K-1 Fiance(e) Visa Process & ProceduresShould I File now?
Thanks a bunch!
Couple more questions. I was told my fiancé needs to send me a copy of her birth certificate and a police report as well as police reports for any countries she had worked if there over 6 months. I didn't see or read that ion this site.
Is this true?

K-1 Fiance(e) Visa Process & ProceduresShould I File now?
I'm from the US my fiancé is from the Phillipines. We met online in march 6 months ago. I went to the phillipines on July1-16th.
Should we file for a K1 with me only having made one trip there? Do I need to make another trip to better the chances of getting approved?

K-1 Fiance(e) Visa Process & Proceduresjust get on plane as a tourist and stay
I am an American living in Ukraine.
There are a few ways that a Ukrainian can get a visa to come to the States... if they are in college, they can apply for a work and travel student visa.

If they are working and they need to go to the States for work, then I have seen them get visas.

But for the average Ukrainian, in order to get a visa, they have to show evidence that they will return. This generally means that they have to own property and be leaving an important family member behind (like a mother going to the States for a few weeks and leaving her children behind in Ukraine.) It is not easy for them at all to travel to most Western countries.

Hello:)

My first post so dont throw rocks at me yet?

My question is,i am trying to get all the paperwork done before the noa2,except the i-134.I have already brought her a complete copy of my w-2 and a copy of my taxes. We filled out the 156k,157,ds-230 part 1 and 2.So we both have copies of all of that.

So,the only thing we have left is the 156 and the i-134?

Some of it will be consulate specific. Once you get packet 3 from Manila, it will tell you exactly what they want back, or you can read the reviews on Manila here and they might list the items exactly.

I have read alot,i think i got it all.Just making sure:)

Here is a quick question for you.If my soon to be wife gets here, and we finish the AOS,and all of that. Can she leave the country and not have a problem getting back in?Second question, can she get a US passport, or should she keep her passport?

Reason i ask, her passport expires in 2011.Should she renew her passport, for travel purpose in the future,or can she get a US passport, after she gets a greencard?

Yes, after AOS ahe can travel. Even before if she has an AP but she will have to be here for the interview. If she will be out of the US for more than 6 months it is adviseable to get an AP.

She cannot get a US passport until she becomes a citizen. She can renew her current passport and may be able to do it at a consulate here (Phillipine consulate) but check on the rules for that

So, it would be best for here to renew her passport there?Reason, i ask this question we plan on coming back to the philippines and have a wedding there for her family. In the US, we are just having a civil wedding. We plan on doing that after about YEAR of her being here.

K-1 Fiance(e) Visa Process & ProceduresUSCIS Service Centers
Today is my 6th mouth of waiting, and i thought i would call and see what they would say. Before the guy had a chance to start reading exactly what it says on the website, i started reading exactly what it says. The about half way into i said, can you tell me anything that didnt say on the website?

He seemed lost and confused,so he paused for about 30 seconds and then said what center did you apply at.I told him vermont.I said before you go reading that webpage.I will tell you it says Dec 2008.And then he started telling me they are in the timeframe and bla bla bla.I told him not more than 2-3 weeks ago it said 6 months. Then he told me they are now working on cases in december. And they are on time.

He said,it should be another month before they start working on their case.

I see this phone service as a waste of time and useless.I asked the guy do you ever have any information other than exactly what it says on the website, again he just paused and didnt say anything.I said thank you for your time, and then he told me if you have any question fill free to call.I said, why should i call if you cant tell me anything that i dont already know?

Has anyone ever got any usefull information from calling up?

K-1 Fiance(e) Visa Process & ProceduresWhy would my I-129 be in CUSTOMS???
I finally found my answer as to why my package went to customs. The Great Wonderful EFFICIENT United States Postal Service read the VT (Vermont) as VI (Virgin Islands) and sent it to the wrong place therefore it went through customs. Yes I am mad that it took 21 extra days. All they could say was.....we're sorry???

K-1 Fiance(e) Visa Process & ProceduresWhy would my I-129 be in CUSTOMS???
It has me puzzled also. I am in Mexico at the moment and I am going to wait until I return to the states in order to question this. I also have never heard of mail going through customs if it originated here in the states and its destination is also in the states. I just hope the people at customs do not mess my package up. I spent many hours working on it and EVERYTHING was in perfect order! My fiance' was able to get some certified copies of many or her documents because they were very easy for her to obtain so I sent those in the package. They have official seals on them. If some of them dissapear mad.gif ...................... need I say more?

K-1 Fiance(e) Visa Process & ProceduresWhy would my I-129 be in CUSTOMS???
I sent my initial K-1 package Oct 1st 2008 by registered mail. After 16 days of hearing nothing I contact the post office. I have the post office inform me that my package was in CUSTOMS!!! Instead of it being in Vermont it's being searched by customs in Illinois. They will not give me any information at all other than it's being inspected. All they would say was it was because it was from Mexico. The odd thing about it is that it was not from Mexico but it did contain some Mexican documents that were required for the visa application. It was sent from Louisiana directly to Vermont via registered mail!

Does anyone know why....... or have you had this happen to you ? blink.gif

Thanks for any info

Hey guys I just got my NOA2 and we were approved :-) BUT the only names on the NOA was my fiance but not her daughter. I was sure to put her daughter on the I-129. I KNOW her name was put on the application as she will be coming with her to the states! Should her name have been on the NOA2? Should I do anything to notify Immigration? Yes I'm worried and concerned! Any info will be great!

Humm, PAYX so this is the standard letter? Does everyone have the ability to interview at a different consulate? I thought Juarez was the ONE AND ONLY for people coming from Mexico. I wonder why they would give me an option for a different one? Anyone know?

K-1 Fiance(e) Visa Process & ProceduresWhy did Vermont SKIP NVC and send NOA2 to Consulate?

I got my NOA2 APPROVED! But this is puzzling to me. The letter starts as follows:

The above petition has been approved, and forwarded to the listed consulate.(Juarez I guess) Please contact the consulate with any questions about visa issuance, or if you would now like them to forward the petition to a different consulante. The petitioner can also file Form I-824, Application for Action on an Approved application of petition, with this office to request the we notify another consulate of the petition approval for visa processing purposes.

I did contact my congressman and told him I was concerned about all the violence in Juarez and was there any way to let her do the interview at her consulate in Guadalajara. (This was before I knew ALL interviews must go through Juarez) It seems as if Vermont sent the approved application to Juarez and skipped sending it to National Visa center. That's Odd... isn't it !

I am in Guadalajara this week for Holy week and can not read the contents of the letter for myself. I had someone open the letter and then email me the contents. I do know the letter was from Vermont and NOT the NVC. So it seems as if they went directly to Juarez with the approval. When I get back to the states I will contact the consulate.

I'm scratching my head here and hoping this doesn't add more time to the whole process. Does anyone have any ideas here? helpsmilie.gif

K-1 Fiance(e) Visa Process & ProceduresFiancee is pregnant

Thanx everyone for taking the time to look at my post.
Didnt expect to cause so much comotion over it though so sorry about that.
As for the few that have negative thoughts about my fiancee getting pregnant it was purely a miracle that she got pregnant just like any pregnancy and i thank god for the blessing so sorry if anyone feels differant.
The reason i am concerned is that a visa once it is issued is only good for 6 months and the airlines wont allow a pregnant paasanger after they are 7 months and there is some concerns of flying a newborn baby until it reaches 6 months of age so i am worried we might lose the visa during this short window of oppertunity.
From the way i am seeing things progress on the timelines of most other cases it will be about 4 months before i get anything back from the uscis and then who knows how long it will be before the papers get forwarded to the embassy in manila.
I just talked to a person at my congressmans office and they informed me that they may be able to help with expediting the interview but thats after the approval comes from the uscis.

Are you sure that all airlines have that policy about the age of the baby? I had my baby fly the first time at 1 month and a half old. It was a european low cost airline and I was flying in Europe, ok, but maybe you can check the rules with different airlines.

K-1 Fiance(e) Visa Process & ProceduresImportant Decision..what would you do?
I was wondering why you think that you can't go into the interview with him. I was with my fiance (now husband) at his appointment. We used his appointment receipt for his admission and I showed my American passport. I had made an appointment, just in case, at the same time; however, they told me Americans can always enter the embassy. We went through security together, we were escorted to the waiting room together. There are two areas in the office. One is for citizens and the other for non-citizens, but we sat together. We were called up to the window together. I was asked to step away from the window while my fiance was asked questions but everyone in the room could hear the conversation. We could hear the conversations at every window. No one is taken into a private area. I was then called to answer questions also. The interviewer asked my fiance to step back. The interview was not long. They looked through all our papers and we left together. It was a very bonding experience to share. I think it is not necessary to be there but it was nice. I'm glad I did it.

Would we need to apply for a K3 spousal visa if she stays here, we marry and try to adjust her status?

K-1 Fiance(e) Visa Process & ProceduresAmerican embassy or consulate
Just a few questions about applying for the K-1 Visa.

I'm from Louisiana and she's from Ontario, Canada.
She's in Louisiana with me at the moment and we'll be getting married here.

We've been going through the I-129F form.
In question 20, "Your fiancé(e) will apply for a visa abroad at the American embassy or consulate at:" ...
We don't know which embassy or consulate she needs to apply at, and write down on the form.

Also wondering how long it usually takes.
Her stay in Louisiana as a visitor is almost up as she's been here since the end of October, 2009.
We're worried that even if we mail in these papers right away, she may have to go back to Canada until they're approved, or until we receive the visa in the mail.
    How does this work?
If she ends up going back home, would we need to wait until we have the K-1 Visa in hand before she can come back?

Any help is appreciated, thanks in advance!

    IR-1 / CR-1 Spouse Visa Process & ProceduresNew to the IR-1 / CR-1 forum
    Hello,
    I'm new to the "IR-1 / CR1 forum".
Well, as you can see from my timeline below, our I-130 & I-129F are approved... and for the moment, it is still early to decide which path we will choose (K-3 or CR-1).
Meanwhile, we would like to understand two points, and I wish i'll find some help & suggestions from you my friends :
well, my two questions are :
    - as the two processes are going, when exactly (i.e which stage) we have to delay one so as to continue with the other (K-3 instead of I-130, and vice-versa)?
    - How can we choose the option of choosing to take the K-3 interview, enter the US and then return for the CR-1 interview)?

In the hope to find some :help:

IR-1 / CR-1 Spouse Visa Process & ProceduresDilemma... Need your help guys
    Hello everybody,

I took the K-3 visa interview on 19th october in Casablanca (Morocco). I was given the 221(g) paper, and was told that the A/P will take about 2 months... if not longer as some VJ told me!! :crying:

In the other hand, my husband, in USA and he is the agent, is following the NVC Chart for I-130 (IR-1/CR-1). As you can see from our timeline bellow, he sent back the I-864 and it was received. He received today the IV Bill. He'll send back the payment tomorrow.

I have a couple of questions, and we'll appreciate your help

    - Could you plz tell me what will be the next step in the NVC follow chart?!

    - option #1 : What will happen IF the CR-1 case is complete BEFORE i get an answer from the consulate concerning my 221(g) for k3-??
    OR
    - Option #2 : What will happen in the opposite case, i.e if the A/P is complete and the consulate calls me to bring my passport before the IR-1/CR-1 is complete?!!

One more question : what is the "estimate time" to the IR-1/CR-1 interview when the agent pays the IV Bill ?

Thank you in advance for your help & your suggestions!!! we really need them at this specific time :help:

    Najia
PS : My husband is coming, in the next couple of days, to visit me in Morocco for a 4 weeks vacation.

    IR-1 / CR-1 Spouse Visa Process & ProceduresDS-230, Part II + enclosed papers
    Hello Everybody,

It's been a couple of weeks that i didn't post in Visajourney, and here i am again need your help and suggestions again, my friends.

Well, my husband (a USC) and I (foreign spouse) are going thru both I-129F & I-130.
I took the I-129F interview in october 2006 and was issued 221(g). My case is still pending in Washington DC. :crying: ... We are keeping I-130 going.

A month ago, my husband received "part I" of DS 230... We sent it and we waited for their answer... Yesterday, he received "part II" and asking to enclose the following documents :
    - my Police certificate
    - a photocopy of my passport (biographical part)
    - my birth certificate
    - our marriage certificate
    - part II

BUT... what we don't understand, is that, i already prepared these documents and I presented them to the consulate officer on the day of the interview !!!

Should we re-send them to NVC?? do you think that the "dates" of these papers (mainly police record, and birth certificate) expired?!!! should i prepare NEW ones & translate them again??

your answers will help us a lot
    thanks in advance

IR-1 / CR-1 Spouse Visa Process & ProceduresCR1 Case Completed, Wait for 8 weeks for further instructionss?
    Hi everybody

The CR1 case was completed on 2/15/2007, but it says to wait for up to 8 weeks for further instructions?

Our case was completed on the same day as you (ie 02/15/2007), there is no update in the USCIS case online !! when my husband called the NVC, the recorder said EXACTLY the same, ie "up to 8 weeks for further instructions"!!!

we are wondering what's going on!!! sometimes I wonder if it's not related to my I-129F administrative process in Washington DC due to 221(g) which is still pending till today (4 months 1/2) :crying:

Do you think that if I have an CR-1 interview prior to the end of the I-129F AP, will I be quite sure that i'll be issued an other AP for CR-1??

plz tell me what you think, or what others experienced ... i'm really worried

    many thanks in advance

IR-1 / CR-1 Spouse Visa Process & ProceduresWhat if..... ?? I need your opinions plz
    Hello everybody,

I have a question for you and I need your explanations, opinions, suggestions and HELP !!
Well, in one hand, I took the I-129F interview in october 2006 (5 months) and i was given the 221g paper for administrative processing in Washington DC. My husband called the DOS yesterday and they told him that the process is at its final stages and everything is good so far. they'll send the answer to Casablanca consulate as soon as the process is finished.
in the other hand, my I-130 case is complete, and NVC told him to call, also next week, so as they'll give the interview date!!

    My question(s) is (are):
    - What will happen to the I-130, if the consualte call me to bring passport to stamp the I-129F visa?
    - What will happen in the opposite senario? i.e I have an I-130 interview before the I-129F A/P is completed? does it mean, that they'll give me an other A/P after the I-130 interview??
    and the main question is:
    - Let's assume that the consualte call me to bring my passport to have the I-129F visa, is it possible for me to KEEP the I-130 interview date, that i'll be given by NVC, and wait this date to take the interview in Morocco?... OR, isn't possible, coz the consulate will cancel my I-130 interview, once they'll give me the I-129F visa?

I hope that i've clearly expressed myself... i really need your help guys
    thanks in adavance
