Removing Conditions on Residency General DiscussionCard Production Ordered - twice?
So i received the following email on 5/1/2010:
"On April 30, 2010, we ordered production of your new card" --> and this was the same for the online status

then, out of the blue, this morning i received this email "On May 10, 2010, we ordered production of your new card" Posted Image

I googled this and it seems like it happened to many people before..but I'm not sure if they ended up receiving two cards or just one. And if they received only one, when was it actually ordered?

Any experience?

Removing Conditions on Residency General DiscussionI751 and Affidavits

Hi,

Are sworn affidavits required for filing the I751. We got letters (not affidavits) from two friends to go along with our application and other evidence. When I read the I751 instruction's "Evidence of relationship" section, it states "The documents should cover, but not limited to, the following examples" and lists sworn affidavits. I was under the impression they were not required, but the wording is not clear to me.

Thanks,
John

Like you said..it's only given as a suggestion but they're not compulsory. IIt depends how much evidence you have, too.

Removing Conditions on Residency General DiscussionFiling for waiver before divorce is final
Look at this case

http://britishexpats...ad.php?t=645577

He's the only person I know who's taking advantage of the new memo (i.e filing for waiver before divorce is finalized). He didn't yet get his RFE. But i wanna say it depends ALOT on which service center he's filing at. VSC tends to be much slower and thus allows more time.

Note: I got my conditions removed without request for further evidence or interview. This is great, however unexpected and not the general rule. Nevertheless, if you need help let me know.

The same here...looks like thats the new trend for waivers! Budget cuts, maybe?

Thank you so much everyone!! I hope whomever else waiting on their cases to get approved very soon, inshAllah (God Willing). I'll still stick around atleast until I submit N400, God Willing.

Hm, "To prevent wireless communication with it"?
I assume it has some RFID tech in it?

Perhaps...either that or that passport chip...or ones where they use it in the new credit cards where you only waive it infront of the reader.. The envelope from the inside is foil-like, similar to bags of chips. Check the attached picture.

Okalian, Congratulations!!We are all celebrating the happy ending of your green card journey!!!! You also have been a great support for many of us (not only at this forum)!!! Please, keep posting your comments.

Thanks a million! It's my pleasure to help you just like others here (and on other forums) helped me :)

WOW that must feel GOOOOOOOD. Congratulations. Enjoy a glass of wine for me. We, VJers are happy for you.

Thanks everyone Posted Image

I think it was worth the wait. I already still have the older one and I know they'll take the new one at the N400 interview, God Willing. So i guess it doesn't really matter old or new!

You know what else? I actually found a photo for the original GREEN card. I gotta say it's greener than the current one, but not as fancy . I think it should've been called the olive green card because it's not quite as green Posted Image

SOOOO today i was casually checking my mail to find a large envelope (Well not so large but it's larger than the ones they usually use) and once i saw it's from St. Albany, Vermont, I COULDNT WAIT TO OPEN IT!!

I tried to bend it alittle and indeed there seemed to be a card inside :)

If you guys notice, the card date is the same as the 2ND card production date, not the 1st. (look at my timeline)

Removing Conditions on Residency General DiscussionI -751 package question

thank you for your responses. I am still afraid they may question why we filed taxes separately & we don't own anything together (like houses, cars, etc)

it's completely normal, as long as the taxes show "married but filing separately" as your status. I didn't even include taxes at all.

let me also add, not everyone is expected to have joint ownership or own a house to begin with. I truly think what you have is very sufficient, God Willing.

Removing Conditions on Residency General DiscussionThis is Our Day

Then on to OKC for an interview if needed

FYI I had my AOS interview at OKC in March 2007. At that time, OKC office was one of only 3 offices in the country that had the DORA (District Office Rapid Adjustment) program where you have your AOS interview the same day you submit your paperwork, and GC was to be issued within 90 days. Ofcourse the program didnt work so well. But it cut the waiting time for the AOS interview.

The IO who interviewed us was very friendly. And when they say they'll call you back within a week, they DO call you back as promised.

Removing Conditions on Residency General DiscussionWill be travelling and reach USA after green card expired

Hi there, thanks for the information.

With NOA for a year extension, would that be more secure to schedule infopass to have a stamp on the passport before I go on travel?

Kindly advice.

I tried to do this when I was leaving the US with NOA1 and greencard. I saw people who got a stamp even when they already had NOA1, so I was motivated and I scheduled an infopass to get a stamp. The IO told me she'd give me a stamp but she will take the expired GC and NOA1 away! That was the case in the Jacksonville office.

Ofcourse i chose to keep my GC. Went home and came back without any problems. Folks at the airport in both Egypt and Amsterdam totally understood NOA1. I don't know what kind of "negative experience" M&M is referring to.

Removing Conditions on Residency General DiscussionMailing address?

Hi,
If my mailing address is different than permanent address, is that going to be an issue? Are we going to be asked any details about it? For example, I'm resident of NJ but my mailing address is in NY....is it okay to put that on i-751 or better stick with my permanent address. But some of my evidence such as back statements are going to show my mailing address in NY ??? :(

I'm sure there's an explanation. Make sure you include it.

In my case I had letters addressed to me at 3 different addresses; 2 in louisiana and 1 in Florida. I explained in detail why it's the case (for example my health insurance statements were sent to my work address)

Removing Conditions on Residency General DiscussionI751 QUESTION! PLEASE HELP!
ITALO,

You can go to the USCIS office and get a stamp on your passport whenever you do your biometrics. Or you can even try to make a walk-in for biometrics if you can't make it for the day of the appointment. But don't worry, you're in a good shape.

I honestly prefer to have a passport stamp as a back up just in case. It's easier to lose a piece of paper than a passport :)

Wow - talk about scaring the poop out of someone for probably no good reason - why would you say all this? Why would he need one right now? Shame on you.

Removing Conditions on Residency General Discussionletter from USCIS

Hello,
I am wondering if anyone has ever got the letter about the notice of requirement to file joint petition to remove the conditional basis of an alien's permanent resident status from USCIS.
My green card will expire Sep. 15 2010. So I was thinking that I can file between June 15 and Sep. 15 if I am right.
Now I got the letter and I am worried when I need to file the form I 751.
I would appreciate if anyone can advise.

The letter is only a "heads-up" reminder that you need to file for removal of conditions, nothing to worry about. And you're right, you're eligible to file starting 90 days from the expiration of your current Greencard.

Removing Conditions on Residency General DiscussionI 751 not submitted but needs to travel

I have a dilemma. My greencard expires in the middle of August. My 90 day period started last friday & i haven't submitted my I751. Documents & evidences are ready to be mailed out but I'm afraid I may miss biometric appt. I will be traveling abroad on June 17-July 4th. Do you think it will be a problem at the airport when I come in if I haven't applied for my I751 yet? I was thinking it may be better to just do it after I come back. Some say that I need the receipt from USCIS with 1 yr extension prior to any travel. Please help!! Thank you.

As long as your greencard is valid at the time when you re-enter, you should be fine. But make sure you send the I-751 package on time so that it REACHES them before your GC expires.

I know I have the option to file on my own, but that requires finalizing a divorce.

Not necessarily. You may file on your own only with a divorce complaint. In such case, USCIS will send you RFE for the finalized divorce decree, which overall will buy you some time.

Removing Conditions on Residency General Discussionidentification expires a day before biometrics appt.

Hi,

I will have my biometrics appointment this JUne 30 and went to Motor vehicle to ask if they will extend or reissue the driver's license or state ID because it will expire by June 29, a day before my biometrics. I explained to the lady that i got an extension letter because my I-751 or CR-189 is still on process but the motor vehicle lady said that they cannot do it because I need to be approved first before they can issue another one.
Need help, what can i do or bring for my identification? I called a man from USCIS and he told me that the only thing i can do is to do an infopass appointment to ask what identification i can bring.

Thank you.

How about your passport or even current greencard??

Removing Conditions on Residency General DiscussionQuestion: Filling out I-751 form, need help

Hi, we just started filling out the I-751 form for my wife and on page one they ask: Country of Birth and Country of Citizenship.

Ok, is Country of Citizenship meaning where my wife now resides?(which is here in the US) or does it mean her native land where she is from? Thanks,

It's the country which issued her passport (I presume in your case its Colombia)

Don't confuse it with country of residence (i.e US)

Removing Conditions on Residency General DiscussionI-751 evidence on house ownership and utilities

Should I just include the proof of payment for the real estate taxes and a brief explanation about the status of our current residence?

Nope. Don't skip it. Explain what you've just explained here. There has been a case here when someone received RFE (Request Further Evidence) just to show a lease (and something else, as far as I may recall). And yes, include the proof of payment if it shows your name.

The same thing with our utility account. It is still under my father-in-law's name but we are paying for it regularly from our joint checking account.

That's still fine too. If you want, you may highlight such transactions on your bank account statement

We don't have any children and both of our vehicles are under his name along with the insurance( I'm still in the process of learning how to drive:().

These are normal circumstances. They mostly look for the overall picture, not just one thing. Include a personal statement and explain whatever you need to explain if necessary.

Among our major evidences, we filed jointly for our taxes in 2008 and 2009, I'm his beneficiary in his life insurance, I'm covered by his medical insurance, telephone, cable and internet accounts are both in our names and we have a joint checking account where our paychecks are deposited.

Removing Conditions on Residency General DiscussionTraveling between 2yr and 10yr GC

Or is the NOA with the expired GC enough evidence?

Correct. NOA1 is a 1-year extension and he shouldn't have any problems travelling with them (been there, done that). However, my concern is if he misses his biometrics appointment (or an interview, if called for one) while he's overseas. If I were you, either travel after biometrics or have someone you trust to check your mailbox regularly to avoid missing any appointments.

Removing Conditions on Residency General DiscussionWill I ever see a Green Card Again?
I'm gonna point out a few facts:

1. USPS cannot forward mail sent by the government, as far as I know. When you get your new greencard (God Willing) you'll se it specifies that on the envelope.
2. I wonder why you didn't learn the lesson about not trusting case status online yet :)
3. In the meantime you can schedule an infopass appointment and get a stamp in your passport that works just as good as your plastic card
4. You're still within the processing window for I-90, so it's too early to panic.

That's right, they likely won't know unless you tell them. And honestly it's situation dependent, too. When I had my AOS interview, my wife and I lived in 2 separate states. But it made perfect sense for both of us not to move together yet since we were seniors at our respective universities. So if you intend to bring it up, make sure you have a very valid reason to back it up.

Does it seem to you that USCIS takes longer to remove conditions when the applicant and sponsor filing do not have any children together?

Like V33K said, i think it's irrelevant. I've applied with a waiver (no longer married and no children) and I, too, have been approved with similar timeline to others. Did your case get called for RFE or an interview?

Removing Conditions on Residency General DiscussionJob offer in home country while on conditional status

How long does it take to process an I-131? Are there any other options?

It says it takes 90 days, but when i filed for I-131 last year (to use as a passport, not as a reentry permit!) it took about 6 weeks to process. That's your only option, unless you intend to visit the US once every 6 months- period. But i advise you that CPB officers may consider this as an abandonment of PR status.

The big question here is; Are you gonna apply for US citizenship? if yes, then certainly file for I-131. If you're thinking about permanently moving to the UK ( or atleast for a LONG time), then you should seriously think why do you wanna keep your greencard! especially that your UK passport allows you to visit the US for up to 90 days..

You're on the right track (hopefully) as far as filing I-131

Removing Conditions on Residency General DiscussionFiled for Removal of Conditions(I-751) today

I don't know if photos are the best form of evidence

I never said they're THE best form of evidence..I said they're ONE OF the best forms of evidence.

Here is the list of documents that USCIS requires

They never actually "require" anything specific. Read the instructions carefully. They give you such sucggestions as examples for forms of evidence, but these (even if they apply to you) are NOT required for your petition to be approved. Pay close attention to wording :) These, however, are the most frequently used forms and evidence and, in most cases, establish grounds for a bonafide marriage (ending in divorce or otherwise). You won't believe how many people had barely enough evidence to submit yet they did fine. Case-by-case is the keyword ;)

Wish you and everyone the best, and welcome to the waiting club :)

I agree with Just Bob. Why didn't you include any pictures? Its not THAT big of a deal, but its one of the best and easiest forms of evidence :)
