There are a few posts on this in VJ. Essentially you can look at IRS Pub 519 http://www.irs.gov/p...rs-pdf/p519.pdf and explains that the non-resident spouse can be considered a full-time resident spouse if the couple signs a statement that they will treat declare thier global income. For most people that is not a problem. In the case of the filipino partner if they had income they can have it then reduced by over $88k.

In Pub 519 look at page 10, right in the middle there is a section on NonResident Spouses

You will need to also attach a form W-7 to get an ITIN in place of the SSN for the 1040.

Is this normal?

Very correct. This is exactly normal. That is the way Trisha's was. There has been past threads about that and to expect that so we did. When we got the to POE there was no issues. The Immigration agent opened the package and just processed the papers and away we went to our home in the US 2 days ago.,

Actually I do this all the time. The worldperks member who has the miles CAN use miles and purchase the ticket for you. You do it online. No need to call NWA/Delta.

If the NOA2 is expected next month any telephone logs, receipts for engagement rings, tax returns, etc that will help in the proof of relationship would be great to bring over at this time. Trisha just arrive in the US. I purchased the e-ticket for her via the internet. There were no problems. Of course since your purchasing it via the internet she will need to pay the PTA Tax (ours was 1600+Php) and the departure fee. (750Php). Both are payable at the airport.

Based upon your timeline you have gotten your K1 through USCIS, NVC and the USEM and I believe your question is does she need the NOA1 and perhaps the NOA2. No she does not. She does need either the letter from the USEM or the email from the USEM to do her Medical at SLEC if she does not have a letter from NVC or the NOA2.

Of course she will need to bring all the other documents that that USEM asks for along with your I-134

When I went back to get Trisha I booked a round trip for me and a one way for her. I did that 2 days prior to me leaving. I also asked that our return flight be linked to each other since we would be traveling together. This is important since they then treat you as a group vs 2 individual travelrs. I brought my stuff over in a small suite case which went inside of a larger one that was empty and that is what we used for most of Trisha's belongings.

Exactly what we had to pay at the airport. 1620 for the Travel Tax. Trisha could not get her boarding card until she showed she paid it and there is a desk in the airport that accepts payment and a receipt. 750 terminal tax. The terminal tax was increased from 550 over a year ago. Note some tickets will already have the travel tax paid. If they are bought locally in Phil that is usually the case. Get it from the airline in the US or via the web and it usually is not paid.

No worries yet. Trisha got the pick slip on March 1st this month. We had some people that we knew get the passport on the 5th. Trisha's number from Air21 showed up on the 5th and she got it on the 6th, a Saturday. And she leaved in Metro-Manila.

I can not speak for CA but for MN I called the MN tax line and what they told me I needed to first process the US tax form and when I got the ITIN to then put that on the MN form and submit it. In the case of MN I do not need to file for an extension but am responsbile for paying any taxes on-time. Luckly in my case I get money back.

Today I also got a notice from the IRS that we should have the ITIN in about 5 weeks. They also returned the ribbon copy for Tirsha's passport.

I was in Manila for Trisha's appt. Same with a few others that day that I got to meet. In no cases were were permitted to go into the interview rooms with the CO. We were along for moral support and standing in the lines with them. When Trisha was called to see the pre-screener I was allowed to be at that window with her. I sat out the the CO's room while she waited but the handler for the COs in no cases allowed anyone petitioner to enter.

In our case Trisha did make it know that I was with her when she began the interivew.
