Filing N-400 based on 5 years of residency is very straightforward and probably the easiest part of the whole immigration process...just like yours was!! Take your paranoia elsewhere.

My point was NOT ABOUT PEOPLE GETTING DENIED. It was about THEIR IMMIGRATION HISTORY BEING REVISITED. Is that loud enough? This just proves you couldn't be more wrong about immigration just looking at the 5-year requirement and approving them away. There's nothing wrong with admitting that you're wrong, you know?

I intentionally mentioned those who were denied. Many others had the issue brought up. Those denied were due to issues in their immigration history (how greencard was obtained and conditions removed). Unfortunately I haven't been keeping up with my immigration's favorites list, but i remember this one case when the applicant was denied because of not just his 10-year greencard, but because of the initial condition greencard having issues, so they reviewed even beyond i-751. Heck, this case was denied because he changed employers too soon after getting his GC through employment. I think you get my point.

I can provide several links for applicants scrutinized, some even denied, for divorcing too soon or raising suspicion. Keeping your head deep in the sand doesn't mean the problem doesn't exist.

Dave&Roza, thank you for your answer.  Do you, or anyone else, have a citation from USCIS stating that getting divorced after being a LPR will not be cause for getting citizenship declined, or even worse, removing the green card?

 

I just want to make 100% sure.

 

There isn't a particular rule that filters divorced applicants from N-400. However, if in cases when the candidate marries a US citizen, divorces him/her once (s)he gets the greencard then wait to apply for N-400....this may raise some flags. They check your file at N-400 prior to any decision. If you've removed conditions and already presented evidence, there shouldn't be anything to worry about.

coming to the usa on VWP or any other visa, then having the intention of getting married to a "usc",.. immigration won't like that..unless you filed the correct visa for your intentions...
and if they get a sniff at P.O.E of your girlfriends intention of getting married to a usc while on such a travel visa will turn her backside back....

There is a valid reason why there is a K1 visa for situations like this....which some folks don't want to understand on a immigration point of veiw...

Why the rush to get married before your usc/oath anyways..? after that you can apply for a k1 or 129 /130 eitherway it dont take that long nowadays like years ago..



The OP clearly indicated that his future wife does not intend to stay here and adjust status, but will go home and apply for an immigrant visa. So the next time she returns to the US, she will enter as an immigrant spouse of a US citizen.

Like he asked, kindly ask questions before jumping to conclusions :)

In order for her to remove conditions on her own, she needs a divorce decree. In her situation, that's her foremost problem.


They changed the rules in in April 2009. According to the new memo, she can apply for a waiver based on divorce without a divorce decree, provided she will have a divorce decree ready by the time they send her an RFE :thumbs:

hello can anybody share their experience regarding my friends status as of the moment?

i have a friend who came in here with a K1 visa they got married and she had her greencard, the problem is her husband abandoned her last december and totally cut off all their communications, her problem is she needs to apply for an approval to lift the conditions on her greencard...would she be able to apply by herself?(what i knew about this was you need your husband's signature in filing the application) and is there a possibility that she will be deported back in the philippines if ever her husband refuses to sign? what would you advise her to do? they havent filed a divorce yet,...and she needs to apply this may coz its in the requirement that you need to apply 90 days before your greencard will expire...what should she do
?


To answer your question, ofcourse she can remove the conditions without her husband, no need to worry. She can apply for and I-751 with a waiver of the joint filing requirement and there's 4 different categories of the waiver (3 of which can apply to her case, since she obviously isnt a widow) and depending on her circumstances she can pick whichever appropriate category, most likely she needs to apply for the waiver based on bonafide marriage to a USC that ended in divorce. If she has plenty of time till her conditional green card expires, then she can go ahead and file for a divorce, then file for the waiver even if the divorce isn't yet finalized (as long as the divorce takes no more than 90 days to be finalized).

If her husband has been abusive to her, she can apply for a waiver immediately based on abuse/cruelty by USC spouse, provided she has enough evidence for such abuse. Actually, she can apply for any of the waivers at any time before she is removed from the US.

When does her conditional card expire?

Don't worry, it's great that you received the biometrics notice. In my opinion, it is far more important than NOA1 because NOA1 can be replaced simply with a stamp. But your biometrics, if missed, is a guaranteed denial for your application. Try to get a walk-in biometrics appointment and get it out o the way (unless your given appointment fits well with your travel plans) and, while at the immigration office, get a stamp on your passport. Make sure you take your biometrics letter with you when you go overseas as a proof for filing I-751 (since you dont have NOA1) just as a backup. I I truly wish you the best :)

I intend to travel overseas in March. And if my biometrics are not done by then, I'm cancelling my trip with no second thoughts :blink:

If you carefully read the instructions, it lists the affidavits as an "example" for evidence of a relationship. So the answer is NO, they're not required. And I've seen people on other forums who submitted there paperwork without any sworn affidavits.

However, i think it's a positive thing to include. There's never such thing as "enough evidence" :) try to include as much evidence as possible. Affidavits, if not useful, won't hurt.

Hello everyone,

My husband and I are preparing my removing conditions on residency file that we'll try to send by Monday 5/4/2009. (Actually 90 days started last week 4/26/09).

we have so many documents that show our continuing marriage relationship as:
- A joint bank account
- 3 affidavits from friends
- Rental Lease
- Rent insurance
- Life insurance
- Giving Birth to our baby girl
- Documents showing our travel together to Morocco
- Travels in the US
- Taxes
- Photos
- etc....

However, I have a concern which is that the car & car insurance as well as the utility bills (water, electricity, internet, cable) are under his name showing of course the home address. And I receive my cell phone bill and magazines under my name at the same home address..

Will this "separation of names" be a "negative" point in our case?? unsure.gif
Do you think I am late sending the package to Vermont??

We just got our approval in the mail today (dated last Friday), and we sent 12 days to VSC before you. There are several people who sent after us and got approved in the past weeks. So, there's a good chance that you'll get your approval letter soon. I know it's hard to wait, but try to be patient.

I just updated the May list as well as the VSC list, so they'll be on the top of the list.

Living overseas on military or government orders is just like living in the States. Your APO/FPO address is your mailing address and that's where everything will be sent to. Since your two-year greencard is expiring in May 2009, you can start applying for your removal in Feb 2009. There are special instructions on the I-751 for military/government personnel living overseas. For example, instead of having a biometrics appointment you mail in passport-style pictures and a fingerprint card that you get from the MPs or the Security Office (usually same building as housing, finance, transportion office... on the military post). On the I-751 your write in big letters 'military overseas', so they know right away. I think this is even written in the instruction. So don't worry, you are just fine.

I know I cannot apply to remove the conditions on my GC while being outside of the US but I don't know what to do if there's a form I should send or inform the USCIS about our transfer so that I don't loose the permanent residency in the US.

Hi - I posted on here a couple of weeks ago with the same problem. Almost identical time line and at the same location. I went yesterday to have them redone. I asked the technician why and she thought it strange and was "probably a mistake somewhere the first time". I seem to remember when i had them done in Feb that they only took a copy of my forefinger on both hands. This time they did a full set. Perhaps that was why? Either way, it looks like you just have to have them done again and it was an error on their end. If it's any consolation i was in and out in under 30mins yesterday but I'm sure our cases have been delayed as a result.

You better send them a question letter,and they will reply why they took mistake of your fingerprint,since the computer tells weather past or not.thanks

today i checked to the proccessing times on uscis website . and i think they updated their timeline.. but i am still seeing to the time of the phili local office .. it shows that they are still working on july 29 2012 for citizenship applications..i send my paper 21 december 2012 and they received my mail 24 december.. 02 januarry they sent me to the fingerprint notice.. almost 1 month 12 days passed on my first sending date.i gave them fingerprint on 14 january 2013. still waiting but no respond about the inline for interview.. or something else.. what happening? can anybody tell me their important comments which are for me..



Mine was received Dec. 10th and fingerprints completed on Dec. 26th, and still nothing as far as I know :) Just be patient. I'm not eagerly waiting to sponsor someone or so, so just let things take their time. There are some who're placed in line for interview and then wait the same period you're waiting! I've noticed that in my local office, they place applicantsin line for interview and then send them the interview notice right after, then the oath is a few days after the interview. Visit other months' filers and check their timelines, especially those in the same local office as yours so as to determine if your office similarly has a pattern.

Also keep in mind that after fingerprints, they conduct a background check, which may slightly elongate the process. So don't worry Posted Image

Is it true that some offices schedule based on your earliest eligible date? I guess I'll be put far in the pack then...my 3 year anniversary was 1/8/2013, but was eligible to apply on 12/18/2012. So my guess is that if there were people who applied after their 3 year anniversary, they received priority. Is that correct? Thanks.


You were eligible to apply way before 12/18/2012....more like October 8th....this is actually good news since it's all up to the processing time, i.e no need for the local office to adjust your application's processing speed accordingly to match your 3rd GC anniversary...check out this case, the applicant became a citizen only 73 days, from start to finish!

Nope, perfectly normal! My local office seems to give preference & priority to those with earlier eligibility dates, thus asking if it's the same rule across the board Posted Image
