I'm so disappointed, I know I have 90 days to wait from the time I was put inline for interview but it's been over a month now since I was put inline and I haven't received anything, not even a yellow letter. It seems like everyone else is being scheduled or getting a yellow letter. I've looked at the status of the applicants that filed on the same day as me and most of them have been scheduled for an interview. Just my luck.


I was in the same situation when everyone else was being placed in line for interview. But then things suddenly moved forward. So relax!

I got the yellow letter as well, since I went out of the country twice and I had a ticket (I didn't have my reading glasses) therefore I have to submit evidence.
The thing is that letter said to bring the documents because I was "arrested"... I was never arrested but I was cited to court.
I just have to go to the court office and ask for the copy of my case that it was resolved and that's it.


I think it's generic information, but honestly you should bring the court letter either way.

When is your interview date?

"On February 12, 2013, your N400, APPLICATION FOR NATURALIZATION was scheduled for interview. You will receive a notice with a time and place for your interview."


Nothing in the timeline to update such status, but you should be receiving your interview letter in a couple of days :) Once done, come back and update us with your interview date and I'll update the timeline.

i'm actually very curious to know your interview date since I had the same status update yesterday, and I won't be back in town until 2/23, God Willing. So I won't know the date until then. And knowing your interview date will give me an estimate on when mine may be :)

In most cases i think it's 1 month after reception of the letter.

Most of their level 1 representatives are not as knowledgeable as you would anticipate, and they will simply tell you to "wait" or their famous "hear back within 90 days" and such. Your best bet is to schedule an infopass and ask off any questions.

I have my interview on feb 19. Someone please share your knowledge . My question is can I know if my approved or not on interview day ? I mean after I am done with my test , the interviewer tell me you approved or not . Or do I need to wait to get the letter from uscis agin to know if I got approved or not . Thank you every one :)


In most cases they'll tell you on the spot. There are some cases when applicants are told "a decision cannot be made" if their application is missing some info, or if the IO needs to further review it.

my previous petitions had been touched during 1751. I understood this was for them requesting my files at the local office. As the files are all kept central. So when you file a new petition that warrants an interview such as the N400 your local office requests the files.



The same here. I just got done removing my conditions and some previous applications, specifically i-485, was touched. It primarily means they're looking at your file, and I think they scan any of your previous paperwork so as to pull up the rest of your info. This is completely normal, don't sweat it :)

I have been in US as a student between 2005 and 2007 with more than 6 months total travel abroad during that period. However, I became a resident at the end of 2007 with only 50 days abroad since then, therefore anything before that shouldn't really matter on their "count", right?


Correct. Only your time as a permanent resident count.

You know whats funny? they consider you non-existent until you become a permanent resident, regardless of how long you've been in the States :) They even send you a "welcome-to-the-United-States" letter when you get your greencard :D But i guess they look at it like you've always been a visitor.

But to be very honest, i really admire the fact that they tell me "Welcome Home" when I arrive at POE, even though im not a citizen yet. Gotta love America.

So the child of a Moroccan born anywhere in the world is automatically a Moroccan citizen without having to apply for Moroccan citizenship ?

The law is similar in Egypt, too. But unless the country of birth grants citizenships based on birth, Egyptians (and similarly Moroccans) notify their embassy to produce an Egyptian passport for their newborn. I wasnt born in Egypt and my country of birth doesn't grant citizenships so easily. But if my parents never applied for a passport for me, I doubt that Egypt will know i even exist. In a country like Egypt, a foreign woman can easily become a citizen after marriage to an Egyptian for 3 years and speaking Arabic. But it's impossible for a foreign man to ever become Egyptian. I know of an indian family who settled in Egypt, and they have 2nd generation kids who know nothing about India yet don't have an Egyptian passport.

It's similar to someone born with American parents overseas. I know someone who has american parent yet doesn't have ( or i think doesnt even care for) having a US passport. She's born in france and her parents settled there. And she can simply file N600 for her rights for US citizenship to be recognized.

Finally, i have some colleagues who are from Latin america but with Italian passports due to their italian ancestry. They're dual citizens yet their parents chose for their kids to have EU passports to have better benefits.

It's funny how alot of Americans (especially USCIS) assume you're a citizen of the country of birth. But I guess they can somewhat justified due to the fact that you can easily change your country of citizenship, but you can never change your place of birth. So they recognize your birth place as your identity instead of some government issued document stating you're that country's citizen.

I'm a huge fan of diversity :)

well...best bet is to do some bank and credit card stuff...there must be some paper traces there i guess...also check ya e mails from the times you booked up a flight cas normally the airline will send you your flight scedule..

Speaking of passport stamps, do you have to show proof to support the dates you write in N400? I still have a while to file for N400, but thinking if i have to keep copies of my passport's pages with stamps, just incase I lose my passport or whatever? Do they ask for proof of entry-exit dates?

You're fine, actually. You have passed the interview already and had travel plans in place. Just go to the USCIS office with your travel tickets and respectfully ask them for to re-schedule your ceremony to a date after your return. They won't have a problem with this. When you do go to your new oath date, bring along your passport as you will update your 'out of country' data at the time. As long as this does not redefine your residential or physical presence requirements to be less than the minimum required for citizenship it won't be a problem at all.

Enjoy your trip and don't worry - you will get your citizenship at a new Oath ceremony after you return. Not a problem :) .


Ditto. My roommate's oath letter arrived while he was overseas and requested that his oath ceremony be deferred. He was rescheduled for a new oath ceremony on Feb. 15th (initial date was Jan 9th i think)

I was going to post the exact same thing.

If they're looking into the timing of your ROC vs Separation vs Divorce then you could be in for a rough time as is sounds like you should have filed single with the "divorce waiver".

Since the Conditional part of your Greencard was being married to a USC then this difference might even constitute Material Misrepresentation which is #2 on their No-No list only to False Claim of US Citizenship.

You need to get some really good advice from a Competent Immigration Lawyer ASAP...



That's exactly right. Why do you think people go through the trouble of filing with a waiver even if they're still legally married at the time of filing i-751?

Why triggered them to know that you and your wife have separated?? Also, were you and your wife interviewed when you filed for I-751?

My lawyer told me that it is okay to be separated and still file for I-751 as long as your citizenship spouse still sponsor you. Also the separation date wasn't correct on the divorce paper, my lawyer insisted that it would not be an issue but it sure did.

My advice to everyone in here. Sometime you can not really have too much faith in your immigration lawyer. I prepared all of the documentations to prove that it is bona fide marriage I would have show everything to IO but again my lawyer said not necessary. I can go on and on... now my lawyer is asking me for more thousands of dollars to put gather paper together for me. Sorry, I could have done it myself-- making copies and gather everything together and mail the package. **SIGH** This is very depressing!


When you filed I-751 (removal of conditions), did you file jointly (with your ex-wife) or with a waiver of the joint signature?

Also, why did you bother bring an attorney for N400?? It's the easiest form ever after form AR-11!

I know you can't answer this with any certainty, but just wondering your opinion -

If the Immigration Laws were to change, as mentioned above, would it be likely that that would effect me? Because I know with some rules they backdate them. As in, if you had held so and so visa/citizenship before certain date, then the new rules don't apply to you.


Usually new rules are effective only on beneficiaries/applicants after the law goes into effect. But this is as good as guessing what Justin Beiber's next joke is about.

Most, if not all, of USCIS's services are first-come-first-serve basis. Those who applied before you shouldn't be surpassed in line just because you have more money. If anything, you should think about USCIS recruiting more officers to speed up processing for everyone.

And there already are some districts with same day oath, and that's primarily because they're capable staff-wise to do so.

Most, if not all, of USCIS's services are first-come-first-serve basis. Those who applied before you shouldn't be surpassed in line just because you have more money. If anything, you should think about USCIS recruiting more officers to speed up processing for everyone.

it's 3 years (minus 90 days) from the date written on your wife's greencard. From your timeline, for example, say they approval date is the same as the date of issuance of the card. Then you're wife has been eligible to file N400 since 10/23/2010.

Short answer: she's eligible now.

Hello All,
My father in-law has green card but spent most of his time outside of USA in the past 5 years. Can he apply for citizenship? Can you please guide me what are the guidelines and rules for the process?

Rules of thumb:

  • Should wait 5 years since becoming a permanent resident while maintaining continuous residency (3-years if married to a US citizen)
  • Shouldn't have spend more than a year in a row, otherwise the clock will reset back to zero
  • Should've spent atleast 30 months inside the US over the last 5 years (18 months if married to a US citizen)
If the above conditions are met, i believe he's eligible. Assuming ofcourse his criminal record is clean of certain "blemishes" that may hinder his eligibility,

IF his passport expires before anything else (ROC, USC application) is dead easy to apply for a renewal at the Egyptian Embassy/Consulate IN USA. He won't be dinged on anything occuring outside of Egypt - they will be happy to take his money, give him new passport.

My husband and I have been married 9 months today. We have had a lengthy process - we did a fiance visa, got married after he arrived, and he already has his 2 year conditional Green Card. I'm seeking advice because I want to avoid future problems.
My husband is a national of Egypt, but was granted refugee status by the UNHCR in a European country. He has a travel document from that country, but it's about to expire. In the travel document, it says that if he gets permanent residency elsewhere, he is supposed to surrender it, so we don't think they will renew it. If he's not planning on traveling outside of the USA, then does it matter that it's going to expire? I'm under the impression that if he let his passport expire before becoming a US citizen, that would be a problem. Does the same thing apply to his travel document?
I've heard about a white passport, which is a US refugee travel document. Since he's not planning on traveling, I don't see that it would be helpful.
My biggest concern is that if his travel document expires it will cause problems with getting the next green card and eventually with citizenship.
Any advice would be appreciated.


The presence of a valid passport is not required to file for Citizenship. And if your husband got his 2-year conditional greencard, then his European travel document is obviously obsolete. His status as a permanent resident does not rely on the travel document, so it doesn't matter if it's expired. In fact, USCIS does not track expiration of passports. Does he by any chance still have an Egyptian passport? The only reason a passport (or a travel document) is needed at the time of filing N-400 is to show entry/exit stamps as proof of travel duration, but again it's not a requirement, especially if he didn't travel at all or doesnt intend to travel prior to filing for N400.

By the way, I applied for the so-called white passport (it's actually turquoise). It serves as an advance parole, a travel document or a reentry permit (they all look the same except for one line above the photo). I'm not a refugee, but I needed it because of a long story. To make it short, i was unable to renew my Egyptian passport. I applied for a reentry permit (white passport). It looks like any other passport but it says "TRAVEL DOCUMENT" on the front cover. I sent it to the Egyptian Consulate and was granted a visa to Egypt, used it to enter and exit Egypt freely until i renewed my Egyptian passport.

I'm so glad we had a revolution in Egypt. It was just about time.
