My husband received his GC w/ conditions 10/4/07 and just removed the conditions. His new GC has issue date of 1/4/10.
Do we file his naturalization paperwork 90 days before 10/4/10 or 90 days before 1/4/11?

My friend is going through the citizenship process and he received a letter for his 1st interview with a request for additional documents.
They're asking for proof of registry for selective service or documentation of why he didn't or didn't have to do it.
He came to USA many years ago on a tourist visa then stayed illegally. About 6 years ago he received his greencard, when he was 30 years old.
He didn't register for selective service because he was illegal and didn't get GC until after the age bracket.
What documentation does he need to provide? Is there something from selective service he can get to take to the interview?

ok, my husband's gc came today and it expires in 2 yrs even though our 2nd anniversary is next june (7 months from now).
should we send in the application to remove conditions 90 days before our 2nd wedding anniversary
or 90 days prior to when his gc expires (10/04/09)?

I've read that it's crucial to file the I-751 within the 90 day window.
My husband's GC expiration date is 10/4/09. I mailed the package and it should be delivered today.

If there are any problems and I need to fix it, will it still be considered in the window since
they originally received the package today?

Also, since the GC expires on 10/4/09 and the whole process won't be completed for awhile,
does USCIS send us any type of notice that states his GC is in process for renewal?
We haven't gotten my husband's driver license and he'll need valid GC to get one. Does this
mean we'll have to wait until renewed GC comes before we can get DL for him?

Removing Conditions on Residency General DiscussionOMG - Nearly freaked out just now!
This weekend I had been looking at info for Naturalization of my husband next year after we finish the process of removing the conditions of his GC.
I had it programmed in my brain about the Texas lockbox where documents would be sent.
This morning in the shower I was thinking about how the I-751 package was delivered this week to Vermont and the tracking info.
All of a sudden I thought that I should have sent the package to Texas and why did I sent it to Vermont! Yelling at myself about what a big
idiot I was, they're going to deport my husband because his GC expires on 10/4 and I really screwed things up!
I had to jump out of the shower and double-check the I-751 instructions, thinking I'd hurry up and schedule an INFOPASS session.
Man, I haven't been this on edge since the last time we had to deal with immigration paperwork - more than 2 years ago for AOS!
I'm just a nut!

So I got the I-751 receipt notice, but when I try to add the receipt # to my portfolio on USCIS case status online, it
says that it's invalid. Does it take awhile before it's updated online? The receipt date is 9/15/09 and only 3 business days have
passed. Maybe it needs to be entered or updated in their system to start showing on the website?

Also, it says "If you have not already done so, provide supporting documents to assist USCIS in processing your petition and to establish eligibility to remove the conditional basis of your permanent residence." Then it gives a list of documents to prove relationship. But I've already sent all this stuff with the petition. I guess I don't have to send them again, right?

Approved on 12/29, but no updates uscis. Then, 1/4 & 1/5 there were duplicate emails saying that card production was ordered.
I checked online status, it said the same.
Now, this morning there was new email saying approval notice sent. #######?
We already received the approval notice, why would we get another one?
And how many card production orders are there gonna be? yikes!
What happens to the expired 2 year gc? Do we need to send that back or cut it up?
I'm wondering if this new NOA is for us to send back old gc....

I never really thought about this until now...
I was married in Turkey to a Turkish citizen. I brought him to the USA on a K-3 visa, did the adjustment of status, and he got his greencard. We've been together for 5 1/2 years in America.
However, was I supposed to register our marriage here in the USA or does filing income taxes together, doing the immigration paperwork, and changing my name with the Social Security Administration automatically register my marriage in this country?
I'm curious because I know that my husband had to register our marriage in Turkey with his ID card, etc.

I mailed in the I-130 petition for my husband, who is Turkish, and I received a I-767C Notice of Action.
I heard that I can file a I-129F (K-3) for him so that he can come to USA to wait for his green card to be processed, and that I should file the K-3 after I've received the NOA1.
I am a little confused...
Is the I-797C, Notice of Action (receipt notice), the NOA1?
Should I now send in the documents for K-3? Or do I need to wait until the I-130 is approved?

I've seen members on different forums stating that when they checked the status of their visa that is being processed, they say it had been "touched".
I submitted my husband's I-130 petition a month ago and last week mailed in his I-192F petition.
I've checked the status of his I-130 once a week, but how can I tell if it has been touched or not?
It says "Last Updated" 10/15/06, does that mean that was the last time it was touched?

I am trying to figure out if I will need a co-sponsor or not...

January 2006 - March 2006 : 2 months in Turkey with boyfriend/fiance.
May 2006 - July 2006 : 2 1/2 months in Turkey again with fiance/husband.
October 2006 - got a new job making approx. $23,000 per year.
October 2006 - sent in I-130 & I-129F petitions.
November 2006 - got a 2nd job, approx. $16,000 per year

I will receive a salary increase in April 2007, $27,000 per year.
With both jobs, I should be making $43,000 per year.
This is well over the 125% poverty level, which is required.
But because this year I only worked 3 months so far, my tax forms will show I made a very low
income. I asked an immigration lawyer if I need to make +$16000 before the end of the year,
and he said no... that as long as I have a letter from my employer stating I am a permanent employee
with my salary information, that I should be okay with the Affidavit of Support.

I am also concerned because in 2005, I was laid off and part of the year I collected unemployment.
My total income was $21,000, but $6,000 was unemployment compensation... my salary from other jobs was only $15,000. Will this look bad? Every year before, I made over $20,000 per year.

Will I need a cosponsor? I doubt that anyone in my family would help me.

I filed I-130 & I-129F petitions for my husband, and designated on each form that the American consular post will be Istanbul.

But I recently heard that Istanbul is no longer processing immigration visas, that immigrant visas are being handled only in Ankara. Does that mean non-immigrant visas are still processed in Istanbul?

If my husband comes on a K-3 non-immigrant visa, will he be going to Istanbul or Ankara?

I am a little confused.

I am trying to find some information for my friend.

He is a permanent resident (Turkish) and his fiance is in Turkey.

If they marry and he petitions for her to come to USA, what is the average time
that it will take before she enters the States?

I'm a US Citizen married to Turkish man, but he will be here in USA with me
after 6 months of filing the petition.

But my friend and I are wondering how long it would take for his future wife
to come to USA.

Anyone on this forum followed that process?

For purposes within the USA (drivers license, etc), you will need to have the
Turkish marriage certificate translated by a certified notary, the Turkish embassy
in the USA or by university, but it is very important that it includes a cover letter
from the translator with their office letterhead stating they are certified to give
translations. I had a lot of problems trying to get everything changed over into
my new married name because the motor vehicle department wouldn't accept it
even though I had certified translation. Because the marriage certificate only
had the local goverment seal (Avcilar) and not authorized/notarized by the
Turkish embassy, it was rejected. Best bet is to get it translated by the embassy
here in USA. Luckily, the Social Security Administration does not require a
translated copy... they have officials working in regional offices that will do the
translations in-house... which is nice!

For my translation, I found a website that you can scan the marriage certificate
and have them translate all the pages, you'll receive it in the mail within a week.
It cost about $40.

I am thinking that because your I-129F is being touched so much is that they are getting ready to approve it.
After I submitted my I-129F, it took only 3 weeks to be approved and they approved my I-130 on the same day.
My I-130 had not been touched for over 2 months until that day. I think now that VSC is handling I-130s & I-129Fs together,
it is speeding up the process.

I think that if I hadn't submitted the I-129F petition, my I-130 would have sat untouched until the VSC started working
on cases with my priority date. Currently, the USCIS website says that VCS is now processing cases with priority dates of March 12, 2006... that is almost a year ago! So, I-130s without I-129Fs filed, will sit until the VSC gets to your priority date.
From other posts on this site, I have noticed that since VSC has combined I-130 & I-129F processing, both are being approved on the same day. The I-129F is being sent to NVC to be assigned a case number, then forwarded to Ankara within 1-2 weeks.
Ankara is taking about 2 weeks to send out the packet (ours got lost in the mail, but I emailed Ankara and they said not to wait, to follow intructions on their website for K-3 process and send forms to them, which we did). It took them less than a week to give us an interview date after they received our forms back, which is scheduled 2 months later.

Someone on this forum told me that the NVC will hold your approved I-130 petition until your spouse arrives to the USA
on their K-3 visa, and then you will file adjustment of status one they are here.

My friend just brought his wife from Turkey without using the K-3 option, and it took 13 months. It took 6 months from the time that he filed it until it was approved, then 7 months until she got her interview date. But they also hadnt included crucial documents in the packet returned to Ankara. He warned me not to do the K-3 option because it could take longer, but it only it only took 5 weeks to be approved.

I don't think that the NVC will send your I-130 to Ankara, even if it is approved. Because they assume that you want your spouse to come to USA on K-3 visa.

my thoughts to you... go to Ankara's website and complete all the K-3 forms, get everything ready and send to your spouse
in Turkey. Because once you receive the approval notice from NVC, Ankara will receive your information very quickly.
The NVC will tell you when they will be sending your information to Ankara, normally 1 week after case number is assigned.
Wait 2 weeks after the shipping date, then tell your spouse to mail the documents to Ankara. This is because Ankara is sending the packet out within 2 weeks of arrival of your information, and they will be expecting your documents after mailing the packet to her. They'll assign an interview date within a week, which may be up to 2 months later.

So, if your I-130 & I-129F are approved within the next 1-2 weeks....1 week to be sent to NVC,
1 week to get visa case # assigned by NVC, 2 weeks to be received by Ankara and packet sent, however much time
it takes for you to send packet back to Ankara, then 1 week to get scheduling of interview which is 2 months later...
my calculations are that your interview date will be sometime in May 2007. But I am not a visa expert! I am
just going by other people's experiences and posts that I've read on here. Typical time for I-129F to be filed and
spouse's interview - within 6 months. Prior to October 2006, it was 6-8 months (maybe longer).
So, if your wife gets her K-3 visa sometime in May 2007, she has up to 6 months to enter the USA.
She can wait until you arrive in July for the wedding celebration and go with you back to USA.

I am disappointed that I had not known that we didn't have to wait for the packet, but could send in everything
a few weeks earlier... our interview could have been a whole month earlier!

If you are hoping to have your interview in July, before the wedding celebration, you may try submitting a letter
"To Whom It May Concern" requesting a later date. I've heard of circumstances (work, travel conflicts) where
the consulates would allow couples to postpone their interview dates if requested. They may even schedule the
interview for a specific date, if you request it. But that is up to the person processing your documents.
But it doesn't hurt to try, right? I have discovered that Ankara is very fast with replying to email inquiries
regarding your case, normally within 24 hours of your email.

i must have been confused with what was told to me... i cant remember who it was on here who translated what the approval letter for
I-130 truly meant. i know that someone had said before that it is retained, but i guess i confused USCIS with NVC.
all i know is that my husband is going to continue with the K-3 then file AOS once he arrives to USA, since now that we filed the K-3
the I-130 won't be forwarded to the embassy abroad unless we file I-824.
right now, all i can concentrate on is the upcoming interview... this whole immigration/non-immigration/I-130/I-129F/K-3/AOS/etc/forms forms forms!
is making me go crazy! hahahah

I just received an approval for both the I130 and I129f as well and the notice said the same thing about residing in the US. Our thought was to apply for both options and see what works out. Using the K3 would depend on if I can enter the US with the K3 and start the papers for the work permit yet keep my airline job in Canada and fly back and forth for work in Canada while waiting for approval. Has anyone else tried moving to the US and continuing to work in Canada? I don't even know if this is allowed. I hear they hold up the I130 awaiting further instructions from us when they know you have filed for the I129. What is the next step to get that I130 moving too?

I called the USCIS today and talked to a 2nd level rep, and they said, yes the USCIS district office made a mistake, in saying the beneficiary was in the U.S. Told me that I had to file I-824. Then I said, well it's your fault, why should I have to file any more paperwork and money. Then he said, well I can't route anything from here. You have to contact the district office (VSC in my case) and today I sent them a letter stating my case. We'll see what happens.



You know, I was confused too when I got that letter. But I found out that since the change in procedure in processing I-130s & I-129Fs in the end
of October 2006, what is happening now is that the VCS is approving both at same time, forwarding them together to the NVC. Then, the NVC is
assigning a case number and only forwarding the I-129F (K-3) to the embassy abroad, and hold onto the I-130 until your spouse arrives in the USA.
You will then file an Adjustment of Status to recieve her greencard. Because you filed both, they assume you want to take the K-3 route.
I am not sure how long it will take to get the greencard after filing the AOS, maybe up to 6 months or maybe less... I am not sure because this is
a new process that the NVC is doing and those people who filed their I-129F petitions at that time are now receiving approvals and being forwarded to embassies. We'll just have to wait until the people who have arrived to USA on K-3 to hear what their experience is with receiving their greencards.
My guess it will take less time than before. Since prior to October, it was taking 6-8 months to get K-3 visa, now it is taking 6 months or less.
I wouldn't worry about filing the I-824, it may hold up your wife's visa... I would just take the K-3 route, bring her to USA on non-immigrant visa
and file AOS.
