US Citizenship General DiscussionAccidental Claim to US Citizenship back in 1988

Then you have to go through the lineup of untrained clerks and several layers of supervision that have no clue what to do next because you are the FIRST one that ever said "no" to that question in all 7 weeks of their employment and they were never trained WHAT to do for THAT!

You're absolutely right...

US Citizenship General DiscussionSpeeding ticket

Unfortunately I got my first traffic speeding ticket today. This is my first speeding ticket since I got my license 12 years. I have already applied for my citizenship. If I pay the fine then do I need to tell at the time of interview?

This post should answer your question :)

US Citizenship General DiscussionChange of Address and N-400

Hi, my wife has started filling out the N-400 and we have it completed now. I've been going over everything to make sure we have it all correctly annotated, but discovered today that we were supposed to keep up with Change of Addresses. I didn't know this until I came across a news article. She's lived in the US since December 2004. We've moved a couple of times since then. I know we need to get this address updated (I just never thought of it as a US citizen), but how is this going to affect us when it comes to the N-400. The article I read said a businessman was deported over no change of address. So obviously fearful of what's to come.

This is someone who was in the same situation http://www.visajourn...filed-an-ar-11/ and this is his post about his approved interview http://www.visajourn...ost__p__5952830 . You can make what you want out of it :)

US Citizenship General Discussionhow do i handle this situation?

i am in chicago do, applied with 5 year rule, and my interview is scheduled for 2nd week of april. i have generally seen chicago do applicants getting oath letter after interview or after some days. i am travelling in may end, and will needs visas to my travel countries.

so should i apply for the visas now, but then i will have to give them my current passport and what happens if they dont send back the passport wth visa before my interview. so i am thinking of applying for the visa on the next day of my interview if i dont get the oath letter on the day of interview.

what do you guys think of this?

It depends how long the visa processing takes (or is anticipated). If i were you, i would apply after the interview. From mid April to end of May is plenty of time to process. Who knows, maybe you could be done by the oath by then and travel visa-free with a US passport :D (unless you're going to a country that requires visas from US citizen!)

On the other hand, according to several immigration lawyers here, they say you don't have to have the passport at the interview. I beg to differ... BUT if this is the case, maybe certified copies of pages with entry/exit stamps will suffice.

US Citizenship General DiscussionTraffic ticket not on driving record
So basically i intend to disclose it, but how far back should I mention? I don't mind mentioning all tickets I've ever had (i think about 6 in the last 12 years), but should I only mention those since I became a permanent resident? It will be very hard for me at this time to obtain receipts for paid tickets 6 or 7 years ago!

US Citizenship General DiscussionTraffic ticket not on driving record
I'm applying based on 5-year rule and I'm preparing a list of documents to take with me to the interview, God Willing. I obtained my driving record, however there is only 1 ticket! I know i had another ticket february of last year but for some reason it's not there.

Basically, if the ticket isn't in my driver's record, do I need to bring it up at all? I don't want to cause any confusion as to why it's not on my record. Anyone had a similar experience?

and for taxes, there are years when i was a student and didn't make enough money to file for taxes. Do I have to bring proof that i wasn't required to file for such years?

US Citizenship General DiscussionPassport and Oath

Hi!

I am starting the process to be a US citizen. My question is, after the interview can I start the process to have a US Passport or do I have to wait until they schedule me for the Oath? I am planning on travelling this year to my country but I don't know if I would be able to receive the passport on time.
Thanks.

You're eligible to apply for a passport only if you're a US citizen, which takes place only at the oath. However, once you become a US citizen, you can apply and get a passport the same day if you apply at one of the passport agencies shown here. Proof of international travel within 2 weeks of your visit will be required.

US Citizenship General Discussionafter 36 years

when they became citizens as long as you were under 21 you should be included.

I think you're confusing 2 different laws. Child Status Protection Act (CSPA) automatically grants a greencard when parents are granted a greencard, as long as the child is 21 years or younger and unmarried. However, Child Citizenship act grants citizenships automatically if one or both parents are naturalized when the child (a permanent resident) is 18 or younger.

So if the OP was 18 when his parents naturalized, he most likely is already a citizen. Since he was 20, he's on his own, citizenship-wise.

US Citizenship General DiscussionCitizenship in 2 years ?? huh
That "person" seems to have a whole lot in common with me :)

There's a 3-years (-90 days, almost) difference between the permanent greencard and the date I applied for N400, look closely at the dates. And that 10-year GC was a couple of years after I received my first greencard. I'm also applying under the 5-year rule.

In summary:
Resident since 3/8/2008
Conditions Removed: 4/30/2010
Applied for N400 12/2012 (90 days prior to 5th GC anniversary)

The waiver mentioned is for the joint filing requirement.

In your case, your husband is eligible to apply based on the 3-year rule, i.e 3 years ( -90 days) from the date he became a permanent resident (assuming you've been married since or before that date).

Found it best just to send in a personal check, check my account and print both sides of that check and file it as proof they received the application.

I thought they'd do that with my application, as they previously even would print a number similar to that of a case number. However, I think nowadays they process checks as an Electronic Funds Transfer (EFT) and keep the check as an authorization..that's what they did with my check for N400.

US Citizenship General DiscussionDual citizenship - Moroccan & American

I have dual citizenship with the UK and USA. It has been suggested that I always use my US passport when entering other countries, including the UK, and that is what I generally do. I know other naturalized US citizens, however, who use their British passports when entering the UK.

It seems to me that, if checks were performed, it is possible that a US border patrol agent could take issue if your husband did not have a Morroccan entry stamp in his US passport and this could have ramifications for his US citizenship. But this is pure speculation on my part. Do US citizens require a visa to enter Morrocco?

G

No they don't require a visa to enter Morocco, but there are some paper to prepare if they exceed 90 days in the kingdom.

well, i see the need to give more info.

I've never been married before. Our kid is from our current marriage. she is USC.

my husband (USC) is also originally from Morocco. We met there. We got married there. I came to the US under K3 in 2007.

He agrees that I go back to Morocco and file for divorce (under the same court where we got married). it'll take us between 6-12 months. My husband prefers to stay in the US. I will get the custody of our child and live in Morocco She'll see her father twice or more/year.

However, I still want "the option" of applying for citizenship next year (April 2012), if I decide so (still not sure). Coz who knows, may be i'll come back to the US one day with my child. I prefer to have both options "if possible".

I want to make things legal and at the right way. that's why I'm asking here, may be somebody went throu this before.

Thanks again

Thank you All for your answers.
Here are some additional info:

we do have a 2 y.o kid from this marriage (USC). Because of my kid, that i'd like to apply for citizenship so as i'll "flexible" to come back to the US if we have too.
As i mentioned before, I planning to go back to my home country to file for divorce. i prefer to be close to my family in this process... there, it takes usually between 6-12 months.

I'll be eligible to apply under the 5 years rule, in April 2012. (almost 14 months from now)

US Citizenship General Discussiondon't know what to do.. please help
Hello there,

Well, i'm in a real dilemma. Here is a summary of my situation.

I've been married to my husband (a USC) nearly 6 years. I came to the US in summer 2007. i got my 2 years GC then my 10 GC.

Based on the 3 years rule (married to a USC), I have the right to apply for citizenship since last April (2010). But I need some documents (such as my husband's past divorce decree, his ex wife-full name/date of birth, last years' taxes..., that my husband keeps hiding and avoiding to giving them to me for my N-400 application.

For the last couple of months, we've been going through very difficult time in our marriage. As for now, we are still married and living together. However, I'm planning to go back for good to my home country (next month) and file for divorce there (coz we got married over there).

my question is:

If I leave the US for more than 6 months (let's say up to 12 months), will I will I lose my "permanent resident" status? can I later (if i come back to the US), apply for Citizenship?

- is it possible to I apply for citizenship in the US consulate in my home country?

a friend suggests me to stay here for a couple of months and hire a lawyer for my application of citizenship, coz, if i later, I'm not in the US for more than 6 months, my GC won't be accepted anymore... I'm not sure how true all this is?!!!

Please share your thoughts and advice.
There are many things going on, I can't focus and make up my mind. thank you !!!

This is where you get a paper hospital gown that you change into.

What? This must be new. Unlike the thoroughly humiliating experience my fiance had to go through (along with everyone else) being completely naked and in front of a female nurse. blink.gif

Yes, I think it is new. My fiance's sister said she did her interview at the old consulate which was much smaller. According to her, about ten people were in a room and all naked. headbonk.gif But yesterday at the NEW consulate it was in a private place and she was given a paper hospital gown. When she had her chest xray, the nurse told her she could cover herself from the waist down and then have the xray. I dont know if she got a caring nurse or what, but she said it seemed to be very professional. good.gif

We are at Juarez now. We paid $135.00 for an adult and 55.00 USD for a child who is 10 years old... plus 10% TAX for the medical exam. We paid this at the Medical Center.

If you are a K-3 (married) and you have to get some shots you pay extra for the shots.

Just as a point of information be prepaired to stay 4 days PLUS your interview day at the consulate if you have to go through the medical exam for a child. The reason is the TB (tuberculosis) shot which takes time for the "reaction" to see if it is possitive or negative.

We got the results of the medical exam the same day! BUT not the TB shot. We got in late Sunday night and were totally exhausted and could not get up at 5 am to go wait in the lines. So we got to the exam at about 10:30 am and went right in! NO WAITING! BUT THIS MAY NOT ALWAYS THE NORM!

First you go into the medical exam building (MEDICAL CLINIC). You go off the street into a gated area where there is a group of people. Some are there to get their results of the exam and some are there for the exam only so dont let the large group of people discourage you.

When you are at the door of the Medical Building the guard asks for your passport and your letter from the American Cosulate General that says your visa was accepted.

Then you walk about 10 feet to a desk and they ask for the same papers. They will keep your paper work (which you will get back later) and forward you to a waiting area. This is where you wait for your name to be called. When its called you will go up to a window then they will take your picture and make a card with your picture and a barcode.

After this is done you will go out of the lobby area and go into the area for a blood test and an eye test. Don't worry there is a lady who directs you what to do and where to go.

Next is the PHYSICAL exam part. They put your information in their computer. This is where you get a paper hospital gown that you change into. They take your blood pressure, meaure height and weight and do a typical short physical exam. They ask about medical history then the next stop is the chest exray.

Then you get dressed and go for innoculations if you are required to do so. Next you pay, and in our case we were told to come back at 2PM for the results.

I dont know if this is the norm or not, but for us... we went in around 10:30 am and had our exam results in hand at 2:45pm the same day. We are now waiting on my fiance's daughter's tuberculosis results.
DO NOT OPEN YOUR MEDICAL EXAM! BE SURE TO LET THEM DO IT!

Hope this helps someone.

Hi I am new here and I'm almost ready to file my first papers but I am confused about the I-129F application on question # 20.
My fiance lives in Guadalajara Mexico and I dont if I put Guadalajara for the answer or Juarez?? I know all K1 visas are issued there BUT do i have to place my initial petition there? thanks for any help.

Juarez is the correct answer. NO matter what city you list, your approved petition will be forwarded to Juarez.

Actually, your initial petition is placed either with California or Vermont. Then all approved petitions are forwarded to Juarez for processing.

My fiance is from La Barca, but works in Guadalajara. You have not lived until you have been to the local wrestling matches at the Guadalajara Arena. It felt like I was in a large high school gym from the 1950's.

GRRRR I dont know exactly how to reply to a post here so i'll try again

Thanks Brian for your reply. I know this VJ web site sure has helped me. Is there anyway to add you or maybe get your email? I'm sure you have advise that will greatly aid and ease my processing strees and frustrations.

Just as a point of interest...I LOVE GDL! It is such a cool place! I've been to the futball games, to the downtown square during holy week, EVERY tourist trap and attraction, and had a blast. I dont know where La Barca is but I will find out tommorrow tonight when I call my fiance. It might be benificial for our "wives to be" to contact each other???

I have a MOUNTAIN of paper work all over my livingroom floor tonight that I'm trying to get together to send off Monday. I never thought it would be so detailed and envolved! My fiance has a beautiful little girl by the name of Michelle who will come here also. They both came here a few months ago and LOVED it! Trying to get everything done correctly for the both of them has been sort of stressful but it will be worth it all! Heck, it took almost 5 months just to get all the paperwork just to file the petition.

Anyhow thanks so much for the information. IT HELPED!

US Embassy and Consulate Discussionquestion / I-134 affidavit of support
Hello everybody,
My husband is preparing the affidavit of support (I-134) and we have "a doubt" for question #11

it says :
11. That I intend --- do not intend --- to make specific contributions to the support of the person(s) named in item 3.
(If you check "intend," indicate the exact nature and duration of the contributions. For example, if you intend to furnish room and board, state for how long and, if money, state the amount in United States dollars and state whether it is to be given in a lump sum, weekly or monthly, or for how long.)

The sample answer published in this website says : N/A ( K1 visa process for permanent residence )

We are filling for K-3 visa what should we answer?? help :help:
thanks in advance for every answer & suggestion

US Embassy and Consulate Discussionwhat if....? i need your HELP PLZ
Hello everybody,

I have a question for you and I need your explanations, opinions, suggestions and HELP !!
Well, in one hand, I took the I-129F interview in october 2006 (5 months) and i was given the 221g paper for administrative processing in Washington DC. My husband called the DOS yesterday and they told him that the process is at its final stages and everything is good so far. they'll send the answer to Casablanca consulate as soon as the process is finished.
in the other hand, my I-130 case is complete, and NVC told him to call, also next week, so as they'll give the interview date!!

My question(s) is (are):
- What will happen to the I-130, if the consualte call me to bring passport to stamp the I-129F visa?
- What will happen in the opposite scenario? i.e I have an I-130 interview before the I-129F A/P is completed? does it mean, that they'll give me an other A/P after the I-130 interview??
and the main question is:
- Let's assume that the consualte call me to bring my passport to have the I-129F visa, is it possible for me to KEEP the I-130 interview date, that i'll be given by NVC, and wait this date to take the interview in Morocco?... OR, isn't possible, coz the consulate will cancel my I-130 interview, once they'll give me the I-129F visa?

I hope that i've clearly expressed myself... i really need your help guys
thanks in adavance
