I never received my NOA letter either and found it was not a problem at all getting the I-551 stamp in my passport. Remember, your status has already been extended when they accepted your I-751 package. You just need to have documentary proof.


I honestly would've preferred getting a stamp over receiving a letter just because it's more widely recognized overseas (not that I encountered any problems with the letter) and it's always gonna be in your passport, so less chances of losing it :)

As long as the package makes it to USCIS by the expiration date (and in some cases, on the expiration date), you're fine. Enjoy your trip!

Please provide your timeline so we can better help you. If you're eligible to apply for citizenship, your N400 application will force your I751 to be adjudicated. In the meantime, you're a permanent resident.

It's all BS. It's already in the system in your file. You should be able to travel without any letter, once they run your green card through a computer all the details are there. It simple doesn't make any sense in year 2010 to rely on a piece of paper.


Even better, why not just run your fingerprint without the need to scan a greencard?

That's not gonna always work. The so-called system isn't really as inter-connected as we may think :) Thus the need for genuine paperwork .

Just wanted to let you know to make sure you have the original extension letter with you when you cross the border. I travel across back and forth to Canada for work every day and I have always carried a copy (just like I did with all my other immigration documents) and today when I came home in the Nexus lane the border guy asked where I was going, when I said home, he asked my status and took my card and extension letter. When he saw it was a copy, he said that was no good that it had to be the original letter and then made me go into secondary. He actually was the one who helped me inside too and said that they used to take copies but now that they have so much forgery/fraud going on that they require the original. After he verified me in the computer, I was good to go. I was worried they would make my husband bring the original to the border (we are a 1/2 hr drive away) before they would let me in. Just wish I would get approved and get my card so I don't have this hassle any more.


You're absolutely correct. Before visiting Egypt in March, I stopped by USCIS to get a stamp (even though I had the original letter, but wanted the stamp as a back up). I asked her if it's a good idea to make a copy of my extension letter. She said a letter isn't sufficient. It was just as good as having a copy of your greencard versus carrying the real one! So if you lose your letter while you have a copy, make sure you get an I-551 stamp.

Hello everyone,

My temporary GC expires in January and I'm gathering all the documentation I can find to file for removal of conditions. Unfortunately, I'm missing some important things (I'm in graduate school and have no health insurance at this time, my husband is on medicaid so he can't add me to his, no driver license (don't need one in NYC!) or vehicle/house ownership). Plus, most of the documents we do have don't go back two years... so needlessly to say, I'm freaking out a little. :unsure:

This is all I have:

1. Apartment Lease with both names (for the past 2 years)
2. Join bank account (15 months)
3. Utility Bill with both names (7 months)
4. Cable Bill with both names (7 months)
5. Evidence of a trip together to Las Vegas (January 2010)
6. Pictures together for the past 4 years (and with friends and family members)
7. Health Care Proxy form, indicating my husband as the person who can make decisions for my health if I can't (I had to get one for a surgery I had in August)
8. Tax return filed as married (but "filing separately" because my husband is on SSI and didn't have to file for taxes)


Can the above be enough to satisfy USCIS?

1. If USCIS knows that a divorce was finalized (or sometimes, filed) prior to i-751 approval, it'll hunt you down later down the road when you apply for citizenship. There has been a few similar cases here in VJ regarding such scenarios.

2. It's the same chances of an approval now, as it's all based on the evidence you presented. Filing I-751 based on waiver doesn't lower your chances of approval, as USCIS looks at how the marriage started, not how it ended.

3. No, in such scenario they may deny your I-751 on the spot and ask you to re-file it with a waiver of the joint filing requirement.

4. Nope. You're a greencard holder and can do whatever you wanna do. I-751 doesn't require any sponsorships.

It opens on November 5th. (90 calendar days prior to Feb 3rd, 2011). Keep in mind that 90 calendar days isn't equal to 3 calendar months. You can send it a day or two earlier, as long as it arrives at USCIS within the 90-day window, or they'll send it back.

Hey All,

So my divorce just got finalized. with about 120 days till the GC expires. so I guess it's time to gather the paperwork, file and join the list soon.
I have a good question though, The ex-wife and I are on good terms since after everything has been said and done, we have realized our faults, what led to the divorce
so although I am really sad of the reality that things have come to a close and didn't work out, I am glad that we both were able to be amicable about everything, although
it did takes months of sorting through pain and raging emotions.

Anyways, my question is, on a Divorce waiver is she supposed to keep her I-865 up to date even after the divorce and subsequently when she moves, I know during the divorce and up until now when we split
she never updated that. Would that effect the divorce waiver? No one has ever mentioned it on the forums, so I thought I'd ask.

And I guess, for when I file the I-751, I just put her current address in which I have now since when she was between her moving places she didn't have a perm address. Also my decree shows her as address unknown
because of her bouncing around when the decree was submitted to the courts, but then when she moved into her new place, they were able to mail her the decree but never altered the decree, since the courts here in AZ are very impersonal. Should I attach a note to USCIS on why it says that, or is it irrelevant.

Sorry for hitting everyone up with questions, I try to research as much as I can but have been stumped on these.

Also, JustBOB, advice question for you, should I file the I-751 right away, or since the 90 day window is close should I just wait till Jan 13 to send it in, so the drones don't confuse things and not realize its a waiver and send it on back.



Her I-865 has nothing to do with I-751's information.
Since you're filing on your own with the basis of a waiver, you don't have to worry about how accurate her current info is, because in most cases people are not in good terms.

As for when you can send the I-751, the FIRST thing they look at is the category of I-751. So don't worry if you send it earlier. In my case, my divorce was finalized within the 90-day window, but there's many others who, in some cases, just got their greencard and for whatever reason figured it wasn't working out.

There's an I-751 thread in this section of the forum that I'm sure you'll find very helpful. Enter your timeline and check out other people's experience. If i were you, i would include a personal statement explaining the "unknown address" part in the divorce decree. A personal statement is not a requirement, but certainly may help you avoid an interview.

As we mention in our first post, We filed I751 more than 3 years ago and We are still waiting for something to happend. Now we are preparing to file for citizenship as adviced by one of the members here; however, we are not sure what to put in Part 10 - D. Good moral character. The problem is that I have been cited for littering, paid a small fine, no arrest has been made, and no jail time. The question is: how can We answer questions 15- 16- 17- 18?
Is this littering citation going to be a problem?
Any help will be appreciated



a littering citation is NOT a criminal act! I think it's similar to getting a parking citation - you did something against park rules, for example. If I were you, I'd answer NO.

I think you're confusing biometrics (fingerprinting) with the interview.

For biometrics, there has been some occasions where applicants weren't sent an appointment, likely because they've had a biometrics appointment within a close proximity of time prior to filing I-751.

For an interview, it may be a random thing although i'm almost 100% sure it has to do merely with evidence provided with the package. I'm a waiver filer but didn't get an interview.

I actually scanned my humongous I-751 package right before sending it off to VSC...this way I know exactly what was submitted and in which order, just incase i lose any of the evidence. So i have electronic copies. But actually i still have the original evidence too! well atleast most of it. My intention wasn't really to keep the evidence but i have almost all the evidence still in a thick pastic bag since I sent off I-751.

But I like JustBob's idea to keep them for 2 years past N400 approval. You never know..

If you, as a couple, were called for an interview but didn't show up, your wife's I-751 will be denied. So YES you need to come back. I'm not even sure (and i hope someone can correct me) about rescheduling options.

no need to worry at all folks. While I-751 is pending, you're permanent residents. I know exactly how you're feeling at the moment, but trust me there's nothing new when receiving a 10-year greencard, you have access to the same rights and whatnot, and your present waiting time counts towards your N400 eligibility requirements :)

Worst case scenario; If it does take long, you can apply for N400, which will force pending I-751 to be adjudicated.

I was told to wait until I get the receipt notice for the I-90 before I go to the infopass or they will not give me a stamp. I called USCIS and spoke to a very friendly immigration officer and she told me to call her back in a week if I don't get the receipt in the mail and she will give me the number over the phone which I can tell the officer at the infopass appointment. They can then look it up in the system and verify my I-90 filing before they give me a stamp. It'll all work out and I will come back to this thread to report as I go along. :thumbs:

I would like to point out one thing; When it comes to USCIS denying a petition, they ALWAYS keep in mind the fact that the petitioner may try to appeal the decision or file MTR (Motion to Reopen). In either cases, USCIS have the burden of evidence to prove and show why they're justified at denying the petition. And unless there're police reports or any form of indisputable evidence that proves abuse, then USCIS won't believe the petitioner and will accuse him of using the "abuse excuse". So believe me, whenever they deny someone, they likely know darn well they'll win the case infront of an immigration judge, unless new evidence is provided by the petitioner/beneficiary.

Please keep in mind that filing a waiver means you have to provide evidence of a bonafide marriage PLUS another form of evidence that justifies the category.

For example:
I-751 waiver based on Divorce: Evidence of marriage entered in good faith PLUS a divorce decree or complaint
And this can be filed simply with the divorce complaint, should the divorce doesnt finalize prior to conditional GC expiration.

I-751 waiver based on battery/extreme cruelty: Evidence of marriage entered in good faith PLUS proof of battery
Legitimate proof of abuse primarily should involve police reports, psychological or medical evaluation, etc.

I-751 waiver based on extreme hardship to return home: Evidence of marriage entered in good faith PLUS proof of hardship
So far I've never seen a case when this waiver was approved. Unless your country suffers from a nuclear attack or Justin Beibers walking around everywhere, this should be your last option.

Please keep in mind that in case of a divorce, in most cases USCIS doesn't give a lick how the marriage ended, as long as there's enough proof that the marriage was entered in good faith, which is the evidence he needs to provide for ANY type of I-751 waiver.

My advice: He needs to file for divorce immediately (he should anyway) and use the divorce complaint to file a new I-751 waiver based on DIVORCE. He made the wrong call initially and (i assume) he didn't ask a lawyer before filing the battery waiver. Simply consulting (or hiring, if necessary) the attorney will back up whatever decision he needs. He may have the option to file MTR and change the category on the existing, although denied, I-751 from battery/extreme cruelty to Divorce instead of filing a new one.

Are you a US citizen? If you are, and you're thinking about sponsoring him, your sponsorship won't help his current petition/stuation at all. He needs to file for a divorce first and then draw the plan from there.

Go ahead and mail them whatever they asked for, again. And try to add any additional forms of evidence. Even junk mail will count as evidence.

We were on a cruise this past week and received the update from USCIS that we were approved and the card production was ordered on May 10th. We received another email the next day saying that production card was ordered on May 11th. Now, when I try to look at our case online, it says that there is a duplicate case and so it doesn't show anything....

But, I think we will be getting my husband's card soon! WooHoo!

Hi! My husband and I are scheduled to go on a cruise a week after his conditional green card expires and I am assuming the way things move at a snail's pace at VSC, that we won't have his permanent green card by then.

Will we have any problems with people not understanding that his expired green card and NOA that extends his green card for one year is enough to travel in and out of the country?

I see that some people get a stamp, a I-155, I think. Would it be better if he had the stamp as well?

due to some reason I mailed my application late. I sent it last feb 9th thru the USPS express mail. But due to the recent storm we had here in PA, when I track my package it was just delivered today. Today is the expiration day of my green card. Do you guys think I made it? Is it base on post mark date or on the date received?


I know this is the least of your concerns at the moment....but do you know you can actually get your money back from USPS since their delivery guarantee wasn't met? :whistle:

Also, did you send a check? keep an eye on your online bank account and see if they cash it. If they do, you're good. It's an indication that your application has been accepted. Accepted = extension. Extension = status is good.

I second Yurika's response. Biometrics are mandatory for applications that require a background check, regardless of the amount of evidence enclosed. In fact, applicants who've had biometrics within 15 months prior to their application don't get a biometrics notice.
Adjudication (RFE, approval or denial) is one thing and security clearance (biometrics) is another..
