I've filed the petition for a few weeks already. When should I expect to receive my first notice that the documents have been filed? I'm not too far away from the processing center, and have received confirmation that it's been received via US mail, however, it's been a few weeks already. I've noticed in a few timelines that there are instances when the first NOA happened within the same week. Any comments of it taking longer?

It is not uncommon for it to take a couple of weeks. But I am a bit confused. You state, "and have received confirmation that it's been received via US mail". What did you get in the mail. The NOA1 is a I-767. It includes your USCIS case number which you can then track on the USCIS web site. You should be getting your NOA1 anytime now.

2) Do they cash the check first before sending the NOA?
I guess this question goes along with the first. I'm hoping for a slight relief that it's being processed.
Yes. The back of the check will also usually have the USCIS case number on it.

3) If I need more info for supporting my Affidavit of support, would this hold up the initial processing?
I am filing the petition myself, and have been trying to find the information to put the packet together. I didn't come across this site until after we filed. I read somewhere on this about it requesting more information that could take a few weeks at the bank. Now... I can't remember where I saw that information at.
No this becomes more important at the interview.

I know I'll be posting quite frequently on this site. I've got a lot more questions to ask, but hopefully this will alleviate some of the concerns I have about this petition.

As an earlier posted CFO is required. Your fiancee will not be allowed to leave the philippines without a stamp from CFO that goes into her passport. So you have 2 options. Wait until she is 18 by the BC or get the BC corrected. Not great news either way.

The issue will not be in NY but rather getting through CFO in the Philippines since she is not 18 by the BirthCertificate. It would be a long road but you might want to pursue getting the birth cert changed.

With your employer he will need to provide you a letter on company letterhead that states your expected annual salary, job title and how long you have been working there. This is used as evidence that your expected to make above the 125% poverty line. If your above that line then your good to for your I-134 form which gets submitted to embassy in Manila. Since it sounds like you have not submitted your visa application yet to USCIS you can get that letter from your employer a few months from now when you have an interview date at the embassy.


Exact dates are nice on the former weddings. If not at least month and year. Maybe attach a note that you do not recall the specific date.

With deceased ex's provide all the data you have and a comment that they are deceased. Give the date of death.

The documents that you have to show proof of relationship are all great.

Sounds like you got the NOA1 which is what you need to submit the I-129f. The approval on the I-130 is the NOA2 which you probably will not get for a few months.

It should not be a problem. My divorce last year was Aug 26th. Sep 29th I got married and filed for a K3 visa right away. We just got approved for a GC. Did questions come up? yes. First at the embassy when I was request an affidavent from them to get married in Phil. The CO said my deviorce was recent. Yes it was. But the date does not reflect when the marriage was actually split - it just reflects the legal date. At the AOS interview the same question came up and I provided the same answer.

Trisha and I are 27 years different. We had no issues. Documentation of the relationship is key. I had been to Phil 8 times to see her and was at the USEM when she was interviewed. I know a few other couples personally who have seen no issues and they have similar age differences.

You want to check with the National Visa Center first. Call them and see if your case made it to them. If so then ask them for you MNL number. The MNL # is how the USEM will track it. After getting the MNL # then ask them if your case has been forwarded to the USEM and if so when.

Once it has been forwarded then it takes about a week to get it to the USEM via courier. After that they process it ......

Actually doing a change of address request with the USCIS does not work and you can not do it since your still awaiting a visa. The reason is that the case in USCIS is for your request and you did not move.

This happened to Trisha and I. Instead when the case got transfered to the USEM I called them and told them of the new address. Of course make sure the forms for the USEM have the correct address on them once you get to that part of the journey.

Finally at the interview Trisha double checked the address with the CO.

Time to relax. Last time I checked the USCIS web site we were still pending on the I130 and I129F. But we got the hard copy NOA2s, and Trisha has been in the US since March and has had a GC since Aug. So the do not rely upon the date. Key is your in the system.

Even with the AOS and EAD we did not show up in the system until it was approved but we always had our hard copy NOAs.

Yes it can be confusing. It is because the K1 by itself is not an immigrate. That happens once you do the AOS. So in reality the intent of the K1 is to get married and then apply for AOS thus convert to immigrate. Make sense yet? So the USEM treats it like an immigrate since it is the intent.
