I have a DV case for spanking my kids... no DV against spouse... or anyone else... I had to go to 4 parenting classes...

normally the sentance on that is a year or so of DV classes and anger management... I could have beat it had i gone to trial, but i just wanted the stupid thing over...

i didnt realize i was going to be filing for a k-1 or maybe a k-3 visa... for my girlfriend in another country...

so this is technically not a conviction.... any thoughts on this??

my ex-wife also got a restraining order against me, but i havent been served... I have never threatened her..

how hard is it to get one of those orders anyways...??? what sort of proof to they have to have and can i get it over-turned... what a joke


Just be truthful about it, don't hide anything, and follow the requirements on the I-129F form. It is indeed a conviction, and they will find the arrest record when the run the FBI Triple I check on you. Restraining Orders/Protection Orders/Injunctions are databased as well.

IMBRA Special TopicsK-1 Visa questionn regarding IMBRA

With the help of many people on this site, I mailed my I-129F petition packet this morning to the Texas Service center. Thanks for all your help and knowledge.

My question is in regards to Question 19 on the I-129F form. (Regarding having met thru the services on an international marriage broker)

I met my novia thru an agency website in October 2006. I purchased her email address and we intitally met thur "email". The company I purchased the email address from and the owner of the company NEVER mentioned anything about IMBRA and I did not know about IMBRA until I started looking into K-1 visa information. I was told to be truthful on the application and I wrote the process of how we met and all the correct information to contact the agency. Since IMBRA was never discussed with me thru the agency and no personal information was obtained on me from the agency, is this going to hinder my filing? I am not a criminal and have never been arrested or been in any legal trouble in my life, so I have nothing to worry about on that end. I do not want to have my process slowed if the agency was not doing their job properly.

Can someone give me some insight on IMBRA requirements when it applies to the I-129F petition?

My understanding is that it should have NO bearing on your petition. Even though I am not effected by IMBRA there are PLENTY of guys who have met their fiancee through a "Broker" and it has no impact on your case. The Brokers have some requirements that they are supposed to adhere to, whether or not the foreign based ones do is another matter in and of itself.

No, you hadn't. You had mentioned "my green card" as if you already had one. If you are now filing for AOS, you'll probably get the conditional green card without this criminal complaint having impact.

Depending on the outcome, however, you could have problems removing conditions. I would definitely consult a criminal attorney who also understands immigration law or have your current attorney consult an immigration attorney to see how your current arrest could impact removal of conditions.

I just can't see you being denied permanent residence because of a minor domestic disturbance but it IS possible.

In the meantime, calm down. Another call to the police by your husband would be really bad for you.

Yes, he is required but it is his word against yours. As I already stated, I don't know if the judge saw the scratches or not but if you want to fight this you need a lawyer and plead not guilty. This is a typical he said, she said case, but if the judge saw the scratches you may have a problem. Also I'm not sure who you harrassed, your husband or the cop. I don't know how this plays out with immigration, possibly pushbrk can advise you there.


Whoa! Lets talk about the 5th amandment shall we. "Miranda" rights are NOT required to just arrest someone. There are two (2) key elements to this requirement: 1. That the person is in custody and 2. Questioning. If you are arrested, one part of the equation has been met. The other part is questioning, and you must be advised of your rights prior to this. An officer can ask "administrative" questions such as your name, date of brth etc, but when it comes to questioning related to the incident itself, you must be advised of your legal rights. Notice I say "custody" because there are times when you are NOT under arrest but in which a "reasonable person" would not fee free to leave (like being in the backseat of a sqaud car in handcuffs).

I have over 20+ years in the business of arresting people. Domestic violence arrests in most states WILL NOT always require the victim to testify. The courts know that in the nature of DV this is common, and that victims often become what are termed a "hostile witness" frequently. In these instances the officers on the call will be the State's witness for prosecution.

My advice is open up your wallet...you need a decent lawyer.

Is your fiance' petitioner here in the US? Whoever the petitioner is, should be calling. I do not know if you are familiar with IP Phones. But in most places, like internet cafes, they have phones you can use that are really inexpensive to call anywhere in the world. And the sound quality is pretty good just like a regular phone. It looks like you may have to speak to a live operator. They always ask for certain ID numbers, etc. for security purposes. Without being able to pass the phone security, the person calling for you won't get any further trying to speak with the operator.



I knew you would wonder why I am calling instead of my fiance doing it. He is a USC. But he finds it so annoying to be inquiring about our case because he has done it many times and he thinks that people in the uscis are not very helpful. Thats why I tried to do it myself, just to help him a bit.


Your timeline shows it was sent to CSC less than a month ago. I guess I wonder if you're jumping the gun a bit.

I wouldn't worry about it, she has actual control over what she sees in front of her ie: your petition. Policy issues and administrative moves to another service center, I doubt.

USCIS believes the delays are primarily affecting approval notices for cases decided between April 2007 and the present, although production of some receipt notifications may be affected as well. USCIS is attempting to identify the source of the problem and generate the delayed notices as quickly as possible. In the interim, CSC has established interim procedures to help facilitate the needs of its customers.

I have seen lot of touches last week. But I wouldn't think that is because they are moving me from CSC to some other service center.


I would agree, if that were the case EVERYONE would be seeing them. Right now the touches seem to be in line with the usual adjudication time periods. I have 68 days into the process, I'm not going to seriously start looking until day 90 or so.

One would assume there would be touches, but with the past 2 months being so sporadic and unreliable in terms of the data entry and notices, who knows.

If on the other hand they are moving them, we have to remember that Nebraska historically (until spring of last year) was doing the K-1's and this will only be a move for them.

I wouldn't start dreaming doomsday just yet, the service centers have made errors before in their reporting. Hopefully if there has been a change they will make a press release within the next week.

Wow, something must be going on huh? Vermont doesn't have the I-129F listed listed either. It was my understanding from their press release last year that the TSC/NSC petitions were to be moved to CSC temporarily at that time. The mailing instructions were never changed on the forms when the new form came out in February, so that would make sense that it would be/was temporary. I guess it is rather unexpected though to not see processing times for Vermont and California. I'm sure we'll hear something in the next week about it.

Also: the USCIS press release from May 23rd ? indicated that they were "supposed" to have the data entry and notification system back on track by June 15th. That was all part of the "unprecedented" numbers of the H1B petitions being processed.

What is interesting on the NSC case status is that they "claim" to be at February 12th with the petitions, which I suppose is better than November or December....but with the missing info from the other Service Centers it is hard to believe anything.

I'll keep praying and crossing fingers.

I did recieve an email from the consulate saying they sent us the packet back in late MAy. We still haven't recieved it. I called USCIS today to see about changing my address and the NOA2( I hadn't read your email, new to this site AND blogging/chatting in general). They said we weren't approved til June 27. Very wierd... Just looking forward to all this being over and getting to be with my fiance again....

Find out what your case number is from NVC. Once you have that you should either call or email the Embassy and see where things are at. USCIS has really given out some confusing information over the past 2 months. Your actual approval date should be on the I-797 (Notice of Action) that they sent to you indicating the approval.

You need to stay on top of this or you may be waiting and waiting and......

I'm also a Jan filer with CSC and I've been wondering, WHAT"S TAKING SO LONG? We did recieve a letter our case was approved. I'm not sure if this is considered the NOA2, because it was just a letter and not a form like the NOA1 (which actually said Notice of action). So should we recieve another NOA2?

We got that letter at the end of May and we're still waiting for the packet. I've noticed other couples, even with fiances from Mexico have already had their interviews...

So why is it taking so long with us? Dealing with all this stuff with immigration, the NVC and the consulate is like wrestling with a black hole...

Please fill in a timeline and add to the database. If you received a letter saying it was approved...then yes, that is your NOA2. Check the guides and call NVC, if you received approval in late May it is probably at the Embassy. You can get your Embassy case number through NVC. Then email the Embassy and see where it is at, you're close to finishing this trek, congrats.

THE PROCESS AT INS

Mail Room: Your Petition will arrive at the INS Service Center's mail room with hundreds of other Petitions.
Intake: Your Petition will be taken to an Intake Clerk from the Mail Room. This Clerk will look it over for all of the proper forms. They will not examine any paperwork, but simply take the form checklist (that they have memorized by now). For example, the checklist will say "(1) Form I-129F, yes here; (2) G-325A's, yes here, (1) Birth Certificate, yes here, etc." Your Petition could sit on the Intake Clerk's desk for days, especially if the INS Service Center is busy.
Processing: Your Petition will be sent on to the Processor from the Intake Clerk. This person assigns your case to a specific Examiner.
Examination: Your Petition will be sent on to the Examiner from the Processor. This is the actual person that inspects your Petition to verify that your relationship is valid, that you are an American Citizen and so on.
Central Processing: Once approved, your Petition moves to Central Processing, where a Divisional Director separates your Petition by region, Asian, Central America, Eastern Europe, Southeast Asia, etc. This task is only for categorizing your Petition.
Outtake: After being classified by region, your Petition is sent to an Outtake Clerk. The Outtake Clerk assigns your Petition an "A number" depending on your region.
Distribution: After being assigned a reference number, the "A number", a Distribution Clerk will carry out any special acts, such as cabling the Embassy. The acts are a result of notes made by the Examiner, not you by you.
Information: If you call INS, you will speak to an Information Officer. This is a glorified term for "INS Secretary." The only access they have is the INS Service Center's computer network, which will not tell you anything more about your Petition's status than you hear on the INS telephone voice message. They do not interface with Examiners, who are much too busy examining than to cater to specific requests.
EXPLANATIONS

Non-sequential examinations: Approval is happening to other K-1 applicants who submitted their Petition after I did (according to the I-797 notice date). At the INS Service Center, various Petitions are randomly pulled from the files to train new Examiners. Most likely, an experienced Examiner grabbed a Petition out of the stack to train a new recruit right there at his/her desk. They then subsequently approved the Petition (lucky Petitioner!). The Petition the Examiner grabbed may have been anywhere and hence explaining why it was "out of order" or why the approval date is earlier than other Petitions with earlier I-797 notice dates. This is happening everyday, Examiners are training new recruits everyday. If your Petition was approved in a very quick timeframe, say within 10 days, it was most likely pulled for training purposes.
Request for more information: There are no rules here, just based off of the Examiner's judgement. If the Examiner requests additional information, it will delay your Petition from about 1 week to as long as 1 month, typically. Your Petition will most likely be sent to the "back of the line." Possible reasons for a request for more information include:
Your fiance(e)'s last name matches another last name of a Beneficiary from a previously fraudulent marriage. Supposedly, INS holds a list containing the names of previously fraudulent K-1 marriages.
You or your fiance(e) did not sign the I-129F or G-325A form
Examination is 15 minutes: The actual examination process typically takes 15 minutes, that's it. On to another Petition.
Priority given to most paperwork: If an influx of non-I-129F paperwork arrives at the INS Service Center, your K-1 Petition could be sitting for a very long time, until the backlog of other paperwork is examined.
K-1 decision legally set at 30 days: No, nothing legally binds the INS Service Center to process your K-1 case within 30-days. Unfortunately, the goal of within 30 day processing is stated in most of the INS Service Center guides, but may not necessarily be followed.
G-325A carbon copies: The duplicate G-325A carbon copies are not used anymore, the INS Service Center actually will throw these away. Your whole Petition will eventually be filed electronically, once the Outtake Clerk assigns it an "A number." Still, you should definitely submit your Petition with the carbon copies, but no need to worry if not every carbon copy is legible.
NSC: The Nebraska Service Center typically processes as much paperwork than all three other INS Service Centers combined. This may help to explain longer waiting times.
File cabinets: Petition paperwork is held in file cabinets before the Intake Clerk pulls it for examination.


Although that is interesting, I would like to see when they published this information. Referring to the pages of the G-325A as "Carbon Copies" makes me wonder. Huskerkiev made some great posts about the process (being a former adjudicator ...they are not called "examiners") and some of this differs from his work.

:blink: Ok..so we've been sitting here waiting patiently on our NOA2 to arrive. Then I start noticing peeps after us getting approved (our NOA1 date was April 18th). I ring up USCIS, and am informed that our case has been approved and sent to NVC...BUT...nothing has been updated..no email, no updating of the system, no NOA2 hardcopy, nothing! They just gave it their stamp of approval and mailed it on! The gentleman I spoke with said he would handle this personally, and he is requesting the file and our information so he can update. So now, I'm guessing it is going to take an extra while to get all of that back and a hardcopy to us. I even rerang up USCIS yesterday...just to confirm what the 1st gentleman told me. This 2nd gentleman said that yes, that was true...and if there was anyone to trust with our case it was the guy we spoke with the day before. (so...am I suppose to feel relieved here?) I'm just taking this as someone was careless in their work..and mailed our case on...they best not have lost it..or I may be knocking on their door ...demanding their jobs. :angry:


This has happened time and time again over the past 3-4 months. I wouldn't sweat this at all. They will get you your hard copy, as far as the online stuff, I know of one filer that had an NOA2 of June 26th, No online updates for it (no touches for 2 weeks prior and after), no NOA2 email, and his online status still has not changed since mid June. He received his hard copy only, and now is just waiting until late Sept. for his Fiancee's interview. No big deal. Others have had the same thing, and only found out about their approval through the letter from NVC indicating they received the petition and it had already been forwarded on.

I met my Fiancee through a mutual friend and co-worker who was from Ukraine and had married his wife while she was working in Ukraine with the peace corps in the mid 90's. It is an interesting story, but the long and short of it is I mentioned to him (our matchmaker) that I had met a Russian woman (already married) here while at work, and he asked me if I was interested in meeting someone. I was not too interested at the time, but then curiosity got the best of me and I started looking at Anastasia.com Well, that peaked my interest even more, and I starting corresponding with a few women to check out the "International Dating" scene. I was averaging about $100 a week in translations for the emails, and thought I would ask my friend to help me make a connection with them, and he could translate for me. Instead of going this route he described my fiancee to me, mentioned that she was educated, fluent in English, that they were from the same home town, and he would speak to her if we both desired the intro.

One thing led to another, the intro was made in Late December 2005/January 2006 and we hit it off right away. It wasn;t too long after that Lena invited me over for a visit, and in August of 06, I stayed with her and her daughter at her place in Kyiv. Lena far exceeded my expectations so much so that I proposed during the visit. I have since traveled over again in January of 2007, and will be submitting the petition within the next 2 weeks. I'll be heading over again in July for a month, and this time I'll be taking a family member with me for two of those weeks to meet Lena and her family.

It took me a fair amount of time to make my mind up about Lena. Obviously Fraud was on my mind, but it didn't take too long to sort through those feelings, and find the reassurances in the relationship. She is leaving behind a solid middle class life in Ukraine, her family, friends, career, and her place which she owns. Her daughter is being uprooted and brought into another country and culture which will forever change her, but at the same time offer her better opportunities in life.

As far as East European women lying, cheating and so forth I agree that it may be part of the old Soviet thinking, but really, American women do the same damn thing. My Ex wife was such a convincing liar and manipulator that she could be a poster child for women to stay clear of. So, I don't think its just a Russian or Ukrainian issue as they are here as well.

I am so glad my fiancee is Ukrainian. Kyiv is far from perfect, but the dollar is welcome and you are typically in and out of Boryspil within 45 minutes of landing. Leaving is a bit longer, you still have to run the "gauntlet" for passport control, but overall it is pretty easy. I think the best thing Yuschenko has done in his term as president is to drop the visa requirement for us Yanks. Ukraine is now offering the opportunity to "Buy" citizenship as well. All you need is a mere $100,000 and you become one.

Like Russia their birth rates are declining, but unlike Russia, their economy is not moving very fast. Add some of the inflationary issues like Putin and Gazaprom screwing with energy supplies and reneging on gas prices, and you have some unhappy, difficult times.

I do like reading about some of the journeys that those of you travel with the Russian Fiancees. I never met mine through a dating service, and some of the discussions you guys have had are invaluable. (Especially from Slim).

The Russia forum is one of my Favorites, although I will say that it is clearly dominated by you guys with Russian Wives/Fiancees. That's ok. I enjoy reading, less so much of the Jerry Springer show, but nonetheless it is good reading.

Culturally, My Ukrainian Fiancee is about as close to being Russian as any out there. I think that many of us who are involved with Ukrainian Fiancee/Fiance's would certainly MUCH rather be grouped into this forum under a new guise of "FSU" as they (as well as other FSU countries) still have ties to "Mother Russia" and there are issues that arise where Russia is going to be involved in the topic : Police Certificates for example. I looked at the numbers of filers out there, and granted the number of Russians do out number the others country for country, the rest of us do add up to a number close to the Russians.

I guess what I am getting at is rather than feeling like an "interloper" why not open this up some...you know share the love.

Ukraine is still feeling it's growing pains like all of the FSU. The political circus that has been going on there since early April has been something to read about, and according to my fiancee something to watch. Cool heads have prevailed thankfully, otherwise it could easily evolve into another Balkans mess.


That's going to go a long way with the EU when it comes time. Nothing is more democratic than a peaceful revolution!


The biggest problem they have is the split between those in Western Ukraine, and those in the East/South. The West has strong Nationalist feelings while the rest of the country either wishes for the "good old days" or is busy worshiping Putin & a desire to be part of Russia. Never mind the Holodomor, Energy cost manipulation, or other historical fact.

Oh well, it's their country and they have the right to decide their own path.
