly with smiles, I asked and was told they had been approved. After about 15 minutes total wait we were called to the interview room and a very friendly man asked us a few more questions, including where we met, what I intended to do for work in the U.S; talked to my husband about his work and then said that the medical was fine and that the financials were fine also and that we were approved. If there hadn't been glass between us that poor man who have been grabbed and hugged. He did not ask for any proof of our relationship. Told us that the visa would be completed either that day or Monday and could take up to 2 weeks to arrive. I found everyone to be very helpful - no one was rude or unfriendly. We were all done and out the door by 9am!

Hi everyone! First of all I want to say a big THANK YOU to everyone here - finding the VJ website and all the folks who contribute here has been a big help with this long process. Best wishes to everyone on their personal journeys. I do have another question tho.....

Visa approved last Friday in Montreal - just called the post office and the xpresspost envelope has arrived - will be picking it up tomorrow and coming through the border from New Brunswick to Maine. I will need to import my vehicle - I have my compliance letter in hand but am wondering about the actual process. Are there forms that I should print/fill out and bring with me? After that is all done I have personal effects that I stored with family but won't be able to bring them across with me tomorrow, and then there's the remainder of my belongings/furniture which are with the movers, in storage, in NB. Has anyone had a problem bringing belongs into the US a couple of months after entering the country? Any experience or input would be greatly appreciated! Thanks very much!

Hi everyone. We are getting ready to file for removal of conditions on my PR. Husband has been off work since Aug/07 and I have had business interests in Canada and did not know I needed to file tax returns here in the US ( I know - sounds stupid doesn't it) I filed in Canada. The evidence that we have for the petition are: joint ownership deeds to home and property and joint title for one vehicle. Insurance for home and 3 vehicles in both names over 3 year period. Letter from my sons school stating he's been a student there for past 2 years and we are both listed as parents with same address; copy of joint credit card, joint bank account cards and statements (not a lot of account activity for the past few months though) over a two year period, 5 affidavits - 3 from family on both sides, 1 from my son's father, 1 from a friend. I can also send copies of receipts for various improvements that we've done to our home. We don't have health insurance. Can anyone comment if they've successfully had conditions removed WITHOUT providing tax transcripts. Thanks very much!

Even if they were diligent and mailed everyone reminder letters without fail, there is no guaranty that it will be delivered. Mark your calendars, learn, and pay attention to your process !


I received a reminder notification about a week before the beginning of the 90 day period - late Nov/09. From everything I've read I didn't expect this and was quite surprised - but I wasn't depending on a reminder - and I doubt many in our situation would wait or depend on such a reminder.

Removing Conditions on Residency General DiscussionForm I-751: Part 5. Information About Your Children

The way I see it, the form is asking for information about the alien spouse. Part 1 - Information about YOU (the petitioner). Part 3 - Information about YOUR spouse or parent. So Part 5 - Information about YOUR children - leads me to believe that they are asking about biological or adopted children of the immigrant spouse. We have never listed my daughter (from a previous marriage) on any of my husband's immigration forms. It just doesn't seem relevant to do so. Just my 2 cents!

I think your two cents make a lot of sense Rosie! This is exactly what we have done - my son is mentioned (I'm the one with the antennas) my husbands children have never been part of the process - they are all USC - which my son is also but he is listed in section 5 of the I-751 as such and I don't expect to get a biometrics fee request for him - he was also listed when we first applied and we supplied his birth certificate at that time. He's lived with us throughout the entire conditional period and a letter from his high school is part of the evidence I'm submitting.

I think what you've said is the only logical way of looking at the question.

Removing Conditions on Residency General DiscussionRemoval of conditional permanent residence

I am eligible to apply for removal of conditional residency on May 1, 2010 (this is 90 days before my conditional permanent residency expires). However, I need to travel out of the country in March 2010 for several months.

Can I apply for the permanent residency while I am away from the U.S.? If it takes 6-months to get processed, then how I will I return to the country?

This is just my opinion, cause I am no expert in anything! But from what I've read on your thread I would agree with waiting til just before your 2 year GC is due to expire to send in the I-751 packet - as he said, about 20 days - this would give enough time for them to receive your packet and send an NOA which extends your status by a year. Maybe you could have the envelope all ready to mail and left with someone you could trust to send if off on the right date. They would then have to watch for the NOA and forward it to you immediately so you would have it in hand to re-enter the US. You'd then be back in the country for your biometrics, etc. I have read on here that some people don't receive their NOA in a timely manner so you and your friend here doing the mailing would have to be vigilant. We just sent in my I-751 and had the NOA within a week - from the VSC. Good luck and have a safe journey.

Removing Conditions on Residency General DiscussionDilemma! Need Advice

You can travel internationally until the expiration date on the Green Card.

After that date you will need the NOA1 or you will have problems getting be allowed in. Keep in mind the NOA1 is not automatic. If something is obviously missing, you can wait for it until the end of time.

A few weeks after the NOA1, the NOA2 appointment will take place. If you miss that, you're in trouble.

The NOA1 is not voided by travel. It becomes meaningless once you have received your 10-year GC, however.


I have a question - I thought that the biometrics took care of photos for the new 10 year gc - this post indicates that once the conditions are lifted you get a letter telling you to appear again at the service office, bringing photos and talks about a new form 551 - which is what I believe is a card that you put in your passport. I have a 2 year gc, have never had to show my passport at a POE since receiving it - I always show my gc and I've crossed back and from to and from Canada many times. Is the 551 for use until receipt of the new gc? I am confused. If anyone could clarify I'd sure appreciate it. Thanks!

You do need that information.

They need to be American citizens and provide a birth certificate. American citizens have SSN's so it's required.

May I ask, why don't they want that info listed? Do they not have them? Or for personal reasons?


Vanessa and Tony: Could you post a link to where it states that the people who provide affidavits for ROC need to be American citizens - I could not find that requirement written anywhere but it's quite possible that I missed something. Thanks!

Hi everyone, I just posted to the January/10 filers thread that I'd received an email update that my card production was ordered on April 14/10.

I wanted to post a copy of the letter we sent with the petition to possibly help others who are getting ready to file their I-751's. We had quite a bit of evidence showing co-mingling of assets and also evidence showing that my son lived with us, including a letter from his high school. What we did not have was tax returns - we have not filed joint returns since our marriage and I was quite concerned that we'd get a RFE on this and that it would cause us problems - but, I've also seen numerous filers on here who've sent tax returns as evidence and still rec'd an RFE. I'm so very happy that the evidence we did send was sufficient.

With the stamp in your passport you should be just fine! It sounds like the immigration officer you saw was very helpful which is wonderful - a reasonable, knowledgeable IO can make a world of difference in someone's situation. If you leave the country with only that receipt in hand you will not get back in. You are divorced from your US Citizen spouse, you have no legal status in the US and you'll be showing intent to enter the country and live here illegally. You will be turned back by the USCIS officers at the Port of Entry when you attempt to come back in. I'm sorry to speak so bluntly but I'm trying to make it plain to you that you should not ignore your lawyer on this. If you really want to continue to live in the US and work here do not leave while you are out of status.

Hi everyone,

I'm about to file my I-751, and am a little nervous that I don't have enough paperwork to send. My husband already owned our home before we were married, and my name is not on it, nor any of our bills at this time. We do have a joint bank account, however, and I am on his health insurance.

Another concern I have is that I am including our personal copy of our 2009 tax return, instead of the tax transcript. Do you think that will make a huge difference? I would order the transcript, but I don't want to wait another two weeks for them to arrive because I've already waited long enough to send this in (my green card expires in mid-July). I hadn't realized the transcript was preferable until now.

Btw, I am a Canadian citizen and moved here on a K-1 Visa. I had no issues getting my green card, and actually received it without an interview. I'll be filing through the Vermont Service Center.

This is the "evidence" I have compiled:

- Cover letter stating:

- we're happily married
- I am home schooling his son (who lives with us 10 months out of the year)
- we have one daughter together
- we are expecting another child
- a list of what's in the packet

- Copy of my permanent resident card (front and back)
- Copy of our marriage certificate
- Copy of my Canadian passport (not necessary, I know, but I feel like I might as well)
- Copy of our daughter's American passport
- Copy of our daughter's birth certificate
- Copy of our tax return for 2009 (everything inclusive - I wasn't sure how much they need, so I included all of it)
- Copies of our debit/credit cards from our joint bank account
- Copy of most recent full statement from our joint bank account
- Copies of our health insurance cards
- Copy of a recent health insurance statement (with our names and our children's names on it)
- Copy of a recent health insurance statement of coverage on an ultrasound I just had for my current pregnancy, with both mine and my husband's names on it
- Copies of approved applications to home school his stepson for years 2008 and 2009
- Many family photos from throughout our marriage, taken both at our home and on vacation together

Does this sound like enough evidence?

Hi there! I would suggest sending not only your most recent bank statement but a sampling of statements that would cover the entire period since you've been married - maybe 3 or 4 per year. I'd do the same with health insurance statements and tax transcripts for each year you've been married if you can get them, if not I'd include your tax return copies for each year, not just 2009. It seems that they want evidence that covers the entire period. Honestly, I wouldn't bother with sending in your passport copy or your daughters - it can't hurt to include the copy of her birth certificate. Do you have home or vehicle insurance in both your names? If you do it couldn't hurt to include annual statements for each covering the entire period. All the best with the petition - I'm sure you'll be just fine!

You put yourself in a BAD BAD situation!!! You can't expect that by you filing on January 7th that you would have a response by now. That si way to much to ask for. I suggest you consult a good immigration attorney and just sit tight. You may have just screwed your ENTIRE case. You will be out of status tomorow, and now You may have to start from scratch AGAIN, and/or go back to your home country.


Wow - talk about scaring the poop out of someone for probably no good reason - why would you say all this? He filed within the time frame and has confirmation from UPS that the packet was rec'd - and you make it sound like he's done something terribly wrong. Do you work for an immigration lawyer? Why would he need one right now? Shame on you.

"On April 14, 2010, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service at 1-800-375-5283".

This was why I used the date the 14th. Was that incorrect? Thanks again!

Any feedback would be gratefully appreciated!! oh yes, my husband has been in touch with his state senator; we spoke to her office regarding possibly transferring - she checked into it and was told that these visas were NOT processed/interviewed for in Vancouver, only Montreal - but I just read a post on here from someone who had their k-1 interview on the 13th November IN VANCOUVER! arrrgggg!


Montreal is the ONLY consulate in Canada that does interviews for the CR-1.

Vancouver has the ability to conduct K visa interviews but generally only interviews people from the west coast. I have heard of people successfully changing consulates for K visa interviews but only when they were able to provide a West Coast mailing address for the consulate to mail 'Package 3' to.

Looks like you are going to have to wait......

Vancouver has the ability to conduct K visa interviews but generally only interviews people from the west coast. I have heard of people successfully changing consulates for K visa interviews but only when they were able to provide a West Coast mailing address for the consulate to mail 'Package 3' to.

hi everyone: I'm a east coast Canadian, married to a USC. Married Dec/06 - filed 1-130 March /07. I-129F filed June/07. Both were approved; just sent back DS230/I864 to NVC for I-130. Also sent DS156 & DS230 to Montreal - working on checklist for K-3, but wondering if we should just let that one slide and focus on the CR-1 via the I-130.
Until very recently we thought we were on the home stretch - a Consulate interview was around the corner. Were very disappointed to find out about the shortage of staff/backlog in Montreal. Apparently this is not the case in Vancouver. We are wondering why a file cannot be transferred from Montreal to Vancouver - or in the case of our I-130, why it cannot be sent from the NVC to Vancouver rather than Montreal. Has anyone heard of this happening or had it happen? I do not mind the trip to BC at all if it would speed up the process. Any feedback would be gratefully appreciated!! oh yes, my husband has been in touch with his state senator; we spoke to her office regarding possibly transferring - she checked into it and was told that these visas were NOT processed/interviewed for in Vancouver, only Montreal - but I just read a post on here from someone who had their k-1 interview on the 13th November IN VANCOUVER! arrrgggg!

where are you arriving in the U.S. from? I go back and forth all the time from Canada and do not need a passport to enter the U.S. - there is also no record of my returns into Canada so I would have to say crossing the Canadian/U.S. border it would be impossible to detect overstays - the use of passports was supposed to take effect Jan 1/08 but that has now been postponed till at least next summer.

Hi everyone! I have a couple of questions I am hoping someone may be able to help me with. I am Cdn married to USC and have a CR-1 interview date in Montreal for February 22nd. We have paid all fees up to and including the $380 IV application fee. Does anyone know if we will be required to pay any additional fees when we arrive at the consulate in Montreal? I had it in my head that there was another $131 fee due but cannot find any mention of it in my letters received from NVC or in the info provided via the Department of State link in the interview letter. On the Consulate website under immigrant visas for family members I did see that there was a $131 fee that had to be prepaid via deposit at Scotiabank and receipts thereof needing to be submitted with the application (the website info also talked about expresspost envelopes being available for purchase at the consulate while the Montreal consulate info accessed via the interview letter link specifically says to bring an envelope with us) Any help or feedback would be greatly appreciated. Oh yes.......can anyone comment on the necessity of bringing proof of a bonafide marriage along to their interview. Thanks very much! Karen

Hi smile.gif I am also Cdn married to USCitizen and going the CR1 route. I chose myself as agent and was then sent copies of notices, requests for this and that etc etc. My husband also received copies and of course he got things quicker than I did because of mine having to cross the border into canada. You can't lose by naming yourself as agent. Good luck with everything!
