"7a just means that her visa was not the proper one (because of the working, and 'intent' to marry) it just means she was ineligible. At this point, she is not charged with Misrepresentation. . .and hopefully the consulate won't try to add it. I would still do some attorney talking in case they think you can go ahead and file the 212 when you start the process. . ."

Much of what I have to add would repeat some of the guidnace offered already, but I will note that if her original return ticket was for April 22, then CBP was correct in noting the I-94 to expire after that date. Even though a visa is valid for a period of a year, it doesn't mean the period of authorised stay lasts a year too. The company should enquire with the individual or agent that changed her ticket to return to Japan on June 26, to see why that issue was not discovered before she was on her way back to the US again. I am 99.9% sure no extension was filed. They kept telling her different dates on when to return and all of them were after 4/22. They had no idea and the lawyer indicated that he had requested I-94 info from the company and they never sent it. They just let the 4/22 ticket lapse and she bought a new roundtrip ticket for 6/26 to 7/6. There was no return ticket to Japan purchased and she wondered if that would be a problem, but no one seemed concerned.

I understand what you mean. The K1 was not meant to circumvent other laws, we really want to get married. I know everyone is a stickler for intent, but I don't think that intent to maintain your job AND get married is wrong. This is a broad statement, I know, but we want both. If we have to go K1 now, then we are doing it on our own. She will likely not have a job there anyway, so we are definitely doing it to be together. My lifestyle will change dramatically for a while and it is not something anyone does for fun I'm sure.

Alex broke his hand playing soccer, he went down on his hand and his face. Busted his lip and broke his hand in 2 places. He kept telling me the swelling would go down and that he did not think it was broken. So we did not go to the Doctor for about 10 days. It is doing fine now, hopefully when he gets the cast off everything will be healed well.

Finally heard from Social Security. They said he should receive his card in about 2 weeks. So he should have his cast off and be ready to get to work. That is if his hand is not stiff from being in the cast.

We really have been so busy and July is not looking any better. U/S on the 10th, cast off on the 11th, we have to go to Indy to get his passport renewed before the interview on the 26th. And these are the things we already know about not the ones that may just pop up.

Hope everyone has a great 4th of July holiday. Party hard, but responsibly. :dance: :dance:
That means drink a few for the pregnant woman, but stay where you drink----just sleep on someone's sofa.

Sorry that I have not been out here much either. Seems like life just gets busier, can't imagine what it will be like when we add the new baby to the mix. We are going to Florida to visit with my mom, we are leaving tomorrow morning and I will be back in the office on the 5th. Just wanted to try to get some more time with them before they leave for Paraguay for a year. They leave on August 1st, they have decided to become missionaries....at least for a year, then they will be back.

Alex broke a few bones in his right hand (lucky for him he is ambidextrous). He got a cast on his hand and will not be able to enjoy the beach as much as normal. I bought his a plastic cover for it, so that he can take showers without getting it wet. We are going to take it when we go to the beach to keep out the sand and maybe let him get in the ocean just a bit. He gets it taken off on the 11th.

Everything else is going ok. We go for the second u/s on the 10th, still not going to find out the sex of the baby. Hope everyone else is doing ok.

Charity: I am still rooting for you and Javier. I am sure that with lots of practice you guys will be expecting soon. :luv:

Marta, I am so worried that I will say the wrong thing here. First off I do not want you to get hurt one way or the other. Please consider what you have gone through (and Joshua) before you make any decision. I would love for you to work this out, that would be the ultimate. But remember that not all relationships work and some people and their families are better off when it does not work. Second, if you do decide to try to make this work, you should take Charity's advise and get some professional counseling.

Whatever choice you make, please make sure and do it for both you and Joshua. Right now he is the most important part of your life. I will keep you in my thoughts and prayers.

Thanks guys. I promise to post photos as soon as I can after the birth. Still a long way off. We did not want to find out the sex of the baby, but it was funny when she was scanning that area I was looking for the hotdog/hotdog bun, but I did not see anything. We are still working on the name thing. Not sure on either yet.


Lets see, morning sickness is different for all people. My solution was some type of carb. I would only have to have one, but if I felt sick I would eat one lays potato chip. That actually calmed by stomach. The other thing---very important-- is do not let her get too hungry. If it is time to eat and everyone is running around and she gets too hungry the next minute she will be sick. So if you are planning to go out to eat, make sure that you have a little snack for her in case you have a wait at the restaurant. Take some grapes or crackers with you.

The "Baby" is doing great. I had the ultrasound today, they said everything looks good, but they want a repeat in 3 weeks so they can better make out the heart and kidney's.

Sorry I have not posted out here recently----but just so you know I have not forgotten about you. Sometimes I only have time to get out here and lurk. :blush:

Things are going ok. I am over being sick and I am scheduled to get the ultrasound to check everything on the 14th. We are not going to find out if it is a boy or girl, we want to be surprised. Charity already mentioned by Alex is scheduled for his AOS interview on July 26th, so we are getting the paperwork ready for that. I don't think it will be hard to prove it is a valid marriage when we have Emily and another on the way.

Charity: I was so glad to talk to you and hear that they were able to open your tubes. Hopefully with my advise you will be expecting in no time. :thumbs:

Elvia: Glad things are going well for you since your move. Hope you find a job soon, so that you won't go crazy. :wacko:

Marta: Since I am #3 responding to your message then I can tell you that I agree with both Melissa and Charity. You are doing a wonderful job with Joshua, a judge would be out of their mind to give custody to his father. And while I believe that we should be there for our husbands at all times, it is a differnt kind of "there", not the kind that makes you scrub out the bathroom or get up to cook for them at 2am. You and Joshua deserve better. Joshua is being affected by this, so yes you getting out of this situation is probably the best thing for both of you.
No way will any daughter of mine end up being a slave and if I have a boy he will be the kind of boy that you want your daughters to marry. I don't want my son raised like Alex was, thinking his mother had to do everything for him. I believe in raising children to respect, but also not to be disrespected. I can not believe that he has been treating you that way. I hope that he does not find a way to adjust status himself. Can you contact USCIS to get yourself and your family removed as sponsors from his applications?

Getting a butt to work sounds great, I have a butt at home that we need to get to work. 10 months of vacation----what about 2+ years. I know he is ready, and I hope that helps us out with his attitude. I wish that he was the one that was pregnant. For some reason he is just not understanding of me being pregnant. He will sleep all day long if he is not watching Emily, then when I get home he is ready to run. He has to go play futbol or visit his cousins. What the hell they have to talk about for 6-8 hours is beyond me. But he comes (not all the time) dragging his butt home at 3 or 4 in the morning. Waking me up and wanting to do the laundry. Or picking an argument and he ends up waking up Emily. :crying: I ask him how he would feel if I woke him in the middle of the night for something like that when he is drop dead tired. Sometimes I just want to make all his family go away, is that bad of me? :(

Move some of your bills to the first part of the month or the last of the month so everything is not due at the same time. Maybe re-arranging things will help you guys get through this rough patch. CONGRATS BENITA!! I was wondering about the AOS and EAD and how long that stuff usually takes. So when he gets his card he can work right away? Does he already have a social? (sorry for being clueless).

Does that mean your interview will come up soon? (there is an interview for the immigrant visa, right?)

When we get the EAD we will go to the SSA to turn in the paperwork to get his SSN, then he can work. When we submitted the AOS and EAD applications we were told the EAD takes between 30-90 days. The AOS takes between 120-180 days. The only question I have is our district office is New Orleans and I was wondering if they were still recovering from the hurricane. I guess they are doing OK, since we have been approved for the EAD within their projected timeframe.
There is a interview for the AOS (this is the adjustment from K-3 to permanent residency; aka green card), you have to provide all kinds of supporting evidence of valid relationship. I would think Emily and this baby would be enough supporting evidence that this is definitely a valid marriage. :D

Melissa: DO NOT GIVE UP. I am almost positive that the permission from the Sec. de Gob only takes about 2-3 days to grant. Yes - you have to physically be there. They were ready to do everything, but then Alex did not have an ID. Your Birth certificate and apostile should only take about a week, then get them translated should be a piece of cake. Have Javier check on the permiso and find out exactly what is needed and the time frame.

Melissa: CONGRATULATIONS on setting the date. I know you will get it all figured out in time. You can order a certified copy of your birth certificate from the vital records department of the state in which you were born. They are the ones that do the apostile, so do both at the same time. Here is the link if you were born in Maryland. Maryland Vital Statistics Make sure that you get the apostile translated into spanish. Do you already have a passport? You will need to obtain permission from the "Secretaria de Gobernacion - Oficina de Migracion" where for a fee of around US$200 you'll need to acquire a permit to marry a Mexican national. The document is known as "Permiso para contraer matrimonio con un nacional". I have attached a link to help you. This is what Alex & I were going to do, but he had not been in Mexico for so long that he did not have any valid Mexican ID's.

Charity: I know a couple that would agree that stress is a major factor. They tried for almost 5 years to get pregnant, they used all types of fertility treatments (invitro, hormone therapy, etc...) They had finally decided they would complete the move to their new house and then adopt. Right after they moved in they found out they were expecting. And in November they just added #2 to their family. Here are their 2 miracles (Evan & Adam). I know after my miscarriage we were in a stressful situation and it took getting out of that (his girl cousin was living with us), for us to get pregnant with Emily. With this baby, it took no time at all, but that may have been because when I went to CDJ to get him we knew he was getting his visa and that sure as heck reduced our stress.

Forgot to mention that I had a Dr appointment this morning with Ultrasound. Baby is fine, heartbeat was 146, was squirming around. Got pictures, even one of a foot. I go back on May 31st.

Melissa: I am so sorry about the denial. Can he wait out the ban and then reapply? I can imagine a whole lot less appealing places to live than Mexico. Even if I had to live where Alex is from I could make it work to be with him. So whatever you decide I will be rooting for you. By the way round up to the next dollar????


Charity: I am sorry your family dr could not tell you anything. Just plot everything you can for the specialist and keep your fingers crossed that they can let you know what is going on. I am also glad that Jaime arrived safely. Is he going to stay with his dad for right now?

I did not understand everything. I didn't know that the decision to get married in Mexico meant that you would live in Mexico and abandon the visa process. :(

Melissa: Not sure what they can accomplish in one day, and I am not sure if I am for it anyway. But if it helps with immigration reform then I hope that what these people chose to do does help. I do hope this does not hurt anyone and I wish the students would stay in school so they do not get hurt (even if it is not physical hurting, I am sure there will be some rude comments made). Didn't you say that you saw the movie "A day without Mexicans", I know it was a comedy, but what was the outcome of them being missing?
