Thank you, Bobby!

No problem -

OH - did you explain your timeline signature?

Your getting married in July 2009, but you just sent in your 129F?

It's just a ceremony, nothing legal. smile.gif

I cherry picked mine from day 1 to present - edited out any "personal" info - and made copies to send them.

wow, how many pages did you send, total?

picking random is fine, just use a black marker to block anything too personal...

Oh, good. That's good to know.
I didn't need to use a marker. It was a very "loving" e-mail indeed, they will want to throw up when they read it haha but there was nothing TOO personal. But thank you!

K-1 Fiance(e) Visa Process & Proceduresproof of ongoing relationship
I've read on previous topics that exchanged e-mails are good for proof of ongoing relationship. I'm wondering how I should pick them? Can I just pick random e-mails from the both of us or whatever e-mails I include should have a "time line"? For example: if I add one e-mail from him, the e-mail from me should be an answer to that e-mail of his? I'm confused. I'm sorry if I don't sound very clear.

I picked random e-mails. I added 3 from him, one from 2007, one from 2008 and one from 2009. From me I picked 4, from 2006 to 2009. Should that be ok? Please tell me how you guys did it. I'm afraid I will get an RFE if that doesn't sound very consistent to them.

K-1 Fiance(e) Visa Process & Proceduresjust waiting.... and waiting :-)
They are apparently working on mid-February applications now so it is possible and likely that you will be approved in less than 6 months, although we can never predict that (as mentioned before). I know, and probably everyone here agrees that the waiting can be a b!tch. Good luck on your journey!

We wrote quite a lot but only because our actual first meeting needed a lot of writing. If that wasn't the case, we would have kept the story short and straight. Good luck on your journey!

K-1 Fiance(e) Visa Process & ProceduresSilly question..does having a common name slow...
A friend of mine applied for a visa to go to Dubai with her grandma, and they have the same name, same last name, live on the same address, work on the same place etc. The embassy ended up sending them back only one visa because they thought my friend sent 2 visa requests for herself. The mistake was corrected with a phone call, the embassy people took a better look on their pictures on the applications and checked the birth dates and they mailed her another visa on the same day. I think her case wasn't common, since they are two people from the same household with the same name who mailed the applications together. Two random people with the same name, from different places... I think that will not confuse them. You should be good. Good luck!

If you downloaded from the USCIS website and it says 05/31/09 or any other date, that's the latest version. If you wanna be sure, check again on the website the day you will mail your petition to your service center. Good luck!

It does fluctuates a lot, sometimes VSC is faster than CSC, and vice-versa. Sometimes you will see people who mailed the petition months after some other people being approved first. Good luck on your journey!

Soon you will receive a letter from NVC, and your case should be forwarded to your fiance's embassy/consulate. The embassy will let the fiance know they received their case.

K-1 Fiance(e) Visa Process & ProceduresInterview
I was able to change my interview date. I was travelling and when I got home I saw the embassy letter, with an interview date scheduled to 2 weeks later. I wrote them an e-mail, said my name, case number, and the reason why I needed it changed. In my case, I still needed to make arrengements to travel to have the medical done (we have no certified doctor in my town), still had to get my fiance's tax returns and I-134 in the mail etc. I also asked if it could be around an specific week. They wrote me back on the same day saying it was fine, and that I would receive another letter from them in the mail soon with a new appointment date. And it was rescheduled for when I asked them.

I wouldn't recommend changing the dates for something small. In my case, it would be impossible to gather everything. My interview was previously set to be on July 28th and my fiances stuff only arrived in the mail on August 6th! But if your fiance really can't take a day off to take vaccines etc., then I don't think it would be a problem to have your appointment rescheduled. Good luck!

K-1 Fiance(e) Visa Process & ProceduresCan we get married in Ireland??
We had a ceremony here in Brazil last month and I'm having my K1 Fiance Visa interview in the end of this month. We are only LEGALLY marrying (signing papers) once I arrive in America. As long as your wedding outside the US is just a non-legal ceremony, you can still apply for a Fiance Visa (that's what the Consulate told me). Here in Brazil priests and ministers can't legally marry you, so it's fine to have a ceremony before going to the US. Good luck!

If they said they approved your visa but they are still waiting on the right Police Certificate, then they are most likely going to mail you the visa once you submit the Certificate. If you weren't approved yet, then I guess you will have to go through another interview. This happened to a friend of mine, hers was mailed without another interview. Good luck!

They don't mail visas at the Bangkok embassy. If you already went thought the interview and if this was their only problem, you will need to return to the embassy to submit the cert. They should have given you a slip of paper instructing you what days and times you can return to submit the evidence. After you do that, if all is well, they well give you another slip instructing you when to come back and pick up your visa.

Ok. Didn't know how it was in Thailand. Thanks for clarifying.

You REALLY need to just tell the truth. No scripted answers and no alibis. Always assume they know more than they think you do, because they probably do.

Good luck.

You are right. I decided that I will write a different answer on the new forms, that I was an au pair for 1 year, which is the truth. If they happen to ask why it is different on the G-325A, I will say I made a mistake (which I did). I will tell them I applied for a change of status, which was denied, and that I came back to Brazil even before I got the denial letter. And if they ask if I worked for my host family family during that time, I will say that I did. If I get banned and need a waiver, I suppose I will just have to do what I need to do. Thank you all for your answers.

hello,

Just recently I had the same problem as you.....I worked for couple of months while waiting for my visa extension. I was employed with my SSN. At my K1 visa interview this problem popded up of course, and I even did not try ti hide it, so for that I got a 3-year ban for working without authorisation. .... luckily we filled a waiver and we got approved just couple of days ago!!!

I hope this will not happen to you guys!! but you have to be prepared for anything while at the interview.

Good luck!!

Wow can't believe it took you so long to get your visa. Congrats on your approval!

I'm freaking out! I didn't WORK WORK. I just babysat for my family a few times. No need for SSN. Also, as soon as my au pair year was over, my host family went to India for almost 2 months and I stayed in the states alone, travelling. I could use that as an alibi. I just wish I knew what's the protocol to change my mistake on the G-325A, where I mentioned I was an au pair for 18 months, instead of 12 months. Do they reschedule you if the info doesn't match? Even if you point it out?

K-1 Fiance(e) Visa Process & ProceduresVisa Extension
You guys are right. I am just going to go there, and if they see the info is different on the forms, I will just say it was a mistake. I know they will check the au pair thing because someone I know went to her interview last week, and she was an au pair for 18 months, and they asked for her extension DS form. My fiance gave me an idea: he said that if they ask me why I put I was an au pair for 18 months on the first form, I will say that since my change of status petition was denied, and my last status was au pair, I thought that was what I was supposed to put there (which is true), and then I realized it wasn't. Will that be ok?
Mrs. DisneyFemaleBrazil2009-08-16 16:04:00
K-1 Fiance(e) Visa Process & ProceduresVisa Extension
That's the thing. On the G-325A I mentioned I was an Au Pair for 18 months. It's not that I didn't check the forms a thousand times before mailing them, it's that I thought that since I was there for 18 months, I might as well put that I was an au pair for 18 months too. I didn't know that they would request the extension DS for au pairs in the interview. So stupid! Should I e-mail them to inform the mistake? Or should I just tell them in the interview it was a mistake if they ask? I've heard about them telling people to go home from the Consulate and reschedule an interview just because they now have a different address from the one they put on the G-325A. What could happen if they see the different answers on the forms? Will I have to reschedule too? My interview is 2 weeks from now and I really don't want to mess it up, and I never meant to lie.

K-1 Fiance(e) Visa Process & ProceduresVisa Extension
Well the only way they will know that I worked there is if they call my host family. I also highly doubt they will make that call. I just sense that they will not think I just stayed there as a tourist, in the same house I worked as an au pair for the previous year, and they will call them to be sure. And, of course, I would never ask my host family to lie about that. Guess I will just hope to be right about them not calling anyone in America.

Thank you!

K-1 Fiance(e) Visa Process & ProceduresVisa Extension
I'm not sure if this is the right forum for my topic, sorry if it's not.

Here's my situation:

Back in 2006 I moved to the US to be an au pair. I arrived in October 2006 and my au pair year ended in October 2007. I decided to stay more but I didn't meet the requirements to extend my J1 visa so I decided to apply for a tourist visa (change of status), my host family was my sponsor. I stayed for 6 more months. I came back to Brazil in April 2008. One month after I was back my American host family received a letter from USCIS saying my visa extension/change of status was denied. No big deal, I was out of States already.

According to Infopass, since I had a pending petition for a change of status, I wasn't illegal in the States. So while waiting for the change of status approval I travelled, as well as worked for my host family as a nanny. I know I wasn't supposed to work. Anyways, my K1 interview is coming up. I didn't lie on the forms. I stated I lived in the States for 18 months, and as for jobs, that I was an au pair for a year.

I know that if you you were an au pair for more than a year, you need to show them your extension DS in the interview. That's not my case. I'm taking my NOA1 (the receipt for the change of status petition) with me for the interview, do you think they will ask for it?

Our I-129F petition was approved by the USCIS without RFE'S, and I assume they scanned me on their computers, and that they probably have some sort of file stating who had been denied a petition or not. In normal circumstances I wouldn't worry about it but since I did work while waiting for a change of status to get a tourist visa, and I know that wasn't legal, I'm really worried. If they find out I worked (by calling my host family), will that jeopardize my K1 visa? What do you think I should do?

K-1 Fiance(e) Visa Process & ProceduresQuestions about how to file K1 visa
QUOTE (honey bear @ Aug 16 2009, 11:11 PM) <{POST_SNAPBACK}>
Some general questions about how to file the K1 visa since I have seen some sites say you need these things and others not.

1. How to send the packet? Do I need to submit it in a folder as indicated on this website? As well as put holes in the paper? Should I treat this as a report for school, put cover pages in each section and put tabs on the sides as well as a table of contents? On the instructions of each form they will tell you how and where to file your petition to. You don't have to submit it in a folder, they suggest it because it's more organized, same for the holes. We added cover letter and table of contents but again that's optional, it's always good to make their job easy so they will be happy with you smile.gif

2. Do I need a color photo copy of my passport and include each page of the passport? The copies in our petition were colored but I don't think that's a requirement. Yes, all pages.

3. How many copies should I send of form G235A? I have seen some say 4, some say 2, some say 1. The new G-325A form only has one page. If the one you downloaded has 4 pages, then send the 4 pages (all signed). If if you happen to print the new version, then I suppose there'll only be 1 page for you to send.

4. I have to submit to Vermont, I heard they are slow but I can have it switched over to California so it would be processed quicker once it arrives in Vermont, do you recommend this and how do you have it switched over? My fiance has already sent me her letter that goes with the forms and it has the Vermont address on there. On the instructions they say which States can send their petitions to either California or Vermont. If your jurisdiction is Vermont, then i'm afraid that's where you are supposed to mail your petition to. For example: when we filed our I-129F Petition, California was way faster than Vermont. But my fiance lives in Georgia, so we had no choice but to mail our petition to Vermont.

Good luck and guides6ly.gif
