A couple of key things I noticed missing from the other responses. She needs to have a CENOMAR to get married in Phil. That takes some time and she can order that now through NSO. Where your there besides getting a signed, original G325 (all pages) from your then wife, get some US visa photos.

We did all of our paper work to apply for the license including the mandatory stop at the USEM to get my legal capacity to marry on Aug 29th. We got Marries on Sep 29th. As you can see it can take sometime to get everything processed. Once we filed as you can see in my signature my wife, Trisha, arrived in the US about 6 months later.

The guides above in Visa Journey will be a great help and so will the forum.

Final note as mentioned in one post you may need consent. Actually if your GF is under 21 you will need to get signed consent from the parents. the form is at the civil registar. If she is 21 - 25 she will need to still get signed advice from the parents. The form is also at the registar.

The first reply is incorrect as of Oct 2008. The USEM does NOT require document verifcation anymore. Just provide originals of the NBI, and NSO CENOMAR (K1), Marriage Certificate (K3) and CENMAR (K3). Although the CENMAR is not listed as a required document some K3 applicates are asked for it. We had it and were asked for it. There is also confusion on what the CENMAR is. It is like the CENOMAR but shows the marriage(s) you have with the index number. YOu can request it from NSO by simply being married and asking for a CENOMAR but since you married you get the CENMAR.

Some bad info was given. K3 is more expensive in the long run that is correct. The fee for AOS and EAD is $1010 which include the bio-metrics. You do not need to do this until either yoru SO wants/needs a job or your coming up to the end of the K3 visa. The K3 visa is multi-entry just like the IR/CR1.

Now the benefit of the IR/CR1 is that it is cheaper since when comparing its cost to the $1010 for the AOS and EAD for the K3. The IR/CR1 holder can also get a job much sooner.

The choice is yours.

Yes, a copy of the NOA1 for the I-130 that you received, is what you need to file the I-129f.

So for the I-130 that means the approval was sent to NVC for your IR1 processing. Your I-129F would be for the K3 visa. Usually you can call the NVC now and get your MNL case number.

Since you do not have approval for the I129F - at least yet. You would want to purse the IR/CR1 route which is covered in the Guides. Get your USCIS case number form the NOA1 of the I129f if it was resubmitted in 2008 and see what the status is.

Having a timeline entered into VJ will really help. It is the My Timeline link on your profile. In your case although you submitted 2 years ago you submitted in 2008 so the duration we are talking about is only since the resubmission. The timeline will also help in determining if a I-129f was submitted.

Please complete a timeline so we can est help you. Since you applied for a K3/K4 visa. I am assuming your approval is the approval by USCIS which would be the NOA2. If that is the case and the approval is for both the I130 and I129F then you need to determine if you will persue the K3 route of the IR1 route. Each comes with pros and cons which are discussed in the guides on VJ.

If your intent is to file for the K3 visa then you need to file the I-129F with the NOA1 from the I-130.
If you want to pursue a IR/CR1 instead of a K3 then you do not need to file the I-129F.

If it was up to me I would file the I-129F and then chose between the IR/CR1 and the K3 later.

Your father is also correct. the green card will be only good for 2 years if your married less than 2 year prior to getting the green card. So assuming you apply for the K3 or CR1 the next day and everything is goes smoothly, 6 months later they are in the US. With the CR1 the spouse has the GC and it is valid for 2 years and you will need to request for removal of conditions (more $). With the K3 at 6 months the spouse comes over, you do an AOS then a few months later the GC is awarded and its good for 2 years. Your back to removal of conditions as with the CR1.

Now if your married 2 years you slide past the 2 year GC and go straight to 10 years.

same thing I ordered Trisha and mine though ecensus and we had it 6 weeks after the wedding. We had to wait the first three weeks for the Marriage Cert to be sent to NSO from the Civil Registar. Once they sent it then I asked for the cert from NSO. They in turn had to manually process it since it was a new marriage cert. That added 2 weeks. Then a week to get it delivered to Trisha.

Another thought is to check the NBI. Have obtain it with the name on the BC and then do an Also Known As. Then you should be covered from that angle also.

First experience from March 2nd interview at the embassy. We were asked for the NSO Certificate of Marriage and Marriage Index. We were prepared since we had both. The Marriage Index is essentially the letter from NSO listing all marriages on the Philippines Citizen. In our case the only listed marriage was to me.

These documents were asked by the pre-screener. Not everyone was was asked. Since I did ask if others were asked about the documents.

In the end we got the pink slip and paid Air21 the delivery fee.

I waited in the waiting area at the USEM. I was allowed to go to each window with Trisha during the interview except for the formal interview with the CO. It was the same with all other spouses at the embassy that day.

We had 100 plus pages of chat logs and in the pre-screen they just asked for about half. Yes just a random half.

As far as evidence you will need it. Photos, anything get creative. Even if you get a replacement passport the old passport is returned and has the old stamps in it.
