I am so sorry you are having such an experience. One suggestion, before you go through with selling off things on ebay, hold on to the dress and accessories; even if you are not able to have your dream wedding in April, you can still wear your dress for a small ceremony when your fiance is able to arrive here. You may also wish to have a large 'reception' or special ceremony at a later date - maybe on your first anniversary - and you can wear it then for your family and friends. I hadn't planned on wearing a wedding dress because I knew our ceremony was going to be very small in front of a judge. Still, I found the perfect dress purely by accident - I wasn't even looking - and bought it. I wore it and it helped to make that small ceremony even more special. So, hang on to things like that for now until you have a better idea of what and when things will happen. Good luck in finding your answers soon and getting your NOA2 and your K-1 visa quickly.

I wanted to let you know about one strategy a couple I know used. Their fiance visa took way longer than the average timeline, and didn't come in time for their wedding date. He came, they had the wedding, but they didn't sign the mariage certificate. He then had to leave and go back to his home country. When the visa came through and he was able to come back, they went back to the person that had married them and signed. So their LEGAL mariage date is not that of their wedding. But emotionally, spritually, etc, they got married on their wedding date and that's what they celebrate as their anniversary.

Buffertortoise - I don't know for sure, but it definitely sounds like enough!!

My husband doesn't really have anything like that to bring (he's leaving his job at the end of this month, moving out of his apt soon too...) But we've pretty much decided to go for it, because it *seems* like they'll probably let him in. He can't work (legally) until he has his visa, and he's in a profession where you can't work under the table. My *impression* is that folks from countries on the VWP who get turned away often have something in their "history" that raises red flags -- like a previous overstay.

I may be writing in with a horror story in a couple of months, but hopefully not. You have WAY more documentation than he'll be able to provide -- I'm *guessing* you'll be fine.

Tell as much of the truth as is relevant. Answer questions honestly. Neither obfuscate information nor volunteer unrequested details. That's what a lawyer would tell someone on the stand. Do not lie. But it isn't your job to give a reason to be refused entry.


I'm in much the same situation as blspicer and msu17 (except we're already married.) We think he'll probably get in, but he's got to be prepared mentally for possibly getting turned back. (And financially prepared - it's unclear to me how easy the airline would make it for someone to just hop on the next plane back.)

Here on VJ, the consensus *seems* to be: don't lie, but don't offer any "extra" info; bring stuff to show some intent to return. We're thinking of buying me a plane ticket to fly back to France with him on the date he's scheduled to return. However, we're not sure I can really go at that time, so we'll probably get a refundable/exchangeable ticket. Those cost an arm and a leg, so our idea would be to "return" it -- still checking on if there are catches with getting refunded for a plane ticket -- does anyone know about this? Also, any opinions on whether such a ticket would just look like a ruse to official at the airport?

Some folks also suggested having your SO fly out of Ireland, as he can actually clear immigration in the airport there, before leaving. That way, if he's rejected, at least he's on the right side of the Pond. (We've actually decided not to go that route, but there are some threads about that here on VJ.)

Does anyone know how friendly/easy Chicago is as a POE?

Back in November my fiancee applied for a tourist visa to come visit the US and was rejected because they said that she couldn't provide sufficient evidence of her binding ties to the country. When we are submitting our information for the visa for the validity of the relationship, we are trying to decide if we should include this or not? On the once hand, we want to because it shows that she was trying to come visit me. On the other hand, we are worried that it may be looked upon poorly because she was rejected.

Thoughts on whether we should include this in evidence or not?

Ours was there for about three weeks. I was told "Administrative Processing" and "Additional Processing". I've seen timelines that take up to two months at NVC.

I got a little nervous but there is nothing you can really do. I called several times and got the same response, I even called a visa specialist at DOS and she told me that it was within normal processing and I had nothing to worry about.

Just keep hanging in there. Good luck.

I got approved by the USCIS CSC on May 20th, it has been sent to the NVC. I hadn't heard anything from the NVC so I called them to see what was happening and they said it had been received and was in "Additional Processing". The woman I talked to on the line refused to give any more details about it or tell me what kind of timeline that meant. Is this standard? How long might I expect this Additional Processing to last. I have all of the additional post-NOA2 information already and am hoping that this process can really get moving now that we got past the I-129F.

Anybody else have this experience?

Everything on this site seems to say DS-156 is what you need, and even one of the letters sent by one of our fellow VJers, but another pointed me to a site on the US embassy page that seems to suggest the DS-230 is needed.



Also, is the K-1 considered Immigrant or Non-Immigrant. It seems like it's saying both on the state.gov site. The title of the page is immigrant visa for a spouse or fiance. But then down below it says Nonimmgrant visa for fiance.

Just so everyone knows before we begin, there is a new DS-156 Form as of June 2011. I can't seem to find any accompanying instructions for it. Here is the link to the actual location of the new form.



I have a couple of clarifying questions:

Question 14: National Identification Number. Is that the beneficiaries ID number from their respective country?
Question 26/27:How long do you intend to stay?
Purpose of the trip? Does indefintely and to enter the USA to marry and fulfill K-1 visa sound ok?
Question 32/33:Do you intend to work in the US? Do you intend to study in the US? If the answer is eventually once we have gone through the change of status should we put that here? I currently have indicated Yes; After marriage and with change of residence status.
Question 36:Has anyone ever filed an immgrant visa petition on your behalf? Should I put yes since I am currently doing this or is this asking for prior to this?

Dr. Situ no longer works with the Peruvian embassy. It is currently almost a 4 week waiting period to get your medical exam.

Please anyone applying in Peru be aware of this.

This is misinformation... translated documents DO NOT need to be notarized.... translated documents need to include a "certifying statement" from the translator that he or she is competent in both languages.... if that is you, then you can do it yourself


I've seen the certifying statements and I feel comfortable signing that myself. I guess I just want to be as safe as possible.

Anyone else have an opinion on this?

My friend Phoebe told me about this site and I'm excited. I need all the help I can get. Lots of crying and being stressed out lately! I'm filing it myself but it seems that everyone's been telling me to get a lawyer, which I can't afford.

Does anyone know:

1) Where should documents be translated? Does it need to be special places?

2) How should I present my "evidence" of having proof of meeting within 2 years (emails, photos...) And how much stuff should I be printing off, old letters and such?

3) Does the I-129 need to be typed or could we just use black pen?

4) Can we visit Nicaragua after we are married, or is there a waiting time that he can't go back into the country?

My fiance's address (Central American) is in Spanish, it's ok to keep that in Spanish, right? He is using his boss' address to get stuff- because he travels a lot- is this ok?

2) The fasteners to use to file- the metal ring binders? or the gold/silver fasteners?

3) I've talked to some people and they advised that I contact my local senator... I don't understand what they would do to help? Does anyone recommend this?

So, after telling my love how long it would probably take (we are still waiting on papers from Nicaragua to get here to send it in)... we are sad and frustrated. He could possibly get a work visa from a fishing company in the states and be here sooner. We made up our minds a while ago that we would just file the fiance visa and wait. But I've been back in the states for a year and 3 months and we don't want to wait another 8 months before we can see each other. (He got denied a tourist visa) I went back to visit once and was thinking about it again this summer. It's so hard (I know you all understand) and we are impatient! We keep trying to be patient but it sucks.

So, my question is: after we file the I-129F, would it cause problems if he was working in the states (on the ocean) for a few months? He knows some people in the states that have a fishing company and they would hire him. But if this is going to mess up the process, we won't even consider it. Am I making any sense? AHHH, why is everything so hard?

I'm sending our application tomorrow (HOPEFULLY) to Nebraska (then they'll forward it to CA). Do you recommend to send it FedEX or USPS express mail? If I use Fed Ex I use the private courier zipcode (which is diffferent from the other), right? Stupid question, but I'm just making sure! I'm sooo nervous and excited to finally get to this step!

Then I request a return receipt and that is what I'll use for tracking?
Can I copy the G-325a form for me and then sign each page with my original signature? (I used the carbon copy but it didn't go through well.)

I'm buying a place ticket tonight to visit my love in a few months! woohoo.

After reviewing our I-129 forms, I realized I screwed up on my fiance's address in Nicaragua. I looked over everything a bunch of times, but I had someone review it and they wrote over my G-325 and at last minute had to do another before I sent it. I was so excited just to send it finally. On the first page his address is wrong, but they ask for it again on the 2nd page and that is right. STUPID MISTAKE, I know.

Do I send a letter with corrections, try calling, or just wait and hope I don't get an RFE on it? AHHHH, I don't know what to do. It's been a little over a month since we got our NOA1. Any advice is greatly appreciated!

We were really hoping to have him here by Christmas and thought it was possible, since some dates from Nicaragua were within 2 weeks of the interview. K-1 Fiance(e) Visa Process & ProceduresIs this true!? I hope not....

Someone just told me that once (if) I get my K1 visa, and am married in the US, I have to return to the UK for 9-18 months to change my circumstances and finally allowed to move to the US permanently?

Can someone please tell me the truth and what does happen after we are married.

Oh good LORD, no! Put that right out of your head this instant. The others who've responded are right. Once you've gotten married here in the States, you'll file for Adustment of Status to Permanent Resident (AOS). Granted, AOS is a giant pain in the rear, from what everyone tells me, but you DEFINITELY don't have to go back to the UK while you're going through it. That would just be the living end!!! Breathe easy. Once you're here, you're very likely here to stay. :D

Could you do us one favor. I know other people have asked, but I'd like throw in my agreement. We'd all really appreciate it if you'd fill in your timeline. You can do that be clicking on the "My Assistant" link just below the blue VJ navigation bar and to the right. Once you click on that link, you'll find the option to "Add/Edit Timeline." We need your information for the stats VJ compiles...and they can't collect your info if you don't fill in your timeline. :blink: Thanks for your help!!

Congratulations on a fast approval at Vermont. I'm happy for you. I wish I could say it didn't depress me at the same time...With all the delays at CSC, I just have this dread fear I'll be there forever.

K-1 Fiance(e) Visa Process & ProceduresSo, I did it..I mailed my I-129F....

Hi guys! Well, I finally got everything ready, double-checked, and mailed off(I-129 original submission). So, I went to UPS and i asked him if he could overnight my application and get me a return-receipt thing...Well, he said we dont mail to PO Boxes...he said that I would have to go through the Post Office but that he could do it from the UPS store...So, I asked him if he had express + return receipt...he said yes but the Post Office is not guaranteeing any express items...SOO...that means I paid $31 for my package to arrive there on Friday (today is Tuesday)...how did you guys mail yours to arrive the next day???? cuz it didn't work for me.
Sidenote: thanks to everyone who has posted questions/answers on VisaJourney...you don't know it but you have been a huge support system for me. I read and take your advice. Even if you are giving it to someone else...it has helped me. thanks! i am officially starting my visajourney!! pray for us!!! alicia and fran
