IR-1 / CR-1 Spouse Visa Process & ProceduresWhere to send the RFE response? ( to be based fr the AOS address or to the RFE checklist indicated add?
Hi guys.

Our packet was return to us last week due to some discrepancies on the address.
We received the RFE for the AOS package since I sent the DS230 package first. Then my husband sent the AOS at later time.

My question is, to which address are we going to put on the cover letter for the AOS?

would it be;

National Visa Center
ATTN: DR- AOS
31 Rochester Avenue, STE 100
Portsmouth, NH 03801-2909
(this is the issuing office from the RFE checklist)

or

National Visa Center
ATTN: CMR
31 Rochester Ave. Suite 100
Portsmouth, NH 03801-2914
(original address for the AOS)

Thanks!

IR-1 / CR-1 Spouse Visa Process & ProceduresDo i need the original borth and marrige certificate??
First, read this.
CR1 guide

Second,Secure copies of your
-Birth certificate, and your spouse's
-Marriage Certificate
-Police clearances from countries your spouse lived for at least 6 months.
-Divorce decrees or death certificate (if applicable)

that should help you.

IR-1 / CR-1 Spouse Visa Process & ProceduresDo i need the original borth and marrige certificate??
If you have few more copies of the original docs. then yeah its ok to send them out with your I-130. That's what we did.
Mainly, the Original or certified true copy of the original docs are just required by the time you reach NVC.

In some countries like Philippines, we have an institution who can provide us anytime we need an authenticated copies of our original docs. So we can produce as many copies as we need.

I would suggest to your sister that she files for the I-130 now though she is just LPR. Wait for her to be a citizen. Then just upgrades the petition by the time she get's naturalized. It will make the petition moves faster.

Nothing beats CR1. The process is quite longer and jiggy but its worth the wait. It'll save you up a thousand bucks for the AOS when your proceed the either way. Good luck!

IR-1 / CR-1 Spouse Visa Process & ProceduresFiled in June, they are backed up until february..
Check the priority dates in the USCIS site.
When we filed our I-130 last November, we were projected to have our NOA2 this August. But hey! We got our NOA2 last January.

Trust USCIS that they are doing their jobs. Though waiting is pain in the A$$.

IR-1 / CR-1 Spouse Visa Process & ProceduresDid anyone else hand write their forms? (specifically I-130)
Yes you can hand write some date in the forms. My address is quite longer that this process so I had to write it down because while I'm filling 'em out online it can't be accommodated by the space provided.

I'd say kudos for Douglasfiel, we can't take away the notion that gov't employees sometimes just prefer doing their job within their comfort zone.. Our I-130 was very well organized by my husband. We put labels so components are easy to be found. So that makes their job a lot more easier.

Anyhow, You can hand write your info if it doesn't fit in the space provided.

When you see an update on the USCIS site that means they are looking at your papers.
There are lucky people who got approved in a month, from the record as what I saw here in VJ, was less than a week. That, if only if you are one good of a lucky person. Goodluck!

These are what we sent to the NVC.

1. Bar Coded cover sheet

2. Completed and signed form I-864
And no supporting documents? (Such as tax returns, W-2's, 1099's or explanation for not filing taxes, if applicable?

3. Completed and signed form I-864A for my Co-Sponsor
No supporting document to show relationship to the Sponsor and that they share the same household? (As stated in the instructions for the I-864A; "If you check
any other relative except for spouse, you must provide proof of the relationship and that you have the same principal residence as the sponsor."

4. Last 3 years IRS Tax Transcripts of my Co-Sponsor

5. Original Employment letter of my co-sponsor

6. Original Pay stubs for 2008
For the Co-sponsor I presume?

2.My Husband was still at school that time and right now he just graduated from college. He worked for a while but then what he earned was not that high to which the US threshold requires for a tax. So he wrote a written explanation about it.

3.About showing a relationship between the sponsor and co-sponsor. Will the Birth Certificate of my husband be enough to prove that our co- sponsor and him are related? or we need another proof?

6.Yes, pay stubs of my MIL.

But what do they mean by this...

"A photocopy of the applicant’s I-864A is required for each accompanying dependent listed in Part 3 of I-864A and Part 2 of the I-864A. Copies of supporting documents are not required for accompanying dependents. ???

Thank you for a quick response.
Do you mean what we sent to the NVC or the RFE checklist?

As in what did you send - exactly - with the I-864 and I-864A (the supporting documents as well).

One reason I ask is because you say you sent last 3 years tax returns but don't mention if you sent supporting document for them (i.e., W-2's, 1099's etc). Nor do you mention what exactly your MIL sent with her I-864A. So rather than guess - it is helpful for folks to know exactly what was sent.

I am not so familiar with Taxes in the US, but I don't know if one of them is the derivative of W2's.

Are you confusing the I-864 and the I-864A? Part 3 of the I-864A is where the sponsor (mother in law) signs the form. Part 3 of the I-864 (your husband's document), and part 2 of the I-864A, is where other immigrants are listed. Are you bringing children with you? Or was there an error in completing the forms?

-We didn't confused the forms. My husband filled out the I-864 and my MIL filled out the I-864A. There were just few errors on the way my MIL filled hers.

Your mother in law needs to suply proof of the household relationship. A birth certificate (petitioner's) showing the mother's name should be sufficient.
-So birth Certificate will be fine.

Mother in law needs to supply full and complete tax returns (including all sections filed) or IRS tax transcripts for the past 3 years. Not only an employment letter.
-We did submit the last 3 years IRS tax returns. ( I didn't had a sight though if the IRS were from Local or State since from the RFE Checklist's note, required were from the federal ones only.)

Schedules are components of a US tax return.
- I see.

Clearly someone has not understood the forms properly. The instructions are clear. If your USC husband and his parent do not fully understand the documents it may be worth them paying someone to help them comply with the requirements.
-This is a good suggestion. However, some information is available here in Vj and kind individual like you can contribute a very meaningful answer so I don't think paying someone to do this not so simple thing is necessary. smile.gif

IR-1 / CR-1 Spouse Visa Process & ProceduresAOS forms complex questions
Good day everyone.

As we all expect it to be, this process is indeed such a painful, disappointing and hurtful in our lives. My husband sent our AOS last week together with our Co-sponsor's forms. We thought it'll all end there but we were wrong. Now, we have new sets of Documents required from us to which we never expected we will be providing.
From Ling Che's shortcut it says there 3 years of income tax returns will be enough to prove stability. But I don't know why NVC is saying that we are missing these Tax returns, and also employment letter, pay stubs where in fact all the ones required were all there. sad.gif

We have endless of things to consider on our RFE list, but these are the ones that require other people's feedback for me and my husband's enlightenment. I am positive that someone, somehow will input the best knowledge s/he has to help us. Any input will be deeply appreciated.

(all the errors were found in I-864A)

• A photocopy of the applicant’s I-864A is required for each accompanying dependent listed in Part 3 of I-864A and Part 2 of the I-864A. Copies of supporting documents are not required for accompanying dependents.
--I don't know what they meant by this. sad.gif

• You as a household member have not provided proof of your relationship to the sponsor.
--Does our Co-Sponsor (my Mom in law) needs to submit my husband's birth certificate? or something?

•A written statement/explantion is required if you are/have been unemployed, retired or dependent as to why tax returns were not filed.
--My mom in law is employed and we even provided the employment certificate, what does NVC mean on this matter?

Schedules are missing for the years ---2008, 2007, 2006, 2005.
--What does "schedules" mean?

I know its quite an inquiry but please, shed some light to us. Thank you very much!

Hi all,

I had posted this question in the regional (philippine) forum, but haven't recieved any response; hope someone can answer this:

Is philippines appointment post or standard post? I am preparing the ds-230 package and plan on using the james and ling shortcuts to speed up the process.

If Philippines uses the appointment post, which I think they do, then I have to mail in all original docs with the DS-230packag; if it is Standard post thn my wife has to bring the original docs to interview.

Please let me knowif the Philippines is appointment post.

Thnk you much

Steve

If you can give us more information about Appointment post between Standard post, probably we can give you more definite answer. But to tell you something about DS230, sometimes if its really that necessary NVC will just ask you to bring the Original copies of the docs by the time of the interview.

Firstly I believe you only send/complete the RFEs marked with an x and secondly, what did you send them/not send them to garner so many RFEs? I'm just wondering as I'd thought that NVC was only allowed to ding you for two only... not a whole pile?

Good luck... you perhaps have a more complicated case than I can conjecture from the reading of your timeline and such...

Or would it be just a standard form that NVC uses to send our RFEs?
Our case is not that complicated. OUr first RFE was when we I first sent the DS230 before our AOS.
Then we received this long RFE list for my mom in law with only 5 [x] marks for I-864A errors. wacko.gif

So I would appreciate it if you input a lot more positive thoughts bcos I believe all of us here would just want to get through in this process quick. smile.gif

In our RFE Checklist, there are portions that has [X] and others []....

There were just a lot of list, and others are marked.
Its quiet confusing. From the instructions, it says pay specific attention of the marked items below. But how bout the unmark items? do we still need to provide those documents that they are asking?

QUOTE (sachinky @ Sep 2 2009, 07:09 PM) <{POST_SNAPBACK}>
My husband, a USC, is a recent college graduate and doesn't have stable or sufficient income yet, so my cousin, also a USC, will be filing a I-864 as joint sponsor.

1) Should my husband and cousin mail both their I-864s in together in one envelope? Or separately?
-together in one envelope

2) Do they use the ones online or wait till the NVC sends the forms?
-You can use the ones in NVC site. and start filling them up.

I'm a little confused as to whether
3) they mail it to the NVC or do they mail it to me and I keep it in my possession till I get to the embassy interview?
-your husband has to send it to NVC, and he has to give you an exact copies of what was filled by him and his cousin for your interview.

4) Or is it just that I should have copies of the I-864 package that was already sent, in hand at the time of the interview?

I've read conflicting threads so I am confused. Thanks for your replies in advance! I really appreciate it! =)
