HI everyone,

 

This is a topic that my husband personally experienced.

 

#1. I'm afraid Hank is wrong about the Philippines not to be able to recognize the divorce decree in US coz the previous Filipino filed for it. As long as you are already a USC by the time the divorce was finalized, you are OK for petition for recognition of foreign judgement, in this case, the divorce decree.

 

#2. There's a reason why they want to have her marriage in the Philippines taken out of NSO records and it's because of properties. Although, Marriage in US can be reported via Philippine Consulate in US via report of Marriage, this does not dissolve the previous marriage in the Philippines.

 

Now, although her previous spouse has nothing to do with the property that her and the new spouse will buy in the Philippines (but could be argued in court), as she's legally divorced in US, the next of Kin based on NSO records will be the previous spouse. So, if she dies, the previous husband gets to claim the inheritance.

 

When trying to invest in the Philippines, it is very important that you have your divorce decree recognized in the Philippines.

 

Now, there's one info in this case that i didn't get to know for sure, Is your future husband a natural born USC? if so, he can't own a lot in the Philippines, a condo maybe but with limitations. A foreigner can own a lot in the Philippines only if it was inherited from someone (the only exception).

 

Good luck to you guys but i still would recommend you having your divorce decree recognized. I do know lawyers who can do it for you and I do have the requirements for it too if you want. But you need a lawyer to file the petition for you.

Its been quite sometime since I posted in this forum. Its been hectic. SN: (currently processing my mother's paperwork)

 

I have few questions though regarding how family laws covers in the Philippines about my situation.

 

When I filed for divorce, I was being processed to become USC, when the divorce got finalized. I have been with the greatest man I have ever met who is also the father of our unborn child. 

We are planning to get married sometime this year here and also in the Philippines for buying few properties wise.

 

I was told that if the USC spouse filled for divorce, which in our case we were both USC when the divorce got finalized... few of our good friends here said, that i just need to bring the divorce decree  to void my marriage in the Philippines from my ex...

HOW TRUE is this?

I've been here for close to 5 years this November,and I have been back to the Philippines once since I moved to the US permanently.  Even before I moved to the US, I was not as festive like any other Filipinos maybe in the country. It's not until Im on the the brink of my 2nd year in the states I started meeting Filipinos in the surrounding areas. But you always learn it the hard way that its your own roots can do such damaging things to yourself. (Gossiping, backstabbing, and "trying to keep up with the Jones") I've always mind my own business anyway but I gave myself the chance to be acquainted to the Filipino culture and share it with fellow Filipinos in the area but I was pretty disappointed with the outcome.I threw my hands up in the air, and say...Fuss it! I have my white and black friends. wink.png

 

My ex-husband was never truly excited of Filipino culture and its traditions. So it was pretty hard to share events and occasions with him which made me even just shrug off any Philippine holidays. I came from a family who celebrates "notche Buena' (night dinner) by Christmas eve, to only me and him --eating in Olive Garden the night before Christmas.

 

Needless to say, Its important to have Friends esp a group of people that understands and share your own culture. Once you have that circle, choose the ones that you think you can trust, and values friendship. These people are the ones that can make you feel "home" away from home. I am blessed to have few but quality friends to celebrate few Philippine events.

My Aunt's annulment only took 8 months.. but that was with some strings to pull in the court system and ####### load of money spent approx. $3,000.

Also there was a vj member here who was from this same regional forum who had a successful annulment process. I am friends with her in FB and maybe she can give some info as to who she used as a lawyer and how to start the process.

Also, keep in mind that the clock starts to tick for the visa time frame of six months when she completes the medical not from when the visa is issued.  Also, don't forget to get the 20% off medical exam fee if she was a victim of Yolanda.

 

See, I expedite the case for my mom r/t to typhoon Yolanda...

but she is doesn't live close enough to the bad area.. Don't know if the 20% discount would count.

Advance medical is okay.  That's what I did because of the dreaded sputum exam.  Aside from SLEC's requirements, she must present any email from NVC that shows her MNL case number.

 

ok. So she can present a printed email of the approved Expedite request from me, and possibly printed invoices from NVC?

My mom's paperwork is now in USEM Manila via Expedite processing. I have not heard from USEM regarding mom's interview schedule..

Questions:

 

-Should I call USEM to schedule her interview or They will email me her interview appointment? Or they will call her?

 

-What should she  bring during the time of interview? since she is IR5 (parent of USC) I don't know what kind of "evidences" she needs to have in her possession during the interview.

I, too petitioned my mother. Her case was completed march 6 and was sent also to embassy. Her case has been expedited and until now I have not received her interview schedule appointment although others who are in her same timeline have gotten their schedule already.
I am losing my cool since it has taken the same amount of time compare to the once who didn't expedite their cases.

Why do you think mum still have not been scheduled yet? :(

Hello,

 

My mother will have her interview on April 4th. Since her paperwork was expedited (I was able to talk to a consul in USEM and get the soonest appointment for her), she didn't have enough time to prepare for medical. It was such a short notice.

Anyway, She has this weird fear of Blood pressure cuffs and doctors. (Its called White coat syndrome) that when she sees BP Cuffs, her BP would shoot to fatal levels. She tried to have her medical last Monday, she had everything done, but her physical examination cos it includes Vital signs...

 

Question:  Anybody here have/had the same situation where you were sent home because of High blood pressure and was asked to get a medical certificate from primary health provider? She's becoming really worried that she will not pass her medical exam and will cause delay on her interview date.  :(

 

 

 

SN: Anyone here have the same Interview date, APRIL 4, 2014, 0630 AM? She would love some company while being processed inside.

How old is your mom? If she's above 60 years old, she's exempted to attend the seminar. She or a proxy can register her at CFO ( ~CFO certficate). http://www.cfo.gov.p...inar&Itemid=833

 

However, the CFO sticker is still mandatory when going through immigration's. 

 

There was a holiday on the 9th in PH. By experience & reports here in VJ, passport with visa will be forwarded to 2GO from USEM within 2-3 business days. She might receive a text from 2GO on friday or Saturday, if you guys are from Manila.

 

My mom is only 50. So she still needs to attend the dang seminar.  And yes, are just in Manila.
When I checked the CEAC web, it says that they have issued the visa last April 7th, so discounting the holiday, She could possibly receive a text from 2GO Friday or Saturday?

Are they open though on Saturday? Cos I can just have her pick it up in the 2GO headquarters even.

Yes she can do CFO without the passport.  Again I am light on the details, but it can be done.  Just that she has to go back there once she has passport to get sticker.  But if you are pressed for time, even if this saves one day it is worth it.

Today is April 10, well within the normal range of the time it takes to deliver the visa.  So don't worry about this being a sign of problems.
 
She can do her CFO before she collects the visa, but she will have to go back when she gets the visa to get her sticker.  But if she is pressed for time, this might save a day or two, so you may want to consider this.
 
What does ustraveldocs say?  Issued yet?  There is a way to track it once it is in the hands of 2Go but I don;t know the details
 
But even if ustraveldocs says issued and 2Go has no record of it, still no need to worry.  It takes some time to make its way from her embassy file to 2Go's delivery system
 
This is government, which has 2 speeds:  Slow and stop.  Private industry would fire anyone who moved this slowly, but for government this speed is just fine.  So please be patient.  It will get there.  Nothing you posted here shows me any sign of trouble.

Yes! However, our mayora right now have it renamed into rafflesia Irigaense. Iriga was once acclaimed because of this flower because its where the biggest rafflesia flower can be found, and also noted as the biggest flower in the world.

Yes I am from Bicol and Catanduanes is one of the Provinces of Bicol region. Catanduanes though us quite in the edgiest part of bicol where typhoon usually bark on. But it is also known for great beaches around.

HI mayalar,

Just be patient. Once your check is in cashed. after several weeks, or it may months before you can get a NOA2.
If you received NOA2, that the time NVC received your papers and soon enough they will assign you your case number.
Then NVC will send your papers to the your local USEM manila, once your case is at their system already, you can now pay your DV, and even you haven't have the appointment letter from the USEM, you can call
the embassy call center to schedule an interview.

RFE: The whole AOS packet. --- As the beneficiary, I sent the DS230 first. Instead of the AOS. I mailed the DS230 assuming that my husband will be able send the AOS the same day, but it turned out to be after 1 good month. So they first look from us the AOS. They issued us RFE.

Well wouldn't that be a kick in butt if it were true. I am just so tired of all this waiting...having our lives in limbo.



How I wish NVC process ours as fast as like their petition. It's kinda unfair that they let us wait like a lifetime waiting for an approval and case completed. However, I am so happy for Merriam and Alain for having a very short journey.
