Hey guys,

My husband just called USCIS again after I told him of the recent rumors of USCIS cancelling K3s after July 30. This is what he just emailed me:


A very nice lady by the name of Officer Mangan today. Nothing exceptional. She said they are working on July 31/08. That does not mean and actual day it's a time frame. She said ours should be ajudicated very soon but it has not been assigned an officer yet. When it is assigned an officer things will go quick, either approval or RFE. I continued to ask questions and shew was very very polite ended our conversation with thank you very much thank you for your patience. She took my number and said she will be off phones tomorrow and will find our file to make certain it's in the correct location then call me and tell me whats up.?.!? Let's hope she actually calls!

This was due to all my I129F questions. She really was uncertain herself. It seems that yes any I129F application w/out fee (after july 31st) will be cancelled upon the approval of their I130. I said, so we will not be given an option between the Immigrant I130 and Non-immigrant K3 I129F? USCIS is going to make that choice for us? She was uncertain at that point! I said, we would have paid the fee if that was the case but USCIS waived the fees. She really didn't know after she thought about it from that perspective.

Also, I mentioned the Ghana person and Mexico person who have been approved with dates later than ours. She said did they have I129F K3's? I don't know? That could be the difference, she said. So the I129F NON IMMIGRANT process may have hurt rather than helped? Again she was unsure but said possibly!!!>:( This is why she is suppose to be looking into it for us and calling back tomorrow. I asked her to look into our file to see if the I129F has delayed us? She said okay.



This sounds like what Nita&Assad were told. I'm going to be really upset if we are FORCED to go the I-130 route and be away from my husband even longer. sad.gif

We are still waiting for our approvals. This is a horrible experience, as if being away from my husband wasn't horrible enough. Steve was thinking of calling USCIS again this afternoon. Last time they said our file hadn't been assigned an adjucator yet.
Hope your files reach NVC very quickly and you can reunite with your SO very soon!

Hello fellow November filers,

I thought I would give a brief description of my oath ceremony to help you know what to look forward to. My ceremony was held at the USCIS builiding in Metairie (New Orleans). It was scheduled for 1:30 pm, but we arrived at 1:10pm. After going through security, all the people taking the oath formed a line to give up green card and the oath ceremony letter. We were also shown the Naturalization Certificate and asked to review that all the information on it was correct. We were each given an envelope and escorted to our seats. We were seated in the same order as the certificates so it was easier when we were called up to receive them. Inside the envelope there was a small book US constitution, a book of general US history, a nice folder to put your certificate in, a little US flag, a passport application form, and a letter from the president.

My ceremony had 57 people from 26 countries. The director of the USCIS New Orleans office started the ceremony by showing a brief video of "United States", then it was the national anthem. He gave a nice speech about citizenship. After that we had a roll-call: he called out every country one by one, and when your country was called you were supposed to stand up. Once every country was standing, he asked us to raise our right hand and repeat after him the oath of allegiance. (There is a copy of the oath of allegiance and the pledge of allegiance in the folder they provide). He recognized the military members that were taking the oath that day (two of them). Then we had the Pledge of Allegiance. Then called each us one by one to come up and receive the certificate. He was very friendly and encouraged all the family members to come up around and take pictures and get closer. He stood with each person that wanted to get a picture while receiving the certificate. After everyone had received their certificate, they played a music video of "proud to be an american", and he wanted everyone to sing and wave their flags. He (the USCIS director) was jumping around signing and waving his flag (very funny). Then a lady from the Passport office gave us some information about applying for a passport. After that the USCIS director asked if anybody wanted to say something about the experience. Two people talked about the wonderful service they'd received in New Orleans USCIS (not exactly what he meant, though). And that was it!

I already sent out my passport application ($135.00), and have to wait 4-6 weeks for processing. You have send them your original certificate, so make sure to make copies of it. I have also registered to vote for the elections.

It was a very nice experience. The ceremony was about 1 hour long, but there were 57 people, so maybe it would be longer with more people. Good luck to all of you!!!! Wow! Congrats! I didn't even know that it was possible to choose your own date. It's really neat they let you know that you will be able to swear in the same day. I've got my fingers crossed that you have a great interview.

Personally, I wouldn't call them unless I did not receive some sort of confirmation email regarding the interview date. But that's just me. If anything, it would provide you peace of mind to double check with them that your interview date is confirmed. Good luck!

Thanks! NOLA is a four hour drive for us, but it is such a beautiful drive through the Atchafalya basin that it's not that bad. I haven't been able to go to Cafe du Monde yet - there is always a super busy Looooooong line. Guess that is a testament to how good it is. But, this Thursday, we might just have to swing by for a celebratory coffee and definitely beignets!

I did my FP at Metaire for my AOS and ROC! I lived in AL then and that was the closest - like 2hrs away. But my field office was in Atlanta, GA. Of course there's a FP office in maybe Birmingham, AL, but AL is long for North and South - I lived in Mobile, so Metaire was the closest. I wasn't overly sad cos I got to go to my favorite place - Cafe du Monde and have some beignets! :P

As promised, here is my experience for the N400 citizenship interview. My U.S. citizen husband and I spent the night at the Days Inn, about a block from the USCIS office in New Orleans (Metaire). I was scheduled for 10:30 am and the letter said not to arrive any earlier than 30 minutes before your scheduled time.

We arrived at 10:10am, and went through security. There was no line. I put my interview letter in a slot through the door and was told to sit and wait. About 30 minutes later I was called in. When my husband stood up to walk in with me, the lady said very politely that she only needed me for the interview. So I was on my own!

We walked back to her office and she asked me to remain standing and raise my right hand - and swore to tell the truth.

First thing she asked was to see my green card, government issued ID (drivers license), and passports. She looked at them, and then started flipping through my file. When she saw my auto insurance card (with both our names on it), she asked who drove that car. I said my husband, and that I drove the Prius. At this she started asking me how I liked it and if it needed special gasoline (chit-chat). Then she looked at my employment history on my application and asked who I worked for or if I worked (I'm currently self-employed). So I explained how both my husband and I have the same profession (wildlife biologists) and what kind of work we do (she was very interested in it).

After the work question she asked if I've traveled outside of the country and for how long. I brought with me a detailed list of all my travels with dates. She kinda flipped through my passport pages, but didn't count the stamps or make sure the dates were the same on the application (I've read on VJ that some officers do this!). I did let her know that I had traveled once since I filed the application, and that trip was 10 days long. She also asked if I was a member of any organizations. I am a member of a LOT of conservation and animal advocacy organizations, so she asked me what the ASPCA and some others were.

She asked if my husband's been a US citizen, and I said yes, that I had his passport with me. But she didn't want to/need to see it. Then asked me a bunch of standard questions (have you filed your taxes, do you owe takes, are you a terrorist, have you been arrested, ect). So she printed out a few pages that were the civics/English test. First was the English test. Asked to write down a sentence she read out loud (something about Columbus Day). And then asked me to read a sentence (about Columbus Day).

Then she asked me some of the civics questions, maybe five or six of them (how many judges, declaration of independence, don't remember the others).

She said "it was quick and painless, right?" And printed out two sheets of papers and she checked two boxes on it and asked me to sign. She handed me the N-652 Naturalization interview results, which said "You passed the tests of English and U.S. history and government" and "A) Congratulations! Your application has been recommended for approval. At this time it appears that you have established your eligibility for naturalization. If final approval is granted, you will be notified when and where to report for the Oath Ceremony". She had me sign my two passport pictures.

So I was pretty happy, but then she said "Are you able to come to the oath ceremony on Feb 2, which is next Thursday?" I was SO HAPPY!!!! She gave me a letter with the date and time for the ceremony and other instructions for that day (bring the letter, green card, travel documents, etc). The back of the letter has 8 yes or no questions that must be uestions li the day of the oath (questions like, since the interview have you been arrested, ect).

She never asked to see additional documentation, although I was prepared with a bunch of papers/proof. I did a pretty good job of sending everything in my original application (3 years of taxes, joint savings account, credit cards, health and life insurance, car payments, car insurance -- all joint. Plus we've been married for over six years). She only made a comment about me JUST being eligible for naturalization -- on Jan 5th was my 3-year Green card anniversary.

The officer was very polite and friendly. She even apologized for calling me in a little later than the scheduled time. All in all it was a GREAT experience in the New Orleans office, we were there for one hour, including going through security and waiting to be called in.

White letter, with appointment time and date. It also lists things I should bring to the appointment (like 2 copies of a passport photo, although I already sent them)

Is your letter white or yellow? Everyone seems to be receiving a yellow letter. Mine is white.

Just checked my status on the USCIS website and I got the standard "scheduled for interview" information. Surprised to see it because I haven't received an email although I am signed up for notifications. Hopefully I am scheduled for an interview AFTER Jan 12, my 3 year anniversary. Won't be anxiously waiting for the mailman, though, unlike the AOS/EAD/K3 process!

Hopefully I did this right. I sent it on the 11/5 and have delivery confirmation for 11/7. I realized today that I sent it to the wrong Lockbox (AZ), when it should have been sent to Dallas. I hoping this won't be a problem and that they can forward it to the right office. If not, hopefully they will just reject it and sent it back, at which point I'd have to resend to Dallas. Oh well!

Hello Ocelittle,

I bet a lot of us can relate to your situation. We had to endure long separations and not being able to even start the visa journey because I had previously had a J1 visa (which required a two-year home country residency).

Anyways, we decided that the US governement wasnt going to decide this for us and we decided to get married anyways, even if I was still under the 2-year requirement. I was fortunate enough to have a US visitor's visa, so I was able to visit my husband in the states (my longest visit was 5 months), and he visited me as often as he could (usually up to 10 days, every other month or so). Obviously this was a blow to our finances, but it was a top priority for us. I even visited him in the states while our K3 process was ongoing.

Good luck to you. I know this is a tough situation and a hard decision.

That is exactly our point of view. Even though we aren't that over due in THEIR eyes, my husband sent letters to his congressmen and senator. His family is also going to write up. Even if we were approved tomorrow, we feel that it is our duty to say something because the treatment there is UNFAIR. He also exposes the cancellation of our K3, basically USCIS taking the liberty of making a family decision for us. Should we wait for USCIS to tell us how many children to have, where and when we should go on vacation? Sorry...I'm just fed up with this!

Hi,

I was in the same boat as you, with the difference that I had not discovered the wonderful wealth of information on VJ. I kept recieving contradictory information regarding this, so my husband and I waited a full year before applying for the I-130/I-129F. Had we applied as soon as we married, I'd be done with my HRR and in the states with him now.

I agree with the previous posts, the J1 visa doesn't prevent you submitting the I-130.

Good luck to you. I know how hard the two-year HRR is; if it wasn't because I was fortunate enough to get a visitor visa and visit my husband every once in a while, I don't know how we could have handled it.

Hey guys!! I am writing to you from beautiful McAllen, Texas. My POE was Houston Intl Airport, and it was a breeze! The agent was very nice. He asked "What brings you to the U.S."'; Me: "I'm attending a conference where I present the findings of my thesis"; Agent: "Oh, what was your thesis about?". While he asked this he was already wrting on my Customs form and typing on the keyboard. So I told him about my thesis, and he said it sounded interesting. He then asked me to place my index finger on the thingy, and then to look into the camera. Something he did that was interesting to me was that he scanned my visa, not my passport. I have an old passport that has the visa in it, he didn't do anything with the new passport. Anyways, he even chit-chatted with me about my thesis/field. And that was it, stamped for 3 months on B1 status. It took less than 5 minutes. I want to thank mikeandlani and mateo for the support. You are right, you just have to be confident and straightforward with them. Oh, and another thing, he didnt ask to see any documentation, not regarding employment or regarding the conference. But I am so happy I had those papers with me, I am sure they helped boost mty confidence. Sorry I didnt write early, things at the conference are crazy! So busy! And I'm so excited, my husband is flying in tonight, his plane should land in about 30 minutes! Yeah!!! smile.gif

Hey guys,
I'm in the same situation as Brian&mel. I am travelling to Texas on Monday for a conference (expenses paid by an American organization). I have a return ticket for 8 days.

I have travelled before to the states while married to USC, but we hadn't applied for the I130/I129F yet, so I was never nervous. I know the precautions to take, and establish that I am returning right away (although, if I can get away with it, stay two extra weeks with my husband, but that would be icing on the cake)

My concern is this: When I reach the POE and they scan my passport, fingerprints, ect. will it show on their computer system that I've applied for immigration I130/I129F? Will the only way for them to know is if I volunteer the information? Yes, it is true I am married to a USC and plan to immigrate, but this trip is BUISNESS/ACADEMIC, and technically nothing to do with even seeing my husband. What do you guys think? Should I volunteer this info? Or only show my evidence of returning if asked? I am very nervous about being returned at the POE, it would be humiliating because these people are paying my way to attend (I am presenting a paper on my research)...and these are the people I hope to be working with once I am able to live and work in the states. Any input would be appreciated! Thanks!

I've come to believe it really isn't much help. Everytime my husband called they said it wasn't assigned to an ajucator yet. Last time he called they were RUDE to him and said it has been assigned, but no approval or RFE since then and it's been a week. I don't know how long it's suppose to take once it's in the hands of an adjucating officer.

I am very skeptical to what they say on the RFE lines...just take VJer Mateo as an example. He called and was told that he wasn't even asigned an adjuactor yet; and then that evening he was approved! I think they have no idea what they are talking about most of the time.

They also always say things like 'call in 2 weeks', 'don't call for another month', 'your case should be approved soon', 'be patient' (that one pisses me off the most), blah, blah, blah.

Sorry, just so tired of all of this. Stupid K3 cancellation really screwed us over...If we'd only gone for I130 we probably would have been approved by now.

I would be very happy if there were any September approvals for IR-1/CR-1/K3, but it would also make me very confused, irritated and upset. Sorry, I've just been waiting for so long to be reunited with my husband and we keep encountring obstacles. And I know my case isn't as complicated as many folks here on VJ. There are folks from May still waiting! #######!!??? I would really need an explanation because I wouldn't understand.

I truely am happy for all the VSC folks, it seems this service center is working faster than CSC, I wonder if they are recieving less applications, or are just more efficient?

Hello,

the most important thing is to check to see if her J1 visa is subject to the 212[e]: 2-year home residency requirement.

If she is, she will need to apply for a waiver if she is elegible for it. Marriage to USC isn't grounds to waive the 2yr-requirement.
