Honestly it sounds like she was using you for money from the very beginning. I'm surprised you fell for that. But regardless, you're now going to have to prove that YOU did not enter into this marriage for the purposes of getting her a green card - which may be hard to do given the fact that you declared here that she flat out offered you $ before you ever got married.

You need to get a very very good immigration attorney (not to mention divorce attorney).



Hmmm. If he alleges she married solely for immigration benefit, the onus is on her to disprove. I don't believe the USC has to prove anything other than his suspicion has merit.

I may sound ignorant but I really want to make this marriage work because I do love her even with all that has happened. I guess love is blind. I am only human and can only put up with so much, when I feel there is no more hope and if she goes then my only choice will be divorce.

You allege a marriage for immigration benefits and yet she has your baby? That leaves a funny taste in my mouth since a baby is typically not what a woman that marries solely for immigration benefits makes part of the equation. :no:


The baby was not planned, she did not want a baby. When we were 1st married we lived in Memphis, she got pregnant. She had to go back to Mexico to see her daughter that she had not seen in 2 years. Our baby was born in Mexico City. I had to go there, have DNA tests done to make him a US citizen.

The reason I beleive this could possibly be a fraudulant marriage is her actions before and after the marriage.

When we 1st met, only friends she asked how she could become a US citizen. My answer was she would have to marry a US citizen. Well she then offered me 2 thousand. I said no, I only marry for love not money and I didn't speak to her for about a month.We started talking again, started dating then married after 8 months. We had what I call normal marital problems from the beginning. Example: Shortly after married she lost her job, 1 month went by and we were behind on bills. I was trying to pay everything but was unable to do so. She finally got another job, I asked her to help me catch up on the car notes, by this time we were 2 months in the red. Instead of helping me she sent more than 1000 dollars to her parents in mexico for her daughter. We lost the cars. I did not have a problem with that at the time because I thought her family was poor. I finally met her family in Sept 2004 and they have an 8 bed home in Mexico City, her father is head accountant for a company and her sister an accountant under him. I do not beleive they are poor. When my wife was staying in mexico 1.5 years while I filed all the immigration paperwork, I was sending her 500 each month. She did not have to pay any bills other than take care of our kids ( My son and Step-daughter ) The problem is she would spend that money rather fast and then borrow from her family. She maxed out her sisters visa card with her permission. I went there 11 times and each time I had to pay her family money for what she had spent.

Now here is another example: On August 17th, 2005 my wife called me and said she was crossing the border illegal again because she had no money. In July i was there and gave her 500 plus bought enough diapers for the month. She wanted to cross the border and go to memphis for work. Well I'm in Louisiana, I asked her why not come to Louisiana. She said she had a job in Memphis and would come see me when she could. I was in a panic and sent her 710 dollars, she stayed in mexico. On September 10th I was back in mexico and she had no money. I asked what happened to the money I sent, she said she owed it to her mom. I find that strange that in a months time she spent 500 and then had to borrow another 710. She had no bills.

In december she was here in my office and we were going over the budget, asking each other questions. I asked her how she spent 500 each month when it was only costing about 220 for the children. Her reply was she was buying groceries and helping her other sister out. I am okay with helping family but I was struggling here to pay bills , pay for immigration and send them money.

I truly do not want to call this a fraudulant marriage but her actions are showing me different. She has been here to months , shows me no love and totaly disrespects me. It was not like that when we 1st got married.

Often, even a full-custodial parent has to demonstrate legitimate reason to remove a child to another state.


I believe if I tell her my son must stay that she will also stay. I do not want that be the reason for her staying with me, because she will not be happy. I'm not going to use my son as leverage to keep her. I'm just not going to stay married to her if she does not love me. I have contacted an attorney to see what my options are because I want full custody. If she moves to Memphis, she will be living with her cousin and a brother that are illegally here in the USA. If we divorce according to the INS laws she is subject to be deported. I do not want that because of our son. I wish she would at least try or tell me the truth that she married me for legal status.

I need some help.

I married my wife in September 2004 in Mexico City. We went through the immigration process and she has been here since November 20th 2005. Only 2 months here in Louisiana and she says she is unhappy with me and her life here. I have tried everything to please her but she keeps giving me hell. She has been wanting to move to Memphis, TN since she got here. The problem is I bought a home here in September as per her request, have a great job, great pay, cannot make this money in Memphis. Homes like ours in Memphis are triple the price. She does not want me with her, she wants to get away, thats why I thinks its a fraudulant marriage. On the way to work this morning I took her to her new job, 1st day there. We were talking and she said how unhappy she was here. I tried to explain that its a cultural shock because she went from a big family in Mexico to no family here, she does not agree. Finally I told her that me and my family have done everything we can to make her comfortable and I do not know what else to do. I bought us a home, her a van, helped her get a job, drivers license and legal residency. Close to the end of the conversation I told her wanted her to be happy and that if her going to Memphis will do that then she can. Her response was, can I go Friday and can I take my papers, ( immigration papers ). I asked her to stay and try to adjust but she does not want to, I believe she had this planned all along. The problem is we have a son 14 months, can I get custody of him?

I am about to file I-130 and I downloaded the file some time back. The one I downloaded says "Expires 11/30/07" on it and the ones that I see linked from USCIS on VisaJourney say "Expires 1/31/07." Which one should I use? Am I missing something?

but see...at the moment what I care about is spending the least time away from each other so I figure that if I go there while we get married we can apply together and wait ....and then...when my 6 months visa is expired I will come back to italy...that way I can stay there while the visa process is pending...I think that with k1 I can't go to the states until visa is issued...I will just go there as soon as he gets a stable address.
I checked the dcf in the netherlands...thanks for the advice, I have been living there for a year and a half and didn't even think I might have needed to go back there to do this....:o)

Yes, I understand your point about spending the 6 months tourist entrance together in the US. There is always the risk that you will not be admitted, so do have a back up plan. The same applies if you visit while you have a K-1 pending. Most people are admitted for a visit while they have a K-1 pending, but some are turned away. As always, it depends on that individual's situation.

What a shame that you did not know about DCF when you were in the Netherlands! Ah well, it all works out eventually :)

"Bouncing ideas around" means just talking about various possibilities.. sometimes when you have lots of choices, you just have to talk them out and see what you can learn so that you can make your decision. That isn't a very good explanation of that idiom, sorry!



I do get the point, thanks a lot! you know....in order to get some info I sent an email to the us consular office in naples and I got an automated reply saying I would get an answer in two weeks!!!!I love this website!!I wish I could also help people around but for now my knowledge is pretty basic.
Anyway, I have thought about the fact that I might be denied entry...but I seriously do not want to staylonger than my visa lasts and I will be honest, I get really scared and anxious everytime I go through immigration in the states even ifI have nothing to hide. I am gonna go there with a baby, wow I really hope they won't be so cruel to send me back right away....

If he is in the military, I believe that the processing centers give members of the armed forces special priority. His Commanding Officer may have to give him a letter.

wow for real? If I knew that just a little while ago..., the problem is that we are not married yet and it would still take some time to get married in europe no matter what country as I have even checked to go to Norway...someone told me you can get married quick over there. not so true..but we are just too tight with time now..we have waisted it on researching in the wrong places...

I know about those European marriage timelines... I hear that Gibralter is very fast, easy and no messing around. Not the easiest place to get to, buuuuut....

I suppose the fiance option is the next best. As a Navy guy, your fellow has not lost his US domicile; he just needs a stable US address to send that petition off from. The sooner, the better, obviously. Going over to marry, then filing for the K-3 would take an additional period of time for virtually the same result.

I checked the Vermont Center and they process the I129f very quickly but if he uses his parents address it's under TexaS center which is taking more time...maybe I should just wait..we also have to see if he will be deployed on the ship...that will slow everything down even more....I will ask him about the expedite..

Since you know something of DCF, I have to ask: How fast can you get to the Netherlands and get married? Amsterdam does not require residency from the USC (tho your fiance probably has it) and they are known to be quite fast with the visa processing. It might be worth looking into.

Members of the US military do not lose US domicile while in the service. Your fiance should send the I-129F petition to the service center with jurisdiction over the last residence he lived in. Or he can use his parents' address. He can even ask for an expedite if he is to be deployed somewhere.

If your husband send the I-129F petition now, chances are you will have a K-1 visa within 8 months.

When we started our visa process we decided on using my husbands parents address also, because he is also military, and moves frequently. All my stuff went to their address and have never had a problem, even after we got stationed in Germany. I simply flew back for my AOS interview.

Hi everybody,

my fiance who is in the Navy had a last minute change of orders so instead of coming to stay with me and our 8 months old son in Italy he we'll have to fly back to the States in less than a month. We didn't marry yet cause we didn't have any rush but now we do if we want to stay together and in italy it takes too long.
He doesn't have a residence in the States yet, only the address where he was born and where his mom lives. Do we have to use that address or do we have to wait until he gets one? Or better yet can we ship the I129f to the States anyway via Dhl? If so what address should I put?

I have another option I have a 6 months visitor visa still valid on my expired passport. What if my son and I join him in the States, get married and the petition for K3. How long can I stay there until I have to go back to Italy for the interview?

DCF is not a possibility, our Rome embassy won't process requests for US citizens who are not residents of Italy and we are notmarried yet anyway.

I would not worry so much about the different visa's in your passport, what I would worry about is the length of time left in your passport and the fact that you have no job in Italy and you are taking your son with you on this trip. Can your partner come to you in Italy?? It would make things a whole lot simpler. Also was just wondering you will need to renew your passport can you not do that now?? I know in some countries they allow you to renew upto six months before your old one expires.

oh no...that 6 months visa is in my old passport but I also have a new almost immaculate one... but reading what you all say is what I am also worried about, so I don't think it's a good idea to travel until we can actually move there..after filing for K1

No one here can tell you what a CO officer will do for sure. It is at their discretion whether or not to admit you, and they can ask you any questions they see fit. That said, you're well within your rights to visit here. Having other visas before that *shouldn't* have any bearing on your visit this time.

The only thing you can do is bring documentation to show ties to Italy, and hope for the best. Perhaps you could schedule your flights to go through Shannon, Ireland as that is a US port of entry (as far as immigration is concerned - not customs - I believe Dublin is also the same way, but research it for sure). That way, if you do get turned away, you wouldn't have as far to travel back home.

Hi, my fiance insists on going to the US to visit him and stay for a period of 3 or 6 months. I have a 6 months visa still valid on my old passport. I have been reading a loton this forum but everybody is going to the US alone. I will bring our son too and I wonder if that will be a reason to make the immigration officer even more suspicious about my intents of going to the US. I do not have a job in my country so I can't even show ties but I do intend to return. I just would like to stay there for a while so that our son can stay with his father for a bit before we decide to apply for a K1 which looks like it's gonna take too long.
Do you think I should just go there for 3 months?
On my old passport I have different visas from the past 10 years, such a j1 and student visa, plus the b2 . I wonder if that can prevent me from entering as they would think that I have tried different ways to cme and stay in the US. and ones I get interviewd should I tell them I am visiting my fiance or my boyfriend? would that make any difference?

Hi guys, I would like to share this with you as it might be interesting and useful to some who maybe are in the same situation as mine:

my fiance is deployed on a ship and as many of you, we were waiting to receive the RFE about IMBRA. Well since he wasn't able to pick up the mail in the US he asked an operator of the call center if it was possible to get a copy of the notice with the supplementary info requested. Well I was skeptikal about them doing it and I was already trying to figure out a way to get the envelope sent to him on the ship, but after two days he got everything in the email from Vermont Service Center!!!! All he has to do now is print it, sign it and ship it back from there!

One thing I am concerned about...is the envelope....have you guys received an envelope with a specified office it has to be shipped to or similar? Because I wouldn't want to risk his envelope to end up in the pile of new applications instead of RFEs and be treated different, or even be lost somewhere!

don't put local address, they only want a US address so your mother's would be perfect. Depending on wether she lives then you will use the US Service center that belongs to that state to file for I 129f.


....don't put your local address at the top of the form cause uscis will only ship notices to us addresses so your mother address is fine also for when your fiance will be in the states.

I realize your frustration. The waiting is excruciating, but well worth it. The good news is when married couples get their approval, the spouse arrives with EVERYTHING! Permission to work, travel, etc. When my fiance arrived on K-1, we had to wait on all of that. I know other married couples from Brazil and Morocco have also been waiting much longer than those who applied for K-1, so it's not just the Tunisian embassy. I also noticed that sometimes workers on the phone were kind and helpful and others were brusque and rude. I definitely think our government can do a better job of training its workforce. However, we always dealt with very kind people at the embassy in Tunis, and had good experiences with them. Hang in there. Use this time to prepare for your lives together, learn more about each other and be productive. As happy as we are together, life here in the states is a big adjustment and will try the strongest relationship. I advise spending the time talking about how you will live here, lining up jobs, preparing resumes, working on English, studying the driving laws of your state so he can pass, budgeting for all the expenses when he arrives, plan what the first months will be like (expectations of behavior such as who will make breakfast, wash clothes, etc. while the other one is working). The energy spent on longing for each could be turned into building time that insures a positive and successful transition. Hoping the best for you. Believe me, I understand how hard this is and just want to be a voice of encouragement.

Hello everybody,

I have a couple of questions and I need your help please :help:

Our I-130 was approved on 08-21-2006 (the I-129F was approved in the same day, too, and it was forwarded to Casablanca)

I (the alien) received the « Choice of Agent form » - i sent it back and chose my husband who lives in USA as my agent.

We are following the NVC chart, but we are a bit confused :wacko: … Sometimes, we wonder if we are going in the « right » track or not?!! :blink:

Now we are less than a week to my I-129F interview in Casablanca (October 19th) … If everything goes well with my interview, I’ll travel to USA by December

For my husband’s side, he sent back the AOS Bill payment. He received also the I-184 affidavit of support package and he’ll send it back in the next couple of days!!

What should the next step be? Should my husband continue following the petitioner track as it is explained at the NVC Process Flowchart??

Or should we abandon and wait till my arrival to USA to start the Adjustment of status process?

We need your help because we are a bit confused and we don’t know what we should do???

You shouldn't have too much trouble finding work if you have experience. International companies welcome people who speak other languages and can communicate with offices overseas, or foreign customers. I'd recommend checking out the chamber of commerce of the city you will move to, to see who the big companies are. If you can find any that do international business they should be your first targets. Shipping companies and exporters or freight forwarders are also good bets. Speaking a foreign language is a huge plus nowadays especially in international sales divisions of major companies.

Hello girls,

Sometimes, I think about this issue too... in my case, it's "me" the job seeker!!

I speak fluent Arabic & French... I can read & write English quite easily, but my spoken one needs more practise... Computer skills are quite good. I worked (and still working) in the administrative field (3 years experience)...

I hear so many people complain about the difficulty to find a job in USA especially if you don't come from UK or Canada, and that your diplomas are not American ones.
It's still early for me, but I keep searching in Monster, Yahoo & Craiglist... so as to have an idea about the job market & the requirements.
I hope that it won't be that difficult & won't take long to find a job... of course, i'm not planning to work from day one of my arrival, i need to have a general idea about the American life style first, but after, i'll start to look for a part-time job or internship or even a volunteer one so as to acquire some experience & not getting bored

He's in New Orleans... But i'm not there for the moment... I'm still in Morocco.

I'm from Mohammedia, Morocco (25 km to the North of Casablanca), its original name was "Fedala", and it was changed to "Mohammedia" in Mohamed V King's reign...
My husband was born in Morocco and has been living in USA for 14 years...

I'm impatient to be with him forever :luv:

Yes, Noura, hope we meet one day... My husband and I started to talk about a "relocation plan"... but for the moment, we put it in a "stand-by" till after my arrival inshallah !!
