Congrats to all of the recent approvals! I am very pleased to see things moving, and I hope they will stick with the work and keep them coming.

Yesterday (Monday Evening here in Kiev...Monday Morning in California) I pulled the "RFE" trick and actually got through to the service center. I, as of today, have never received any correspondence from USCIS after they signed for my petition on April 11th in Lincoln Nebraska. I used that issue with the CSR and she actually put me on hold for about 3 minutes, and then came back, verified my information, read some information back to me regarding the spelling of my Fiancee's name and so forth, and then told me that my petition is with an adjudicator currently. So, what a relief. She gave me the company line of I should know "within 30 days" if I have an approval or an RFE.

I have an NOA1 of April 20th, and it seems as though they are gradually working their way in that direction. For those of us still waiting, keep the faith, we're getting closer.

I hadn't checked my case on the USCIS site for the last 2 weeks to keep myself sane…. until yesterday my fiancé told me that :dance: WE FINALLY GOT OUR NOA2!!!! :dance: :dancing:

It arrived via snail mail. Approved July 19, 2007, never received email notification.
For those April filers who are still waiting, I know this is soooooo frustrating, but hang in there. (F) I hope to hear your good news soon!!

Remember this is vacation time, and if an adjudicator has his "Box" of petitions sitting at his/her desk and goes on vacation, they'll sit until they return. One could also assume that all of the H-1B's need to go through NVC as well so the tidal wave moves in their direction at the same time.

I don't think that has anything to do with it. This is delaying the paper receipts only. You can still check online at the USCIS website to see if you have had any touches or approvals.

It may still have something to do with:

The California Service Center does have a backlog since accepting many I-130 petitions from embassies abroad since enacting the Adam Walsh act.

As of January 22, 2007, consular offices abroad were instructed to cease accepting certain immigrant visa petitions because consular officers lacked the means to perform the required criminal background checks on American citizen petitioners, as required by the Adam Walsh Act.

All lawful permanent residents, and American Citizens resident in the United States or with a permanent address in the United States, must file I-130 petitions at the USCIS Service Center having jurisdiction over their place of residence.

Apparently California Service Center is experiencing the brunt of this and as a result is really backed up.

I don't know if this is still the case with the CSC.


On a side note my adjudication estimate has only increased by one day.

So who knows if this is the reason they are still experiencing delays but it is annoying that someone didn't have the foresight to see that this would be a problem and divide these extra petitions evenly so as not to completely bog down one service center.


The I-130 issue is really old news. There was some problem initially when the DOS did not have a mechanism in place to run the corrected criminal history checks for the Adam Walsh act component. The Embassy's are doing DCF again, albeit modified with a 6 month residency requirement. I know that there were quite a few sent back, but overall I think the issues have more to do with H-1B's and systems issues. Remember this is vacation time, and if an adjudicator has his "Box" of petitions sitting at his/her desk and goes on vacation, they'll sit until they return. One could also assume that all of the H-1B's need to go through NVC as well so the tidal wave moves in their direction at the same time.

I feel so horrible :crying:


That's been talked about ALOT on here. Anytime you have a K-1 Pending you run the risk of being turned away. I would imagine that even with the H2B they assumed he wouldn't leave because of the K-1 pending. It has happened to others before. Sorry.

Hi Michele,

It's strange that there is no WAC# on the back of the check. You could try calling, but I have a hunch they'll tell you to get an info-pass appointment to go into your local (or not so local) office for the information. I mailed mine to NSC two (2) days before you did, and was able to at least get the case number off of the check. I have not received the NOA1 in the mail yet however, and I guess there are a number of filers who never have as well.

Please keep us posted on the situation though, I'm interested in hearing if the customer service reps are consistant in giving the information over the phone.

Ok, Count me in FINALLY! After waiting 6 months, it went out for Nebraska this morning. My thanks to those of you "Veterans", FWAGUY, and Huskerkiev for offering the insight needed to compile this mass of paperwork, and make sure the petition is complete with it's content.

looks like about 90 waiting for may, 90 for june and 90 for july in the pending K1. doesnt seem to be a vast influx of petitions to beat the deadline of july 30th. looks like the monthly average of around 100.


What I found though is that as the timelines for the month someone filed approach that 90 day mark, the number of other filers grows. Originally, at the end of April I thought the same, there were only 57 or so filers listed in the database. That has grown consderably over the summer. Rest assured the increase in petitions of this type will pale in comparison to the 150,000+ H1-B petitions received by the service centers on April 1-3 2007. The advantage now is hopefully the CSC and VSC will have more fair, equal, and consistant processing times.

Maybe in Egypt or the MENA areas but most areas of the world it is based on the evidence presented. He has a solid case and it is not like his 3rd, or 4th K-1 like a few guys have had AND were approved nonetheless.

I know MENA Visas get more scrutiny than many areas, and the "consulate officer" does have more of a burden on them, but it is due to national security issues and THEN visa fraud.

For what it's worth, I do remember finding and reading the press release last year when they stopped processing at TSC and NSC and began forwarding them to CSC. They announced at that time they were doing it so TSC/NSC could focus more on the I-129 (Employment type) Visas. I tried to find it yesterday, but they revamped their website last September and now it must be off the server floating around in cyberspace. I think the ones who will see the biggest impact on this will be the VSC filers as I really don't think they will be be seeing their 20-30 day approvals. If they (NSC) can at least keep all of the petitions moving and do so in under 100 days like those of us stuck at CSC have been experiencing, I won't have a meltdown.

I am waiting for him to send me a copy. The problem with going to Morocco is my son is in school and we do not have family in the area that can help. Just 3 hours away. He can't miss school. My available time is in August, during Ramadan. I am assuming that would be a nightmare to try to get married in even 3 weeks then. My next available time? Next June.

I am so sorry that you are going through this. I want you to know that I was married to my husband Faisal in Morocco on January 10th and I arrived in Morocco on December 27th. Yes, there is a lot of running around that must be done however, with alittle diligence and alot of patience for long lines and such, I think you can get everything together in about 2 1/2 to 3 weeks. be able to routinely file Forms I-130, Petitions for Alien Relative,
with U.S. Embassies and Consulates except in locations where U.S.
Citizenship and Immigration Services (USCIS) has a public counter
presence within the Embassy or Consulate. Petitioners residing overseas
in countries where USCIS does not have a public counter presence will be
required, starting August 15, 2011, to file their Forms I-130 by mail
with the USCIS Chicago lockbox. U.S. Embassies and Consulates that do
not have a USCIS presence will only be able to accept and process Forms
I-130 in exceptional circumstances, as outlined below.

Aside from the fact that none of us are perfect, including you, have you even considered the type of sadness and stress that this person is going through being in a new country, pregnant, armed with vague medical information about chemicals pumped into the body? Please be supportive or just keep your comments to yourself. The fact that this was even shared on this forum, although I agree with the other posts that she should seek professional advice now that she is here, is a testament to her trust in the collective wisdom of us as a group AND her real, valid fear humbles me and makes me sad at the same time. My husband and I received the appointment letter for his CR-1 Visa interview in Casablanca. We are very confused and need some guidance. Would you please help? See below for questions. Sorry for the long post.

1) The appointment letter states that he needs to bring original documents if they haven't been submitted to the NVC. They gave a long list of what was required/missing. We BELIEVE that we do not need to bring any additional documents. It SEEMS like everything is on file. What do you think? The legend for this is as follows:

* Document Status Description
A = Applicant must acquire this document and present it at the time of the interview.
C = Direct inquiries to your consulate / embassy
D = Certified document received
F = This form is not necessary for this application.
I = The required form is incomplete. Please ensure that a complete form is presented at
the interview.
O = The original document has been received and accepted as meeting post
requirements.
P = The police certificate must be requested by the applicant. If you have already
applied for this document, no further action is required. The issuing police authority
will send the police record directly to the appropriate US Embassy to have on hand
at the time of the interview.
R = The electronic DS-260 form has been submitted and reviewed.
S = Scanned document received. The original document must be presented at the time

3) Will he receive any further information in the mail? I have heard of things being mailed to the applicant (aka Package Three). Is this a thing of the past or will he expect something in the snail mail?

4) Does he need to fill out any additional paperwork or sign anything additional to be submitted prior to his interview? I have heard of some people having to fill out other types of forms like a DS-156 or something?

5) How far in advance should he arrive at the consulate?

The family code in Morocco is based on islamic law and the same goes for Algeria and most other muslim countries. The mother is granted custody of children after divorce and then when they reach the age of reason they are allowed to choose which parent they want to live with. Unless the mother is unfit, and the mother simply not being muslim(which we're not even sure is the case) doesn't make her unfit, then she gets the child...islamically and culturally. Even if we want to look deeper into the islamic laws then if a mom is unfit her muslim family would get custody of the child after her, followed by his family, and lastly him.

I'm not judging him through some American lens. I'm muslim and married to a man from the same culture, religion, and language as the OP for nearly a decade. I'm not saying he shouldn't see his child, but I think a child that small belongs with their mother as long as she is capable.

Do you really expect a woman to just send the child she carried for 9 months and delivered to you? You have a right to see your child and build a relationship with them, but that doesn't mean she has to hand him over.

Why does she want a divorce after so long and what happened with the petition she filed before this change of heart?



I understand that this idea of the father wanting sole custody and discussing it in this matter is jarring but, there is a different social context here. In some countries, men are awarded custody of children, unlike here in the USA where mother usually gets custody. I don't find it unusual given different divorce/custodial circumstances and the fact that the communication is in his second or third language.

For the original poster: Yes, you should contact a lawyer in the USA. In the USA, mothers get primary custodial rights (meaning that the child gets to live with her) unless you can prove she is not a good mother which is hard to do. However, you can ask for joint custody or visitation rights. This is your right as a father. Depending on where she lives in the USA, she may have access to No-Fault divorce which means you do not have to consent to the divorce...she will get it regardless. In other states, she has to prove a reason for divorce. Either way, the divorce will happen eventually. I realize that this is upsetting for both of you but, try to get an attorney to help you through the process and keep in mind what is best for the child. Is it possible for you to communicate with your wife regarding a compromise for custody or how to raise the child? I know this might be the last thing you want to do right now, but regardless of whether you divorce or not, this woman will always be in your life as the mother of your child--sometimes it makes it easier (and less expensive) to work the details out between yourselves. And as a child of divorce myself, it made it easier knowing that my parents tried to compromise alittle on the issues about me and my sister despite their divorce.

I am not an expert so, I can only go on intuition. First, I would call the NVC and speak to a representative. Explain to them this situation and ask them what to do. I believe they will go a long way on filling you in. While you do that, email the Consulate and ask them to withdraw the interview.

These are huge red flags as everyone is telling you. You do not need to go through this and since you aren't married yet, there is no legal ramifications, only emotional ones for you. I am so sorry you are going through this but, thank God you found this out now. He overplayed his hand in all of this and that is a lucky aspect for you. Heaven forbid he waited until he got here and sprung this on you. Please keep up posted and just know that we are here for you.

My husband paid 1300dh. :blink: It has increased significantly. I heard there have been some problems with Dr. Khadija with getting your papers over there in time. Then, talk about needing more money to release the medical eval. Not sure if this is true or not but, I would certainly avoid.

Go about two weeks or so before the interview. You have to bring two pictures, money, and a copy of the appointment letter to the chosen doctor. There will be alot of running around to do with x-rays and blood work and vaccinations and pharmacy stuff. However, it is not very invasive.

when you go to the courts you should be able to get certified copies with the courts seal on it... Here where I live the seal is a big gold sticker that looks kinda like a star. We got married in Fes and had no problem.....


God Bless you for going through that and still having a smile on your face. We had two days of striking....it nearly whittled my nerves away to nothing.

THINGS You NEED:
Documents a U.S. Citizen Needs to Marry in Morocco

a. A valid U.S. passport and copies of the biographic page and the page containing your date of entry to Morocco. Some but not all local authorities require the u.s. consulate general to certifiy these copies.

b. If divorced, proof of dissolution of any previous marriages. Provide original or certified copies of these documents. (TRANSLATED)

c. Certificate of nationality issued by the authorities of her country or the consular services in Morocco or in the host country. (TRANSLATED)

d. A completed Affidavit of Nationality and Eligibility to Marry. This document may be obtained at the U.S. Consulate General in Casablanca during public hours. There is a fee of $30.00 for a consular officer to notarize the document. The document is in English and you will need to have it translated. The document is the only reason you will need to visit the U.S. consulate General in relation to getting married. (TRANSLATED)

e. A birth certificate. Provide an original or certified copy of this document. (TRANSLATED)

f. An American police record must be obtained from a police department in the state where you last resided or from the FBI at http://www.fbi.gov/h.../fprequest.html (i couldn't get the FBI document in time so got a state one problem is Washington state only does records via the internet therefore I had to get affidavid from u.s. consulate and certified)

g. Work certificate (u.s. does not have this so I brought my pay stubs and a letter from my employer translated)

i A medical certificate of good health from a doctor in Morocco. This document must be obtained in Morocco. (he didn't even examine me we just paid the money and he wrote the certificate)****IN MOROCCO****

j. Four recent passport photos 3cmX 4 cm, same size required for a moroccan passport. ****IN MOROCCO****

K. The fee for submitting an application for marriage to an adoul is 150 dirhams.***IN MOROCCO****

L. Resume' highly suggested.

WHAT TO DO WITH EVERYTHING:


1) You will need to have it translated into Arabic and be certain ALL U.S. documents are translated.

2) Take your completed Affidavit of Nationality and Eligibilty to Marry and other documents to the following government of Morocco offices to be certified:

a) first go to

Annexe du Ministrere des Affaires Etrangeres
Zankat Zallagh,
Agdal, Rabat

b) and go to

Ministere de la Justice Sections des Marriages
Place de la Mamounia, Rabat

****we did both in the same day while in Rabat be prepared for a long day and a long line unless you know someone wink wink)

3) After obtaining the certification from the offices above make 4 copies
4) You and your fiancé must contact (you will just go in) the Family Law Section at the Prosecutor's office at the Court of Appeal in the city where you will be married.
****You will need to provide that office all the required documents.
****Authorization to marry will be granted after the court completes administrative processing.
****The length of time required for this process varies and the file with your documents is forwarded to a family judge who will inform you of the next steps (but I will tell you)

5) After granted the first judge at the "court of appeal" will give you a packet.
a) Take this packet to the larger court of justice near the palace (I do not know the name but the moroccan residant will).
b) After this location they will issue another packet (granted this part of the process can take days be prepared to run all over town).

6) After this location you will get another packet in which you will go to the Police center (casablanca) for questioning (I like to call in interrogation). This is where I suggested bringing your resume' with education dates and times is vital. Once they approve (they will let you know when to pick up the documents)
7) It may take around 2 days then bring it back to court of justice near palace.

8) After receiving final papers from the court of justice near palace, it is required to go back to the court of Justice Family Marriage section.
****Be warned here "mixed" marriages are on the bottom of the pile. You will most likely wait a day in this office be ready to go for a walk during their lunch time.

9) after that you have finished the governmental approval to marry... find your Adoul and you are finished.

P.S....in places where it seemed to be taking a long time, my husband had "grease" some palms with alittle additional money to make things go faster.

I believe that it is because you need to present your passport to them in order to check in. Don't quote me on it but, I think that is the issue. Do you have a seat on the flight? If there is assigned already and the flight isn't cancelled then this is surely why.

Agreed...Madrid is easy.

However, I hate to say but American Airlines sucks a lollipop. I experienced cancellations, delays, rudeness from the staff, and very little in the way of accommodation. Not to mention, I had a few things wrapped up in my luggage and they broke EVERYTHING...even my hairdryer :angry:

Double check everything with those fools.

It can mean anything from reviewing the missing information he had to provide or doing a background check because his name (not HIM mind you just his particular name) was flagged for shady activity. For example, John Smith of Any City, Nevada has committed a felony. John Smith of Main Town, Florida applies for a government job. John Smith (the general name) is on the system as name to look out for. The government has to make sure if it indeed two different John Smiths OR did John Smith of Nevada move to Florida. If they have his passport and everything, don't worry. He will get the visa. It just takes some time. Be patient. When you follow up, do not be hostile (not to say you are either of these things but it is natural to get this way when we are uncertain about our future). You will see that they will give him the visa. Remember it can take a little time... Look on the forum to see averages and hear about experiences...this should help you eliminate the uncertainty you are feeling. Sounds like Sa'ad has a name that needs checking...but they will soon figure out that he is okay. Remember there are ALOT of databases that require checking and they have to be done by different people in different branches.

You don't know anything about me aside from the tiny blurb here on VJ about my life. However, you spoke about being a researcher in your above post. I have no problem asking for 'pointers' when I need them. When I do, I tend not to ask from people who initiate a post then jibe at people's english because they are asked who they are. Although I believe your intentions are innocent and agree that it is an important topic, as a Moroccan expert you must be aware that some people don't have good intentions when it comes to asking sensitive questions about visa issues--thus people ask them to identify themselves.
