Cool. Just so I understand...

NOA1 and NOA2 go to my USC fiancee petitioner. Then the approved petition goes to NVC who collect payment and give me a case number. Then it's forwarded to the Sydney consulate where I go for my interview?

Who (petitioner or beneficiary) actually gets the NOA1 in the mail? USCIS says:

"USCIS will then send the official receipt notice, Form I-797C, Notice of Action, to the person seeking the benefit or the person's representative, as appropriate, via the U.S. Postal Service."

When one is a beneficiary, does this make them the person seeking the benefit or is it the petitioner? I'm the one getting the visa, not my USC fiancee...

Apologies if this is covered some place else, I just wanted to be clear.

No problems as long as there is no overstay. You will have to meet entry requirements like everyone else. Ties back home, that you intend to leave, basically no intent to immigrate..etc.....
Someone will definitely reply with how to withdraw the application properly..

Awesome. Yeah I definitely have those ties back home. I have a letter from HR at work saying I'm expected to report back to work at a specific date, and a copy of the lease on the house I rent :)

What you are pointing out is clearly some benefits. If we had it all to do again and knowing what I know now.... We would have done CR1.
In my opinion, it is more efficient and cheaper. Not too mention you can work and travel after you get here instead of waiting for adjustment of status from K1 after marriage.
The only drawback I see is that you lose the money for I-129F petition and a little more time.
I do not know how to withdraw the I-129F. You may want to inquire about how to do that correctly should you choose this route.

Yeah, I also don't know how to withdraw the petition but I will find out. It sucks to lose that money but it's not such a big deal. I have two short trips to the US planned before the end of the year. As long as I don't overstay, and can prove to USCIS and DOS that I did indeed leave after we get married in October, there shouldn't be any problems right?

Hi everyone.

We've submitted an I-129F and got the NOA1 not long after... But once I get to the US I'm not going to be able to work immediately obviously.

My fiancee and I don't want to wait to get married so we're thinking of getting legally married in October.

I work for a US-based company in Australia that is willing to transfer me to the US once I have my visa. So to us it makes sense to get married, then submit I-130 and follow the IR-1/CR-1 path so that I enter as a permanent resident and have work rights straight away.

I know we're still up for a wait, but could anyone provide feedback? Like positives and negatives of doing this?

i doubt such a list would be available to the public, but it would likely exist. otherwise how would they know who to put in AP and who not? countries with high immigration and low GDP and regional instability would be one focus. areas linked to terrorism. whether or not the state is an ally of the united states. whether the intending immigrant has multiple citizenships.

 

there's probably a whole lot of reasons, not all of which would be written in concrete as things change :)

What airline are you flying? If you booked connecting flight on the same ticket you will make it, also if its an airline like QANTAS or AirNZ they have fast track through customs passes you can get as you leave the flight and you go to the express customs lane and should be through in 30 minutes.

 

Flying with Qantas, and yep, booked all my sectors in the same ticket :)

 

So how do you go about getting the pass to fast-track through Customs? The second last time I arrived in LAX it took me three hours to get from the gate door to passport control. Really hope it doesnt happen this time.

I'm really sorry to hear that happened. That's the kind of nightmare we all fear. What I love about Ireland is the US authorities do the visa check and open the packet in Ireland so that when you get to the US you don't have to show anyone a passport or visa because you already entered the US in Ireland. They should do that in more countries and then you won't have to worry about the visa and packet your carrying until you get there. 

 

that sounds so much easier! i really hope 3.5hrs at LAX is enough for me to get through... i arrive at 6.30am (really busy time for arrivals from asia pacific. last time it took 3hrs to get to the customs checkpoint from the plane...).

 

hope the OPs situation is able to be resolved as soon as possible!

At first I assumed that our packet 3 didnt ask for it either, but it actually asked for it in a different way. Best advice I can give is to either email or call your embassy and ask them. They will be able to give you the most secure answer.

I have an artificial hip replacement and I set off the metal detector machines every time I travel via the airport but I have never been asked for a medical certificate.  I am always processed physically with the pat down and the hand held metal detector unless the airport has one of the newer x-ray machines.

Well we used a lawyer also. everything seems simple after you get your noa2, but sometimes its better to let someone else do it so you don't make any mistakes. Also Mr Phair was 100% money back if any problem. he had me send in all our info and looked it over. and if he thought we wouldn't be approved he wouldn't accepted to do our application for k-1 visa. i spent 400.00 and that includes aos help also when that comes. I have a few questions concerning the Affidavit of Support form:

 

 

I currently do not earn enough money to meet the "above poverty guidelines" so I will be needing a co-sponser for this form.  Do I fill out the form and another person and send both?  Or is it only necessary to send the form of the Co-sponsor (my mom in this case)?  

 

Also, is it necessary to take the original form the day of the interview or would a scanned copy work as well?

Yesterday I received a notice that my approved petition was sent to the NVC to be processed.  I believe I have seen post that I should call the NVC or DOS to get the new case number.  Is this correct?  And would I then know what my fianceé will need for the interview?

I would like to thank you ahead of time for reading this more lengthy message and any help/advice you may provide me with.  I am grateful for this community of people who have been very helpful through this process.

 

As my I-129f petition has arrived in Bogotá, Colombia I am now trying to figure out the Affidavit of Support.  This will be the most difficult I believe up until this point.  Please let me explain my situation and any help is greatly appreciated.

 

 

I currently do not hit the minimun financial requirements to support my Fianceé when she arrives here.  Last year, I spent 11 months in Colombia serving as a missionary.  I made only 11,000 dollars.  And now I am in a transition period and am currently unemployed.  Though I should be employed within the next two weeks.  So should I still attach a w-2 form for last years work even though I will have a new job this year?  How do I declare my new job for this year?  Should I record both?  Can I add an attached statement explaining everything?

 

 

Also, I realize I will need a Co-sponsor for my fianceé.  My mother has agreed to be that.  She currently makes plenty of money receiving both a salary and her retirement funds.  Her job is temporary.  However, she receives enough monthly in order to meet  the poverty guidelines.  Should she just report her retirement salary?  Or that and the job she currently has?  Also, she has plenty of assets and money saved in the bank. 

 

Also, is it necessary to attach both a w-2 form and a letter from current employee?  Or just one or the other?

 

 

I know I have asked a lot of questions and I will probably think of more.  Thanks a lot for all your help!  I'll be checking this post if there are more questions!

Hello everyone,

 

 

Do all documents that my fianceé is required to take to the embassy in Bogotá the day of the interview need to be translated to English?  This would be things like police certificates, birth certificate etc.  

 

 

Also, as far as evidence of the relationship, we have harldy done any communicating via email or snail mail but almost always we speak by way of skype or facetime.  Is there a good way to show proof of facetime and skype conversations?  Of course apart from this we have other evidences such as ring, ring receipt, many pictures together etc.

My fianceé has now finally received her K-1 visa from Colombia and we are thrilled.  We have tickets purchased for her to come through Miami in May.  I will be with her as well.  

 

Is there anything she should know when going through customs?  What kind of questions may they ask her?  Should there be any problems whatsoever?

Hello everyone,

So after a long time of waiting my Fiancee was finally ready to travel back to me to the US after getting her K-1 visa. As we were in the airport today they told us that she cannot travel unless she has the sealed manilla envelope THAT THEY SHOULD HAVE GIVEN HER at the embassy the day of the interview


They only gave her a few medical documents including a lost of the vaccinations and lung X-Rays. The day of the interview my fiancee took the manilla folder that they told her not to open and she gave it to the person working at the consul. They DID NOT return to her the envelope.

Has this happened to anyone else?? What can we do? Is it absolutely necessary to have that envelope when entering?

We are currently in Bogota since we missed all our flights today. Please let me know what we should do! Thanks!
