Hello everyone,

just recently a friend who has a temporary green card with removal of conditions in july 2015, has taken the courage to tell me she and her kids are in an abusive relationship. I know she has to file a separate I751 and not jointly with her husband, but what's more important what are the steps she needs to take to keep herself and more importantly the kids safe and also start building proofs for her case to be approved by uscis. Is it by restraining order?She is afraid to leave the home or the kids and can't go back to her country. She wants to stay here in the US.

 

Any help is appreciated.

If I remember correctly, they contacted my husband directly in Tunisia to make the appointment. Use this time to collect whatever missing paperwork is listed and get it to the beneficiary. I did write to the embassy directly to try to find out more information. They are very good about responding but may not be able to tell you anything other than what is on that form.

I've had a similar scenario when I was enrolling for summer classes while adjusting status (i didn't even have a GC at that time). If i were in your shoes, I would've printed out (from their website) whatever documents they list that are necessary to get a new DL and refuse to give them anything further, or question them why on earth do they need more documents than necessary.

Or avoid the fuss and go to a different DMV office.

As far as they're concerned, they need to only see her greencard (regardless if it's conditional). It's NOT their job to determine whether or not your marriage is real, USCIS has that covered.

I agree. I've never heard of a letter from USCIS that asks a permanent resident to surrender a card.

Its not unusual, so don't worry. You may be among those who don't need biometrics! But to overcome any worries, make an infopass. You've received your NOA1 so its unlikely that there's an issue with your address.

p.s. i am confused also because at the bottom of the NOA it says that " The I-751 form type will be listed as "CRI89" under the application type in our case status on-line tool"

The case # that you can check online will be listed on your biometrics notice (aka ASC appointment letter), NOT the one listed on NOA1. If you read the NOA carefully it says that on the bottom somewhere :)

Are they using another technology or machine readers to read the photograph while entering the US?


When I was applying for a reentry permit in 2008, at the biometrics the guy took my picture without using a flash. My photo ended up only showing a dark face with a shiny tooth. Looked a lot like a pirate.

Thanks guys, I hope so this is our first baby and the first interview was
very difficult, there told her that I had an affair and just married her for the green card.
I don't know how there can just make up lies like that.


Some of them can make great soap opera stories! When i entered the US in March i was taken for secondary processing (he claims its because my GC was expired and i had NOA1) and he brought up ####### like "isn't it a convenience to get a greencard through marriage?" and such, after knowing I have a waiver on file. I told him my ex-wife and I come from the same cultural background, and if he knew how difficult marriage criteria in my culture is, he will firmly believe my marriage was genuine :D The funny thing is, he seemed very convinced that my marriage was real, but it really seemed like he HAD to ask such questions. Overall he was very nice and at the end he said "don't worry about it, you'll prolly be getting your new card by the end of the year" and wished me a safe trip!

Even when they seem rude, I think they're only doing their job, which is trying to crack people down to see whether or not they'll fumble Posted Image but i agree that in some cases they abuse their power

That's true. However, if they considered it late, then they would've already mentioned it but you are correct, it's anyones guess now.


I presume they're in a good shape since they received NOA1 which extends their residence for an additional year. Otherwise they would've been in removal proceedings rather than receiving an extension!

You can file for divorce and file for a waiver on your own. I think you have very valid reasons.

As far as the waiver, your evidence seems good. Also, if you can obtain a copy of her son's birth certificate and attach it to your personal statement, I'm almost certain you'll be fine.

Your concern at the moment is to file for divorce, then worry about the waiver later.

Just file when you're back from your trip if that's gonna make you feel better. You have a whole month before your greencard expires. And as long as your paperwork reaches USCIS before your greencard expires, you're in a good shape.

My wife's green card expires December 2nd, we filed for her Removal of Conditions on September 3rd, just yesterday October 18th we did her biometrics.

We are planning a two-week trip out of the country where we'd fly back on December 5th we are afraid we might run into problems if say the airline, on the return trip refuses her on the basis of an expired green card (even though we'd present the letter of extension).

Has anyone traveled abroad on a letter of extension? if so please comment, we need to purchase our tickets by tomorrow night.

travelled with extension letter in march before my waiver was approved without any problems (Praise God :)) Just make sure she takes her expired card with her.

THe I-797C is the extension letter. If you read details of the letter, it will state that your status is extended. I would recommend you either call or schedule an infopass. You don't want it to go without it being attended to.

In USCIS's database, your wife's GC expires Nov 2011 and not Nov 2010 (since you applied for ROC and received a 1 year extension) and no one can argue otherwise.



small correction :) the greencard will still expire Nov 2010, but her status as a permanent resident is what's been extended till Nov 2011. This is just to ensure the OP doesn't think the plastic card is is extendable or sufficient without the extension letter.

I have gone through various forums and found that it is very difficult to apply for wavier of joint filing for men.
Not true. I've been through the process, so did many other VJ'ers here who are also men. All what matters is evidence. Your attorney doesn't make your case any better infront of immigration, all what he does is ensures you properly file the I-751 (and anyone can do it), as well as sit there with you if you're called for an interview (again, you'll be doing the talking, not him). The whole case depends on God's Will, thenyour evidence. No evidence, no approval, even with the best attorney.

1) Kindly suggest what is the best way to waive the condition? As I don't see the future in this relation, Is it good idea to initiate divorce from my side or wait till she initiates the process?
USCIS doesnt care how the marriage ended. It cares whether or not it was bonafide.

2) Your evidence list looks good. Just exclude any videos and focus on financial matters.

3) If my I-751 with waiver case was denied, how much time or days I will have to wind up stuff in US and leave the country?

It's too early to think of this option at the moment, but just to let you know the deportation process is a long one.

4) If I lost the case, can I come on my new H1B in future and apply employee based green card ? I really don't think so

5) Is there any way to get Canadian Citizenship using US conditional green card ?
Seriously?! what does one country's immigration system has to do anything with another????

I never received my NOA letter either and found it was not a problem at all getting the I-551 stamp in my passport. Remember, your status has already been extended when they accepted your I-751 package. You just need to have documentary proof.


I honestly would've preferred getting a stamp over receiving a letter just because it's more widely recognized overseas (not that I encountered any problems with the letter) and it's always gonna be in your passport, so less chances of losing it :)
