She has 18 more months before she can file for citizenship. But she can be outside the country as long 18 months is spend in usa

It is a "judgement call" pure and simple. They have to determine, without knowing you and interviewing you, that your fiancee will not become a public charge, based on papers you provide them. The better "it looks" the better your chances of convincing them.

As mentioned above, it is common for self employed people to deduct lots of income as business expense (perfectly legal and legitimate) but it DOES reduce your income (line 22 of the 1040) and this can be a problem. If this is the case, line up a co-sponsor.

This is all consulate specific, and Manilla is NOT one of the easier consulates to deal with. You certainly need an explanation for 2008. As for the others, I would suggest having them available to your fiancee in case they are needed and asked for. I would also include an explanation of the others, such as the low income for 2007. Also provide as much documentation as possibe of current employment and that it is "permanent". An employer letter, check stubs and a bank letter would be great. Since you are "lacking" in one area you need to make up for it in another. It is a judgement call on their part and it is better to provide more information than less. You want to remove as many "question marks" as possible. Question marks are NOT a good thing especially with a consulate like Manilla. If they have unanswered questions they will not issue the visa. It is best to be prepared and not hope they "won't notice", assume they will. I would also inform your fiancee as SHE will be the one answering the questions. If she is somewhat knowledgedable it not helps your cause for the I-134 but shows solid evidence of a sincere relationship.

Yeah, there's not much information around here about K2's. blush.gif

You have to submit an affidavit for each of them, along with supporting evidence. Most consulates require only one original copy of the I-134, and will accept photocopies for each additional applicant.


Probably correct about the I-134 also. Kiev said I needed three full and complete separate I-134s and I did that, but they handed back everything except Alla's I-134. I cannot tell anyone otherwise though, the next CO may want the full thing for everyone.


Certainly was not what I did for Kiev... I submitted one I-134 for both the K-1/2.. no photocopies or anything


As it turned out, that is what happened for us. And for several others I talked to. But the instructions said a separate one for each, of course the instructions also said the tax retyrns had to be notarized...oh well.


It also says "may" submit an I-134... not "must"



Be that as it "may", I brought two originals, silly me. We walked out with two no-questions-asked visas and some extra paper...oh well, I took it back home with me.



Question, as I see it if its fiance & child just double everything to be safe, But do you get all your documents back (e.g. employment letter, bank statements, etc.) or do they make copies first?

1.I-129F Petition completed and signed with 2 passport photos (petitioner & beneficiary) with our names printed clipped at the upper left corner of I-129F.
2.Check for $455.00 for the filling fee clipped together our passport photos.
3.Attachment to I-129F (How we met).
4.G-325 forms (petitioner & beneficiary) completed and signed with our passport photos clipped to the upper left corner
5.Copies of Birth Certificates (petitioner,beneficiary & child of the beneficiary)

I cannot help but notice how concerned you are and uncertain as to whether the feelings you are having are right or not. I will say this to you and I feel I am right about this. If your husband and his ex-wife have no children together then the truth is it is unhealthy for him to continue to have a relationship with her. He must certainly be aware of how this would make any new wife feel. What if you had an ex-husband and were constantly having conversations with him. No new husband would be comfortable with that nor would they tolerate it. Your feelings about this are not without merit, he should immediately cut off all contact with her and advise her that it is not appropriate for her to be always calling you. Yes, should you two run into her somewhere, be polite, but you are not required to have her as a shopping buddy. As for the computer, my wife can look at my computer anytime, any place, she has all my passwords and I have hers. A marriage can only thrive when there are no secrets, no matter how small and love and complete trust is the foundation. If he truly loves you he will be sympathetic to your feelings and not just be your husband but be your best friend & buddy too. My god, you're alone there with no family or close friends, does he not know that. I can only speak from my own perspective and experience, but I feel so blessed to have the wife I do, she is my life and my world. Nothing is more important to me then her. I hope this helps, again this is just my opinion, I may be wrong, but I don't think so. The only advice I can give you is to sit him down and be certain you have his 100% undivided attention and tell him in no uncertain terms just exactly how you feel and ask him to love you enough to work with you. Suggestion, Try calling Orbitz, Travelocity or Priceline they offer the lowest prices anyway and see if they will give first time immigrant discount. I checked on a one-way for November and it was approx. $650.00 and if they would give another 20% off that would be a good deal. Good Luck

This is not good what is happening. I hope you do not mind me giving you some advice but I think you need to know some things. First, Under no circumstances hit her back! do not even swear at her no matter how bad you feel the impulse. In the US they have some very strict Domestic Violence Laws. she can without much effort, secure a Domestic Violence Injunction on you, seriously! You would not be able to return to your own home, you could no way directly or indirectly contact her. I do not know whats really going on behind closed doors, but this could turn very serious for you, very quickly. I have not even mentioned you could be arrested. Maybe she has emotional problems, its hard to know for certain. But the fact is, it could turn ugly and you could lose almost everything. Its not worth it. I truly wish you and her the very best, but by all means please be careful.

Ok Zeth77 I really believe Tngirl 21809 is giving you some excellent advice. Should you try to run this through the US Embassy without getting found out may present more risk then you may think. If they discover this, they could interpret it as fraud! You could run the risk of being barred from ever getting a Visa and I know that would devastate you. So whatever you do give it very careful consideration. Tampering with legal documents can be a serious matter. What really matters here is that you and your fiance together "hand in hand" get on that plane to the USA (legally)

Another good way to safely send money is to the Philippines is go to a AAA office and get a AAA Visa Travel Card. You will need 2 of them, one for you and one for her. You can put as much as $1,500 per week on it. There is no charge except for a $3.00 charge for withdrawal. She can go to any ATM that accepts Visa. Withdrawal is in Pesos. The minute you make a deposit it is available to her. We have successfully used this for awhile now. I hope this helps.

My reason for using 1099 alone is because with a 1099 (which is really being self-employed) by the time you take all your allowable deductions it brings the adjusted gross income down to over half what is stated on the 1099. When they look at an individuals W-2 they look at the gross, but I believe on a 1099 they look at the adjusted gross income. Hopefully you know more about this then I do. I stated on my G-325 that I did not work in 2008 because I took a sabbatical plus 3 trips to the Philippines. I will also include a letter to this effect with 129-F.

Is it not the current income that the USCIS is most concerned with? That past years tax returns have little or no bearing on the decision. If my fiance shows them a letter from my current employer plus some copies of pay checks along with a letter from my bank. It is my understanding that is all that is really needed. I went to the Philippines 3 times in the past 18 months so I had no income for last year. I agree I should show up with more then what is required, but not having an income for last year makes it a little difficult. Anyone been thru this type of situation? Any and all advice is greatly appreciated.

You can get a ticket that you can change. Depending upon the airline and ticket you might have a change fee. I usually fly with one that has a $100 change fee. It is a small price to pay when I have to change. Frankly they have even waived that a few times for me.


The point that i'm trying to make here is ,, why aren't they allowing a US CITIZEN to fly to the Philippines on a one way ticket using an airline different from Philippine Airlines? I can't find anything on any website that explain such matter.


You got my curiosity going about this because I totally agree with you it makes no rational sense. So I had to do some checking on a flight for myself so I asked United Airlines if I can buy a one-way ticket to Manila? Get this, they said no! they told me I would not be allowed to board the plane here in the US because if they let me fly there, the Philippine Immigration would not let me off the plane and then United would have to fly me back to the US at their expense! As to Philippine Airlines being the only one they allow to do this, well it just makes you wonder who the majority stockholders are in that company. I hope this helps you to some degree as it still does not fully explain the reasoning behind it. Good luck with everything and we wish you and your fiancee the very best.

That data is from the end of April and it means they were sending files to NVC that were approx 6 months from NOA1 to NOA2. They are shooting for 5 months in the coming months... The data should be updated in a week or so... expect 6-8 months for your interview if there are no problems.. maybe sooner maybe later...

I just went to the USCIS website indicating processing time frame for the Vermont Processing Center. It states they are just processing applications received last Nov. 25th, that's 8 months. Now you wait for it to reach US Embassy in Manila. If this is true, which is really hard to say since we dealing with bureaucracy, there's a real wait ahead for those just filing, like us. I hope this is incorrect but here is the link. Comments welcome.
