This is stupid that someone who did all the right things and made a mistake a few hours before their interview can be deported for life. Meanwhile there are millions of illegals in this country that the government is doing nothing about. Guess uscis doesn't have their priorities straight.

Sounds reasonable to me, but I can't answer for the consulate.

How old is the appraisal? Things change with time, sometimes things can change rather abruptly.

You can take more money out of the business for your personal use.

If you were to decide to sell the business, how would you set a price? And what documentation would you use to justify the price in negotiations with a potential buyer?

Keep in mind that if you were to show the business as something that you could sell to generate cash to support yourself and your alien fiancee - what is the impact on the income that you do have?

i own 2 usedcar dealership with over 100 cars which i own 100% no liens. i have a fully operational service shop in one of them. however my problem is i reinvest over 90% of my money back into my buisness, i dont have to i just choose too. so 2 of my years are below and my 2005 im just slightly above the poverty level. what if anything can i do to show that support is not an issue. ive been told to put 50k in the bank before the interview. is there any recognized way to show my buisness value to the manila embassy.

most people in my buisness floorplan there cars with a bank. after sept 11 my credit was shot to hell so ive had to carry my buisness on my own. although ive restored my credit ive gotten use to not depending on banks. my buisness was valued last year at 500,000 by a law firm. but it was used in a child support case i dont know if the embassy would accept that. i basically work 7 days a week (no life) and whatever i cant right off i claim. up until last year i lived soley for my buisness. if push came to shove i can sell a car at the auction to free up money but i sell 400+ cars a year so its never came to that

A good excuse to get inside the embassy would be: you're going to the American Citizens Services to get a Certificate of Legal Capacity to Marry. You will need to bring your passport to show proof of US citizenship to the guards and they will let you in.

By the way, the Legal Capacity would come in handy in case you decide to abandon K1, marry your fiancee, and then file IR. Just a thought.

1. You are not required to submit any bank statements.
2. However, we did submit six (6) months of paystubs for which you are missing from your list.
3. Please be sure that your pictures are not copies. The USE only accept original pictures. For example, my wife and I made copies of our online photo album on paper for which the USE did not accept. Lucking we also brought our photo album that was accepted and reviewed by the CO and returned subsequent to the interview.
4. I also noticed that you stated the NVC letter has a typo. Did the USE mis-spell your fiancee's name on any of the corespondence with your fiancee? If so, please have your fiancee address that with the CO, and/or call the USE at your earliest convenience to ensure that error is not translated onto the Visa. If this is the case, it's imperative that your fiancee's name on the Visa is correct. Traveling with a misprint on a Visa will endeed cause you unnecessary heartache that you will not need.

p.s. - The USE will take one complete copy of your I-134 Affidavit of Support and back-up because only one is required per visa applicant, but do take both copies.


if your self employed like i am you have to have bank statements plus a letter from the bank showing your in good standing

and if you file your taxes monthly and or quartely that will help also.

How much in advance should the interview fee be paid? It is $100? Where is this fee paid at? Also, where does she pay the medical exam fee, when does she pay it and how much is it?

The time is getting near for us and I don't want any delay. I appreciate all of you that answer my questions. I hired a lawyer to handle this and now see all I did was as Gary said before, paid his Country Club Dues!

This doesnt have much to do with k-1 and k-3 Nonimmigrant visa.
This is only immigrant based greencards that are so backedup.
This has been a problem for many years due to the high demand for the u.s to fill jobs with qualified workers that most americans either dont want to do or are not educated enough to do.



actually it does have a lot to do with all visa's my wife's AOS an EAD paperwork has been delayed for additional 64 days so far. we have our congressman and senators offices working on it, but the delay is based on the backlog of illegals immigrants paperwork being processed. although getting her here may not be as big an issue as you think. she wont be able to do much till the rest of the paperwork is done ,and that can be very cruel to your future atawa.

thought i should give you all a very important heads up [/b] MAKE SURE YOU PHOTO COPY EVERYTHING[b]

WHEN YOU COME INTO THE COUNTRY CUSTOMS TAKES ALL YOUR PAPERWORK and then immigration never gets them so you have to redo all the forms again. :( and dont throw away anything that letter they send to the petitioner the 129 approval letter is needed for the final AOS meeting.

when dealing with the US government remember 3 rules

1. if it sounds to dumb to believe it is

2. make enough photo copies that a small forest is cut down so that the paperwork will be filed away an never read

3. keep your senators phone no# on speed dial for all the bull they will put you through.

we have been able to get yoves EAD through with no problem with help from the senators office but the AOS is a whole new ball game

expect me to kick some dirt on home plate and scream at the umpire

Oh Wind, so sorry to hear that. But don't worry too much about the reason for the AR. Your fiancee had some changes made in her birth certificate and the embassy just wants to make sure that everything was straight and legal. They will probably double check with both the LCR and the NSO (Philippine govt.) and once they’re satisfied that everything is above board, everything should be ok.

You know the problems we had with her BC, that's what worries me.....we couldn't get a new passport :(

wind at this point its being held up by the US government (there the ones that sent it out in the first place) you need to contact your local congressmans office ,and explain how long this has been ,and i strongly suggest you go there in person. i think you will find that 4 to 6 weeks will be very short when they get involved. everytime i call my government official it seems to fix the problem in under a week. the only time i couldnt get them to fix a problem was because it was a philippine issue that we paid off the required fee ( a big bribe) and it was fixed in a week. and you've seen my post since i started i may be loud an obnoxius , but i get it done. you an PW are the last of us old timers left if anyone one needs to make some noise its you and PW

well they told me something like that on the phone too, but i've never been one that waits ,or follows the rules (im a 100% ### that you want to get rid of) i went in there once they never forgot me ,and never wanted me to come back. and when they say theres nothing they can do ask to talk to the congressman you'll be amazed at how much they can do when there ability to do there job is confronted. go angry and commited ,and make sure they know it, and dont just go to your congressman go to both state senators office ,and do the same i did it and you know that Yove had a birth certificate issue and EAD issues i got both taken care of with in the week instead of the 90+ days they say it takes. and when they tell you that it might be a month to talk to your congressman or state senator make sure you get the spelling of there name so you can write it down on the letter to the congressman/senator that there telling you a month to talk to them. this will also get them off there lazy ###'s to get them to do there job. they may not be motivated by advancement in the civil service field but they dont like to be embarressed at there lack of ability. (like i said i can be a grade A ###) its also good to go in with a digital camera so you can take a picture of the person for your letter :devil: . i look at it like this i pay taxes i want a return on what i pay 35% of my yearly pay too.

so kick ### and take names pictures and let it be known that your the squeakiest wheel they will ever ever see.

this way may seem harsh ,but it works yove being here is proof enough.

PW, i'm not done so fast :( they didn't release my fiancee's visa :angry: So i called the embassy to find out why they didn't release it yet, she told me they sent the case to Philippine government to verify documents. She said it would take 4-6 weeks. She said it was something the officer noticed and wanted to verify. Kinda odd she asked me if she planned to come to USA and marry me. She said everyone goes thru the review, of course i said that doesn't make sense because i know people who have already received it around the same time she had her interview.


Not sure what it is, i know they asked her who the baby was in the family picture we took in the Philippines. Maybe the lady didn't believe her when she told her it was her sisters. :ranting: :cry: I dunno what to do, seems like we get so close and then get it stripped away. Pretty rough times :( I dunno if that is considered AR or not, i worry why they would send the case to the Philippine government. I dunno. :help:

I think we finally have good news. :P My fiancee said all the papers were correct and they didn't say anything about needing more documents. She never asked if she was approved like i told her she should, so i hope she did get approved. She told me she got a pink slip and payed Delbros, so i'm thinking she did. :dance: :thumbs: Going to get the full details tonight :D She went in at 6;30am and didn't get out until after 2pm i think :( She said she was interviewed by a big american female hehe. :wacko:

I wonder how long it will take to send the visa to Bohol. :unsure: Also hope the plane tickets aren't all sold out for mid-Sept. :wacko:

OK PW you need to get your fiancee to start to make some noise on his end. call his congressman ,and both his senators offices they have immigration specialist there. i believe you said you had all your paperwork done on your side. if it is i know that the local offices here in the US can make the embassy look at your case. trust me on this tell him to read my post. ive also found out that the average wait to bring family members to the US on a F4 is only 3 years provided you call the government officials ,and make some noise. we met an entire family that came over here in less then 3 years as an average.

how did they get here they called there local government officials and made some noise a lot of noise and guess what there here.

you can sit back and let the government officials tell you what to do or you can call the people in power and tell them what you want done and continue to do so till you get what you need.

(forgive my grammer here im pissed)

PW i can think of no one here that deserves to be here more so then you. tell your Fiancee to get calling and to keep calling make some noise a lot of noise go down to there offices get to know the people.
meet the immigration people and make sure they know his name bring pictures if he has to and make sure he leaves them there in there office make sure that the immigration specialist know your pissed and want action.
Yove got here and got here because of a lot of screaming and calling and making a whole lot of noise.

I've received my visa yesterday.

Though, I just want to confirm/clarify something.
The visa package is wrapped in a clear plastic (inside are purposely cut brown envelope, some documents outside the brown envelope, instruction for CFO and my passport). There's an instruction that says I should not open the visa package because it will be opened upon entry in US and if not followed will cause some difficulty and delays. My understanding to this is I can open the plastic but not the brown envelope and one more thing the brown envelope was cut purposely, so that adds to my confusion bec there's also instruction that I should not open it.... Help! Please shed the clouds :)

I can't afford to make mistakes now so I'm asking folks out there who have been through this process.... :help:

ok spoke to yove she states that the brown enevolope is cut by the embassy but only a few inches to show that there is paperwork in it

as for my fight with the government i found out i ruffled a lot of feathers :lol: the senator's office told me that i made my problem well known to everyone. she laughed said she would hate to be on my bad side.

Can't kick my soon-to-be asawa's butt as the ball is still in my hands. I'm not done with the LCR-NSO annotation thingy. Can't imagine him screaming his head off though. He's way too nice for his own good sometimes. Prefers to suffer in silence -_- ... which is a good sign for a good husband :lol:

K-3 Spouse Visa Process & ProceduresPlease Help
I'll try to be brief. I am a U.S. citizen. My wife has Serbian citizenship. A few months ago we got legali married in Serbia. 2 months after the wedding, I returned to America to file her papers. My wife stayed there to wait until I can finish them all. She is pregnant now. Exactly three months pregnant. I have been following this forum and I thought to try K3 option. Because I think it is the fastest way for her to come and give birth to our child in America. I thought I send I-130 and when receive NOA, file I-129f with affidavit of support for the K3 visa. Correct me if I'm wrong.
I forgot to say that I have all the necessary evidence and copies of documents to sent with I-130 application.
But if anyone thinks that this is possible and that the K3 visa obtaining the fastest process than others? And would the cover letter should add that my wife is pregnant and that they should hurry with little paperwork?

you really should/MUST have all of those things listed on the checklist (that apply to you) in hand at the interview. but i think it is generally acknowledged that it is okay to send back the checklist saying you do have them all, as long as you feel confident that you will have them by the time the interview rolls around.

i believe they will not schedule and interview without a complete checklist.

Yep, just the DS forms and the checklist. As long as you have the police report/other supporting docs before your interview you'll be fine biggrin.gif

Depending on whether you have a K-1 or K-3 visa (or otherwise), the forms you need for your visa can be found and downloaded from here. Your Packet 3 should explain which ones you need to fill in.
