If you are married to an American, you only have to be living in America for 1 and 1/2 years. If you are not married to an American you have to living in America for 3 years.

The real problem is missing your biometrics appointment. The letters are delivered quickly.

We got out NOA and biometrics letter within 2 weeks of sending out our N-400. Plus, depending on how good your local office is, you may have your interview date within a few months.

Maybe have someone keep an eye on your mail?

Congrats. I felt alot better when we got the first NOA in the mail, then even better when we got the biometrics appointment letter. if there were any problems with our form I think we would have gotten a notice or request for more proof.

But, a cashed check means you are one step closer!

Ok, my wife had her biometrics this morning. The USCIS lady said it may take 1 to 2 years to process the N-400, and that the local office has no ability to change appointment dates.

The USCIS local office processing time news release dated April 22, 2008 says Helena, Montana has a 5 month average time.

Anyone have any input on this?

So here's my story:

May 2008 - Interview : Denied, eligible for I-601 Waiver
June 2008 - Waiver submitted (We did it by ourselves)
Aug 2008 - Waiver disapproved, we didn't meet the deadline to reappeal
Last quarter of 2008 my husband was basically looking and inquiring for a good lawyer, he found one then started to gather strong evidences.
Aug 2009 - Submitted a new I-601
Nov 2009 - Waiver approved (GOD is so GREAT)
Dec 2009 - Medical, found a scar on my lungs need to have sputum test-smear test negative (another setback)
Feb 15,2010 - Culture test negative (Thank you LORD)
Feb 16, 2010 - Immunization and Medical Result
Feb. 17,2010 - Submitted new DS230 and other requirements to the US Embassy.
Feb 20,2010 - Visa received (PRAISE GOD).
March 8, 2010 - Departure, SFO-Port of Entry

just pretty excited , manila takes 3-7 delivery days only though air 21 would not assure you of that but i know lot of friends here in manila they just got their visa 3 days .i believe those from province would take 7-15 days,i finished my cfo seminar and so i only need cfo stamp when i receive my passport with visa. i'l just keep in touch for any info...

Hello everyone. I am new around here. My name is vicki and I am in the middle of the procedure to obtain my K1 visa so I can fly to US and marry my sweetheart who lives in MT and is USC.

So question ---Our I-129F was approved and I recieved the paperwork from the US embasy in Greece just a few days ago.
I am so confused though.
Should I only send back the forms DS-230 Part 1, DS-156 and DS-156K and wait till I have all the paperwork needed
so I can sign the checklist and send that too to the embassy ???
Do I have to complete the form DS-157 or leave it blank?
It's all a huge mountain infront of me
and not being american makes it difficult to understand
cause english is not my native language. unsure.gif

BPI Express Remittance Corp will accept deposits in the US for BPI accounts in the Philippines. As I recall, $8 per transaction. They make transfers the night they receive, if it is a money order or cashiers check. They wait for personal checks to clear. Probably more convenient if you live in a city that has an office or you have an account at a "partner" bank.

Wells Fargo issues ATM cards, one for the US account holder, one for the recipient. Five dollars per deposit or transfer. The account is accessible online, and if you have another Wells Fargo checking or savings account, it's easy to make online transfers. If you make a transfer from an account where the funds are available, then the funds should be immediately available in Philippines as well. But it's ATM only.

I've heard CitiBank has easy transfers between accounts in their US and Philippines banks. There are no CitiBanks nearby, so I never pursued it.

Just a few more ideas. It really depends on how you want it to work on the other end, or what is most convenient or safe to use. I'm always looking for a better way as well .

The US Consular Office in Cebu can also issue the affidavit, but be sure the office is open and the CO is there. The day I wanted to get mine, the CO was not going to be there, so I went to Manila. They suggested calling a day or two ahead (Cebu), because there are days the CO is requested to be in Manila. The affidavit is required, if you're trying to do this "by the book".

If you are really taking the seminar, which we did, we were told the license would be issued 10 days from the seminar, not 10 days from the application. The office where we applied for the license gave us the information about the seminar, when and where it could be taken. It's not easy getting it done in 3 weeks, but it is possible.

I'm not convinced this is either a mistake or unfortunate. It's something I've been contemplating... I just don't have the approvals yet, so I haven't had to make the decision (gamble) :)

If it's taking 4 to 5 months to get a "K" visa interview at the Manila embassy, isn't it possible the IR1/CR1 could catch up, especially if some of the shortcuts are used to help speed up the documents at the NVC? What happens if the embassy receives the CR1 before the K3 interview takes place, and the K3 interview has already been scheduled? Is the CR1 interview given at the K3's scheduled time? If the K3 has not been scheduled, does the CR1 just "overtake" the K3? Except for the extra $200, has the I-824 changed any of the assumptions of the past that it was often a good thing to have both visa applications proceed to the embassy?

It's a little unclear to me in looking at the timelines for people who have both the I129f and I130 approved, which visa they were interviewed for, and which one did they receive. I know it's difficult to include EVERYTHING on the tables.

It is similar to what you are asking, but there was no consensus amoung members what the correct or legal course of action would be. The bottome line is, you might be able to get a visitors visa, and you might be able to file for AOS once here, but there are risks with potentially serious consequences.

Try this link. Looks to me like the general rule for the spouse of a US citizen, is a physical presence in the US of at least 18 months during the 3 year period, and no absenses of 6 months or more. Read through it yourself to see how the requirements apply to your situation. There are many variations and exceptions ... makes it difficult to state anything with certainty. :) If you haven't already, you might also try the citizenship forum.

So she could go to USA and then return to her country for a 6 month visit and that would not interrupt the process? Are you positive about this? This is very important to us. How long after she has Permanent Resident Status is it before she becomes Citizen? I have heard three years...is this correct?

After she naturalizes, she then can get an American passport and travel to the same places that an American is able to visit. Keep in mind that before she naturalizes she may still be subject to the same restrictions bu other countries and may need to get a visa to visit the other countries.

After she adjust status and gets green card, she will need to follow the instruction of the country she wants to travel to. If for example China requires a visa for people from her country than she will require a visa untill she becomes a citizen after which she will follow the rules with respect to US. Some carribean countries have some lax for US green cards holder

So I've accepted that my K-3 will be at Missouri for a lil while until they decide to send it to Vermont. What I want to know is....the message that I'm getting is that Missouri is a service center, but then when I lookup the timeframes on the uscis site missouri doesn't come up at all as a service center. Only Vermont, Cali, Texas and Nebrasca.

The requirements are specific to the embassy/consular office you go through. You can try the embassy website to see their requirements. We went through Manila, where the 156k is used for K-1, but not for k-3. I wouldn't worry too much about form expiration dates, they are generally good about posting new versions as they are available. The electronic 156 does have to be filled online. When it is completed, a pdf is generated with a barcode. you can print it, and/or save the pdf file if you want to email or print later.

You might be better off contacting the NVC. Your case is complete, but have they sent the file to Manila yet? I could be wrong ablout this, but while K visas are scheduled by the embassy, I thought NVC played a role in scheduling CR1 interviews. Just a thought...

As to who should fill out the I-134 (for a K visa), I've read of others having two, as in, your spouse/fiancee would submit your father's form at the interview, but also have yours ready in case it is requested. But I don't really know what they will accept in Manila. You might try searching the archives, or asking this question in the context of the Manila Embassy, or even in the "Manila Interview" thread. Maybe you can find others who have successfully gone through the same thing there.

From what I have heard about St Luke's, if they see something suspicious on the xray, they will take a second. If they are still suspicious of tuberculosis, they will ask you to come back for sputum tests (before the interview).

in the manila embassy thread in the foreign embassy forum there was recently a k-3 applicant who arrived at the embassy for her k-3 visa interview appt and she had a cr-1 interview scheduled already. she was allowed to go thru the whole k-3 interview process and at the end was told to just return on the date of her scheduled cr-1 interview date. they did not grant the k-3, but i think they told her everything was ok, but since her cr-1 was less than 1 month later to just return then and get the cr-1 visa. good luck!



If this is the same person I'm thinking of, I believe the CO told her she could not interview for the CR1 because they had not yet received the physical file.

This is specific to Philippines. The visa fee has to be paid at a bank. From what I've heard, some banks will stamp the back of a filled ds-157, other banks will only give you a blank ds-157 stamped on the back. It is essentially a receipt of payment. I think the packet 4 instructions say the bank will validate the ds-156, I think it's the 157 they actually validate. You could take both, just in case.

I confirmed with my fiance that he had a typographical error with these. Will this be a big problem? I am so worried. How can I correct this? I would guess, this can be corrected at the embassy on interview day. Or you could call or email the embassy and ask. My experience with emailing them got me a response, but it took a couple weeks. Good luck!
