Hello,
I have a question, based on what I read under another thread. As it appeared to be a DCF filing and not a K-1, I was hoping someone in this forum would have some advice. This other person was told they would need a co-sponsor for an I-864 due to the fact that they had been at student the last few years and weren't above the poverty line that whole time.
Now we already have an appointment for the K-1 visa interview at the embassy in Costa Rica. I'm concerned that they will deny/delay the approved based on a similar situation. I just graduated from grad school and effectively had no income for 2004 or 2005 (just student loans), and took my first job in January. We'll be submitting an I-134 with paystub, bank statement, and a letter from my employer stating start date, salary, and non-temporary status (and I am definitely above the 125% income level).
Anyway, my question is this: has anyone been in a similar situation (recent grad) and had the K-1 approval process affected? If so, what did you end up doing?
Should I just put a co-sponsor down, just in case?

They (USCIS) are just asking the applicant to fill out the IMBRA Supplement form they provide with the RFE letter. This is because when the petitioner originally filed his/her petition, he/she did not use the new form that includes the IMBRA related questions.

1.Did you meet your fiance through an internation marriage broker?
2.Have you ever been convicted by a court of law of the following crimes?

We've got all docs ready for the interview. Police report should be sent to my fiance this week (40 day mark). We decided it would be best for him to download all forms and prepare them from the consulate website so that he can send them off as soon as he receives the packet.

The US Embassy website in London says:

My fiance called the expensive number this morning. They said that there isn't a date set, nor a packet 4 sent out yet. They went so far as to ask if he sent everything in. When he told them he did and he had it signed for on the 7th, they said it takes 4 weeks minimum for processing. So, I guess we would have to wait 2 more weeks before we hear anything.

Thanks for the suggestion about emailing. Although I have never had a response the few times I emailed (save the automated message) I went ahead and sent the following:

I guess it's not the fact that we haven't received the packet, that matters, but according to the timelines, no one has really received a packet 4 since the 14th! If anyone (who sent in packet 3 early this december) receives packet 4, I would be absolutely thrilled!

I hope they haven't stopped it totally for the holidays! Its a bit too soon!!!! (i hope)

I also agree there is no wavier for AWA. The initial application requires (in the USCIS memorandum ..2007) the petitioner to submit evidence of certified court records, pre-sentence reports, psych report, community service and any evidence that would prove that the petitioner is not a risk/threat to the beneficiary. When we filed for K1 back in 2006, we did not submit all these because we thought they would send us RFE specifying what kind of evidence they need. But our thinking was wrong. The burden of proof is on the petitioner. We guess that's why our case had been pending for 2 years. .. by the way I sent a PM to you..

Does have the paperwork from court/probation officer that says he doesn't need to go thru counseling or rehabilitation programs? If yes this is one of the most helpful evidence. Current psych report from a licensed psychiatrist/clinical psychologist/psychologist is a must too, personally i think. My husband was discharged in 2005 and since then we don't have any "paperwork" to prove that he is not a threat therefore even tough I KNOW he is not a threat we still had to get a psych report from a private-practice licensed psychologist recently before we filed the petition. My AOS is still pending but I was scheduled to an initial interview next Month. Besides the certified court records, we also submitted a current psych report, an affidavit from me(4 page long), an affidavit from his roomate, and letters from friends. So far we have not received any RFE but the interviewer might ask us for more evidence at the interview. Depending on what she/he would ask for, we will then gather the paperwork..but there aren't anymore we can think of now... There is a topic in this forum about polygraph. Actually..our attorney is from a non-profit organization and he charged us a very low price for filing the paperwork for us. After he sent out the paperwork, he said to us because our case is special and he has never had experience handling such kind of cases, he is willing to come with us to the interview for free. We are going to call the attorney this week to find out if we have to go to the county clerk to obtain the same batch of certified court records again for this interview, because the interview letter mentioned about "original copies"...we already submitted the certified copies ...

Hi Old Dominion, I don't know if my husband's I-130 petition for me is approved or not. Since I am adjusting from B2 visa, we had to submit both I-485 and I-130 together for my AOS. But even I received NOAs for all forms, the I-130 case number is still "not found" on the USCIS website. I am not certain if USCIS has adjudicated my husband's I-130 petition yet. Therefore I am confused as to why the local office would want to interview me and my husband even though the I-130 has not shown up on the status system (assuming that not showing up on the system means no actions been taken...) ... So far we have not received any RFE... so I suppose we submitted everything they need (certified court record, psych report, letters from friends, affidavit from me, joint sponsor paperwork, I-693 medical sealed report, etc).... our attorney said he is surprised at such fast pace. Contrary to us feeling excited and hopeful, attorney feels skeptical and does not expect me to be approved at the interview. He will come with us to the interview perhaps to prevent IO from asking illegal or leading questions....

Noversation - Ya I was aware of the details of husband's convictions. I read every page of his certified court records and the dedective's reports. Some details were graphical. If USCIS asked that, think I will just tell them there is no point digging the past but important to focus on the presence...

You are the AOS applicant, and the two of you just need to prove in every way possible that your marriage is real. Your lawyer can't help you do that in an interview environment. Hi pals, today I received the interview letter for my I-485 from USCIS in the mail. The interview date is Dec 17. I am so surprised to have received the interview notice in less than 3 months after we filed the AOS paperwork (Sep 16). How can they be so fast to review the thick documents that our attorney submitted?! I am really excited and worried at the same time. On one hand I am hopeful that USCIS is efficient on my case. On the other hand, I am worried that it might be a trick for them to deny me as FAST as they can! We are gonna talk to our attorney on Monday.... Our attorney also agreed to represent us at the interview... I am so overwhelmed now cause a few days ago I received my EAD approval notice too. The USCIS website did posted a memorandum pdf about the evidence a petitioner can provide to prove that he is not a threat to the beneficiary. To shorten the length of time for this "battle" (by this i mean it's a long period of time that would exhaust you and your wife, not really a war), I suggest you to focus on providing the evidence the USCIS requires, even though the memorandum says the decision of the USCIS is upto the discretion of the DHS head. Nonversation, if you focus on the unconstituional/flaw aspect of the Adam Walsh Act, you will need a very competent lawyer specialises in consitutional lawsuits.....it can take years.....

My husband and I are doing the first route. We are trying to work within the guidelines set out by the USCIS. So far I am still staying in the US but have not had any interview yet. We are still waiting for their decisions. If they want RFE, we will submit. If they deny, we will appeal. If the appeal fails, we will think of something....

I can understand your anxiety if your wife is still in the Philippines. I have read a case on VJ about a K1 SO peitioner waiting for 2 years but finally the petition was approved.

So they are reviewing the law by trying to give amnesty to illegal aliens...thinking about this..my wife jokingly said that she should have been an illegal alien than me filing for her I-485. I am an AWA filer, I did the right by filing legal status for my wife. I submitted documents to prove that I am not a risk to my wife. I have not received any reply yet, 6 months after the RFE was submitted. But now they are considering granting amnesty to those who have stayed in this country illegally...is it right? Is it because I am an AWA filer, but I am a US citizen born in this country.



Eagerly, if your wife is illegal and you are AWA filer, it could be even harder.......I am not sure what to think of the USA... but I am grateful everyday I spend with my husband. We are waiting and waiting as well...

Music, we married in 2009 April and we filed i-485, i-130, i-765 in 2009 Sep. So it has not been 3 years yet. But in 2009 after we got married we did withdrew our K-1 petition filed in 2006.

I have a question about EAD renewal for AWA Petitions.. I got my EAD last Oct. 2009 and it is valid till Oct. 2010.. My question is, Am i allowed to renew my EAD while my AOS still pending? Do i have to pay anything? IS there anyone who is in the same situation, AWA beneficiary and planning to renew their EAD? I just wanna know because I don't want to lose my job and my driver's license. Thank you in Advance.


I got mine in Nov 09 and my husband is also an AWA peitioner. I also want to know if the renewal of EAD will be affected. But anyway, we will submit the renewal application 3 months before my EAD expires.

In my I-485 denial letter, it does not ask me to leave in 30 days. It just says there is no appeal for this decision but if I am ever put into removal proceedings I can present new information to an immigration judge if there have been changes in the circumstances. So I don't think I am accruing unlawful presense. But I believe I could have been out of status. Our lawyer mailed out the appeal today and we hope that we can get back the 87 days RFE response time (because USCIS claimed they sent such RFE to us in Jan but neither we or our lawyer received a copy). I really think USCIS needs to provide more training to their adjudication officers. From that denial letter, I am really disappointed at their level of profession and accuracy. They are under department of homeland security but their notices in writing were written so loose.

Forgot to clarify: there is no appeal option for I-485. but the appeal our lawyer mailed out today is for the I-130.

We did not receive any NOID in the first place. All in a sudden, end of May, our lawyer received a denial letter from USCIS for my husband's I-130 and another denial letter for my i-485. The denial letter of I-130 says that USCIS mailed out a RFE on Jan 14 and we did not respond. The fact is that both our lawyer and we did not receive any RFE in the mail EVER. I took screenshots of USCIS online case status. I took one on May 22 - 3 days before the date of the denial letter. The online case status was showing "initial review", like background check, etc. It never reached the stage of "Request for Evidence". If you have used the website to check your case status, you will know what I talking about. So this screenshot is going to be one of the materials in the appeal. There are also some erros in their denial letter as well.

For example, the psychological assessment my husband did in June 2009 was done before we submitted an application for I-130 and I-485 in September 2009. But in USCIS's denial letter, they mentioned that the assesment was done in response to the Notice of Intent to Deny that USCIS sent to us. I fell off my chair. How can we do a psychological assessment for a NOID in June 2009 when in fact our application packet was sent in September 2009 ?!

Our lawyer is going to send an appeal by this Friday. However the appeal is for my husband's I-130. My I-485 denial letter says that I-485 is not appealable but I can file a motion to reopen within 30 days from May.

The appeal fee for my husband's peitition is $110. The motion to re-open fee for my i-485 is $585. Since money is a issue, we decided to appeal for my husband's I-130 peition only (and because lawyer told us I-485 relies on I-130 result so filing a motion for I-485 now won't change the appeal result of the I-130).

But I am wondering - if I let this I-485 unactioned, will I be "out of status" or "unlawful presence" in legal sense? Cause now, i-485 denial letter has said that my EAD has been revoked and cancelled. Any benefits granted been cancelled.

I want to know how soon will I be put into removal proceedings? Will I be put into removal proceedings really? They really want to deport a US citizen's spouse for the wrong past of the US husband?

2010-6-24: our lawyer sent off the appeal package for the I-130 by overnight delivery. Packaged was received and signed on 6-25, right on the 30th day since the denial letter was issued.

2010-7-6: received lawyer phone call saying he received a letter from USCIS saying the appeal form he used is not the latest version and the appeal package was rejected. But lawyer said the appeal form he used was downloaded strict from USCIS website one day before he mailed the package out. So it is the current version. Lawyer resubmitted the same package again today asking USCIS not to reject.

2010-7-14: touched but no actual textual update
2010-7-15: touched but no actual textual update
2010-7-19: lawyer received a receipt from USCIS for the I-130 appeal.
2010-7-29: lawyer submitted his brief in support for the appeal and my affidavit for my husband. This brief is not to argue for approval, but to get our 87 days back for the RFE that USCIS claimed to have sent to us back in January while neither we or the lawyer received it.

2010-8-16: EOIR-29 form (appeal for I-130) touched on USCIS website. But no status update.

2010-8-27: received a counter brief from USCIS National Benefits Center towards our appeal for I-130. The brief from USCIS was addressed to BIA but copied us and lawyer in. In their brief, they still said that it was valid to reject our case because they did mail us a NOID or RFE (which we did not receive). They also said we filed an untimely appeal - which according to the certified mail delivery status on USPS, the appeal was delivered on time. Dirty trick on USCIS. They look like they wanted to fool BIA.

Our I-130 and I-485 was also denied, but a lawyer advised us instead of fighting USCIS to wait to go in front of a judge! Then flask the judge for more time to prepare a good case! I am not sure if I understand you correctly? You mean you are not gonna appeal the i-130 and just wait to go to your removal proceeding hearing resuled from the i-485 denial? If you don't at least appeal the i-130 first, the immigration judge at the removal proceedings will not have any ground to re-open the case because there will be no status change on the denied i-130. However if you file an appeal first for the denied i-130, then when you go to your removal proceeding hearing, you can show the judge that your spouse's peitition is being appealed therefore the judge hopefully could suspend your removal (or deportation or voluntary departure). If I have misunderstood you, please clarify. I am so sorry to hear another denial.....
