K-1 Fiance(e) Visa Process & ProceduresPolice check needed from a third country?

I hope someone can help me with this. My finance is a Vietnamese citizen.  She spent 6 years living and working in Japan when she was younger.  She has read on a Vietnamese forum site that she will need, at the interview,  a police check from Japan stating that she had not been charged with a crime while in Japan.  Problem is that the Japanese authorities will not issue this unless requested  directly by the American Consulate.  When requested, it will take approximately two months.  So, going to the interview and them finding out that the Japanese Police check will be asked for is quite discouraging.  Does anyone know anything about this or have advice.  Thanks.

My Finance in Vietnam just received first packet of forms to send in so as to get her interview scheduled.  One big concern is the Police check. Vietnam check is not a problem but she lived in japan for 4 years.  I sent the consulate an Email and asked,

  "My Fiance lived in Japan for 4 years. She has gone to the Japanese Embassy for the police check but was told the US Embassy has to order it and it will take 2 months after ordering. Can you expedite it by ordering it now so she can have it for the interview? "

 

 

The response form the consulate was,  "

"On the apppointment date, the interviewing officer will review the case and give further guidance regarding how to obtain the Japanese Police Record."

 

So we have to add another 2 months to what will be our  11 month wait?   This is ridiculous and very frustrating.   Am I missing something?

Harpa - whilst I understand you're saying the right to work and love etc is done through the AoS process... What I'm talking about with work is not necessarily the case as far as I can see. If I am working remotely for a UK company, paying UK taxes and getting paid in GBP, but the remote location is in the US... Is that legal?

Carla - thank you for the information. So when your hubby gave you his pay stubs etc, was that on request of the embassy or just to be safe? How well was that received in interview? Did you have to submit a new affidavit?

Hi all,

 

We've been lingering around here for a while, and doing what I suspect many people do when going through this process - checking the timelines religiously!

 

It's now come to the point where we have a bunch of questions prior to the interview stage, and just thought we'd ask here to see if anyone can help or guide in the right direction...

 

First question is regarding the affidavit of support. This process obviously takes quite a while to go through... if the petitioner changes job during the process, will this drastically affect the application outcome? Same question if it's involuntary (i.e. redundancy).

 

Second question is to do with marriage location. We are going through the K1 process to be together and to get married, but is it possible to get married outside of the US on the K1?

 

Third question - once married, are we then able to take our honeymoon abroad? We understand that there is a certain period where the applicant will be "land-locked", but does this happen once the AoS has been filed for? Would we need to file for parole? If so, how do we do this prior to AoS?

 

Fourth question is somewhat related to the first question actually... once we are finally together and married, in this example let's say we haven't filed for AoS yet, will we be able to move state? The reason it's somewhat linked to question 1 is it will then subsequently mean that the petitioner will have to change job.

 

Fifth and final question is to do with the applicant working prior to EAD. Is it possible, if the job is working remotely, to work on a "secondment" type of basis for the UK company, getting paid into a UK bank account, paying UK tax, etc and transferring funds (subject to normal fees and everything) to a US bank account?

 

Sorry to bombard everyone here in one big post/thread, I just thought it would be easier to consolidate the answers idea9dv.gif

I have my I-94 in my front right now, it is the small paper from the plane that u need to fill up before you go through the immigration.. they attached that to your passport nxt to your visa..

 

The bit of paper I filled out was taken off me as I went through immigration...

Hi everyone,

 

I'm sort of panicking a bit... I've just looked up some information that I need for drivers license and for AOS etc... and the I-94 is something that appears everywhere, but it doesn't look like I have one? When I came through POE, I handed over my sealed envelope, gave my fingerprints, handed in my customs form, have the photo taken with the webcam-looking thing, and then the officer stamped my passport and wrote in it. The whole process took around 5 minutes...

 

Should I have received an I-94? Does my stamped passport with the VISA inside count as the same thing? As far as I can tell, the I-94 is to state admittance with an expiry date, and that is evident on the stamp in my passport.

 

Any help would be appreciated!

Hey all!

This forum is amazing I got to say. Found it two days ago and my fiance and I have been in the process of a K-1 visa for many months. Our petition has been severely delayed because the VSC had too many applications. About 8 months ago we filed it now and we still haven't gotten our NOA2. VSC said they sent it to TSC a couple of weeks ago but we haven't heard anything since.

1. Now to my question. We thought the whole process would be done 8 months after we filed it so I got a plane ticket to America that leaves in a week. I'm going to go and visit her for 2 months while waiting for the NOA2 and the interview. I was just wondering if it OK to sign and send the checklist that comes with package 3 from America or do you have to sign it in your own country?
Obviously I'm going back to Sweden to have the interview when that is scheduled. Already got other documents ready and done the medical as well (it wasn't a problem doing it before you got package 3 apperently) so I can come home and be ready for the interview as soon as possible.




 

2. Thanks for all the tips and advice on what to bring to prove your ties to the home country. I'll bring bankstatement, paychecks, statement from employer saying that they are waiting me back a certain date, and a return ticket. Do you guys think that's enough? And with the document from my employer, what should they write?

I went to the US once when me and my fiance were dating and now when we were waiting for the fiance petition to be approved.

First time I went in was in December last year. The conversation went something along the lines of this:

Officer: Hello, what is the purpose of your trip to the US?
Me: I'm visiting my girlfriend's family.




Officer: Ok, how many bags do you have with you?
Me: Three bags.

Officer: THREE BAGS?! Why do you have three bags with you?
Me: Just left Australia, I was studying there for two years and I won't fly back there but I will fly back to Sweden.

Officer: Do you got a flight ticket?
Me: Yes (showing the ticket).

Officer: Ok, looks good. Welcome to America.

 

I was very naive when I came the first time. I did not know they would even question me at customs and I had no proof of ties to Sweden (my home country) because I hadn't been there for over a year. I also had three bags with me and flew in on a one way ticket from Australia. Not the smartest, but it went well.

Second time I flew in was about a month ago. This time we were engaged and I had read up on some more stuff about customs and questions. Partly from this thread. Brought several ties that proved I would go back to Sweden after my trip.
This time they asked me questions at customs again. Something like this:

Officer: Hello, what is the purpose of your visit here in the US?
Me: I'm visiting my fiance.
Officer: Ok, how long have you been engaged?
Me: 8 months.







Officer: Is she a US citizen?
Me: Yes.

Officer: Ok, how long are you staying in America?
Me: Two months.
Officer: Two months? That's a long time. How many bags do you got with you?
Me: One.


Officer: Just one? What are you working with in Sweden?
Me: I'm a psychiatric aide.

Officer: And they just let you go on a holiday for two months?
Me: Yes. I'm working part time right now, worked full time until a few weeks ago.

Officer: How many bags do you got with you?
Me: One. I got a return ticket and other proof of ties if you want to see them.
Officer: I will let you follow this man and we will talk some more to you. (Leading me to a special room where I waited for about 10 mins before getting called into an office.)

This time another officer: Hello Mr.
Me: Hello sir.




Officer: Why are you visiting the US?
Me: I'm visiting my fiance.

Officer: Ok, how many bags do you got with you?
Me: One.

Officer: Ok. How did you and your fiance meet?

Me: In Australia, we were both studying over there.

Officer: You won't get married during this visit right?
Me: No, not this visit.
Officer: When are you guys getting married?
Me: When the fiance visa gets approved. We applied for one in December last year.
Officer: Ok, let me see the papers. (I'm showing him them)
Officer: So what's the hold up? Why hasn't the petition gotten approved yet?
Me: If you could tell me. I don't know. We have waited for over 8 months without getting any information.





Officer: Ok, let me see what's going on with it.

-- 10 min later --

Officer: Looks like it is still pending. So what are you going to do while you are in the states? I mean, your fiance will be working, right? What will you do during the days? (This question I was completely unprepared for.)
Me: Eh. I will study. I'm doing online study right now. (Luckily I had printed out my acceptance letter to the degree I'm studying online.)
Officer: Ok. What other documents do you got with you.

Me: Letter from employer, pay stubs, travel insurance during this time, flight ticket back, proof of address, resent bills, etc.

Officer: Ok, let me see. (Skimming the papers really fast).

Ok. You're ok. You can be here for three months now, but if you come back a few weeks after you get back to Sweden without the visa I think you will have a hard time getting approved for another three months. Welcome to America. (Stamping my passport and showing me out.)

All in all, it is not too hard to visit and the majority of people get through without too much of a hassle. It gets harder if you visit for a long time, have many bags with you and don't have proofs of ties.

I think my husband is going to bring his coffee cup. because we bought it togeather when i was there, And he wont let any family member use it. I told him to pack his best cloths. I have so much for him here.
He loves american and Mexican food so i'm not gona worry about the recipes. But I do have his moms chicken recipe. I really dont like most the food there so i wont cook it.
I think he will pack some of his art books. They will be handy when he learns to tattoo with me. (he is a artist)

Well I've told my story several times but to sum up the major stuff that happened:

People just have to learn to let go and move on. I have but my family hasn't.



Thank goodness im not the only "crazy person" around here. I was beginning to feel isolated. My family did the same thing and treated me terribly at first and called the Sherrifs Dept too. My mom and my daughters started coming around and are actually looking forward to his arrival, on the other hand, my father and brother and rest of my extended family hasnt spoke to me in over a year . O well Im not living my life to plz them
