I'm sorry, but very little can be done. Take a look at the link below, once the alien has been deem inadmissible and expedited removal has been ordered, it is done so without a right to a hearing or an appeal, this includes administrative appeals.

It's section 302 - it also explains the purpose of the waiver as well.

I know this is a long shot, but I was talking with my fiancee tonight about details of her detainment in Dallas customs. Apparently she talked with the supervisor for a little while about her situation and he, having a Japanese wife himself, seemed sympathetic to her troubles. He actually consoled her a bit and told her that things would be ok and she could get back in with a fiancee visa, etc. Granted, he did all this and still approved a 5-year ban, but I don't know if they have any flexibility on that.

From what I understand, the waiver process is one way to remove the ban, but there is also the unlikely way of appealing to the supervisor at the POE. Is this even worth a try? What would be the drawbacks to attempting it? Any thoughts?

"I would call the DOS once a week or so. In my experience DOS has more information about cases (atleast my case they did). USCIS will sometimes just give scripted answers."

DOS does not seem to have any info since this is processing at the USCIS field office. Last info they had was that it was sent to Seoul from Tokyo and that was over a month ago. They have always been helpful when I called though, it just seems the field office does not have any tracking system which they update.

"I called USCIS every day for 1 month and noone told me to stop calling them. I kept calling until one day I was so mad that I kept asking to be tranferred to a supervisor. I have no idea how high I got but I spoke to 4 persons and finally got some helpful answer."

My fear was, since I assume Seoul Field Office is fairly small (one person i talked to knew about my case before I even said my name once I said '212 and K1'), that I would piss them off if I called too much. That is why I was trying to gauge from you guys what your experience has been.

"Why did you file the 212 in Seoul? If you are filing a lone 212, it is supposed to be filed in the US where the removal occurred. A 212 is filed at the consulate if it is in conjunction with a 601 waiver."

Seoul is processing because it is a 212 with a K1. This is a special combination that processes similar to a 601 whereas a standalone 212 would be sent back to the US.
The processing times, from the documentation I found about 601 processing in Jan'09 (http://www.uscis.gov...der_27Jan09.pdf) seemed to indicate that processing times were about 1-2 months in Seoul. In fact, I called after two weeks and they had already looked at it and said it should be about a week before they had a decision. This was apparently before they realized they needed some paperwork from the US. I don't know what they need and the lady did not know how long it would take.

Why are you calling the USCIS? If the case is in Seoul it is not there issue but belongs to the DOS


How do you mean? Seoul is the USCIS field office that adjudicates our case from Japan.

I am just wondering if anyone has called USCIS frequently and either found that they were consistently helpful or if they eventually were like 'stop calling us'?

Our 212+K1 is processing in Seoul and I've called twice so far (after two weeks each time). So far they have been helpful. The first time I called they said they should have a decision in a week, so I waited and then called two weeks later and now they say they are waiting for paperwork from the US. I have no idea what paperwork or how long it takes for an office in the US to mail it. Things seem to process quickly in Seoul, but I am disappointed to hear that they are waiting on anything from the US. I hope I am wrong in assuming anything from the US is slower than it should be....

Well, my main question is about calling USCIS. I want to call in a week to see what's up, but I am worried they will get annoyed. I am really trying to be patient, but it is getting so hard. Any comments?

My fiancee and I were not sure if we needed an I-601 and I-212 or just an I-212, but we knew we needed something for an overstayed B1 visa, so we started the I-129F and I-601/212 at the same time. That said, we did not file the I-601/212 until after the I-129F interview, so really you need to start on the I-129F now and then start preparing the waiver. You will have several months before you need the waiver. First thing I'd recommend though is to call a lawyer or two or three and have a consultation. They will go through the whole case and give you a great starting point and path. Consultations range from a couple hundred dollars to free, so try a few. Each lawyer I called had a slightly different view of the case, so it is important to check with a few.

As for proving the hardship, a lawyer is a great resource for that also. Our waiver was much more detailed than I could have done without A LOT of legal research. They can help you find ways to present the waiver, but...of course...it's not cheap. This website and http://immigrate2us....forum/forum.php are great resources for waivers, it just takes time and effort to prepare yourself.

I just called USCIS in Seoul about the status of our 212/I-129F from Japan and they informed me that they are still waiting on an 'A File' from the US before they can make their decision. They have been waiting on this paperwork for over a month and I am curious what it is. Does anyone know? Who can I call in the US to check on it? They said they would have a decision a month ago, but now they are held up by this paperwork, so any info is welcome.

My fiance and I have been waiting for a little over two months for Seoul to receive an 'A-File' from the US to complete the I-212 waiver we filed. We might be thinking too much, but I was wondering if someone can have two A-file Numbers? Looking at the NOA2 I see a number Axxx xxx xxx. I assumed this would be the only number. Then we looked at her passport and on the expedited removal stamp there is another Axx xxx xxx number written, but it is different. Is that also an A-file number? Could that be a problem?

Yes, I am trying to keep things in perspective, but I think anyone in the midst of this process knows how frustrating it can be to feel that things are finally moving forward and then find that small things have slowed it all down again. My main point was if Tokyo was incorrect or missed something in their statements about the I-129F and medical. Thanks for the information regarding that. We are sending the letter tomorrow and will work again on Monday to get things resolved. The waiver was approved and we are very thankful, but, of course, I miss her so so much.

I know the system is what it is, but I still see so many things that could improve it and make life better for a lot of people. I'm not saying that I specifically deserve better, but I think we all do.

I am a little upset right now, but I will try to ask this without inserting too much of my own disappointment with the visa system. Firstly, I have found out today that our waiver approval from Seoul has apparently been lost on its way to Tokyo. My fiance has received her letter saying it was approved, but Tokyo has no such information. It has been almost two weeks since it was mailed. It costs $25 to call and check the status in Tokyo (even though Seoul just answers the phone for free) and they still don't offer to just call Seoul and see what is going on.

I also find out that: (A.) My fiance's I-129F is expired as of March 1 and she will need to send a signed letter stating that she still wishes to continue the I-129F process in order to extend the petition and (B.) that once a visa is approved it will only be valid until June 11th since her interview was complete January 11th and the medical exam is only good for 6 months. If anything gets messed up and she has no visa before June 11th, she'll have to go back to Osaka and get another exam and then submit it.

Why aren't there procedures in place to extend these 'rules' when a waiver is processing?? They know that it won't be approved before March 1. Why isn't a courtesy notification sent to tell us 'Just wanted to let you know the I-129F expired, please send a letter to extend the request."?

Maybe Tokyo is wrong about these two items?

I find it amazing that some systems of government (i.e. taxes) are so efficient and electronic, and this process that so deeply affects people's lives is so archaic. Sorry, just disappointed right now even though I still am ultimately glad we are upset about an 'approved waiver' :)

I live here in Louisville. And as for a big Asian community for Thai people I not so sure. Though there are several Thai resturants run by families. They may be able help you out. There is the "Crane House" on 4th St. I believe, that may have information for you. I do need to double check on the name and address.

One good place to check is at Fort Knox and Radcliff because of the base you will have many wives from all over.

Kentucky biggest asian groug is Japanese due to Toyota ans spin off auto company suppliers. Other groups are quite smaller. I'm a widower and my first wife was Japanese and she found a few ladies to talk to due too her job.

Charity: The ONLY way that you should agree, is if the situation is temporary? Why is Javier's dad going back so soon. I thought they only returned in December, sort of like a migration thing. Go down for the holidays and come back in Jan or Feb. So here are some obvious reasons.
#1 - "THE ONE WE DON'T WANT TO MENTION"
#2 - this will greatly affect your relationship with Javier
#3 - problem is if you dispute toooo much this will also affect your relationship with Javier
#4 - you guys are trying to have a baby, this is not the best situation
#5 - you are not Jaime's mother and belive me he will soon forget this and have you doing everything for him.
#6 - financially it will burden you even though he may end up getting work, you buy extra food, do laundry, etc...

Good Morning Everyone.

Alex had his fingerprinting for the Employment Authorization Card and Adjustment of Status this morning. Then he had his stitches cut out. Now I am back at work, sucks. Especially considering the night we had.

I am not everyone's mother and I did not sign up to be everyone's mother. Yet, everytime someone is sick or needs something read they come to me. I am getting fed up with it. I just want to be left alone. Everytime this happens then there becomes issues with Alex and I. I just know if we were left alone none of these problems would happen.

So here is the story. Last night Alex's brother gets off work, he does not have to work today, so he is going to come stay the night with us. Alex went to pick him up and when they got back Emily and I were in bed, it was about 10pm, but I have had terrible sinus problems and just wanted to sleep. Alex comes bursting into the bedroom, flips of the lights and tells me that his brother is having terrible stomach pains. I have to get out of bed to check his brother. This has given Emily permission to get up and run around. All heck is breaking lose. His brother is holding his stomach crying in pain. But it is his entire stomach, not like appendix problems. He tells us that he thinks the guy he worked with must have put something in his drink. I am doubting this and actually am having a hard time believing this show he is putting on. (He is used to getting his way and he is a real momma's boy). So Alex says we need to take him to the hospital. We get into the van and start down the road. Well the complaining stops, I tell Alex that I think his is faking and that the hospital is going to cost a lot of money, I think we should stop and buy some Mylanta. So we stop and get this and head back home. We no longer get into the apartment then he is doing it again. SO back into the van and to the ER. Where after being triaged we sit until 2AM, at which point I tell Alex that how can someone who is supposedly in so much pain sit in a waiting room chair and sleep.

THis made me mad because Emily was still running around. We had to be downtown this morning at 9am for Alex finger printing and his brother gets to sleep all day. First I get in trouble because I go to an ER that is busy, and why couldn't I pick somewhere that could see him immediately. It is not like this in Mexico!!!! So our anniversary starts out very badly, with Alex mad at me and me frustrated at the fact that I am having to take care of someone who should not be my responsibility anyway. Alex and I end up working it out before we went to sleep at about 3:30, (I made his brother leave AMA from the hospital).

Sorry about venting, hope you guys don't have to do anything like this EVER.

Charity, I am sure we all feel that way at some point. First lets try to remember that we are still dealing with the government and whatever can go wrong will. Now just relax until tomorrow and call them back. Do you have to have it right away? I would hate for you two to have to make that long trip again, if you could wait for them to mail it out. Maybe you can ask them to mail the printout to your home. Least they can do since they have messed it up so badly.

We may not be able to tell you until it is born, as we are thinking of keeping it a surprise this time. But Alex wants a boy, although he said if we have another like Emily he will be just fine with it.

Yes, the Dr. said it was the trip to CDJ. Guess we came back with more than a VISA. :lol:

I just went today, it is funny, I thought I was all screwed up and just skipped the February one, I even tested 3 times the week of the 14th and all were negative. The only reason I tested again (Saturday) was because I have a dentist appointment on Monday and wanted to make sure before they did any x-rays. I was shocked, Alex was sure that I was pre-menopausal. He was probably going to have his mom send up some funky herbs.

So the Dr. is guessing 9-10 weeks, I go back in 2 weeks for an US to determine how far. I will not be comfortable until I know everything is OK. I don't think I will be able to relax until I am past the 13 week mark. (I had a miscarriage before Emily and I was 12 weeks).

Thank goodness no snow here. Although we can not rule out it happening again before spring. Sometimes we get snow on Easter and even in May with the Kentucky Derby.

Elvia: Sounds like a rip off. I would require documentation before I would pay a bill like that.
By the way I am fine, Alex is much better, but his face is swollen, looks like he got into a boxing match. I hopt that goes away before Tuesday. We got the letter for his USCIS biometrics and it says to make sure you don't have open wounds, bandages or casts when you appear or it may be rescheduled. I guess I have to take it easy on him until after Tuesday. :lol:


Charity: Still no plans for the anniversary. Wish I was rich. Then it would be easy to make plans.

We are not planning anything. I guess we will go out to dinner, but nothing special.

Not sure about Emily's birthday, probably just dinner with family.

Everyone, Thanks for asking about Alex, he was in lots of pain last night. He only had one wisdon tooth removed, but it was impacted (came in sideways), so they had a tough time getting it out. He got 2 stiches and has to go back in a week to get them removed.
When we got home, instead of taking his pain med and going straight to bed, he sat on the sofa and watched TV, talked on the phone and talked to his cousin (one of the ones staying with us). So about 8pm he was dying. I told him again to go to bed, he wanted to blame the pain on me because I made him get the tooth removed. I did not sleep well last night because I wanted to make sure he took his medicine so that he would not be in anymore pain.
He is doing ok this morning, pain is minimal and thankfully he is staying in bed. So hopefully when I get home he will be in a lot better mood than yesterday.

Elvia: He does not work right now, remember he came in on that I-129 as a K-3 visa, so we had to apply for EAD and AOS. Waiting for permission to work (should take about 90 days).
