Does anyone know what the going time frame is at NVC Portsmouth? They claim that the going rate at this moment is up to four weeks. But we all know that these time frames that are posted, i.e., the Service Centers are not exactly accurate?

I am suprised that they are using NVC for name checks as last year alone they had 7 million false hits as the software being used is not very accurate. I do not understand the point of this. It is like a polygraph test, being that they are not accurate, they are not submisible in court. Not too mention after 9/11 the USCIS conducts a security check anyway and then another one at the Embassy.

On that note any info on the time frame for the London Embassy relative to appointments? Again we all know that the ones posted on official sites are not very accurate.

Its usually only at the NVC for a couple days before being sent to the embassy, but it does take a week or so in transit between the NVC and the embassy its being sent to. That applies to K-1's. Spouse visas spend more time at the NVC.

We've been there now for at least 3 weeks. I'm waiting to call this coming Wednesday, on the 5th week to see what is happening. They do tell you (USCIS & NVC) that normal processing time is 2-4 weeks. This was reinforced by my Congresswoman's office. It is such a drag.

That's nothing. Try over 7 weeks from NOA2 to being sent out from NVC.

Congressional didn't help much either, DOS will send when they're finished with it. Very, Very, frustrating for us. I'm just thankful it's out of there.

They will NOT expedite on a "possible" deployment. He has to provide "orders" to make this happen. That means the deployment is in the works, and he is going to where ever. Also remember that you'll need the consent of your child's father to remove him from the country if you haven't already thought of that.

I know this is an old thread, but you're right, it is very hard for anyone from the FSU to get a Visa. I would have given anything to fly my fiancee and her daughter here for a visit last year just to give them a taste of what it is like here.

Hello from Wisconsin everyone. I "stumbled" upon VJ yesterday quite by accident and boy am I glad I found it. I have some concerns about what the USCIS and Embassy are going to be looking at when I submit our petition in April. Here is the story: I am recently divorced, Wisconsin requires a 6 month wait before you are leagally able to marry (we are also a martital property state where it can take several years to get a divorce decree). I cannot submit a K-1 petition until that time. In my research (and in conversation with the immigration attorney I have hired here) there seems to be little or no clarity as to the financial requirements in filing the I-134. On one hand they remind you that you must meet the 125% poverty guideline. On the other hand they are asking for property values & assets, tax returns, whatever.

I am a career (over 20 years in the system) government employee who makes good money. Over $65G a year. I pay about 12G a year in child support, and as I am now filing taxes as "single" the state and feds eat alot of my pay. I have a sizable savings, but lost the house in the divorce, (actually I gave it up rather then pay maintenance), I have a good retirement account through the State with cash value, and full medical benefits.

My question is this: Is this enough to show for a K-1 petition where the 125% guideline will be $25,000 a year? I certainly surpass it on paper with gross income etc but are they going to look for where every dime is spent? I read many others making far less than I do getting approval. Any opinions/experiences would be greatly appreciated.

If you are not in Ukraine, you have to go through the consulate or embassy in the UK. It will take months to get it as far as I remember from someone else needing it. There also seems to be some confusion at the consulates on how they process these, check on the posts by NY Girl her fiance was Ukrainian/Israeli and I know she posted something about it.

The NVC already schedules the immigrant visa interviews for some countries. It would not be surprising if they were to expand that role and take over scheduling for more countries as time goes on.

It was brought to my attention by a VJ Pal that there is a change about to take place and/or has taken place where the Embassy interviews are going to be scheduled by the NVC directly and Beneficiary will be mailing any checklist to the NVC for the appointment. Great (NOT) The Kyiv Embassy just changed last week to a call center for appointment scheduling (sounds similar to London basing it on $12 for 8 minutes to call them). I'm sure this will add more time to the process then given they'll have to handle more of them. The Kyiv Embassy has NOTHING indicating this just that they are now using the call center as of April 10th.

My husband and I do not have a huge age difference (just 7 years), but when I see some of the criticizing remarks regarding age differences, it has really made me think. Really, who care what the age difference is with a couple? What gives others the right to pass judgement? I personally don't care what the age gap is as long as the relationship is bonafide. :thumbs:


Personally I feel that gaps bigger than ten years have the potential to cause problems. I've not seen a marriage yet among friends and family succeed that had an age gap bigger than that.

My husband is 8 years older than I am, and to me that's pushing it. People here tease him about being a "cradle robber" even though I'm 31 years old. :lol: :lol: :lol:


A lot depends on the individuals involved, and life experience. Culturally, even in the states 10 years is not that big of deal, and the older the couple is (ie: He's 50 she's 40) the less likely it will cause problems.

Personally I would never look for someone who is 12 or 15 years younger than I am, I just feel that I would rather have a partner closer in age, but more importantly one that has the life experience, education, and common interests and values.

Vilma completed the interview on 23 May 2007. As far as I know, there were no problems with the interview or the documentation which we supplied. The financial statements, the photos, all the I-134 stuff apparently was accepted. It was complete and I thoroughly checked and double-checked everything.

The problem is that she has a professional background as a biologist, they suddely wanted her CV or educational background, and this isn't listed as required documents for the K1 fiancee visa. The only thing I can guess is there there are some reactionary people in the US embassy and they are constantly accusing Cuba of "bio-terrorism" and they want to pick on Vilma simply because she has worked in the medical field as a biologist.

BTW from what I know about CIA destablization programs against Cuba, the reverse was true, that the US gov. conducted decades-long covert campaigns of biological warfare against Cuba, this has been documented extensively and repeatedly by many researchers so maybe they are trying to divert public attention away from themselves by accusing Cuba of doing the exact things which they were doing against Cuba for over 20 years. I'm trying to avoid political debates in this process but they seem to be obsessed with the idea of injecting that into a normal immigration process.

I understand that Cuba has specific prohibitions for emigration of its citizens for certain fields (a 5-year waiting period, for example), and this includes professions such as medicine and biology, but we have been able to overcome those hurdles on the Cuban side. The Republic of Cuba has every right to protect its intellectual capital, this is their policy and I believe it is justifiable, even though it has forced Vilma to quit her job as a biologist almost 5 years ago.

The US has already done extensive background checks on me and my fiancee so I think this new request is totally unnecessary and it is making us wait longer for no good reason. Her CV clearly shows that she worked in civilian positions, related to immunology and laboratory quality control. She was not in the Cuban military.

I'm writing some letters to my local politicians wrt this red tape and beauracratic delays at the US embassy. I will follow your advice about contacting an immigration lawyer after a few more weeks of this waiting-game and pure silliness on their part.

I dont know anything about the embassy in havanna, but we had big problems at the embassy as you can see by the timeline below. my wife was denied the visa when we went there the first time. if i was in your shoes i would wait 2 more weeks and be patient, and let the embassy get this paperwork sorted out, think the best, if your fiancee has still not been given any explanations on why it is taking so long or has not received the visa after 2 more weeks, i would contact the office of your representative for help. when i contacted my district representative through my family in the states, he was very helpful and sent a fax to the embassy for us, If that do not get results i would then contact a lawyer which is gonna cost some bucks. was your packet complete? i mean did you have photos, letters, telephone records. im not understanding why why your case is taking so long?


Your situation does seem strange. In the K-1 Forum the ocassional K-1's from Cuba seem to be processed immediately at CSC with an NOA-2 within a week after their receipt. The rest of us agonize for months. Congressional Help is probably your best bet at this point.

I don't have a list but Canada and the UK (or the major European Union countries) are far easier than China and the Philippines, for instance. In general, it's the high fraud countries that are most difficult. That tends to include the third world and the middle east as well as the countries that were part of the USSR.

That's a great point! On a top of $131 for visa (paid in ukr currency in the bank), she'll need $100 for a medical test - paid in American dollars. It's also $8 for the passport with the visa delivery and she will also need to buy a password to make an appointment for a visa interview -it's another $12.

I cannot think of anything else:) I'm in Ukraine also, and right now waiting for my NO2 reach the Embassy in Kiev.

You are not eligible........yet. You have to wait until you are within 90 days of your 3 year anniversary IN ARRIVING TO THE US.

Better straighten out your taxes. If your spouse was able to provide an affidavit of support, he/she should have filed joint status. He/she lost money filing single if they did file.

The problem with the tourist visa is that it is a 10 year multiple entry visa with each entry to the United States subject to the time limitations stamped on the I-94. When you overstay the time stamped on the I-94 the visa is canceled and the next time you try to use it to enter the United States you will be turned away. So the visa was no longer good after she did not leave on or before the June 2007 date. They do not have to notify you of the cancelation.

I was on a payment plan and it was never mentioned in either the K1 interview or the AOS. Of course I got on the plan after submitting my taxes and realized I did not whithold correctly for self employment taxes.

When we went through they updated it about once a month, but I had only seen one month at a time last year, this list is for three months. But it does illustrate a point about how busy the embassy in Manila is, 140 pages with about 50 cases per page is 7000 interviews in three months, and this might not reflect all the types of visas.

In order for a K1 visa to be approved by USCIS they want to see that both are free to marry and they have met in person during the past two years. Some people get their NOA 2 with very few photos and other proofs that they met. Now during the interview the CO looks at other imformation including the benificinaries responses to questions. Now if they suspect that the person is married they can look for further evidence. There are petitions that are approved by the USCIS and sent to the embassy in Manilla, Philippines for the interview and they request a certificate of no marriage from the Philippine government, if if shows the person is married then the visa is denied. India should be no different, the initial petition approval from the USCIS is based upon what evidence the petitioner submits and it can be false or misleading.

One case that was initially denied by USCIS because they did not prove that they met in person, they petitioner appealed and provided evidence that they met. The catch was that they met when the benificionary was in the US illeaglly. USCIS approved the petition but stated that there was no guarantee that at the interview the fact that the benificionary was in the US illeaglly would not result in denial at that time. They are looking at the fact that you meet the spirit of the law which is that both are free to marry and have met in person during the past two years.

I agree, with having the child in her country if you do not have health insurance in the United States. I will almost guarantee that she will not find an individual health insurance policy in the US that will cover her pregnancy. Even if she does not have insurance in her country it is most likely cheaper for you to cover her hospital costs in her own country.
