I heard this mentioned before but I'm sure that some may have missed it. If you you have read this before, my apologies:

Breaking News: FY 2008 H-1B Cap Reached in One Day on April 3, 2007


The USCIS announced that as of today, April 3, 2007, they have received 150,000 cap-subject H-1B petitions and as such the H-1B cap has been reached. As such, the USCIS will use a random selection process for all cap-subject filings received on April 2, 2007, and April 3, 2007. In other words, no cap-subject case is safe and guaranteed of a spot!



USCIS indicates that it will reject all cases received on or after April 4, 2007. In light of the high volume of filings, USCIS will not be able to conduct the random selection for several weeks.


However, USCIS does not know how many of the 150,000 are cases for aliens with US-earned masters~{!/~} or higher degrees. The first 20,000 H-1B petitions for such aliens are exempt from any fiscal year cap. USCIS will make a future announcement regarding the final receipt date for these petitions.

It took me what seemed like a while to get my NOA1. Remember that VJ only caculates for those on the site. I'd give it 4 weeks before I called.

You are absolutely right, VJ is a small number of petitions, but it is a good statistical sampling and has proven itself to be pretty accurate. I think that most of us waiting for the NOA1 are more concerned about the petition being misplaced, lost, or otherwise mishandled. I would gladly sit back and relax knowing that I have a case number and that we are in the system now.

I see that there have been a number of "touches" for the January filers yesterday, and maybe things are going to start moving again. I hope so, I want to see everyone get their approvals, and see the "machine" back to work.

We posted off our K1 package to TSC on 12th April. And apprently (According to various VJers) an NOA1 can be expected after 10-12 days.

My question: is the 10-12 days measured from when TSC take receipt of the package or from when it is received at CSC? If the latter, does anyone know what sort of time I can expect to receive NOA1?
(We tracked the package via USPS and it was signed for at TSC on 17th April).

There have been a number of us (mine was received at NSC on April 11th) that still do not have one. I think last year around this time there were a number with the same situation. There is a slow down in NOA2's as well, and I guess all we can do is wait. I know it's driving me nuts thinking about it, but they signed for it in the mailroom, and they are bundled for CSC after that. It should come soon enough most likely with a NOA1 date earlier than what you would expect given the wait.

That may be only partially true.....if they have your address correct. If you never receive the I-797 you might want to check if they have that correct. For my piece of mind, I'd rather make certain of this rather than have an RFE or approval sent to the wrong location. That could be a problem.

There must be something going on with the Mailroom there. There are a number of people (myself included) who have NOT received their I-797 for their NOA-1 yet. This getting more than aggravating ...I know...Patience...

You're in a large "boat" with many others. They received mine on April 11th, NOA-1 obtained on April 20th via the WAC# from the back of my personal check. But still no written notice (Form I-797) received. I have posted on this a number of times, and the H-1B's that were received on April 1st and 2nd are the only thing I can imagine as to have creating the slow down in the mailrooms. California and Vermont are the ONLY service centers who receive the H-1B Visa type, so forwarded petitions from Texas and Nebraska end up in the CSC Mailroom mess. It must be just overwhelming there.

My calls (twice) to USCIS were for naught, they will not give you information over the phone, and I was told I had to make an info-pass appointment. My attorney is going to handle that trip for me.

I guess receiving the I-797 for the NOA-1 is NOT really needed, many others who filed in the months before us never received one. The only thing to be concerned about would be that they do in fact have your address correct. If your NOA-2 notice get's sent to the wrong address, or an RFE gets sent to the wrong address you're going to be in for some stressful days waiting for nothing to arrive.

I guess I have heard that there are a few Embassys/Consulates that want to see the NOA-2 I-797, why ...I have no idea, it is just a letter and they have the approved petition sent to them. I have heard however it IS needed for when you adjust status, so I suppose that would be something to watch for then. In the mean time hang in there, you have a case number and that is the most important part.

Well, there is that CSC glitch to think about....you know the one where they're forgetting to tell people that they've actually been approved? I swear, a large percentage of the people who have been approved in the last week or so only found out they were approved because they called CSC. Their electronic system is all screwy....not to mention a bunch of people recently who still haven't gotten an NOA1. Perhaps the wonderful visa stat lists that some of the really awesome members of VJ compile for us (out of the kindness of their hearts) haven't been updated to reflect the new approvals yet? (PS Thank you Fwaguy and Kengumbo, your lists are my security blanket!!)

It's coming. considering I'm an april flier, i really don't want to read something that's telling me i'm going to have wait any longer than i need to. So I will continue to believe that CSC is working at it's usual snail pace, and not a snail moving up hill in a black hole pace.


You're absolutely correct. Since FWAGUY is now in Ukraine and will not return until the 27th we will continue to live in mystery (or misery I guess). But I'll be interested in seeing the numbers for last week. They are working them, and they will continue to do so. Keeping things in perspective, the members that went through IMBRA hell last year had it a lot worse. There is no dark cloud hanging above our heads here gang, it is just part of the "ebb & flow" effect of a overwhelmed system/mailrooms from the H1-B Visas in early April, I think that is pretty clear now.

Starting to get a little frustrated now. Received NOA1 2-6-07 and nothing yet. No touches, nothing! I did call the service center Friday after reading about all the delays. Talked to a really nice girl (Stacy) just to make sure no RFE's had been issued or I had missed anything. She seemed to be really straight forward and basically admitted that the processing has slowed down considerably with all the immigration reform going on. Actually she probably told me more than she was supposed to.

Anyway just looking at some of the stats posted by other members on here at VJ and less than 55% of Feb. filers have received NOA2. We're at 104 days and counting and with the holiday thrown in next week I don't think processing is going to speed up at all. They haven't even updated the processing times on their website since 4-18!

I can definately see processing times extending out to 120 or 130 days! Sorry to disappoint any March or April filers but you still have alot of people ahead of you. Hopefully this week we'll hear something but you know Friday they'll be out of there early for the holiday weekend and won't be back until Tuesday!

Wish us good luck and hopefully everyone gets approved quickly. I was going to write my Senator but there are even Jan filers who have not been approved yet so I figured why waste the time.

Come on USCIS, speed it up!!


Gee thanks for the Pep talk :) Seriously, Immigration Reform has NOTHING to do with it. It hasn't been passed in the Senate, and then it still has to go to the house. It will be debated in both places, and the house sounds like a tough place to get it through.

Inspite of the spin on reform, it will still take time to go into effect after the president signs it (normally 90 days). So, hang in there, your's is coming soon.

They even forwarded it to our new address, we just moved and I changed the address online the day I received the email had the form ready to mail in but did it online when I read the email. The card was sent to our old address. Tax stimulous check came today also.

No, she wouldn't. You need the documents on the I-9 Employment Eligibilty Verification form. If she shows up with only a driver's license and a SSN, she will be requested more proof.



As was said before, an UNRESTRICTED social security card and a drivers license is all that is needed, just like a US citizen. The unrestricted ss card is only given after you get a green card.

Before your conditional green card expires go to the ss office and get a unrestricted SS card. That way when you apply for a job all you need to show is a drivers license/state id and your unrestricted ss card. Then you do not need to deal with the extension letter.

We received an email before the letter came the green card arrived less than 2 weeks later. I did not check the website. I was actually surprised when the email came, we had just moved and I was ready to mail out the change of address form when I got the email. I could not update the file online because it was already approved. Lucky for us the post office did forward the green card to our new address.

I don't believe it was...there was only one "I-485" statistical column...for processing times....and we are not being processed in Columbus, Ohio....thee is no Service Center here.....our application is pending at the California Service Center

If you look at the CSC they are processing employment based applications read the entire line.

We just had our landlord, never had to renew the lease after the first year, sign a letter I wrote stating that she is living with me and the landlord sees us together when she works on the lawn etc. The letter stated that there was no reason for a new lease because the lease went month to month after the first year.

Did not have an interview for 10 year card.

They like to see representative evidence from the entire 2 years, so if you send bill, send some from every few months. Try not to bulk up on only the recent statements. We sent in copies of christmas cards addressed to both of us, plus a copy of the envelope. I also sent copies of money grams we sent to the family and pictures of us with my family at holidays, and during vacations together. I had my landlord write a letter that we have been living together since she arrived, I was on a month to month lease.

We also sent in copies of Id cards and paycheck stubs that show our joint address.

What they are looking for is documentation that spans the time from your green card until the time you applied for removal of conditions, some people just send the latest documents, such as bank statements. This does not show joint "ownership" over the past two years. Send them information such as: joint bank statements from every 4 months, christmas cards addressed to the both of you from the past few years, leases (if any) that were renewed each year, last 3 years of taxes filed jointly, proof of vacations the past few years. These are just a few ideas but I hope you get the idea they want a continum of documentation not just the latest.

Yes, I have a driver's license. I just took a look at I-9. SSN card plus driver's license is enough.

My SSN card still says "does not authorize to work in the US". I think I just need to get a new SSN card. Then I am good to go.

When my wife tried to get a new ss card without the notation on it with her extension letter they would not do it. No problem getting a job with the letter, I just needed to explain the process to the employer.

I had just finished smoking a beef brisket the other day and the apartment smelled wonderfull. I went outside for a few minutes and when I came back she was frying up her Tuyo, so much for the wonderful smell. I can handle all of the other things she makes and enjoy eating them I just can not get over that particular smell. After I got her to try the brisket she loved it. I do use the smoker to make her tinapa.

I did find something that she can not stand the smell of...... brick cheese, she does not even eat it just the smell of it out of the wrapper makes her crazy.

My bags have been inspected and a flyer placed in them 2 of the 3 trips to Philippines. When I opened my suitcase in the Philippines I found the flyer, nothing missing. I use my had carry bag for all cameras and camcorders I do not put them in the checked baggage.

She does currently have a Globe phone (that is the one I have been calling) so I guess we will just have to learn to deal with signal issues but the info about the IDD cards is awesome to know! star_smile.gif

I was using a calling card at roughly 13 to 14 cents per minute and if my math was right the IDD cards would be only about 5 cents per minute. THAT is good to know. I like saving! Might actually be better if she was the one to place the calls also as then there would be less of chance for her to get any grief at work for personal calls.

I do not think it will be cheaper for you. You still need to make an international call at the calling card rates or what the rates are through your phone provider. She was not paying to receive your calls.
