I am just wondering. Is USCIS sending email notifaction now regarding the interview schedule? Just asking cause I read somewhere here that s/he got an interview email notification.

Yes, being the only non-divorce waiver in our group here does make you feel a bit lonely. But I'd rather have everyone get divorced than widowed.

1- Yes, been there done that. Traveling with your NOA1 and GC (expired or not) is exactly what you should do. I entered the US in March with NOA1 and my EXPIRED card without any problems (praise God!). I actually don't think you need your NOA1 since your card isn't expired, but it certainly won't hurt to bring it. The NOA1 is pretty much an extension notice that serves as a proof of continuing permanent resident status for those with an expired card.

2- See my answer for question 1. They won't deny entry simply because your new card hasn't made it yet, and your NOA expires in May 2011. Will you still be outside the US by then?

3- I'm not 100% sure, but I'm almost certain they give you the right to appear in front of an immigration judge. I honestly haven't ever heard of an i-751 waiver due to death of spouse being denied. Please think positively, since this is the best cure to the waiting process.

If i were you, I'd schedule an infopass and ask if a biometrics notice has been sent at all. I know of a japanese immigrant (also applying for I751 waiver) who was questioned during her entry to the US because she was supposed to appear for a biometrics appointment even though she never got the notice in the mail. They let her in, no worries. Apparently it's your responsibility to appear for biometrics even if you never know about it. So ask them if they've sent you one. I wanna say they don't need your fingerprints again, but ask, just to be on the safe side.

P.S october is still 2 months away :) too early to worry.

I filed for removing of conditions on my GC through a lawyer under good faith marriage waiver. i am done with my biometrics and just waiting for an answer from USCIS. I am pretty hopeful that I will be granted my permanent green card because i have a very good case and documentation.

1. In case God forbid that they deny my case, my employer is ready to sponsor my GC under employment based green card. I am eligible under EB-3? what should be my next course of action?

2. Considering the scenario above actually happens, what would be my travelling document?



The process for GC sponsorship through an employer is so long it's easier and faster to go through the hoops of MTR (Motion To Reopen) and appeals for your I-751 denial (God Forbid). Have faith in God and don't worry. You may thing you don't have enough evidence, but in case of a denial and appearing infront of an immigration judge, USCIS will have the burden of evidence to show that your marriage was a fraud. And that's not easy. Trust me, if you marriage is real, you shouldn't worry a bit. And cheer up :) I was in your exact same shoes and i got approved in less than 3 months, Praise God.

I just found out that USCIS cash the check of my application and it shows wroted by them a serial number starting with EAC-XXXX of course I went ahead and checked the USCIS webstie for this number and appears invalid.

also it shows that my application for I-485 was approved on sept 26, 2008 and for some reason in my portfolio shows that it was last updated on (04/18/2010)way before my application 90-day period (dont know why)

any comments :devil:



Been there, done that. The number on the back is completely meaningless (and so is the EAC number on the receipt notice). The number you'll use to rack your online case status is the one on the biometrics form.

They touch other files for several reasons, probably to send you a reminder about your 90-day window.

what is the diffrence between infopass appointment and if I make inquery on phone with uscis and they issue service request on my case.
and if I do both then is that be okay?



Calling on the phone gives you only the same exact information you can see online (i.e useless). An infopass is when you meet a real immigration officer (not just a customer support representative) who can do real stuff.

This is correct. If they decide to deny your I-751, USCIS has the burden of evidence to prove your marriage was not real. And this isn't very easy.

Just to confirm what you said, Are you sre i can travel with the unxpired greencard. Does the divorce not terminate the status and then you have to have to NOA with you?


Your conditional greencard is *supposedly* contingent upon the continuity of your marriage. However, if you get divorced, or if your USC spouse passes away, or if you're being abused, then you're entitled to keep your greencard as long as you meet the criteria for your waiver's category. Applying for a waiver , therefore, keeps you in status, even if you're divorced. This is why conditional residents who are divorced are advised to file I-751 as soon as the divorce is filed (it doesn't get adjudicated until a final divorce decree is sent to USCIS).

Since you filed for I-751 and received NOA1 (which extends your status), I think you should be okay to travel. HOWEVER, the intended nature of this forum is only to give some suggestions, but a lawyer's advice should be what you base your decisions on. So please act accordingly.

Almost every previous months, there were some VSC filers who never got NOA.
You might be the one too. (As I remember, they weren't waiver filers though...)


Yurika& jim is right. There's a selection of people who don't get one. I see your greencard will expire jan 11, means it was approved jan 2009 and you've had your biometrics (for I-485) probably a few months before. I heard (and i definitely could be wrong) if your last biometrics were less than 15 months old, they still use it. I think this may be your case. but you never know with USCIS..

Please keep in mind that, under normal circumstances, waivers and jointly filed I-751 take the exact same timeline. I was approved just as fast as (and even faster than a few other) jointly filed applicants.


And yes, you may travel with you unexpired greencard. But make sure someone locally is checking your mailbox to see if you get a biometrics or an interview notice. Failing to appear to either one will guarantee the denial of I-751. Take your I-751 receipt notice with you.

I have a little piece of advice for those waiting on Waiver decisions:

When I filed for divorce, I was very worried (ofcourse) about alot of things including my immigration status. And as the divorce process progressed, I went on forums trying to study waiver cases based on divorce like mine. Trust me, this is one of the most useless things ever! I worried for no reason whatsoever.. I literally googled "I-751 denied" to see those who were denied and understand what they did wrong. I tended to worry too much, but honestly i see alot of people here worried, too. I know this is a very normal way to feel, but it really doesn't help. I've read tonnnssss of posts relevant to I-751 Waivers. You know what I've found out? There's 3 different categories for those filing waivers:

1. Those with good terms with their ex-spouse: Usually these cases go very smooth, as long as the immigrant has enough evidence the relationship was real.

2. Those with bad terms with their ex-spouse, Usually causing the ex to report the immigrant as a fraudster. USCIS isn't stupid, they know people hold grudges against one another expecially following a divorce, so it's not unusual to expect the USC spouse to accuse the immigrant of marrying him/her only for the GC. In such cases, it has to do primarily with the evidence presented by the immigrant, but due to the nature of the accusation, the case also passes through Immigration fraud department. This causes it to take a much longer time than usual, but all the cases (except for 1) that I've read have been approved, atleast by filing N400 application, which forces USCIS to adjudicate (i.e approve or deny) the I-751 on file.

3. Those who really ARE fraudsters: Obviously no one will post online saying they're a fraud, so I've never came across this kind of case (Atleast online). Mostly posts which talk about fraud are posted by their USC ex-spouse, so it's hard to judge whether or not the case is real. However, these cases are usually accompanied by the accusation of fraud by the USC spouse and will certainly take much longer times.

I know you think this is crazy, but I actually wanted to have an interview! I was so worried they were gonna deny my case without interviewing me even though (praise be to God) I've had more than 300 pages of evidence. And I thought an interview is my chance to prove my marriage was real.

If you're worried, sad, etc, please keep the following in mind:
1. You're a permanent resident.
2. You're authorized to live in the US
3. You're authorized to work.
4. You're authorized to travel.
5. The time you're spending at the moment is counting towards your citizenship.

Besides the little piece of plastic's expiration date, are you any different than a permanent resident whose conditions are removed?!

What's the worst case scenario?
Assuming your marriage is real ( I have no pity for fraudsters), you have the following outcomes (and God knows best). You either will:
1. Get approved (no RFE, no interview)
2. Get RFE, then approved
3. Get RFE, interview, then approved
4. Get RFE, interview, then denied
5. Get RFE, interview, then denied. File motion to reopen, get approved.
6. Get RFE, interview, then denied. File motion to reopen, then appear infront of an immigration judge for a hearing. Then defend your case, in which the burden of evidence to show that your marriage was a fraud is on USCIS. I havent heard of a hearing that didn't end up with an approval.

Above all, keep your trust in God, not your evidence. God can do magic far beyond your reasoning.

Looks like USCIS want to scrutinize "Waiver I-751" thoroughly. I guess we are presumed fraudsters in their view. However, looks like CA service center has higher rate of approvals than VSC.

Hey Okalian -- I have seena lot of posts from you and they have been very helpful. What do you think the average timeline at VSC would be for a waiver? Do you think it's resonable to expect them to do this within 6-9 months (including the interview)?


If neither an interview nor RFE involved, it takes exactly the same time as the jointly filed ones.


However, I've seen cases on other forums when it's been pending for more than 18 months. Such cases are rare, and are usually due to something wrong with the applicant (for example, if the applicant's ex-spouse accused the beneficiary of immigration fraud, or if the applicant divorced once the GC was received)

Question on the DS-156, we didn't fill in initially questions like any previous surname or middle name. Can we write those in now? will they not accept the form? Will they go over the forms and have her fill in any missing information?

They will check your forms before giving you a number for interview. Once you missed some information that you need to fill up they will allow you to filled it up by hand writing. So, dont worry about it. But if you still have time to get online do it now and re-check before printing it. Good luck her interview... star_smile.gif

We specifically asked for the stamp in the passport at our infopass appointment(which we made the same day of biometrics appt.) after explaining that we never received the notification letter to extend green card. They said they couldn't do it. Not sure why and they didn't give a reason but said the would send a duplicate NOA1. We got the duplicate in the mail yesterday. Good luck to all with the process!

I thought I'd post again in case my information is helpful.

My wife and I sent our joint I-751 on March 23, received in VT on March 26. We got a biometrics appointment in the mail on April 12, for a May 7 appointment, but never got a NOA1. Our mailperson is awful, so I suspect she lost it or delivered it to the wrong person.

I made an infopass appointment for the same day as my biometrics appointment, in Atlanta. At the infopass appointment the USCIS staff member put a year-long I-551 stamp in my passport. I'd only half explained my situation, but as soon as I mentioned I hadn't received the NOA1 she stopped me, checked some stuff on her computer, and went off to get the stamp. She didn't suggest mailing me a new NOA1.

I'm quite pleased about the I-551 stamp. We're travelling overseas in June, and the letter would have been a hassle. Plus, the expiration date on the stamp is May 6 2013, probably a month and a half later than the expiration date of the letter.

We went to my husband's biometrics appointment yesterday. All went well. We also made an infopass appointment for the same day since we never received the NOA1. They requested a duplicate to be sent to us. They said they couldn't stamp the passport. I'm not sure why unless I misunderstood about that's what others have done. I pray we receive the duplicate notification!
