Hi,

I have been in the U.S. for five years now and came on a marriage based visa. I never got chance to apply for citizenship after 3 years. When applying now, do I still need to provide all the documentation showing I am still married?

If applying based on the 3-year rule, then yes. You obviously are better off opting to go with the 5-year rule as it requires much less evidence and paperwork to include with your N-400 package.

I got everything they needed my son original birth certificate plus translate one and also his greencard

Why did you show her his greencard? Maybe this is what confused her. I understand that this is a requirement, but just go by the list item by item and present it when asked for it.

I would go back there again (or another post office) and apply. In the meantime, ask to speak to a supervisor if she's rude.

My question is that Will USCIS count those time while She was living with me( Permanent Resident)?

If you are at least 18 years old and:

Are currently married to and living with a U.S. citizen;
Have been married to and living with that same U.S. citizen for the past 3 years
and Your spouse has been a U.S. citizen for the past 3 years

Were you a US citizen when you were a permanent resident (stupid question, right)? That's what I'm trying to tell you in my previous response.

Actually my ex huusband was american. I met him in iraq while he was serving there as a us army officer so we met in a war zone.. Thats why the relashionship dindnt work out..i will wait 30 days before i take the next step..my n 400 is based on 5 years residency not 3 years marriage because the marriage lasted only 2 years..

Did you submit the divorce decree with your application? And are they asking for you I-751 petition for waiver, or the divorce filing papers?

Advice please : Incude complaint or not?

I'm gathering up the various documents I'll need to send in with my N-400 in a couple months (filing on 5 year rule since I'm divorced). I know I need to include the divorce decree with the paperwork, but I'm wondering if I should also include the complaint/petition of divorce as well. I notice that some people are asked for it and end up getting an RFE for theirs.

What do you think? Is it important for me to send it or should I just get my hands on a copy and bring it along to the interview in case the officer would like to see it?

I just want to be prepared!

I only included the divorce decree, but took everything else to the interview. The IO didn't ask for anything.

Even though it wasnt continuous. My case kept pending because judge kept postponing my date.

What do you mean by "wasn't continuous"? if your permanent resident status wasn't terminated by a judge, then it should be continuous, unless you left the US for more than a year. Has this been the case?

Agree, you are consdidered married, and you should mention it in your N-400. Be prepared to include a copy of the marriage contract with your package, if its not issued yet, then you need to wait till you have one. law kan katb ketab yeb2a el mafrood te2dar tetala3 3a2d gawaz.....

and yes, even when you do the katb ketab in the mosque they give you 3a2d gawaz (marriage contract) a couple of weeks later after they process your paperwork and whatnot.

Additionally, in my case since I'm divorced, according to the instructions the ONLY thing that needs to be submitted with the application is the divorce paperwork, PERIOD? nothing else?

Well i'm back again for N400 this time. This is my timeline in a nutshell:

Marriage Jan 2007
2yr GC March 2008
Divorce Dec 2009 (2 yrs 11 months)
Applied for I-751 Waiver Jan 2010
Approved April 2010 (no interview)
Engaged (legally married in Egypt) May 2012

God Willing, I'll be eligible to apply for N400 in December, based on the 5-year rule.

Here's the thing; I got "religiously engaged" about 4 months ago in Egypt, which is pretty much legally married there (without yet consummating the marriage). Since so far we don't intend to move to the US right away, we're not really concerned about filing a petition to bring her here. We plan to wed mid next year or so, God Willing.

I have a question about part 8 of N400. It asks how many times have I been married. My future wife isn't in the US, never entered the US, and we're not really "fully married" yet. So if such "half-marriage" is legally licensed only outside the US, do I need to bring it up/mention it in the application?

Expired forms

On their website, this is what it says in their N400 forms page:

Edition Date : 03/22/12; (06/17/11; 01/18/11; 11/23/10; 04/05/10; 01/15/10 and 01/22/09 editions also accepted).

A new edition of this form is coming soon. In the meantime, customers may file using the 3/22/12 edition. Editions dated 06/17/11, 01/18/11, 11/23/10, 04/05/10, 01/15/10 and 01/22/09 may also be accepted.

So compare it with the edition you have (should be printed on the bottom right of the page). Additionally, if your current edition is different than the latest one available for download, it REALLY won't hurt to use the latest one

Nothing to worry about. It could be that you have a big file (like my case) or he didn't go over your file prior to the interview. In my case, I called the 1-800# a week later, spoke to a level 2 supervisor who told me my application was approved later the same week of the interview. And my online status didn't change until oath was scheduled (not placed in queue)

Give it a few days and call their 1-800# and check on it.

US citizenship for child born abroad to 1 naturalized parent

The USCIS Field Adjudicator's Manual states "(2) Naturalized citizens may count any time they spent in the United States or its outlying possessions both before and after being naturalized, regardless of their status. Even citizens who, prior to lawful entry and naturalization, had spent time in the United States illegally can include that time."

Read this:

A child born outside of the United States to one U.S. citizen parent and one non-U.S. citizen parent may be entitled to citizenship provided the U.S. citizen parent, prior to the birth of the child, had been physically present in the United States or one of its outlying possessions for five years, at least two years of which were after s/he reached the age of fourteen.

In case the US Citizen is naturalized, Is it safe to assume that such five years of physical presence requirement applies to the years AFTER that parent was naturalized, or do all years prior to naturalization count as well?

Hey everyone, I have my interview tomorrow. Please wish me good luck, hopefully all goes well and I can do my Oath tomorrow. Appointment is at 9.30am and the first oath is at 11.30am. Newark has 3 Oath ceremony per day so I hope my journey will end tomorrow on a good note.

Or did I miss something?

I called their 1-800 number about 2 weeks ago and they said my case was approved, thank God, a few days after the interview and waiting for oath. Then i called to check up a few days later and the lady said only the adjudicating officer has approved it so far, but not yet approved by supervisor. I called for a third time (to get a final opinion Posted Image

) and the guy said there's no way to say whether or not a supervisor approved it, but it's approved...
So i scheduled an infopass last week and, to my surprise, the IO at the infopass window was the same lady who did my interview. She told me that they need to do a few internal things before scheduling oath, and confirmed that my application is approved. I asked when does she think I can have the oath she said next month.

So I'm waiting! And the best remedy for waiting is keeping myself busy Posted Image

I really hope I can do the oath soon because i have travel plans later next month or early June. Maybe in a couple of weeks or so I'll make another infopass, but i really hope I get the oath letter (or atleast get the "oath scheduled" status) by then, God Willing.

Congratulations! If your family or friends accompany you, it would be interesting to see a list of other countries represented, too (at least for me). If you get pictures, you must post them. There were about 20 in my husband's ceremony.

What an exciting day! The interview was at 8:50. The approval was done by 10:30. The oath ceremony was at 2pm. It was interesting to see all of the nationalities represented at the oath ceremony: Sudan, Mexico, India, Iran, El Salvador, South Sudan, Burma, Brazil, Iraq, Kenya, Afghanistan, Great Britain, Peru.. I know I couldn't hear a couple. The field office calls names and then mentions their birth countries. Very awesome.

Interview is done . We drove down to Philly for 10:30 am appointment time (arrived about 20 minutes early found on street parking.) We went through security, they were cautious but polite. Richard was taken back at 10:48 and was done eight minutes later. I asked him what questions he was asked and he said he did not remember, after quizzing him for months he just happy for it to be over. He was told he would get his oath letter for a ceremony in about eight weeks. I was hoping for sooner, since we are traveling in June. But the interviewer assured him it would be in plenty of time for our trip with expedited Passport handling. I am hoping the sequester does not foul things up but truthfully it is what it and if he has travel on his UK Passport again, no biggie. Good luck to all that follow, may you interviews be this easy .

Congrats! Although I wonder why he told him 8 weeks? I think it will be sooner...

Unfortunately my birthday on April 13th, If i will get approve that will be my best birthday gift ever

Wait until tomorrow and see. Normally it takes around a week, but if you live near your USCIS office i recommend an infopass.

It's around 5 weeks from the time your online status changes to the interview date.

Congrats Hopin. Tomorrow is my interview and I have to say that I'm so anxious. Usually when I have any kind of test or important interview I can't never sleep the night before, I'm going to have to drink some tea tonight.
