My fiance got RFE from CSC today.

He got a form with 2 pages. I am sure about the question #1 ("did you met your fiancé(e) or spouse through the services of an International marriage broker?") our answer is "NO". but he is afraid i am wrong.

I sent an email to www.incredidate.com (the site we sent our first message) asking them if they are related to international marriage broker. This is their answer:

I agree with this.
This site hosts profiles and we can send and receive messages (as any other site they charge you to read any message - if one pay, the other one doesn't need to pay).

when he filled the I-129F he mentioned we met at first on the site: www.incredidate.com.

So, do you guys think i am right? Should he answer "NO" to this question?

I see she's in deep trouble and I don't think her deportation could be canceled, to be honest.

Plus, marriage is something very serious, it's for life and it must be real. If she gets married just to gain immigration benefits, this is considered FRAUD, therefore more trouble.If this is her lawyer's advice, stay away from him, he's trying to make her break the law even more. That is not how you fix things.

Priscila, I know if your mom says she is coming to visit you might be worse, but, on the interview they may ask her and she will fill out a form where they ask this (something like: do you know someone in the USA?). She can not lie. I hope she can get this visa (I cross my finger for our moms hehe). But it would be better to have a denied visa for telling the truth because if one day you apply for her I-130 they would ask her why she lied. She could be in trouble. So, I hope and pray to God she gets the visa. I think the best you do is: to send a letter to your mom. She takes all documents she has. And try the tourist visa. At least they will see you all are saying the truth. Maybe her work can help her because you said she has been working there for 6 years. She needs to show ties with Brazil.

If you want to be together ASAP, you might also check out DCF if you're still planning to get together and you're sure that you'll be married there (and not immigrate as a fiance then get married here). Seems like i've heard this is even faster ('cause i guess some of the paperwork is actually filed and processed there already.

I read about DCF and that is what we tried (and wanted) to do.
We send emails to Brazilian Consulate in Rio de janeiro and they replied exactly this:

"You must apply for this visa in the United States. Please follow the instructions of the form I-130 available at: www.uscis.gov" -------- (because he lives in the US).

Then I asked to a friend to call the consulate and to ask for informations. She called them and they said the rules changed in June 2005. Now they don't accept DCF at that consulate anymore.
So, what we can do is: to marry here in Brazil and my husband petititions in the USA.
Do you think it will take so long? We want to be together ASAP :luv: :luv: .
I asked for informations and some people said it will take up to 6 months. Is this right?

I know I'm nitpicking but your husband doesn't "apply" for anything. He petitions for you to apply for a visa. It's a small but very important difference between petition and apply.

But to answer your question, no your husband doesn't need to wait for the I-130 to be approved before he sends the I-129F petition. Read the K-3 guide.

Your husband petitions for you to apply for a visa. Once his petitions are approved, then you can apply for a visa at the appropriate US post. He must petitions for a K-3 in the US. He can petition for a CR-1 in your country or in the US. You must apply for a K-3 in the country where the marriage took place. You can apply for a CR-1 at any embassy or consulate.
