My son is 6 years old and he had to have his biometrics done. As far as what I have read and asked on here, all children need them done. When I was at the biometrics appointment there was another couple there with their 4 or 5 year old and he was having his done too. I don't know what visa they were going for but the child needed his biometrics done as well. I would print out everything you can on the USCIS website about children and biometrics and see if you can get another infopass appointment and speak to someone else. I know how frustrating it is to have to go back there, believe me, but if your step-daughter needs the biometrics done, you do everything you can to get it done. That way, as you said, you didn't just abandoned the card process. I hope this helps.

You are wrong. MOST children going for ROC are not required to get their biometrics done.

USCIS takes the fee, but often does not make appointments for children.

Why has she not filed? If she was a student/ didn't make any money, it won't affect the petition but she will need a co-sponsor for the affidavit of support. If she simply "forgot to file" she needs to backfile taxes asap, as she will need proof of filing (or not having to file).

Not sure of why she didn't file, will ask....

Now if she files and owes taxes, will that affect the filing process?

There is NO possible way in my knowledge that he can come here. No waivers, nothing a lawyer can do. He has to wait out the ban and reapply.
In my experience, people who reapply do get approved second time around.

I have been reading through most of the info on the site, kind of hard to digest though!!

My fiance is a USC living in the States, I am a UKC living in London.

We have talked about marriage, wanted to get married either late this year or early next year.
Then, found out I am about 6-7 weeks pregnant.

I don't really want to be here alone for the baby's birth, but from what I understand, it seems the timeline for getting to the States is about 7-8 months which is cutting it very fine. He has recently started a new job, no way he will be able to take 3-4 weeks off to stay here around my due date to be here during the birth.

My questions are

1. Is it worth appealing to the London Embassy for a DCF on the grounds I'm pregnant or does that count for nothing??

2. What are the chances that if we did apply for a K1 and it wasn't approved in time that I would be allowed to enter the US at 7 months pregnant, stay until the baby was born and travel back until the visa came through?

3. When they take his ability to support me into consideration, does the length of time he's been employed count?
He just started a job with the US government 3 months ago, but has always worked.

4. I'll be getting 6 months paid maternity leave, also have 10 weeks leave added, would they take that into consideration at all?

My fiance will hopefully be sending off all our stuff at the end of next week.

We have met one another 7 times, all via flights.

I have all the online emails confirming flight reservations which we're going to include, and also a few of the boarding passes as well.
Also have 3 hotel reservation emails which we're including.

Do you think it is worth getting copies of my bank and credit cards showing the ticket purchases? Or are the emails and selection of boarding passes/baggage claims enough?


I could order phone bills for each month, but that would take a week or so, so have included 3. Do you think this is enough??

He has a few bills showing text messages to me, but only about 2-3. Do you think he should order a year's worth?

We have photos of the both of us only on two occasions, but photos with him and my son on 3-4 occasions, would they be helpful to include?


On another topic, can I check that my fiance's birth certificate, my birth certificate and my son's need to be included?
As well as biographic information forms for all three of us?

To answer one question, once you have the visa, you must use it on your next visit... There is no can't I enter as a visitor this time and use it later... The K visa trumps VWP... In non VWP countires, a B visa would be cancelled for the K visa to be issued. You can't have two active US visas at any one time...


If you do not wish to have the visa issued until after the baby is born, you can ask the consulate to delay issuance of the visa until you wish it to be issued. It has to be issued within a certain time period of the petition approval...

Once the I-129 is approved, can you choose an interview date a few months down the road to fit into your timing?

I'm interested in this topic because I might be in a similar situation. (No, I'm not pregnant. :P) We'll be able to mail our I-129F within a few days (filing through Nebraska), and that means the interview might be in July or thereabouts. But I have to go to the US in July to attend a conference, and I'll need a month or so after the interview to get packed and ready to leave here. Based on what's in this thread, I'm thinking that if my interview isn't in June or earlier, I should postpone it to August.

This would be a good time to find out how long we have after approval of the I-129F to have that interview.

I think in your case it would be easier, you can just delay sending the documents back to the embassy :)
The reason why I wanted to actually have the visa itself BEFORE going is that it might be harder to convince them that I'm going back after waddling up to them 5-6 months pregnant lol...

If you enter with a K1 visa there is no asking immigration not to start it. The whole point of the k1 visa is to come and get married, and when you filed for your K-1 petition you submitted 2 different letters of intent stating you would get married. You have up until 6 months once your visa is issued to leave your home country and come to the USA, once here in USA you have 90 days in which you must get married. To my knowledge they dont offer any extensions on the 90 day time frame either.

If you need to come to the USA before getting married, its probably better you do it before you send off your k1 petition on a vistors visa or VWP or if your petition is already sent off then come before you have your interview ( just make sure you under stand there could be a delay in getting your visa if you are denied entry).

I am kind of scared about coming to see him before, due to the fact people have been turned away, even though I'd have a job letter and my son would still be here.
So what I'd have liked to do is come over and visit him, that way he could save all his leave for after the baby's born.
While we have submitted letters of intent, that doesn't obviously mean the NEXT 90 days, but 90 days after entering USING the visa.

I'm sorry I don't know the answer to your question about going thru the Barbados embassy. But you could email them and see what they say.

As far as the letter goes.... in Canada, it was called a "Statutory Declaration", and I wrote the contents myself, which basically said: I, xxxx xxxxxx (birth parent's name, giving permission for children to move to US), give my permission for xxxxx xxxxx (child's or children's name(s)), to move to the U.S. to live with xxxxxx xxxxxxx (children's Mother/Father's Name). And then, there was the date signed and the parent's signature. That was about it. It has to be notarized.

Children that young do not have to be interviewed, but I believe they do need to have the physical exams.

If you need any further information, don't hesitate to ask.

When your finace gets the packet from the Embassy, couldn't the children fly down to where he is?
Then do the medicals at the same time as him, get the visa issued etc. If they couldn't come to the States at the same time as him, they could always fly back to Canada and when it's time for them to come to the states, just enter on their visa.
Otherwise, perhaps the Barbados Embassy may authorise them to have their medical at the Embassy aprroved Canadian doctors and get the Embassy in Canada to issue the visa to them.

Hi Guys, I'm a december filer and I don't know if I want to keep going with the prosses. This is what happend. I found out that my fiance was unfaiful to me. She said that she travel to singapore for a working purpose and I found that she really went there to spend a weekend with a guy. I feel really bad because I was taking things seriously with her. I can't not sleep because of this. There is not doubt that she sleep with this guy. One of my fiancee cousing knows her pass word and she feel bad of what she was doing to me and she told her that she gave her 24hours to tell me the real reasons she went to singapore or she will tell me the true. so my fiance all wasy said that she did not sleep with this guys so what I did write the guy that was with her and singapore and he told me that yes that she spent the weekend with him. That he paid her for the ticket and give her 250dls. Then I thought that her couising should know more about this history and she did sent me a e-mail where she wasn sending him her pass port and tell him that she can not wait to be with him. This really broke my heart. Afther I show her the e-mail with the pass port that she sent to him she admited and told me that she god blind with money that she does not know what she was doing...A few hours ago I talked to her in the camera and she was crying and told me that she will kill herself if I liave her....could anyone tell me what I should do? After this all that is in my mind is that if she love me she should not had done this to me....please help.......should I just stop talking with her? she is being calling me and calling me trying to get my forgiveness

While I agree some have better attitudes, I'll be the first to admit that securing good, decent employment without even a COLLEGE degree is hard in today's workforce. I was lucky and happened to fall into a job that paid a liveable income, but depending on the location, etc. it's not always that easy. I empathize with her - I really do. I've been in situations where running always seemed the only viable option, but problems follow you. I think that LisaD's advice should really be heeded - as far as the transference of dependence. The poster below you mentioned her getting raked over the coals and being judged due to her age - it's a big deal, as we all know, starting over in a new country, esp at 16 with no marketable skills. I'd advise being on your own in a familiar place first (which I didn't do, and I wish I'd had the opportunity) so when the OP got here, she'd at least be able to survive if things went awry. Transferring her dependence to the boyfriend is going to be an awful stress on him too - after all, he's only 20.

She was asking about marriage, and how she'd be 16 in April and her parents would give her permission to marry, and that's legal in her country and his state - it seemed very much she was planning on marriage at 16 to me. I know the person I was at 16 and the person I am now (and it's only been 4 years) are too very different versions of the same person - and the 16 year old version couldn't handle a lot of things I can now. I feel that this is probably why teenage marriage statistics are so leveling, and the odds of that type of marriage are working out are not in the OP's favor. And that's probably why she received the advice she did from so many people - to wait, try a student visa.

More power to her if she makes it work. I always wish everyone the best of luck with their loved ones, but the trials that will be endured are not easy, especially with a foreign spouse involved. It would have been hard in the best of circumstances, but dealing with AOS, etc. add stress, not take it away. I just felt she deserved a fair warning that it wasn't a walk in the park and it wasn't as easy as she envisioned with her preconceived "answers" to every problem.

I should be able to sort out something without resorting to having the car repossessed. I just wanted some info incase my worst case scenario happened. I've been told from a friend that I cant legally sell the car then pay the debt off because technically the finance company still owns it. I dont know how true that is but ill be making enquiries with them tomorrow.

That's incorrect.
You can quite legally sell the car if you inform the finance company and the buyer of the car.
However, you'll have seven days after you sell it in which to pay off the outstanding balance. The person buying the car would of course have to trust you to pay it off or it could end up getting repossessed from them.

I just have one question. I guess I am just curious to know the outcome of the people who get pregnant while still having their fiancée’s abroad? What does the USCIS do in these type situations? In the UK I hear that some go there on tourist visa, and end up pregnant, and they are allowed to stay.

However, I do not believe this is the case for Americans petitions for their fiancées. in situations like this does the petitioner move to the country of their fiancée in time of the birth or what.

Just curious of how things turn out for those individuals who seek those routes.

We filed in Feb, was approved in May. Don't think was any faster, apart from perhaps the Vermont approval....
