December 7 2012 is my 3rd anniversary . I applied on dec 12. Any problem?

I just got this email "On January 11, 2013, your N400, APPLICATION FOR NATURALIZATION was placed in line for interview scheduling." So if someone more tech savvy than me would add this to the list I would appreciate it. It looks we are running parallel to our neighbors to the north :dance: .

The last 3 numbers of your receipt is basically the number of applicants that applied on that day, so for instance if your last 3 numbers of your receipt number is lets say 100 that means you were the 100th applicant that apply on that day. So what I do is I check the status of the applicants on that day, I would go 101, 102, 103 and so on. I found that most of those applicants are already inline for interview or have been scheduled for interview. I'm still stuck at initial review. I'm just one of few people on the day that I applied that's still stuck at initial review.


This is actually very interesting :) So I played a little with my number and indeed there are many others placed in line for interview. Then i proceeded to play with all the numbers(not just the last 3 digits), and found how it looks like to be told you're being placed in oath ceremony. But there's the interesting part; Some people even since February, such as NBC*002310209, haven't gotten anything changed since being placed in line for interview. Either the system isn't very reliable, or that guy/gal must be freaking out by now :D

Can we have a discussion on why no one from Texas has been put inline for interview as of yet? This is a bit odd to me; also I check the status of the applicants who applied on the same date as I did and I would say 75% of them are already inline for interview.

Within 7-10 days by standard mail you will receive your official Receipt Notice (Form I-797) with your Receipt Number " I don't understand ,do they send the application to NBC ?

Hi all,
I am about to start my N400 application I have some questions and hoping to get some helpful insights from you folks. any advice is greatly appreciated.

1)I have been married to a US citizen for 4 years and I have my green card for 4 years now. I didn't apply for citizenship last year when I was 3 years married and have my green card for 3 years. However, is it still ok if I apply for N400 now and use the "3 year married to US citizen" rule for my case? I guess my question is for that 3 year rule, do you have to do it at 2 years 9 months or 3 years exactly and if you miss that period and you are over that amount now, you have to wait till 5 years to file for citizenship?

2) I have always used my PO box for my mailing addresses for bank statements, bills, etc... and I would like to use my PO Box as mailing address for this N400 form as well. Is it ok to put PO box in the mailing address section (below the physical address)? Will USCIS send all the letters to my PO Box? Have anyone done this before? I am sorry I am a little concerned because I sometimes hear stories that USCIS will still send mail to the physical address even though you put your PO box as your mailing. Since we might be moving to a new place soon therefore I don't want to get mails at our physical address in case we move and they send me biometrics letters and I won't get it.

3) I have all our joint tax returns for all the years we are married, is that enough to send or do I need to send in bank statement and other bills for the last 4 years as well? (because that would be a lot of paperwork!)

Hey December Filers,

I have a question to ask that I obviously don't know the answer to. When I filed my N400, they ask to list all your trips taken outside of the United States. I listed all my vacations I've taken out of the US because I have records of those. The problem is I am a Flight Attendant, and I've taken many trips out of the USA as far as work related which I did not mention because I don't remember dates and times these work trips were taken. I mean I fly out of the USA at least twice per week so it would be difficult to remember all these trips from the past 3 years. I don't even remember what country I was in last week. I forgot to attach a separate sheet of paper explaining the situation. My question is would this be a problem at the interview and should I get a letter from work to take to the interview? On the application it states where I currently work and my position/title with the company, so I don't know if they would understand the burden of what I would have to go through to remember every country I've visited for work. So I'm not sure if they only would like to know where I've been for vacation or if they would also like to know where I've been for work. Most of the trips I've take were 24 hours or less. Someone a little longer, some were 48 hours, I would say a handful were 48 hrs. Please advise. Thanks in advance.



P.S As a Flight Attendant we don't get our passports stamped, so no records.


If i'm not mistaken, the primary reason they ask for trips taken outside the US is to ensure you've met physical presence and continuous residence requirements. Since your trips were so short, there's no question that the continuous residence requirement is met. However, they will need to verify that your physical presence requirement is clear as well, so it might've been a good idea to include a record from your company with your flights in and out for the last 5 years...You've already submitted your application Posted Image so not sure what's the best thing to do here. I do know however that the IO, at the time of the interview, gives you the chance to make any changes in your application since you'll answer questions under oath. I've seen numerous cases when the applicant would update his/her travel dates (And this is what I intend to do) in the time between submitting N-400 and the application. So if i were you, I'd prepare that list for the interview. But most importantly, look closely at that list and verify you've met the physical presence requirement, because this is their most important reason to look at your trip record. Verify that you didn't spend more than 30 months (from the last 5 years) out of US soil.

I just searched and found this link for a similar case with responses from immigration attorneys. They equally advise to include the flight record with the application.

So I'm currently out of the country and won't be back until later next week Posted Image

My check was cashed today but the bank won't yet release an image until it's no longer pending, and I recall they place a number in a format similar to a receipt number on the check. Any of you guys who already received receipt notices and had their checks cashed, did the stamp on the check (from your online bank account) match the receipt number? I remember when filing ROC they didn't match, but just to see if it may work with N400?

I'm not really that worried :) but just the slightly early piece of info would be nice. I don't think the biometrics appointment will be anytime before i return to the US, God Willing.

I guess this is normal. It's only the notice that they have the applications, since it's express mail and has to be signed for. :thumbs:


You know what's even more weird? Mine was delivered on Sunday! and after it shown notice left Posted Image Did someone from USCIS pick up the mail on sunday?!

By travel book, i guess you're referring to Travel Document/Reentry permit? Eitherway, you need to know the difference between continuous residence and physical presence. Her continuous residence will reset if she leaves for more than a year. But the issue isn't only about number of days, it's about the big picture. A greencard isn't simply an entry visa or a status in the US, it's also about the "intent".

Looking at the dates you gave me, your wife was out of the country from Jan 28, 2011 to June 14, 2012. That's almost 1.5 years -> Continuous residency clock reset.

"(ii) For period in excess of one (1) year. Unless an applicant applies for benefits in accordance with § <a class="Jump" href="http://www.uscis.gov...ml#0-0-0-19531" style="font-family: Arial, sans-serif; font-weight: bold; color: rgb(0, 128, 0);">316.5(d) , absences from the United States for a continuous period of one (1) year or more during the period for which continuous residence is required under § 316.2(a)(3) and (a)(5) shall disrupt the continuity of the applicant's residence. An applicant described in this paragraph who must satisfy a five-year statutory residence period may file an application for naturalization four years and one day following the date of the applicant's return to the United States to resume permanent residence. An applicant described in this paragraph who must satisfy a three-year statutory residence period may file an application for naturalization two years and one day following the da te of the applicant's return to the United States to resume permanent residence. (Amended 9/24/93; 58 FR 49913)"

Overall your wife may seem to the immigration officer, at the time of N400 interview, like a visitor to the US as opposed to a resident. But assuming a residence is established and whatnot, the earlist your wife can apply for citizenship, (assuming she fulfilled the 18-months physical presence and all other requirements) will be 2 years and 1 day from June 14th, 2012, i.e June 15th, 2014.

I won't even ask about your taxes, since you have more basic N-400 requirements to focus on.

o wow , i was not aware of that.so you mean , i can even file for N400 even i have been a conditional resident(2 years) who had filed for the removal of conditions and have been waiting for the time that constitutes 3 years. i.e 2 years as a CPR plus 9-12 months wait for the removal of conditions.correct me if i am wrong.thanks for your input.


I must also reminded that you should be a permanent resident AND married to the same USC for that duration. Say you got the greencard through your employer and married a USC 1 year later, then you'll be eligible to apply using the 3 year rule after 3 years minus 90 days from the date of your marriage. But if you acquired the greencard through marriage, then simply you're eligible to apply 3 years minus 90 days from the date shown on your card as "resident since".

From the DOS's website: "Special Entry/Exit Requirements for Dual Nationals: U.S. citizens who also have Brazilian nationality cannot be issued Brazilian visas and must obtain a Brazilian passport from the Brazilian Embassy or Consulate nearest to their place of residence to enter and depart Brazil. In addition to being subject to all Brazilian laws affecting U.S. citizens, dual nationals may also be subject to other laws that impose special obligations on Brazilian citizens. Information about dual nationality can be found on our website. "

So they keep in consideration the existence of another passport that should qualify you to enter Brazil visa-free.

Hello all,

My sister is a naturalized USC and a citizen of Trinidad and has both passports.

She is planning to visit Brazil, and as a USC she needs a visa but as a Trinidadian citizen she doesn't.

If she uses her Trinidad passport to leave the US and enter Brazil will she have trouble entering the US with her US passport, seeing that there won't be a stamp in it?


She's a US citizen, she MUST leave with a US passport. She can enter Brazil with her Trinidad passport. Return to the US with a US passport.

I have been in the U.S. for five years now and came on a marriage based visa. I never got chance to apply for citizenship after 3 years. When applying now, do I still need to provide all the documentation showing I am still married?

If applying based on the 3-year rule, then yes. You obviously are better off opting to go with the 5-year rule as it requires much less evidence and paperwork to include with your N-400 package.
