Not to worry - It is a good thing !
I had the same thing happening to me when I filed (2 years ago) to the TSC (Texas) they sent my file to California Center too. I think they process much faster so you are in good shape !

Faster? Not lately. All petitions are now being sent to either Vermont or CSC. The other centers are forwarding for the next 30 days since the BIG change on July 30th. After August 30th, they will be sent back to the petitioner if received by NSC/TSC.

They also restructured the "jurisdiction of the two centers, with Vermont taking on more states, and Cali getting fewer....about time.

The wait is inexcusable, it seems like every step of this process has been one "backlog" after another.

Rambaldi, I can't help but worry about it. I know things are going to get more delayed for me. I feel that they just sent me the approval notice without updating their system. If they did update it, they wouldn't approve me again right? my first NOA2 date was AUGUST 2. I'm even touched again for 3 consecutive days for my second approval AUGUST 21 date. unsure.gif


Whoa! RELAX you have the original hardcopy...go by that date. The computer system really means NOTHING. That hard copy is what is needed for the AOS and is really all you need. Remember there were other filers several months ago who never received anything, just the letter from NVC and I think a few actually just received packet 3 from the Embassy without having any knowledge of the approval.

So, don't get worked up over it it is just waiting to be shipped to NVC like the rest of us....and boy is THAT burning my a**.

Been over a month now since I first sent the package, when can I expect to receive my hardcopy NOA1?


I sent mine on April 10th, and have an NOA-1 of April 20th. I never received a hardcopy. Some people do, some in the past have never seen one.

I just found about this website from a friend of mine and I wish I would have known sooner... I feel so lost in all the information. Get your receipt number from the attorney. He or she should have that if indeed they filed for you. If they can't produce, ask for doumentation on when it was sent (exactly_ like the registered mail receipt). Then I think your only recourse is to contact your State Bar and file a complaint. They might be able to pressure him to pay back the retainer.

There seem to be a number of Immigration Attorneys out there that are really untrustworthy, and do very poor work. Petitions are easy for them, they don;t make as much money and in many cases I think they prefer deportation issues which give them the court time and more $$. I will say there are many GOOD Attorneys out there as well, you just have to shop around. This process, provided you have no complicated issues, can be done by the petitioner. It only takes time and paitence on your part to make it through it, and sometimes that in and of itself can be a challenge.

It took 17 days for mine to make it to NVC and now it has been another 18 days that it has been sitting there. In my conversation with NVC yesterday I was told it was in the mailroom waiting to be dispatched to the Embassy and it takes "2-4 weeks" to do so. So much for the letter saying "within a week we will forward this petition to the Embassy"

My understanding is that it is $100 MRV fee, and the Fed Ex cost. Nothing more.

Also, what's the sense of even having them (the Embassy) send the Packet 3 when you can download it online and take care of it yourself? You no longer have to fax/send the KEV-1 Checklist, just bring it to the interview.

You're right about Kyiv Postal Svc though, I have never had a problem and normally it is there in a week.

Maybe this should be moved to FWAGUY's "Kiev Beat" thread? At least then we'll be able to find it later.

I haven't posted in awhile with any updates on on where my fiancee and I stand, so I'll give a brief update for those of you still reading. I first should say congrats to all of you who have arrived at NVC and made it out to the Embassy. For those of you with interview dates set, I can honestly say that Lena and I wish you god's speed and hope you get approved, get the Visa quickly and without delay, and that you're reunited as soon as you both desire.

Tomorrow wll be exactly 5 weeks since we arrived at NVC. I have not contacted them since the 12th of September, and only yesterday took a stab in the dark ad sent an email to th Embassy to see if they may have received it since then. I received my reply today and it is not there. So, tomorrow evenin I'll call NVC and inquire once again about where we are at. In a call on September 7th to NVC I did ask specific questions regarding the file, and was told we were NOT in Admin Review, NOT stuck in Name Checks, and was told we were waiting to be sent out. That was nearly 3 weeks ago, and I have to believe that even though the CSR seemed sincere and polite on the phone, something is going on. I have a packet of information ready and waiting for Thursday morning to send off to one of my State Senators, and hope that if they are sitting on it, that my Senator can render some aid in getting some clarification.

I can't begin to tell all of you how difficult it is after the 119 day wait for the NOA2, the 17 day wait to be sent to NVC, and now the 5 weeks of not knowing when or how the file will be sent out. October 7th will leave 60 days validity to the petition, although I guess I can request an extension from Kyiv, and will have to do so if needed. My finacee and her daughter completed their Medicals today, we have our case number, everything is in place, just not the file at the Embassy.

We will wait as long as needed. I never dreamed that I would be going through this mess at this phase. Neither of us has ever applied before, have any record of any type, are both working college educated professionals, and have provided a ton of evidence of the relationship including my 3 trips to visit in the past 13 months. From my perspective I just have no idea of what sort of delay we are experiencing and am clueless as to why this is happening.

I will update everyone when we finally are sent out. I wish everyone luck in the mean time, and welcome prayers, or crossing of fingers from anyone.

For Kyiv you actually set it yourself. You now telephone a callcenter, which costs money, and then they help you make the appointment. A filer more senior than myself told me to call as soon as I have my KEV# and set the appointment. I tried that, but now it appears that the case only makes it into their system when the embassy receives it. So alas I must wait for a couple more days and try again, since this time I pay for my impatience. blush.gif


Very interesting! This way people going through Kiev don't have to wait 2 months for their interview! I assume you can set it as soon as possible. We are going through Moscow, it's been almost two weeks after NVC and still no interview date. Will wait...


That is not quite true. The average (on VJ) is 54 days for Kyiv, but I know of 2 people who were over 60 days out for their interview. It's not much faster than Moscow, but one can assume that Moscow moves a much larger number of Visas through that Embassy.

How long on the average does it take for petitions to get to Moscow embassy from NVC? If they use DHL it should only be 3-4 days, however, some people's timelines say 8-10 days...



You know, it seems that these dates bounce all over the place, and it is hard to imagine what on earth really happens.

I know that they wait and send them in batches. They will not just send a single petition. My guess would be that it should be there within 2 weeks. I have seen a few that went longer than 20 days, but that seems like the exception. I also see that there must be more movement of petitions to other countries, and that the ones moving to others are just flat out slower to get there. The Embassy also needs time to check in the petition and I know that in my case Kyiv typically takes about a week or so after they get it.

So, I know I probably didn't answer your question, but I would think it should be there soon. My case is still sitting at NVC after 17 days (completely processed and in the mailroom) and it's like deja vu all over again with CSC. I'm seriously beginning to think that calling them often (I haven't done that) or requesting a congressional somewhere during the entire process (I have done that) really angers them. There is no way to know for certain, but after watching others and now myself, I am really beginning to believe that. NVC says it can take 2-4 weeks to ship a case, I guess I'm destined for the 4 weeks.

I re-checked the website, and it still said they need to have the hard copy available to schedule the interview. I sent an email asking about if it was ok to proceed with the medical, and they sent me a canned response. So, I think we'll proceed with the medical within the next couple of weeks, and hope they have the file either then, or soon beforehand so I can schedule the interview.

Where are things at with your petition Deron? Is it at NVC yet? (I'm almost afraid to ask).

Etripke, if you have your KEV# you can call the call center and get an appointment right away. No need to wait.

Rambaldi, I called again today and I was told that they contract the shipping out and that the system wouldn't say when mine was shipped. Funny, they said I had been shipped out when I called yesterday, I just forgot to ask when. Anyway, the guy is getting a supervisor to call the contractor and then call me back (fingers crossed, hope absent...). NVC says 2-4 weeks, I said it's been 29 days...do something....sorry, you just have to wait. My Congressman's visa gal is on vacation this week so Tuesday is the earliest I can hope for anything. Only a month and a day after approval...ludicrious. I'm so happy I got to see my sweetie this week, I'd be irate otherwise, especially seeing people approved well after me already on their way to the embassy. If I had applied two weeks sooner I'd be within weeks of seeing my honey, now it looks like months if everything goes great from here on out.

On a happier note, I hope everyone has a great long weekend. No matter what else is going on in our lives, the visa process alone makes us deserve this as much as anyone. Take care all...


As I understand it, they MUST have the petition physically in hand prior to setting the appointment. That is from the Embassy Website. Do you know something I don't?

It would be nice to be able to make it however.

Cassandra, I'm so sorry to hear that. Do call CSC and find out when it left. I'm certain it has to be on it's way by now. If you don't get results, go ahead and get to work on that congressional

After about 7 tries I got through to NVC and now Have my KEV Number for the Embassy. It was received on the 22nd, giving it a 5 day transit time from CSC. It is still at NVC however, I'll call later in the week and hope that it is on it's way to Kyiv. The VJ average for NVC processing is listed at 8 days.

Again, this might be answered quicker if you post it over in the Embassy or Regional forums. Some Embassys do not require the DS-230 (my Fiancee's for example) for the K-1.

Like everything else it varies. I guess there is no way to predict, but one might assume that it takes them about 5-10 days to receive it, and depending on your luck just a few days processing at NVC and off to the Embassy. One thing you might be aware of as other Russia filers have learned is that NVC may hold your petition for some additional processing (Admin Review) for a short time once it arives there. Bluesfairy is wrapping up hers right now, and I have seen others who have had that happen in the Russia Regional Forum. It seems to be routine, and why they are doing it is beyond me.

Like everything else it varies. I guess there is no way to predict, but one might assume that it takes them about 5-10 days to receive it, and depending on your luck just a few days processing at NVC and off to the Embassy. One thing you might be aware of as other Russia filers have learned is that NVC may hold your petition for some additional processing (Admin Review) for a short time once it arives there. Bluesfairy is wrapping up hers right now, and I have seen others who have had that happen in the Russia Regional Forum. It seems to be routine, and why they are doing it is beyond me.

Well, I decided yesterday to contact my congressional representative and spoke to her immigration specialist on the phone this morning. Within 3 hours, I had a call back and she had heard back from the congressional liaison at CSC. She told me our petition had been sent to NVC on the 17th of August (10 days after approval and 7 days after the last touch). So, she is following up with NVC to see if it is there yet (I'm guessing it is) and hopefully it will be on it's way to Kyiv within a week or so.

My guess is that if any of you have not arrived at NVC yet contact CSC first to check with them. If it had been sent, I am assuming it takes NVC a few days or so after the receipt to get it into their system. I would imagine that when I called NVC on Tuesday the 22nd, it had not been entered yet and the CSR couldn't do anything about that.

Hang in there, and don't forget to update your time lines when you get to NVC and when you're out of there.

Long before I started this process I hired an immigration attorney. At the time (about a month prior to finding VJ) I thought it was the right thing to do. After I found VJ, I more or less took control of the petition which was being compiled, and have done everything by myself with the attorney just being given updates and used in case of problems. Well today I contacted her and this may explain some of the mailroom delays:

"While it is always hard to say, the "backlog" could be a result of the flood of fiilngs that came into the
system just before the fee increase on July 30."

I guess when I look at it in that perspective, it would make some sense. She is in contact with other attorneys, and they have their own user groups to excahnge information and ideas. I would think that this assumption may very well be correct.

So, we weathered the H1B mess in April that flooded the mailrooms and delayed the NOA-1's from being issued as well as the computer system mess. By the sounds of it we are most likely weathering another delay because we are in the wrong place at the wrong time. I know this adds little comfort, and I am as furious as anyone else in the same situation, but I guess it is what it is.

Everyone hang in there, they can't take away an approved petition, we'll be on our way to NVC soon enough.

Check with the Embassy (Website?) most likely just originals of the evidence of the relationship, all of your flight(s) information (boarding passes et. al) cards/letters, and more photos. The NOA1 and NOA2 I-797's are normally not required, they received the approved petition it was approved when they touched it, so that might be overkill. Check the NL Embassy though they will most likely have a section listin what you need to have for it.

No but I have two prior trips to US, one on J1 (long ago) and one on B1 (recent) visa. Perhaps this causes extended security checks.


Maybe that is it. I don't understand the reasoning at all, but some of you Russian Beneficiaries are seeing this. It is routine and nothing to worry about, especially with no prior K-1.

This seems to be a common theme for Russian Petitions of late. You should be out of there pretty soon. Check in the Russian forum, I remember reading about this same thing back in June I believe. Ditto when I just called. She said "2 to 4 weeks or up to 90 days" . When she asked when I was approved she sounded surprised that I had even bothered to call about it. I told her it was ridiculous to have something take this long just because it is sitting in a mailroom.

Well its time for more of the wait and see routine. I hope everyone is keeping up with their timelines and announcing when their petitions are actually arriving at NVC, I want to stay on top of this in case I initiate a congressional.

Give your case number and explain no notice received. You should have had it by now. That email address was in June 26th 2007 press release over their computer troubles.
