Howdy folks!

So I'm pending ROC (applied Jan 2010 at VSC) and while casually checking case status updates, I've just noticed that my I-765 has been touched on april 10th!

Now, They touched my I-485 once they received I-751...which seems normal, right? Then they touched the I-751 itself 3 days after my biometrics, fair enough yeah?
Well...why in the world would they touch my employment authorization application Posted Image? Did this happen to anyone?

I'm writing on behalf of my friend who is a USC. She had an arranged marriage which is breaking down. She is now in the 90 day period for removal of conditions for her husband, but she is unsure about filing for it. What are her options? Can ROC be postponed, can she get an extension? If ROC is not filed and he returns to his country, can she re-file for him to come here in the event that they can eventually reconcile their differences?

Please advise... Vj'ers your input is greatly valued. Thanks!


With or without her, he MUST refile, otherwise his status as a permanent resident will be terminated and USCIS will start removal proceedings..

He can file WITHOUT her if he intends to obtain a divorce...or they can file together..very few couples are being called for interviews anyway..

Howdy partners!

Praise be to Allah, I got an email today saying my card production has been ordered. I've filed I-751 at VSC (aka the slow mojo :)) with a waiver In January. I was married to a USC but unfortunately the marriage ended with a divorce. I filed for I-751 approximately 5 weeks after my divorce was finalized.

I was awaken by a text message saying "there has been an update to your case". I thought approval messages usually say "card production ordered" so i FREAKED OUT. I never became extremely awake after being asleep in such a short period of time!! Anyways i checked my email to find the following message:

Current Status: Card production ordered.

On April 30, 2010, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service at 1-800-375-5283.

I didn't use a lawyer either. The total weight of my i-751 package was a few ounces less than a pound, with a total of 300+ sheets of paper (some printed on both sides) of evidence. I didn't include taxes because I didn't file jointly with my ex-wife, even though were were married for almost 3 years. My ex-wife was very cooperative too, and I included a personal statement explaining everything.

I honestly expected an interview or RFE especially that I've seen a few people here get RFE or an interview notice even though they filed jointly.

Anyways, I've been helped by this forum and I hope i can help others as well as a payback. If you have any questions about details, I'll be happy to answer.

Except what she meant was, the OP filed for joint-ROC, but BEFORE the I-751 was approved the OP was divorced. Their GC was approved based on marriage and there was no interview. Because they were divorced before the card was approved they should have withdrawn the petition and self-petitioned.

Not sure they will even give you the stamp. The NOA1 is the extension of your GC so it should work without problems. Hence, since some of the dumbest people work for the DMV, you may have to explain it to them or even demand the see the manager.

make an infopass and get a greencard stamp (I-551) on your passport. It will be valid for 1 year from the date of expiration on your plastic GC. The DL office will use it as proof of your permanent resident status.

Keep in mind that CSC is very quick with processing i-751's. Take a look at fellow applicants' timelines in their respective threads in this forum.

I have seen from my previous experience that USCIS seems to process the applications if an attorney representation is present. I am looking at about $4k in attorney fees to file above 2. Financial situation is a little tight. Does it make a difference to file by myself or should I definitely go through attorney?


I understand how costly it seems...but honestly with such mess, I would go with an attorney. InshaAllah it'll go smooth.

Thank you very much for all your replies. I got a second opinion from a very competent laywer in New York that some family member recommeded. He said, I cannot file another I-751 at this moment. The only thing I can do is to appeal for N400. According to him, if they put be in green card removal proceedings, only then I can file I-751. It sounds very strange. I read numerous forums, and I have seen some cases where writers said that they filed I-751 waiver after their original joint I-751 was approved. This lawyer also said that they may start green card revoking process.



I honestly would listen to your 1st lawyer. Your N400 was denied because you didn't meet the primary requirement for eligibility; Being a Permanent Resident. In the eyes of immigration, you were not supposed to have the greencard because it was approved based on a petition which you didn't meet the grounds for. Why do you think people go through the hassle of withdrawing their joint I-751 and refiling with a waiver if they get a divorce?

So you're dealing with 2 separate issues:

1. Having a valid permanent resident status
2. Eligibility for Citizenship (if and ONLY IF condition #1 is met)

Trace your problem from the source. If you have a leak, you don't keep adding more water, you fix the leak first THEN add water. Refile I-751 with a waiver.

But again, wonders happen with USCIS....

Waiver = I-751 that isn't filed jointly.

Correct me if I'm wrong, but this is what I understand about your timeline:
Married: February 2008
Greencard Issued: July 2009
Separated: May 2009
Filed for divorce: March 2010
GC expires: July 2011

And with a joint account as the only proof? No bills, no driver's license, no insurance, no lease, no taxes, nothing?

Did you have any letters directed to you and your husband to the same address? even separately?

I think you may have a very difficult time trying to convince USCIS that your marriage was real..unless you come up with more evidence.

I did my waiver on my own without a lawyer. However, depending on your situation, you may need one. Most importantly you'll need more evidence than just a joint account. Do you have letters addressed to you at your address? Address on your drivers' licences? common bills?

When did you get married? when does your conditional GC expires? When did you file for a divorce?

The I-797C, Notice of action for the I-751 RECEIPT NOTICE is your one year extention.


WRONG! Tavoludo is correct. The letter says your status is extended for one year. EXTENDED = adds to where it last left = 1 year from the date the greencard expires.

it won't hurt to call the misinformation line to confirm.

How soon after you sent application did you receive notice of Biometrics appointment? It's over a month now since we sent our application and have received NOA but there's no letter of notification yet for Biometrics schedule. Thank you.





There has been many cases when people don't get a biometrics appointment if your last biometrics are still valid. Check timelines for previous months to see what I'm referring to. It's unlikely that they still intend to send you a biometrics notice, but it's still foreseeable.

I didn't white my a# on each page either!

After weeks of planning, arranging and polishing my evidence packet, I fastened everything together with a prong fastener, with each section covering a certain category (e.g health insurance statements, bank statements, etc) and was planning on using tabs.. Only to go home and realize I forgot to use tabs! I was so mad at my self especially that they mention it in their instructions...I had more than 300 sheets of evidence and I was hoping they won't hate me. But they approved it!

My point is; it's good to follow their instructions (or preferences, per se) but don't think they'll deny you just because you stapled them :) In my case, i put the check in an envelope to make it visible enough.

I-751 was denied due to your inability to provide divorce decree. It was not due to a lawyer mistake...


At the time of the filing (and this was before the april 2009 memo from USCIS), the lawyer should've known that the I-751 waiver based on divorce MUST be submitted along with the divorce decree.

My evidence was 312 pages, including the I-751 form and the address change sheet. Weighed 1 lb 15 oz. No taxes were included, so I had to make up for that too.

Dude i was really worried too! which is why i included everything i can. Put yourself in my shoes :) Divorced, no lawyer, etc. My marriage lasted 1-month-shy of 3 years.

Was it worth it? abso-freakin-lutely :D No interview or RFE, approved in 96 days.

Here's the breakdown of the package:
- Signed I-751 form

- Personal Statement (Explaning how our marriage went down)

- Notarized affidavit letters from friends, one from our marriage counselor.

- Table of contents TOC breaking down the whole evidence package into sections:

  • Section A: Important general documents (Marriage certificate, divorce complaint, divorce decree, etc)
  • Section B: Proof of joint residence at State X
  • Section C: Proof of joint residence at State Y (energy bills, random letters)
  • Section D: Wedding Preparations (Gift registry, wedding hall documents, etc)
  • Section E: Joint car insurance statement
  • Section F: Joint cell phone statements (only included 2 because these statements were 40 pages each ..see? it could've been worse if i included all of them like i did to others :))
  • Section G: Joint Health insurance statements
  • Section H: Joint bank account 1 statements
  • Section I: Joint bank account 2 statements (these accounts were opened one after the other...not both at the same time)
  • Section J: Photos (60 photos, 4 per page)
Now, you may ask why did I include wedding stuff.. In my culture, we first get married but don't consummate the marriage until the wedding itself. In fact, we did our AOS interview the same day we submitted I-130 and I-485 (it was a pilot program - google DORA) and the USCIS officer approved it in 10 minutes even when she knew we were students and lived in different states at the time, prior to consummation of the marriage and our graduation (we graduated, wedded, moved in together). My ex-wife was also from my country of origin but born and raised in the US. We had letters from our inlaws and friends who attended our engagement, and thats all the evidence we had at AOS. So this further explains why I needed the additional amount of evidence.

Let me also add, one reason for having such a big number of documents is because I included every months' statement of everything (health insurance. car insurance, bank statements, etc) whereas you need to include only one per quarter. I was approved without an interview or an RFE.
It's more about quality than quantity. Your 100 pages is more than enough, if it covers what needs to be covered. I just don't see how an overkill could hurt..

I may be the one you're talking about..I included the 300 pages (some of which were both sides) because it wasn't just a normal I-751. It was a waiver. And with a waiver, there's no such thing as an overkill.

Correct me if I'm mistaken, But i think JustBob once mentioned his package was only 12 pages or something around that number. It's more about quality than quantity. But in my case, I had no chances to risk :)

Your 100 pages is more than enough, if it covers what needs to be covered.

That's right, the 90-day window starts 90 days prior to the expiration date on the card. If you send it before the 90-day window, they'll return the package to you.

By the way, you seem like a very polite person, and I truly admire that. I can never stress enough on how far politeness can take a person. Keep it up.

I think it takes around 2 weeks from the card production email until you receive the card...


It's been 3 weeks since the 1st notification, but alittle under 2 weeks since the 2nd one.

I didn't receive an approval email, but I did receive a notice in the mail. In my case there has been 10 days between the 1st and 2nd card productions, so i dont know what they're up to!

And i haven't received anything yet! I'm waitinf until June 1st to infopass them. But i truly hope i receive the new card by then.

Ok this is what is happening.USCIS has changed apperance of green cards starting from today so that is why they delayed peoples GC so that they can get the new more secure GC check their website for details.

Yes - very common... check my timeline (in green). You might also receive approval letter sent notice... but it is quite normal....

then, out of the blue, this morning i received this email "On May 10, 2010, we ordered production of your new card" Posted Image

I googled this and it seems like it happened to many people before..but I'm not sure if they ended up receiving two cards or just one. And if they received only one, when was it actually ordered?
