My fiancee was recently sent back to Japan with expedited removal because of a 65 day overstay on a B1 and because she mentioned getting married to me when being interviewed at the POE. She came here orginally for work and her intent upon return was work, but she now has a 5 year ban. This was about two weeks ago and we are trying to weigh our options. I have other threads on the site asking about different waivers and the process for those, but in all my reading so far it seems like there are two mutually exclusive ways to enter the country: to work and for a relationship. I can't seem to find any process for my fiancee who would like to maintain her job at her company and consider transferring to their office in the US AND get married to me.

After the problems at the POE, I don't see any way for her to get a new business visa since she mentioned getting married. Even if she got one and she came here, I would be afraid that an AOS would be denied if we got married while she was on a business visa. If we go the marriage route, then I am afraid that her association with the company and the potential for her to work in the US after we get married would bring up a 'red flag' when her visa is processing because they think she only wants to work here. We almost feel like she needs to cut all ties with her company before we get started.

Perhaps I'm just getting scared because nothing is a sure thing with this visa process, but can someone from a different country fall in love with an American and have a job?

Thanks a bunch everybody for your responses, and knowing I was not to far off track in my line of thinking.

One update note. I called the NVC and was told that our case has been forwarded to the Embassy in Manila on the DEC 5, 07. So if were lucky we might get a interview by the end of Jan or early Feb. Just my guess and hope.

I want to put "After getting Visa Approval"

And Question 26 and 27 Will "Indefinate" and "To get Married To Fiancee" will these answers be ok.

When i first came here 6 years ago (K-1 visa) it was really overwhelming and intimidating on whats going on the airport. I flew from manila to L.A. thru Philippine airline but my destination is maryland.. Anyways L.A is my POE which is a huge airport and they have a lot of IO and it only take me 20 mins from the end of the line to the IO, and im done. going to my next flight which is a 4 hours waiting.. But every POE is different so u better give her plenty of time for her next flight.Meeting her up in the airport of her POE is a good idea...

Oh, super helpful! I don't have that much in assets that I can prove, but I do have income that's non-taxable that I could prove. I wasn't sure if that would count as income. Though, I'm not sure if she, alone, could prove she can support 3 of us. Would it look bad for me to only have only had a job for a few months?

I haven't posted where I am in the process because I haven't started yet. And I haven't started yet because he's only legally separated. You have to be legally separated for a year before you can even file for divorce in Manitoba. That's another issue I wanted thoughts on, but not really sure where to post it. They filed for divorce at the beginning of June. I'm wondering if the fact that we're going to be filing this as soon as his divorce decree shows up in the mail might be a problem for us? Also, the fact that we've been seeing each other while he's legally separated but not divorced. I assume it'd help for us to attach the copy of his legal separation document along with his divorce decree...

Should I be posting that concern under another topic or start a new post?

I'm really sorry if I've posted this in the wrong area, but I'm still in the process of becoming familiar with the forums. If it needs to be moved, by all means.

My question is, obviously, about the affidavit of support. I basically am living off of money I inherited. I'm looking for a job, but don't have one yet. I was told I needed to prove I have a steady income, which I cannot, seeing as there's no way I can prove I won't go spend all of my money tomorrow. I've asked my parents if they'd be willing to co-sponsor and they've said "yes", but my step father is on disability for an injury and my mother is on VA benefits because of my deceased father's military service. So, are they not able to co-sponsor because they live off of money from the government?

Edit: I have searched in the forums and can't find anything related to this.

It's not going to be a problem, once you file for k1 he will be divorced right? ( Do not file unless his divorce is final) and at the time of interview 4-5 months divorced, by that time he uses the visa after more then half a year after divorce. At the interview he can actually take a copy of his one year separation to have it with him if they ask for it. Other then that it won't be a problem.

I have a buncha questions in here. You guys have been so great thus far.

He's also a British citizen but has been living in Canada for 30 years and just took his citizenship test. Should we wait for that to be approved? He only has a British passport. I'm not sure how long it'd take for him to get a Canadian one. I don't know how much that matters, though. The main problem, I guess, is that we would have to wait longer if we filed saying he's a Canadian citizen, and he hasn't traveled to see me on a Canadian passport. I don't want it to seem like we're lying on anything. We had no idea what we were going to do (who was moving where or when) when he took his citizenship test (which he applied to take way before we met).

I'm wondering if this whole thing is getting too complicated for us to do on our own. I'm freaking out and getting discouraged. He was here for a month and left today, and we have no idea when (before we get the visa) we're going to see each other again. Really tough day and I just want to get things sorted out as best I can and know what I'm in for. This is awful. I know you've all been through it, so I know you guys won't think I'm just whining. This whole thing is just so agonizing. Again, thank you.

Hi, all. I'm new, and confused! I live in the US and my fiancé is from Canada. We just visited an attorney and were given the fees as follows:

Attorney flat fee: $2100
Adjustment of status: $1080
Filing fee per person: $1300 (=$2,600)

In the end she is expecting over $6,000 from us.

Does this make any sense? I've not seen anywhere where any site says that it will cost over 1,000 dollars per person to file. Our case is pretty straight forward and we're wondering if we would be better off hiring someone to prepare the documents, or do it ourselves, rather than hire a lawyer.

I've done a fair amount of research so far, but am still having trouble with these particular concerns.

Any help would be greatly appreciated!

Take your EX-WIFE back to court Get the spousal support removed, and/or get the child support lowered to a resonable amount. If you are paying that much in support, you shouldn't be paying spousal support. Excuse my french but your EX needs to get off her dead-beat BUTT, get a job, and support herself.

As for the chid support, I am not sure why it would be that considering the amount of money you make. I would definately hire a lawyer and take her back to court.

I wasn't trying to glean any information from the touch. I was simply asking if anyone was aware of the people at the USCIS working on sundays....
