My husband is looking forward for our NOA1 this week, since he's not at his house every weekdays, he can't check his mailbox, hopefully this weekend we have our NOA1 waiting in our mailbox.

hmm, new process huh.

But wait, before once you enter US with a Cr1 visa, you will only need to wait for your green card to arrive in your Mail at your US address., But what does this new USCIS thing mean? I can't seem to comprehend how does this new loop comes from.

I got some questions here that will not only benefit my curiosity by also others who will be arriving to the US.

-Do you get this notice on your POE?
-Do you receive this notice in your email/mail shortly after your POE?
-or do we need to send something again to the USCIS so we could get an appointment?

false RFE is when you received an Email from NVC asking you to:
?submit something which you already submitted and and later on when you ask the operator they will say everything is fine.

?situation like, Mine. Which we first submitted the DS230 rather than the AOS package, so they NVC sent us an email looking for the AOS which we sent a week after the DS230. So we just disregarded the RFE. We call it False RFE.

I understand that if i apply for my spouse from US i can use IR1 visa.
BUT...
How do i get Evidence of a Bonifide Marriage ???
I mean,im in US ,she is in europe, we are separated for now, how we can have joined property or bank account? Or anything else.. Its impossible.

Can someone explain me please if im missing somenthing here...

There is a difference between IR1 and CR1

If you are just getting married,.. then after the marriage you can apply for CR1.
IR1 applies when you have been married with your spouse for over 2 years.

Hi everyone! Hope y'all are doing well. I found out, through one of the VJ members here, that in calculating the income of a petitioner who works in the military, only the basic pay (excluding the BAS and BAH) minus the taxes, medicare and social security will be considered. My husband has three dependent children from his previous marriage. Following this formula, he is a little short for the 100% poverty guideline with a household of 5 (himself, his 3 kids, and me). So we consider having a co-sponsor. Now these are my questions:

-I am aware that the co-sponsor should be a domicile in the US. Is it okay if our co-sponsor is living in a different state? He is my brother and an LPR. What should he present to prove that he's a domicile there? Would a copy of his green card be enough?

My husband and I had our co-sponsor which was my mother in law.
Have your co-sponsor filed out the I-864A and of course he has to submit his Tax Transcript for at least 3 yrs and also anything that would help to boost up the qualification for poverty guidelines.
My husband was still in school that time and never had any Tax transcripts or whatsoever so we solely used my mother in law's income for the Affidavit of support.


-As of today we are still waiting for our NOA2. I know that the petitioner's affidavit of support will be submitted to the NVC. Do we also have to submit the co-sponsor's AOS to the NVC too?

The petitioner will filed out I-864 while the co-sponsor will have to filed out I-864A. This two documents should be submitted altogether to NVC.

If yes, will it cost another $88?

No. This is just a supplemental evidence for affidavit of support.

Can I bring co-sponsor's requirements during the interview instead?

Better just submit it together with the IV packet to avoid unnecessary delays.

On what stage of this entire process that we are required for a co-sponsor?

You already mentioned that your husband was short for the poverty guideline qualification.. You just answered the question.

I-130 now takes quite the same now with K-1. So if I were you, I would go with I-130 it'll save you more time,money and effort in the long run.

Hi all,

I just wanted to introduce myself, not sure about the protocol here, but I am here for the long haul. My name is Deb, from Arizona, and just last week married whom I believe to be the most wonderful man in the world, who is a citizen of England. We are going through a lawyer to assist with all of the steps to get him here, to the US, so we can truly start our life together. However, going through a lawyer is still completely confusing to me, so I'll be around here a bunch maybe asking questions and looking for teachers of patience ;) We are in the final stages of collecting the last of the documents needed for the I-130, then I guess it goes to a K-3 visa from there? Our lawyer has done his best to explain the process to us, but its still overwhelming...and even though he just left only 5 days ago to return to England, I am terribly impatient and while I realize this could all take up to a year, I am missing him terribly. But I guess we are all going through the same things...which is why I am really, really happy to be here! I'll be going to England in March to visit him, but in the meantime, I am hoping to learn, find peace and sanity, and hopefully remain optimistic for all of our sakes :)

My main frustration right now is that the I-130 won't even be able to be filed for a few more weeks, so I have a feeling its going to be a looooong time for all of this...but I'm committed to him, the process, and making the best of the time between now and him stepping of the plane here in the US for good.

I hope you are right because my package was received by NSC on April 25th but because of the transfer to CSC the notice date wasn't until 21st May. It would be nice to think that they processed packages in the order of receipt and that I hadn't lost a month because of internal transfer procedures.



My Check was cashed on May 29.

I got my NOA2, 155 days from the day that I sent my petition. So sit back and try to enjoy the ride.

It's best to follow the instruction from the Consulate, which are to return part 1 only. You can fill out part 2 and take it to the interview if you want. Instructions rule.

I have read the instructions over and over. But I did not see mention of DS-230 Part 2.

If I understand correctly, we are only to send Completed and signed DS-230 Part 1 and the Checklist (form 169). and nothing else.

Everything else she will take to the interview?

Complete both parts (I & II) at the same time - if returning with Packet 3, send both portions - the only thing you do not do/complete is Section 35 (and the signature) - these must be completed in front of the officer. good.gif

So I called DHL to track it. Using the zip codes from NVC and GUZ. And the date the package was shipped.
4 business days!

It's been two to three months for quite a while. It fluctuates a little bit with workload and holidays. I've seen cases take as little as 6 weeks but 3 months is more common. You can check their current timelines for the most up to date NVC out to P3 times.
