Congratulations - that's great! It must be something specific to petitions for Cuban fiances, as I have noticed others go through faster as well. But still, it is heartening to see the process moving along for you.

As for the rest of us... I have been following the progress of petitions filed to the NSC, and they have barely issued any NOA2's since the end of June. I'm wondering what the holdup is. Not that I expect mine any time soon - I would just like to see them moving forward with petitions that are in front of mine!

Hello all,

I'm excited to have a thread for June filers. I sent out our petition to the NSC on June 4th. The check was cashed on the 19th, and the NOA1 was dated June 18. I received the hard copy in the mail on the 20th I believe. I'm not looking forward to all the waiting we have ahead of us now. I'm hoping to have my fiancé here by the beginning of December - it would be really great if he was here by Thanksgiving, but I think that may be stretching it. It seems a few of us are thinking December as well... What is everyone else thinking? (Not that it matters what we THINK! :no: )

I think NOA2s are being delayed due to the H1B processing going on right now. Sit tight and start getting your Packet 3 together, it'll keep you busy in the meantime while you're waiting for that copy to come through the mail. ;)



Oh, we're well on our way with that stuff. I would just prefer to have a copy to send with him. Plus I don't want to let it go too long. I doubt the H1Bs have anything to do with them getting mail out in a timely fashion. They approved it already, so the work part is done. But, nothing to do but hang out. I'm certainly not watching the mailbox like I was pre-approval.

In an effort to give our customers more accurate information about current receipting timeframes and USCIS service level commitments, we are providing the following projections for fee receipting and data entry processing for H-1B cap cases currently at our Service Centers:

Note: These projections do not apply to Premium Processing or I-129 H-1B (cap or non-cap) cases.

California Service Center

USCIS expects to provide in time-compliance for receipting of all form types by June 15, 2007.

Nebraska Service Center

USCIS is currently providing in time-compliance for receipting of all form types as of May 10, 2007

Texas Service Center

USCIS is currently providing in time-compliance for receipting of all form types as of May 10, 2007.

Vermont Service Center

I guess this pretty much sums up the delays for the I-797's for everyone. What gets me is the last paragraph and when to call = CSC July 15th? Crazy...

I stand corrected on my previous post. you CAN be stuck in name check hell at the Service Center. I read a previous post of yours and realize now how that is happening to you. It is a shame they cannot clear these faster than what they are doing, and I would bet there were some "near" hits on a watch list of some type. I feel for you.

We waited 150 days for the NOA-2, with no complications and more than ample income. Others waited much longer.... some years....

Have you contacted USCIS? Do you have an online account? Have you received an RFE?

Please advise.


No Complications???? You had not one, but TWO (2) RFE's. That is NOT normal by any means. You were also caught in the hell of IMBRA where 150 days was not so rare.

Waited years??? Maybe in name check hell at the NVC or Embassy but not just for a petiton approval.

To the OP: Hang in there it's coming, the H1-B mess will be finished up shortly.

No news yet, but the cash the check last Friday, hopefully we will get the NOA1 next week, I will let you know what happens.


Get your case number off of the check, and set up an account w/USCIS. You can enter the case and sign up for email updates, and also see your NOA-1 date from there.

Mail has been VERY slow if not at all for receipt of the NOA-1 (form I-797). I sent mine in on 4/10/07 and still have not received the I-797.

Yes fwaguy! The NSC sends the packages to CSC, but the OP is just trying to compare his timeline to other filers of the NSC, nothing wrong about that!

I feel your frustration checking every day your bank account, and seeing that your check has not been cashed :( Since mid April, NOA1's for NSC filers have been taking a little longer. We waited for ours for 34 very long days!

Not true. CSC is slow and becoming even slower as more Service Centers are forwarding their I-129F Alien Fiancee Petitions there for processing. It appears the only Service Center not currently forwarding all or part of their I-129F Petitions to CSC is the Vermont Service Center (VSC) which accounts for VSC's much faster processing times.


You're partially correct Buck. They have been forwarded from Texas and Nebraska since spring of 2006. There was some thought that it was originally just a "temporary" fix, but who knows. I guess on one hand if it was going to be a permanent change they would have made the mailing address change on the "new" forms when they were released in February, but they didn't.

The other issue is that the VJ timelines are still being tracked by service center. There is a difference in processing times between CSC/TSC/NSC as shown when you look at them. I know that there has been some thought that perhaps the NSC/TSC petitons may (and I say may) be getting processed by specific groups at CSC. In other words the forwarded petitions are being processed seperately from the CSC petitons. This would account with the disparity in the timelines. I would encourage ANYONE who has filed at TSC/NSC to keep that service center listed as their service center rather than change it to CSC for that reason. It will provide a more accurate reflection of the processing times if that is indeed the case.

Need a copy for Moscow? I don't think every Embassy/Consulate needs to see it. After all it was approved before being sent to NVC and on to the embassy.

I've read on a couple of other posts about people receiving the letter from the NVC but not receiving the NOA2, but I was curious:

When I get the affidavit of support is it supposed to be mailed to the NVC before it goes to the embassy? or is it supposed to be used at the interview? Logic says it should be sent to the NVC, but my letter says "This letter is to let you know that within a week the petition will be forwarded to the appropriate visa-issuing post where your visa interview will take place." Does this mean that the NVC forwarded my petition without the Affidavit of Support?!

My congressman's office told me they have never seen this before, but I have a sneaky suspicion they rarely know what they are talking about anyway.

Sorry. I'm really confused and worried!


What's there to worry about? You have an approved petition, NVC has received it and most likely sent it on it's way. Like FWAGUY said, the I-134 is for the interview, NVC has nothing to do with it.

Congrats! Be happy, the USCIS doesn't have it anymore.

I have never heard that ALL Embassy's require it for the interview. I know for a fact Kyiv (Kiev) does not have it listed. Maybe in Manila or others?

That's a great Question Samar. I think we get the point. However, you might want to fill in a timeline with the correct dates, country of origin, and Service Center first. Also, don't forget to list the dates of these RFE(s) you have been referring to.

Well, after my nightmarish time in the system I think I have finally got everything cleared up!

I had a phone call from the consulate today to say they had received my dutch police certificate and all I have to do is courier them my passport for them to issue my visa, thank god it's over! For people that don't know, I turned up to my interview on the 11th to be told they would have to file for the dutch police certificate and then my application was on hold, with no idea when it would be completed.

Well, the courier comes on the 3rd so they should have it processing away by the 4th of July! I'm recovering from wisdom teeth surgery so I probably sounded crazy on the phone due to all the painkillers, but I'm so glad to have it finishing up. :)


Don't forget the 4th is a Holiday.

Yeah, and the most amazing thing is that Cubans can take advantage of the 'Cuban Adjustment Act' which allows them to by-pass all legality of the US immigration laws and covertly sneak in to the US and claim a visa based on the fact that they orginated from Cuba. If any other foreigner comes in this way, it's called illegal immigration and they get deported back immediately.

Considering the fact that it's been over 500 days since I first submitted the K1 paperwork, I followed all the rules and paid all the fees, and even almost 2 years, and after the interview at the USINT (US Consulate in Havana), they still find reasons to kick it back to Washington DC for additional review by some other inter-agency task force.

No wonder there are so many Cubans trying to come in thru the 'back door', so to speak. Why waste hundreds of dollars and years of uncertainty with the legal way to immigrate, when all you need is an inner tube that floats, and catch the right current and drift to Key West or Miami in a few days. Then you get instant adjustment!

Considering that your fiancee is from Cuba and the U.S. has no direct diplomatic relations with them, if you get her here soon that will be amazing. Hang in there a little longer. I read the state department information about U.S and Cuba relations and it isn't getting any better right now.

This is strange because over the past 6 months there have been a number of Cuban fiancee/fiance who have received an NOA2 within days of being checked in at CSC. It seemed like they were given special processing for what ever reason.

I'm not sure if this is going to slow your petition down any but your fiance should forward it to the NSC which will then forward it on to the CSC. I don't think you are supposed to send it straight to the CSC.

I realize that this may create a stir or I might get flamed over it, but I just cannot understand when someone goes through all of the hassle, pain, cost and misery of waiting for this process to be completed and their "fiance/fiancee" has to spend time with their "family". They come here to marry, they can travel ANYTIME once they get to you, but now they want to stay with their family for a couple of weeks? I could say alot more but I'll stop here.

I'm not sure where you're getting this information from, only one April Filer has received NOA2 so far. the rest of us early April filers haven't even gotten touched yet.



105 days and still waiting was touched on 6/29 and 6/30 I beleive that my files were handled and the data base was updated on the weekend seeing since the touches occurred after midnight It looks like on weekends and holidays they update their database


I guess when the database is actually working. It's very hit & miss from what we're seeing.

We're in a similar position. We filed in April and haven't even had the NOA1 sent to us. We can't get our receipt number from our check as we used an international money order, we called and the lady was no help at all. We have no clue if our case has been touched or anything.

My NOA1 is the 20th. I have never received anything on Paper (no I-797) but that list is rather long as well. One year ago, those petitioners who were in this "spot" were just starting to receive their RFE's for IMBRA. The average timeline during the summer and into September of 2006 was well in excess of 130 days and beyond. I guess we could consider ourselves lucky that we are not dealing with that mess, and the switch in June of 2006 where TSC/NSC then moved all of their petitions to CSC.

What we are experiencing is most likely a combination of things. First of all was the H-1B Visa debacle from April 2-4 where the service centers received over 150,000 petitions in less than 48 hours. You can imagine the mailrooms were just overwhelmed and then factor in the number of those petitions that get turned back once they reached the maximum, and so did those who were not selected, they were busy. Then factor in the number of petitions needing processing under the "premium processing fee" which means USCIS had to adjudicate them within 14 days, and the crush was on. I would imagine that many of those petitions had the extra$$ attached to them so they had to be worked. Coporate America is willing to pay the money...despite the fact that many of the H1-B's are abused.

In early May (the first week I think) they were behind on NOA2's and came through with an astounding 46 approvals for VJ members. It was unbelievable and then things slowed some. The other issue was that the notification system(s) and automatic updates seem to be working only sporadically as time has passed. There have been a number of filers without ANY touches or anything to indicate they were being worked, when in fact they ended being approved weeks before. The Petitoners in many of these cases have received just a letter from NVC and were told the petition is going to be forwarded on to their respective Embassy.

The last update I believe was for the CSC to have their act in order by July 13th. The issue of the notifications was addressed by the USCIS within the past 2 weeks, and at least at this point they are admitting that they have a system that is currently "hosed". Hopefully the pace of approvals will begin picking up some over the next few weeks, primarily after the 4th of July holiday week(s) given the 4th falls mid week, and no doubt many people are taking advantage of the mid-week date.

My fiancee and I struggle day to day with this wait as well, but like someone else said, it will come, they have to act on the Petition someday, and this too will pass. In the mean time I am heading back to Kyiv (Kiev) on Sunday for nearly a month. Maybe, just maybe, we'll have our NOA2 by the time I return on August 6th.

My mom mailed the I-129F package July 20 certified return receipt to the CSC from Ohio (I FedExed it to her from Mexico). Almost 2 weeks later we have still not received I'm back in the US from Mexico (where I live with my fiance) visiting family and getting some things in order, and tomorrow I will call the post office to find out what's going on. However, isn't it strange that 2 weeks later we haven't even received the receipt that they did indeed receive the package? Just wondering if folks have had similar experiences with US post. Quite nervous that I'll have to redo the package and pay the increased fee and need some calming. :blush:

I'm just a little behind all of you. I was imagining the slow down with the summer months, but when I look at my timeline every other day or so, and see it bouncing all over the place, it really is getting to be a drag. It was at July 23rd when I checked in early July but has jumped now to August 26th. What I don't understand is the fact that my timeline can be different when compared to others with the same NOA1 date from CSC/NSC/TSC.

I'm overseas right now with my fiancee, and due to return to the states on August 6th. We're praying/hoping for the NOA2 prior to my heading home.

One thing I will do once I arrive home I guess, is start calling using the RFE trick. I never received my paper NOA1 (many haven't) and I suppose I could use that angle for a few inquiries.

Well, they can't sit on them forever. I just hope that it comes sooner rather than later.

I'm reading about the materials to send your fiance' after NOA2. It says we need to send another letter of intent to marry only dated closer in to the interview. Do we address that to the embassy?


Yes we do. I am actually going to draft one for them that is a "mutual" letter with both of our signature blocks just my signature will show a date which is a week earlier than my fiancee's.

Say's who? There was a spike in H1-B's in April too, yeah it slowed the Avg by about 20 days but NOT 6 months. If you know something others don't, please share.

I was of those too, and looking at your timeline, I would call them today using the RFE trick. You can always tell them your concern over never seeing it, and have them look at the petition on the phone and confirm your mailing address etc. This will most likely generate a touch, and you might also find out on the phone if your petition has been called up for adjudication yet.

I have to make sure that all my ducks are in a row now so that, Lord willing, in a month or bit longer I will be able to quickly respond with all my paperwork immediately. I can not find anything anywhere that talks about the forms and paperwork that are included with a Packet 3 and Packet 4. I'm not even sure who gets what packet! If you have any example forms or a place where I could get a list of what I will need to respond to the packet that I will be receiving, please send it to me.
I read in a response by another member that I can download a packet ahead of time through the embassy so that my fiance can be prepared with the paperwork already. Is this the case, and does that help to make things go more quickly?
My fiance and I have not seen each other since applying for the visa nor will we see each other again until after our visa is approved :crying: Neither one of us has an opportunity between now and then to make a trip either direction. So my question is, with many people saying that they take more up-to-date pictures to the interview and we won't have any more recent pictures other than what I sent in with the I-129, is that going to be a problem? We will have plenty of proof of E-mails and phone calls, packages with stamps, engagement ring receipt, etc.

A lot depends on the Embassy. Some do have them for download, some not. Some will send the packets, and then others do both. Read the US Embassy website's information. I would assume they will have their procedure well outlined for you.

Hi all, Well I have called the uscis, Washington visa center and then uscis about 6 times trying to get my NOA-2 that they never sent me. One guy at the uscis told me to send in the I-834. I found this form and saw the fee for this form for a new NOA-2. $340.00. That really pissed me of !!! I called back to the uscis and told a woman there my story again. I have an approved I 129 f , My fiancee has her interview set up for Sept 26, and I never recieved the NOA-2 and there was no way I should have to pay for this. WHAT A PAIN !!!!! She sent an e-mail for a request for the NOA-2 and said I should get it in 45 days. I pray that the letter from the NVC stating that the I 129 f was approved and they sent it to Kiev will be good enough along with the NOA-1 US Embassy !!!!!!! Jeff


Like FWAGUY said...NOT NEEDED for the interview. The computer system was pretty hosed for a couple of months, you fell through the cracks of the system during the approval. I guess your calling around may have solved the problem, however, on June 26th the USCIS provided this email address in a press release which can be used to request your missing I-797. :

Hope you get the form soon, it is not needed until you adjust status.

This is easy for you to fix my friend. Get copies of all the "Primary Evidence" Boarding passes, Ticket receipts, Itinerary, AND Passport Stamps. I would send them another complete copy of the passport with all pages and a post it on the front saying which page(s) they are on. Then get some photos together in front of KNOWN locations in PI of the two of you together. The Tickets, boarding passes, etc just get you into the country, now yo have to show proof of being together (meeting). On the back of each photo: MAKE sure you right down the date and location of where the two of you are at in the photo. National landmarks are best, the adjudicators have access to the Internet to find them.

Accompany this with a cover letter and in it give them the dates, flights, and general meeting information. Try to be ####### about it and cover your bases.

This should be easy for you as long as you have the materials to throw this together. You'll have an NOA2 in short order once sent in.

Huskerkiev (former NSC Adjudicator) said the RFE's are "scripted" letters. The copy of the divorce he sent may not have been completely readable. Check your copies and make certain they are and resend them. It is my understanding that the scripted letters may have items that will not apply such as the translations of foreign documents in this case, so get a letter together for them for the RFE response, explain the lack of foreign documents in the petition, and resend the divorce document.

If you have any doubts on this, you had best consult with an immigration attorney. In any case make certain your copies are good and there are indeed no documents requiring a translation.

You guys can make it through this, many have, and this is not an uncommon RFE.

What he means by the bolded statement is that the copy was probably blurred, making it difficult to read. Not unreadble as in not in English.

An RFE is by no means the end of the world. As some have said, it may sometimes even be for something already submitted, and usually it is for something easy to provide. Go through your copy of the petition that you made for your records, and see exactly what you sent in for birth certificates etc. Some people have been asked a number of things in an RFE and the RFE's themselves are pretty much scripted in what they are asking for.

Over the 8 months or so that I have been a member of VJ I have read of many reasons for the RFE's being sent. I also have seen from timeline information that most RFE responses are acted on very fast once they receive the information they are requesting. The denial rate of I-129F petitions from member accounts are very, very few. If you meet the basic criteria of being a USC, Having met one (1) time in the past 2 years, and are legally able to marry, you should be approved. With that in mind, review your petition and look for any weak links.

Denials come more from Embassy interviews and dealing with the Dept. of State not at the first step of petition submission and approval.

Not to worry - It is a good thing !
I had the same thing happening to me when I filed (2 years ago) to the TSC (Texas) they sent my file to California Center too. I think they process much faster so you are in good shape !

Faster? Not lately. All petitions are now being sent to either Vermont or CSC. The other centers are forwarding for the next 30 days since the BIG change on July 30th. After August 30th, they will be sent back to the petitioner if received by NSC/TSC.

They also restructured the "jurisdiction of the two centers, with Vermont taking on more states, and Cali getting fewer....about time.
