US Citizenship General DiscussionWhen can my spouse file

Hi,
since your husband became an LPR in August -- 2008, he is eligible to file 3 years (Aug -- 2011) minus 90 days after that, assuming you still live together. That means he could file already now - it's June now, even less than 90 days prior to the 3rd GC anniversary.
Conditional or unconditional GC won't matter - what counts is the date on the GC that says "Permanent Resident since ---".
Good luck on the last step of your journey! :star:

Wow! Did you call them or something or the interview letter just came? Do you have problems with your fingerprints (like mine for example, not readable)?
My application was going relatively fast but after biometrics it got stuck. :bonk:

simply put, it took them forever plus some to send me the interview letter. you can look at the chart for exact dates. i woudln't worry, atlanta seems to be very good at being slow.

Lovenjstar, did it take long for you to hear something or some change of status after having your fingerprints done?
I'm asking because I had mine on May 23rd (application was filed in April 2011) and my status keeps saying Initial review (it says: 04/25/2011 N400
APPLICATION FOR NATURALIZATION ). Plus I have problems with my fingerprints (they are not readable). Do you think I should worry or just wait for now?

here is my interview experience yesterday in Atlanta. I had appt at 1:30pm, got there at 1, took about 5 minutes going through security. Checked in on first floor and went up to 3rd floor waiting to be called. I was called 5 minutes after I sat down. The officer greated me and my husband and shaked my husband's hand. I think it helped a lot that he was there so the office did not ask ANY question about our marriage during the interview.

everything else was very easy and smooth. we went through all the basics on my N400 application, bday, name, ssn, address etc. then he asked me the yes/no questions on the application. signed my name like 5 times. answered the 6 questions and wrote down "Alaska is the largest state". I was out of his office in 10 minutes. Since my appt was later than the cutoff for oath (1pm), he gave me a piece of paper that told me i am scheduled to oath on 6/28.

overall, i don't even think mine was an interview. it was more like going to the field office to sign some papers and answer a few questions. best of luck everyone.

Go to the Oath Ceremony on the day they schedule it then you can throw a party or go out for dinner to celebrate with the kids. It's something they for sure would have much more fun. ;)

I'm almost sure kids would get bored with the Ceremony. lol

And it is not that I am in a big rush to get my citizenship. I am not planning to enlist or serve on a jury, or vote in the near futute. My delivery due date is approaching and I don't feel like travelling to Kansas City with an infant.

Still you could try calling them again and explain the situation.

I applied N-400 2004/10/15, and got FP appointment at same time as NOA-1 for 2004/11/15. At FP, I was asked if I wanted to take the civics/English test to which I said yes--and passed. Nothing further happened until 2005/01/30, sometime after which I got an interview appointment letter for sometime in March 2005--and was finally naturalised 2005/04/25.

Wow that was a long wait! As I said my AOS sucked because it took so long (over a year) this is why I am worried.

I am also begining to be alert. I had my interview a month ago in Kansas City, MO. And still no appointment for Oath Cer. It says that a ceremony should take place within 45 days of recommended approval. And I have not even been scheduled.

Oh sorry I just saw it was recommended to approval.Did you contact them after that?

Yes, I'm with them. Everybody but me (from my office) has interview date or already had it. And same thing on the other office (i'm from April 2011 filers thread).

Wow you waited for months! How was it after that? More delays or was it faster then?

I don't think you're delayed at all - getting the yellow letter is a good sign that your interview scheduling is imminent. I had to wait from March FPs until end of June to get an interview in July . You may want to check out the thread for the month you filed in to see other people's times.

Yes, they mentioned about the yellow letter. Some people received it before or after me. And soon after that they had their status changed and mine keeps saying this:

Last Updated Form Number
04/25/2011 N400 APPLICATION FOR NATURALIZATION

That date means when they sent me my biometrics appointment letter (which I did on May 23rd).

Maybe I'm just kinda frustrated and should stop looking at dates,

the yellow letter is a good sign! That means they are processing your application. Although it feels strange that you are "singled out" in comparison with others at the same location, but it sometimes happens... why? it is USCIS!!!

Since we don't track the yellow letter on VJ, probably many people receive it and they mention it in between posts, so there is no way to compare dates. However, given that it was the 4th of July weekend, it could be that the officer overlooking your petition was on vacation... give it a little more time... I am sure you will hear something soon.

Oh - I believe the waiting time is 4 months, so you can schedule an infopass if an office is near by and try that route.

My case is very delayed if compared to the other people here on VJ who filed in April 2011 same office as me. All them either had interview or have it scheduled but me. :(

My application is based on 3 years marriage to USC.

Here are the dates:

Application sent: 04/02/11

Check cashed: 04/07/11

NOA: 04/06/11

FPrints: 05/23/11

My online status says: Initial Review, the date is April 25 2011 biometrics appointment letter was sent.

My husband and I called Immigration some weeks ago and she said there was nothing wrong with my application and we should just wait. A few days later I got a yellow letter requesting me to bring driver's license or state id to interview (the letter was not an interview appointment letter though). This letter was dated 06/15/2011.

I'm worried. Fp was done 45 days ago and NOA 3 months ago. My fingerprints has never been readable but I always received another appointment letter (didn't happen this time).

Has anybody had this same delay here? Any suggestions what to do? :help:

Same thing here. My last update was on April 25 (when they sent me FP letter). Last month my husband and I called them and she said there was nothing wrong with my case. Few days later I got a yellow letter requesting DL or ID (from state) for interview. It was not an interview letter. This was almost a month ago. Since then, nothing else. I live in MI and sent package to Phoenix too.

US Citizenship General DiscussionUS Passport Place of Birth Issue.
I'm not sure but I think it's the same with Brazil. I would not pay under the table because this would feed even more their corruption.

I guess the best option is to get Colombian passport. I know it's a pain but at least she will avoid problems. I'm sure I would have to do the same to go visit Brazil.

Discussed this issue, again with Senator Kolhs' office, a common occurrence where their officer at the POE in Bogota is looking for money under the table before they will let a prior citizen of Colombia to enter. But against all agreements between the USA and Colombian officials.

Question is, what to do about it? Either pay under the table to enter or get a Colombian passport. Far cheaper way is to get a Colombian passport, so that is the route we have to take. So my wife can visit her mom. Another option is for my wife to bring her mom here, but she doesn't want that as only my wife is the only family deserter. Mother-in-laws' entire family is there.

I did question about the place of birth on the US passport, not about to change for long time until they can come up with a different means of identification.

Suppose could also yell, a corrupt official if that happens again, but again they are all corrupt. Just want to enter quietly and peacefully, so obtaining a Colombian passport is the easiest way.

US Citizenship General DiscussionInterview finally scheduled: fingerprints not readable

If you're 99% SURE you're going to need the certificate because of the condition of your skin, it won't hurt to short-circuit the waiting process and get your own. It's not like they're going to say 'it's not good enough, go get another one' when you hand it to them at the interview, and you could save yourself the extra waiting time.

As for the kids, if they're not your own biological children and they don't live with you, why would you need their birth certificate? They're not part of your family if you don't have custody. They want birth certificates for children you have actually given birth to yourself on US soil.

Yes, I am 100% sure it won't work again. Never does. hehehe

Yes, I think that's the best to do.

Regarding to the children, yes, it was kind of stupid my question, but sometimes it gets a little confusing.

Thank you for clarifying the point. :)

US Citizenship General DiscussionInterview finally scheduled: fingerprints not readable

They should be able to tell you before you leave the ASC whether or not the fingerprints are readable. Overseas, some of the embassies started making the applicants wash their hands before attempting to take fingerprints. Don't use any lotion for a few days before having your fingerprints taken.

The wife had that problem at the Embassy in Manila, they made her come back the next day to take them again. The last time we went to the ASC, they finally got good prints after trying for about 45 minutes. They wouldn't let her go until they came back as readable.

Yes, she said they were really bad.

In my case nothing I do works, I first had an allergy when I was 7 or 8 that "destroyed" one of my fingers. With time both my hands got really bad and I have to use lotion all the time or I get bad cuts on my skin. :(

Well, the thing is, they never work and I end up having to get Certificate of Good Conduct from the local Police.

ummm, hehe you made review this whole thing again. I would think that if something is wrong with your finger prints (not readable or so) your IO should tell you during your interview and then you could give the certificate right there. BUT if you feel that you should to bring it up and telling the IO that you bring a Certificate of Good conduct then do it. There is nothing bad doing that. I would do it. Worst case scenario she/he will ask for another most update which I don't think so will happen. Don't worried too much about it. You'll be fine.

You're welcome! regarding the Certificate i don't think it can hurt to bring it. If they ask for this then you give them it. but if they do not ask you for one so just don't mention anything about it.

Yes, it could happen that they don't mention it and then I would get a request (like it happened to my friend, they didn't approve her and at the end she got a paper with the request). So, do you think I should let them know I brought one "just in case"?

US Citizenship General DiscussionInterview finally scheduled: fingerprints not readable
My interview was finally scheduled for 03/20/2012.

I had my fingerprints taken 2 times and I'm sure it didn't work again on the second time. Usually they request a Certificate of Good Conduct from the local Police.

My first question is:

Since I already received my interview appointment letter and did not receive any letter requesting Certificate of Good Conduct, do you guys think I could go and get it and take to the interview? Or do I have to wait until they request one? Because if I could take one and they accepted it would help on the process maybe?

My second question is:

They are requesting certified copy of birth certificate of all "your" children born in the US. I don't have kids myself (have a kitty but it doesn't count :) ), so do I have to take my husband's children birth certificate or it's not necessary? Just to make it clear they live with their mom.

Thanks in advance. :luv:

US Citizenship General Discussionn400 part 7 C question

Hi everyone-

Hopefully you all can help me with a couple of questions. I'm filling out form n400 and I'm stumped now in section 7 C.

Back in 2005 we went on a cruise and I can't remember the dates, I've looked at my passport but it only has the stamp from when we came back into the US, not when we left. Any ideas as to what can I do? I've called the cruise line and their records don't go back that far.

Also, this past December, I took a trip to Reynosa, Mexico. I was gone from 12/28/2011 to 01/04/2012. The "problem" I'm running into is that one day (12/30/2011) we crossed the border (legally of course) back to the US so that my family could do some shopping. Since I came back in the US, does it count as two trips? Or is it all one trip?

Any help you can provide, would be appreciated.

For the second question they ask for trips of 24 hours or more so you just do the math. If you got there on Dec 28th and came back on Dec 30th, that's more than 24 hours, right? So, after that did you go back to Mexico? If you did go back, and it lasted more than 24 hours it counts as another trip.

The first one, if you have pictures taken on the first day of your trip you can check the date there. That might make you remember how many days your trip lasted and refresh your mind. :)

US Citizenship General DiscussionPart 7. A on N-400

Part 7, section A: How many total days did you spend outside of the United States during the past 5 years?

I arrived in the US soil September 4, 2008 on a fiancee's visa and has not left the USA since. Calculating from the day of my arrival until the day I file my N-400 (Sept. 4, 2008-April 2, 2012) would only give me 3years and 7months in the USA. Should I write the number of days comprising the 1 year and few months before I came here as days spent outside the United States in the past 5 years?

Thank you so much for all your help.

I used the date calculator website http://www.timeandda...te/dateadd.html and you calculate from the day you arrived here.

I applied based on 3 years married with my USC hubby and I did the math based on 5 years (actually for us applying based on 3 years it should be 3 years). I had interview yesterday and she just corrected it. :)

US Citizenship General Discussiondo I need to provide proof of new address?

Hey VJ member,
We bought a house 30 miles away and so it's technically a move but within same state. We already have license showing new address but do I need to provide any additional proof showing we've been at the new home for at least 3 months? My first guess is that since we're in same state and our Local office is same, I don't need to provide any proof except maybe copy of both our licenses showing we live at the same house. But other that that, do I need to get into utility bills and stuff?

I think you never know what they are going to request so, yes, I would have more proof. I had my interview yesterday and the officer was very nice and professional. I took all originals (and copies) from the copies I had already submitted and more copies and originals from the period after I sent my application (I sent my application in April last year, but I have problems with my fingerprints that can't be read, so it always take longer for me). Well, making the long story short, she didn't ask to see the originals, she said the copies would be fine. She even said I had more than enough proof. :) You can use car, home, health insurance for example, I took copies of our federal and state check (from tax return since I didn't have our tax transcripts from 2011, only had tax return form. If you have bank statements, utility bills in both names, take what you have. This is valid if you are starting your petition, sending more proof (RFE) or going for interview.

I think it's always better safe than sorry, so this is my advice and I hope it helps and I wish you good luck. :)

although i still not get my RFE, but i want to know how to answer this question too. I knew my bf on a webpage, www. asianeuro.com. He need to pay 25$ a month to contact others. How i answer? Maybe i should answer yes, right?

Well, my fiance said we should say NO because we sent an email to incredidate.com and they replied saying that site is not international marriage broker. He said we should attach that email and and another sheet explaining some things such as saying the name of the site and how we had the first contact. Although he already did this when he filled our petition, he is going to do again.

well i met my fiancee on filipinaheart.com and when i called csc and asked i was told that seems they didnt specifically hook me up with her per say then its not a marriage brokerage.
And its also a free web site that you have an option of paying to upgrade your account and it gives all the people there that puts a profile on the site to either stay for free or pay for gold membership.
So the woman i talked to said that it doesnt fall under the marriage brokerage catagory so i answered no.
from the way she explained it to me os that if i requested a 19 year old philipina with such and such qualitys and then the web site host gave me the information to contact such person with those qualitys and i pay them to hook us up then that is a marriage broker.

I agree with your explanation.

IMBRA Special TopicsGot REF from CSC - how to answer?

I am in a similar situation and have decided to answer no. I met my fiance through a site called singlec.com. It meets the exceptions that are identified in IMBRA. Its primary business is not to provide international dating rather it has a large section for USC to meet USC and a smaller section to meet non USC. It also charges the same rate for every person regardless of country the person is in. Eventhough the exceptions are not listed on the RFE they do exist and exclude those sites that meet the criteria. If your "dating site" meets those expections than I see no reason to answer yes. I have been considering attaching an explanation that my site meets those exceptions, you may want to do the same.

Shimmy, I think our friends above are right.
My friend sent an email to a famous lawyer and he answered that immigtation will probably consider those sites "sell" communication between men and women for potential marriage. he said she should answer YES.

Anyway i sent an email to CSC and i hope they answer me soon.

Thank you for all replies. You guys helped us a lot. :)

I sent an email to www.incredidate.com (the site we sent our first message) asking them if they are related to international marriage broker. This is their answer:

"Incredidate is not an International Marraige Broker.

I agree with this.
