PhilippinesI-130 petition: Do we need NSO marriage certificate?

We are getting married in Manila soon. And, we hope to file for the petition as soon as possible.

Annoyingly, NSO takes months to process marriage certificates. Can we send a local civil registrar-certified marriage certificate with the petition?


Getting back to the orignal question. You can send in the local registrar-certified certficite. Send it in as a photo copy. This way you can start the I-130 right away. We did that. We also asked to have things expidited as others suggest. You will to do that to ensure that you have the NSO version for the USEM Intervew.

Within the Philippines there are naming conventions that must be followed. So the middle name will be your maiden name since that is how NSO will register it. You do not get the choice. The exception is when the baby is born in the US then there are no naming conventions.

Hi, we just flew last week and the terminal fee is 550 and the travel tax is 1620 pesos. Yes they will both pay both fees



Correct it is 550 per person, age does not matter. We have had to pay that a few times with our son who at the time was under 1 year of age.
Now for the travel tax she needs to pay it. To avoid having to pay it for your son have him leave on his US passport. THen he does not.

When Trisha came over hear I had a check list for items that we needed to review such as laundry, smoke detectors, garage door openers, garbage disposals, the list is long depeindg upon the background of your asawa. But is is also fun. I would do it all over again.

as pointed out english is second langague for most.

And there will be cultural differences.

 

Best thing to do it admit to each other there will be and to discuss them. They may be items that can not be changed but at least your aware of them.

Hello. I just went back to the philippines with expired GC last december 6. My GC expired November 2011. I just present my green card and NOA1. I had no problems or whatsoever. All they asked was if I already did my biometrics I said yes because we did it before I left for the philippines. They let me back to the US. :)

I'm not sure with a expired Green Card you will be allowed back in. Please call the USCIS to reaffirm you reentry status. I know you said you have a NOA extension, but I don't think that allows for international travel.

Normally: About 1-2 weeks from receipt... there are exceptions though.

Glad to see that you're still here!!

From our experience, the check gets cashed first, then they send out notices. In our case, they sent out the biometrics appointment letter, but we haven't received an NOA1 extending the green card for 1 year. We're trying to find out what happened to that letter, because it will be important if my wife wants/needs to travel.

I recieved my biometrics letter today scheduled for 2nd of may, this is no problem but on the letter i noticed what i need to bring in terms of id, it says to bring state id card which i have and passport, my only worry is my passport is in my maiden name, is this a problem? thanks

I believe that you can ask for a stamp in your passport if you pass on the day of the interview. Best to ask the interviewing officer the day of the interview.

Share your travel needs at your interview and ask for the stamp in the passport. It is a temporary greencard usually valid for 1 year. We did this in Aug and got the stamp. It took about another 20 minutes for the local USCIS office to complete.

Yes we was both put into seperate rooms and interviewed. Not once during the interview did they ask me about Nicole's salary going back to help her parents...

I'll get the notice back from the lawyers office sometime today and post what it says. Had to take it their and give it to his secretary since the lawyer is on vacation (grrrrrrrrrrrrrrr)so she could start the paper work on it to have it ready for him when he got back. I asked the lawyers secretary if she has heard anything like this before. I don't know if she knows what she is saying or just telling me something to get me out of the office. She told me that its all based on what they have seen in cases that end up later on being fraudulant. She said that "Nicole shouldn't have been sending her entire salary (18,560.00+ each year)back home. It makes Nicole look like she has no desire to (commingling assets???) or share in the responsibilites of using some of her salary to pay on some of the bills. Sending once or twice a month would have been acceptable but sending her entire salary for the full two years would make things suspicious in the eyes of immigration or any other person who was looking at our case. You both should have waited until after Nicole obtained her us citizenship this way you wouldn't have had to deal with immigration any more." I plan to see if I can talk to someone in immigration about it again today. I tried to call uscis yesturday but after being on hold for 2 hours I just gave up waiting.

This countries immigration rules are all messed up!!!!!!



Okay so they already suspected something based upon interviewing you sperately. What evidence did you provide them in support of the joint applciation. Things like joint bank statements, utlitiy bills, etc. Getting the lawyer started on the appeal is good. Calling USCIS at this point will not help so just avoid that frustration. You need to do an appeal. Best of luck.

We have a joint bank account. According to the person I talked to about it 1 hour ago. They asked Nicole why she wasn't using her salary to help on some of expenses we had as a couple. The person on the phone was very hot tempered and had attitude that the interview followed procedure and the problem is with us. I plan to appeal the decision. I guess I shouldn't have included the bank statements.



So it does sound like the two of you did have an interview. Was the interview together in one room or were each of you interviewed alone. Do post the text of the letter you got and what evidence you did provide.

We got an email as an answer to our Service Request concerning not getting a biometrics appointment letter within 30 days. The response was:

"The process for fingerprint appointment scheduling has been requested. Applicants will be mailed appointment notices when the ASC in their area has appointments available."

So we are still waiting for the letter
