K-1 Fiance(e) Visa Case Filing and Progress ReportsWhat Do You Do If You Are Denied a Visa?

Well I'm not in that category, but if I was... we'd move to Europe, maybe Asia (where we met) I'd say! I mean, it's only America we're talkin' about! It's only ONE country in the WHOLE WORLD! No big deal if I couldn't get in. In my opinion!

South of France is nice! B-)

I totally agree!! If there was absolutely, positively, no way for my fiance to enter the country legally - then I would move to Scotland.

K-1 Fiance(e) Visa Process & ProceduresHelp sorting which visa to choose?
Thank you to both of you!!

I was unsure about getting married in the UK b/c I had come across the visitor visa with intent to marry - but thought that was with intention to stay - not leave. So, good to know!

As far as the CR1 & K3, the book referred to both, which was one thing that had REALLY confused me!

Since going to the UK to be married does not seem like an option, I guess that picks the visa for us, as he can't come here and marry me - from what I've read that tends to make a marriage look a bit shady to immigration.

K1 looks like the way forward!!! I'm so excited to have sorted this out and can now begin the process!! Is the timeline of 7-8 months from start to finish about average? I know there are obstacles that pop up, but assuming everything goes smoothly, is that about right?

Again, thank you SO much!!!

Charlotte

K-1 Fiance(e) Visa Process & ProceduresHelp sorting which visa to choose?
I am currently engaged to a man living in Scotland. I will be visiting him in February, we are trying to decide if we should get married in February and go the k3 route or stay engaged and go the k1 route. Because of this we have been looking at both the K1 visa and the K3 visa hoping to pick the one that fits our needs the most. I have been researching online the differences between the two as well as reading the book "Fiance & Marriage Visas" by Nolo. I feel as though I understand the basics of each but have a few specific questions as far as comparison.

1) Through my research it seems to me that the K1 visa allows for fiance to work when he entered the US, although tricky. However, it states that you can file an adjustment of status after the wedding (within 90 days of his arrival). The adjustment of status, from what I gather, will be approved within 90 days as well, allowing him to work? Is this right?

2) If we were to go the K3 route, it looks as though once he is approved to move to the USA he would then apply for a greencard - which could take up to two years? Meaning he couldn't work at all for two years, correct?

Either way, from my research, it looks like both the k1 and the k3 are taking about the same time to process - so my big concern is when he will be able to apply for jobs and have an income. While my income exceeds the federal poverty income needed, neither of us are comfortable living off of just my salary for an extended period of time.

Also, regarding either visa - it is my understanding that he will remain in Scotland while they are being processed. He had found a website stating that with the K3 visa he would be able to move over here and wait while it was being processed. Is that true?

I apologize in advance if this question has been asked numerous times - I have been lurking around the site on and off for a few days and haven't seen those specific questions. Also, I'm becoming a bit frustrated with all of the information that is out there (often times not matching up from one site to another) that I figured I would just ask!!!

I am very excited to be a new member of this forum - the knowledge and support offered here looks amazing!!!

K-1 Fiance(e) Visa Process & ProceduresQuestions about Evidence to send with I-129f

Onward we go!

K-1 Fiance(e) Visa Process & ProceduresQuestions about Evidence to send with I-129f
I am trying to write statement about how my relationship started with my fiance, when we met etc. and have a few questions. 1) Do they want it all "matter of fact" or should I include emotions? 2) How long can a letter be? Is there such a thing as too much? 3) Should I include our future goals (i.e. when/where we want the wedding to be?)

Also, should he include a statement in the petition packet? The guides that I am following do not state this, but I saw it mentioned to in another post on this forum.

We have only met once face-to-face so far (I have a plane ticket to visit him in Scotland in Feb), and during this time we took pictures, but not many as we didn't realize that this was a requirement to prove our relationship. I will be submitting the pictures I have (about 7-10), will that be enough? We would like to submit the packet in January before my trip to see him, but I am worried with the lack of pictures we might get denied.

The other things I am including to support our relationship will be: Emails, phone logs, faceook messages, a copy of his plane ticket, a copy of his stamp from his visa, a copy of my travel itinerary for feb, a letter from the venue where I booked the wedding, a copy of the receipt for my wedding dress, a letter from the florist and the person conducting the ceremony stating I have booked them. Should I ask friends and family who met him while he was here to write a letter about meeting him and spending time with us together as a couple? I'm just very worried about the lack of pictures from our first meeting.

Also, I read on another post that some people are including a cover letter, however the I-129F instructions I downloaded from the USCIS site does not state this as a requirement. Should I include it?

Thank you so much in advance for any suggestions! I feel truly blessed to have found this forum in order to ask questions!

K-1 Fiance(e) Visa Process & ProceduresFacebook communication
Thanks, I wasn't sure how much was needed - just a few from each source, or pages and pages?
cmoore25FemaleScotland2010-12-23 14:53:00
K-1 Fiance(e) Visa Process & ProceduresFacebook communication
What is the best way to document facebook communication? I figured copying and pasting it would not be helpful as you can easily change that. But, what about using screen shots of messages and printing that way?

I have over a years worth of communication on FB alone, how many pages, message etc should I compile to send with the petition?

Also, any good suggestions about documenting skype conversations and/or chats?

K-1 Fiance(e) Visa Process & ProceduresHow do you prove intent to marry?
I am preparing my petition and had a question about how I would prove my intent to marry my Finance once he arrives in the states? I have read on other threads that it is not a good idea to book a place b/c you do not know when the visa will be approved, however, I am planning to get married on the island I work on (small island in Maine) and my work has been wonderful, allowing me to book knowing it might change. Would a statement from them work?

What typically serves as "intent to marry"?

K-1 Fiance(e) Visa Process & ProceduresDo you need signature on each page??
Great, thanks! I must've confused the information, which might be why I didn't print that page off - b/c it wasn't important! Lol
cmoore25FemaleScotland2011-01-10 17:28:00
K-1 Fiance(e) Visa Process & ProceduresDo you need signature on each page??
I thought that I had read somewhere on this board that each page you sent in the initial petition needed a signature or initial on the right hand corner of each page sent. Is this true? I usually try to copy or print posts like this - but I can't find it anywhere and the information is not in the fiancee/marriage visa book bought.

I am wondering if I should have my fiancee sign the papers he is sending me before I send in the packet...or should it just be my signature as I am the one submitting??

Thanks :)

K-1 Fiance(e) Visa Process & ProceduresSecurity Clearance - does it help?
Correct, I am the USC - he is the Scottish citizen with the security clearance.

I did not have high hopes for it - but it sounded nice for a second!

Oh well, we will wait for the processing like everybody else!! Well worth the wait!! :)

K-1 Fiance(e) Visa Process & ProceduresSecurity Clearance - does it help?
My fiance worked in the military for many years. He has a very high level of security clearance - and has spent time working in the US during his military (not US) career. He seems to think that this will help the process along. He lived in Australia for a short period of time on a work-visa and said it was approved extremely fast because of this. Do you think it will make any difference in obtaining a visa to the states?

After reading the topics posted on this forum for about a month, it seems that very little helps to speed the process along, so I am a bit skeptical.

BTW - I am very thankful for this board! I feel as though I've learned so much not only through my questions but others as well!!

K-1 Fiance(e) Visa Process & ProceduresG-325A question
But I still sign that box? It just seems to written in a way that only a person with an A# would sign it. Or, maybe, that's just how I'm reading it...

Thanks :)
cmoore25FemaleScotland2011-01-18 19:01:00
K-1 Fiance(e) Visa Process & ProceduresG-325A question
At the bottom it says:

Applicant: Print your name and Alien Registration Number in the box outlined by the heavy border below.

I don't have an Alien Registration Number (I'm a natural born resident) - so do I just sign it and leave the A# blank? Or do I not sign it at all??

Sorry in advance if this seems like a stupid question!

K-1 Fiance(e) Visa Process & ProceduresChanging font size on the USCIS pdf forms?
Some of my addresses and answers do not fit into the box - is there a way to change the font size? What do I do if I cannot fit it all in?
cmoore25FemaleScotland2011-01-19 14:20:00
K-1 Fiance(e) Visa Process & ProceduresCity & Country?
I noticed on the G-325A that it asks place of birth but it wants the City & Country - it does not state that they want the state indicated.

So, for example, mine would be: Tacoma, USA
NOT: Tacoma, WA

Right? This seems so obvious - however, I don't want to assume anything is as easy as it looks on here.

Also, I noticed in a post before that things should be spelled out and not abbreviated - so should I write out United States of America instead of USA? Or Washington instead of WA?
cmoore25FemaleScotland2011-01-19 14:19:00
K-1 Fiance(e) Visa Process & ProceduresPrimary Vs Secondary Evidence?
Can somebody give me examples (or a link) to primary evidence that should be included in the K1 application?

I am in the final stages of putting together our packet to mail to Texas and just want to make sure I have everything possible to avoid an RFE. I am following the Step-by-Step Guide from this site - are those the only things I need to include?

I am a bit worried b/c I see people talking about FB & Skype transcripts. The extractor program for skype does not work on my computer (mac) so there really is no way to prove that. I have FB message and emails, however, as far as phone calls go (many a week for the past year) I have no evidence b/c it was all skype to skype. Ugh...

I just don't want to miss anything, I suppose it's just nerves about FINALLY submitting everything. That, and all I've been reading about the Vermont processing center...goooooodness!
cmoore25FemaleScotland2011-01-18 18:07:00
K-1 Fiance(e) Visa Process & ProceduresWhat's up with the Vermont Processing Center?
So, I'm still waiting for my fiances paperwork to prove that he is divorced before I submit our packet, however, I try to visit this forum every day to learn new tricks and tips! However, lately, I have seen an outpouring of dissatisfaction with the Vermont Processing Center, which is the center that my petition will be processed at. Has something recently changed at this center causing them to be so slow? Are other centers as slow as Vt? Is anybody having luck being processed in a decent time?!? I guess my question is: what is the problem that is causing all of this?

K-1 Fiance(e) Visa Process & ProceduresQuestion about visiting a Fiance
Thanks - it would have felt very strange saying I was visiting a "friend" and not my fiance! Also, I'm not big on trying to hide anything. I googled this scenario (I google everything which isn't always good) and read some horror stories of being turned away or grilled for hours....so I thought I would check with a place I trusted!!

I am so nervous, but excited at the same time. So far he has visited me - and I have never been out of the country except for Canada when I was younger (and I was with my mom and dad!)...so I'm not only excited to see him -but also another country...

Hopefully I'm making a bigger deal about immigration/customs than need be!

K-1 Fiance(e) Visa Process & ProceduresQuestion about visiting a Fiance
I am the USC - and will be visiting my Fiancee in Scotland in 12 days (!!!!!), however, I have never traveled abroad and I am a bit worried about immigration once I land at Heathrow. I am worried that telling them that I am visiting my Fiancee will make them think that 1) I will try to get married in Scotland w/out a marriage visa or 2) I will end up trying to stay. We are currently are waiting to file our I-129f because he is waiting for his proof of divorce to be processed (he was divorced 10 years ago and needs a new certificate from his gov b/c he lost the original). So, we are engaged - but I have no proof that we plan to marry in the US. Will this be a problem? I will be taking proof of a return flight. Should I take a pay stub to prove I am employed in the US? Would it be better to say that I am visiting my boyfriend instead? Any thoughts on this would be greatly appreciated!

K-1 Fiance(e) Visa Process & ProceduresQuestion about the actual mailing of the petition
We FINALLY have everything ready to go and I will be mailing the petition to begin our visa process on Friday. My question is: How did you mail it? Is there a better method? UPS/Fedex vs United States Postal?

Also, if I choose US Postal, and choose first class is this considered "express" and therefore sent to the Lewisville address?

Thank so much for the help!! :):)

K-1 Fiance(e) Visa Process & ProceduresVT Processing time question
I know a month or so ago the processing time was starting to get quite long - and I know there is a chart showing the estimated times - but I didn't know if there was anybody who had any actual experience with the VT processing times recently?

Also - is the estimated processing time just for them to view the petition - or does this include the medical exam & interview as well?

I am trying to estimate (not for wedding planning, just for my own sanity) how long I might have to wait until my fiancee can FINALLY be with me!

K-1 Fiance(e) Visa Process & ProceduresWhat's next?
After the petition packet is sent, what is the next step? I read a lot about "packet 2" and "packet 3" - where are the directions to completing these? I apologize if it's an obvious question, I've tried googling it with not too much luck! I just didn't know if it was something the processing center sent directions on or if I'm missing it on the gov website...but I'm assuming I should start preparing these packets as well :)

K-1 Fiance(e) Visa Process & ProceduresReady to send - one last question
I have all of the documents and information ready to send. I have read the instructions that came with the I-129f and I do not see where it specifically states how to organize all of this. Do you staple it, clip it, folder it all together? I guess my question is: what is the best way to compile this all for mailing?
cmoore25FemaleScotland2011-03-10 17:56:00
K-1 Fiance(e) Visa Process & ProceduresHow did you compile your packet?
Many thanks! I will look for something like that this weekend! I'm just waiting on a packet from my fiancee - we filled all of the forms out together last month when I was in Scotland, but somehow forgot signatures!! I'm getting very anxious to get this in!

K-1 Fiance(e) Visa Process & ProceduresHow did you compile your packet?
Alright, I found out what to do with the photos!

I suppose my last question is - did you send all the paper separately, or in a folder, or possibly clipped together?

K-1 Fiance(e) Visa Process & ProceduresHow did you compile your packet?
I noticed some people have paperclipped photos to paper, others put them in a ziploc bag. I guess my main question is how exactly are you sending the packet out? Did you staple any pages together? Paperclip? Send it all loose or possibly in a folder?

Thanks :)
