As for Question #13:

9 times out of 10, the Address and Phone WILL match the Household Registration. Sometimes there are instances where the fiance is not living in the house.

Just put the address where your fiance currently lives.

Dai_Tx is correct.

First 2 pages are part 1 - Fill out and Sign

Part 2 - Fill out but DO NOT SIGN.

It will be signed at the consulate.

ANH MAP is correct. While the consulate gave the answer you wanted to hear.

I have not heard of a SINGLE case where a co-sponsor was accepted. Although I have been wrong before (but it doesn't happen very often tongue.gif)

Take us off the list. Today in HCMC we got pink!!!

After several visits to the Consulate. The Supervisor promised something in a week. We recieved a request for new medical (blue paper). Dao took the new information in today 1pm VN time. She turned in the material and took a number to wait. Number was called and pink issued.

Dao was really worried that they would interview again and has been pumping me for answers about the house, city and extended family.

Good luck to all.

My advise, If you have an attorney that says be patient after 2 months of waiting. Get ride of the attorney. If you are in AP. Flood them with evidence of your relationship they have to except it. You have to proove a bonified relationship and eligability. They have to qualify a denial. Fill their file box with all your junk!!! The more times you go inside the Consulate the more you learn and become familiar with it.

Asia: East and PacificPaper Size
QUOTE (toddandhien @ Oct 19 2009, 04:55 PM) <{POST_SNAPBACK}>
they are used to getting paper in both sizes at the consulate. Don't kill yourself getting 8.5x11 paper. They expect that some of these forms will be printed in Vietnam where the standard office paper size is A4. Any forms that she has from the government like birth certificate or police record will surely be on A4.

TODDandHien is correct. Both sizes are acceptable at the consulate in HCMC.

Asia: East and Pacificwhen is it too late to apply for AOS?
Mike,

when deciding on when to file AOS, keep in mind that your Fiance/Wife should leave the US until she has received her AP (Advance Parole) or 2-yr greencard. If she does, she will not be allowed to re-enter the US.
b_weeksMaleVietnam2009-10-19 20:02:00
Asia: East and Pacificwhen is it too late to apply for AOS?
I meant to say that. Not sure why I said there wasn't.

AOS must be filed before I-94 expires.
b_weeksMaleVietnam2009-10-19 17:19:00
Asia: East and Pacificwhen is it too late to apply for AOS?
My wife(then fiancee)came here on September 8th, 2009. Her I-94 stated that her K1 visa will expire on December 7, 2009. I haven't apply for AOS yet. I was just busy with the wedding and work. I didn't even apply for a social security card or employment authorization card yet either. As long as I send in the application before December 7th, I should be ok right? I need to get the ball rolling that's for sure.
The important this is that you get married withing 90 days of entering the US. Then it is advised you file for AOS as soon as possible (there is no time limit but sooner is better than later).

As long as you married before the date written on the I-94 which is typically 90 days after ebtry, you can file AOS anytime after. Most people file AOS within the 90 day window. You should file as soon as possible.

Btw, I went to the social security office to apply a card for my wife. They said I needed an employment authorization card. I posted this question before, and a member here link to a page on the ssa.gov site stating that a K1 visa holder does not need an employment authorization card. I brought all the papers and even printed out the link and they told me I still need the employment authorization card. I guess I should just go apply for one.
Yes - you should go apply for one.

This is NOT CORRECT. My wifes first SSN card said 'NOT WORK AUTHORIZED' on it. After we recieved her EAD we then went and replaced it.

Were you in AP? If so, what date did you get your 2nd blue slip? Can you post the reason(s) your case was denied so that we can understand your situation and so that others with similar circumstances can help you?

Yes, she got the blue slip. It said the following:

"in contrast to VNmese social and culture norms which mandate a lengthy and carefull period of pre-nuptial arrangements. Petitioner proposed
marriage to beneficiary within 4 days of meeting in person for the 1st time.

.. unable to provide basic facts (such as ceremony, manner of celebration, venue, guests, approx cost) regarding the claimed planned marriage in
the US. It appears that the relationship is a sham or that Beneficiary has no actual intent to marry within 90 days of addmission to the US (or both)
.. unable to provide basic facts of honeymoon (destination, hotel, duration, transportation or approx cost)

Sorry, I don't know how to append this to my original post
Thanks all

Well alot of this could have been overcome depending on how weel she was prepared for the interview ang what your supporting evidence was.

We had our Dam Hoi 5 days after meeting in person. But we chatted online for about 1 1/2 years.

I agree with Kevin. I would let it run it's course as well. Address the problems in your rebuttal to the USCIS and/or a new petition.

Asia: East and PacificK-1 Visa - Submit now or later?
QUOTE
Weaknesses
- Calling card used from Nov 2008 to TET did not have retrievable call records
- Did not retain any hotel receipts while on first trip
- Currently unemployed, but have some promising prospects and should be employed very soon
- Had engagement party on first visit to Vietnam
- Was introduced by her sister

Strengths
- Income is stable over past few years despite current unemployment
- Have call records on Skype, SavingCall Calling Card and Yahoo Messenger
- took many pictures while in VN
- Have all hotel receipts for 2nd trip in July 2009

My questions are:
Do any weaknesses stand out and are a cause for concern?
Are my 2 visits to VN sufficient for K-1 Visa?
Are there any other steps that should be taken prior to filing for K-1 Visa?

I'm very anxious to get the paperwork submitted, but I just hope to be able to avoid the dreaded Additional Processing.

Thank you in advance for reading my story!

Long

The weakbesses you list can be overcome. It is all how you present your facts.

I was introduced by her sister and had the Dam Hoi on the first trip. filed K1, whole process about 4 months, but we were LUCKY...

Take your time, do it right. See my post HCMC - Evidence you should have

PM me if you have any questions.

Yes, you should list all children, even if they do not live with you.

They do this because they include those children in the dependant count when figuring out what your minimum income requirements should be.

So let's say you have a child from a previous relationship (no marriage), and your fiance has 1 child. Your income would have to be high enough in their guidelines to support 4 people. You, your fiance, and the2 children, regardless of where they reside.

Why would that very personal tax information be more safe in the hands of complete strangers (even if it is employees of a US consulate abroad) than in the hands of your future son-in-law? Sending it directly to the consulate, you run the risk of the papers getting misplaced, landing in the wrong file, etc. (the what-ifs are scary). I would feel better knowing I'm sending it to someone who's going to be part of my family. smile.gif

-P

I agree 100%, but for whatever reason, they don't see it that way. They have these visions of someone breaking into his apartment and going straight for a folder filled with paperwork (?? blink.gif ) or something.

Thank you for all your responses. I have emailed the consulate, so hopefully they can give me some answers for our case. good.gif

Thank you so much for the quick responses.

I read on a couple of those links that the sponsor/co-sponsor can mail the forms directly in some cases, so I'm going to email Vancouver and see if that is possible for us. I don't think the parents will have a problem sending any or all of the information if they can send it to the office instead of to Alf.

My mother is the actual co-sponsor, but did I read correctly that my father would have to sign the form as well?

Thanks!!!

US Embassy and Consulate DiscussionHelp please! (Affidavit of Support)
Could anyone point me to an "official" site that lists tax transcripts as required supporting evidence for the I-134? And/or that the fiance needs to take the documents to the interview?

My mother has agreed to co-sponsor my fiance since I meet the poverty guidelines, but fall a bit short of 125%. I'd much rather use a co-sponsor to be safe.
Anyway, my father 'called immigration' (not sure exactly who he called) and they told him that nothing should be sent to Canada (he asked about sending to Canada, not to my fiance for the interview) and that instead it should be sent to the office where we filed to petition. He mentioned tax transcripts and was basically told that he needed to only send the form, no supporting evidence. Nothing else. And again, only to the VSC.

I have sent my parents a copy of his checklist along with links to some guides here, but since they haven't seen anything that specifically mentions tax transcripts, they're refusing to send them. They said they don't want to send their personal information like that, etc etc. While I can understand where they are coming from, I need to make them understand that Alf needs the documents to take with him to the interview.

Africa: Sub-SaharanLeaving for Gambia
Can I ask you who did you purchase your plane tickets through? Where are the layovers and how much in advance did you purchase the tickets? What are the average cost of the tickets you have purchased?

Sorry for all the questions but I need to start planning for our trip to The Gambia next year. We went around this time last year but I was coming from the US and he paid for the tickets while in England. There are a number of available flights out of London regularly. It is easier to get to The Gambia from London then from here ....it seems. We are adjusting his status now and so we will be leaving from the US this time around.

Africa: Sub-SaharanVaccinations!!!
You are more than welcome to reject any vaccination that you want at the medical. However, once you are here and need to adjust status, they can deny you residency based on your immunization status. Tetanus is good for 10 years. The rest of the vaccinations do not have a time limit on them. The MMR requires two shots.
