Of course they can;but you need to do everything in your power to make sure that your spouse has everything he/she needs to make it a smooth interview.We all went through the process. I was there with my wife and I know that everyone cannot be there with their spouse;but it is a good thing if you can be there. The Manilla Embassy staff in my opinion are great and friendly;but you must be very prepared for the interview. My wife's interview was a breeze.

My suggestion to you is to make sure that your spouse is well prepared. If your spouse is denied, a paper will be given stating what is needed to get the visa. Good luck.

Like others have said, it think it is country specific. I attended my wife's interview in Manila, Philippines. All I had to show to enter the embassy was my US passport. It is nice to be there with your spouse. It gives your spouse more crediblity and moral support of course. Good luck.

We were in there at 7:30 am and out by 10:15 am. The interviewer only asked him some questions how we met and about the wedding. Did not ask to see anything and we had just about everything under the sun. Tooled all that evidence from the US to the interview for nothing. Not that I am complaining. It was just alittle strange to me after hearing from everyone else.

Maybe since we sent alot of information with the I-130 is the reason they did not need to see anything. That is my only guess. So everyone who hasn't filed yet, it might help to over kill with the USCIS to save hassle during the interview.

We are flying back on the 24th to the US together!!!

You are 100% correct. USCIS wants all the forms. Examples of schedules are Schedules A, B, C, D, E, F and so on. Good luck on your journey.

It has no effect on your petition. My wife is a licensed Dentist in the Philippines and it came up in her interview; but had no effect whatsoever. Good luck on your journey.

In some cases, you can print out a 1099 from the company website. If not, he can ask for expedited processing from his employer.

Hello all
Before I continue a big thanks to all the amazing members on this board who helped me with my answers to questions and of course everyone's support.

So I have been away a while the reason for that is b\c my wife finally got her late in 2010. So I am trying to figure something out and I need a little help from the VJ community again. My wife and I were married in November of 2009, so we have been married for less then two years. Her green card is set to expire in 2012.
I know we have to file her I-751 but I am not clear on something. My question is do I file it 90 days before the green card expires in 2012 OR do I file it before our 2 year wedding anniversary which is in Nov 2011?
Also on a related note IF we are supposed to file the I-751 in 2012 (before her green card expires) can my wife travel back to her home country for a few months?

Hiring a lawyer, in my opinion is a waste of money. YOU only need a lawyer if you have a complicated case. I DID EVERYTHING MYSELF; SO it cost me $0.00. We are going for AOS interview on FEB. 23. I have since then helped 2 other friends do the same.

My question is has anyone used one of these agencies? Do you think I was ripped off, knowing that I could do all this myself? I am not sure if having this agency will be useful later on in the process??

We went out for some drinks and ice creams, then we drove on our motorcycles as we watched the beautiful view of city lights together. This is when we both fell in love with one another. I stayed at a hotel named Cathy near my aunt's house. Nham, along with Thuy and Quyen came over to my hotel very often to hang out. We talked, listened to music on the laptop or watched movies together.

Almost 2 weeks later, I proposed to her at a very romantic place called Grammy in Ho Chi Minh City. Then we had our engagement party with her family, in her hometown Khanh Hoa, Nha Trang on May 11, 2008. The engagement party was in the morning, then we went to a nice beach with a few people on my side and hers. The beach was about an hour drive from her house. We took some pictures there as well. A few days later, we went back to my aunt's house in Ho Chi Minh City. Not long after, we went to visit my grandmother in Thoi Lai, which was about 6 hours drive. I went with my fiance and Thuy. We stayed there for about a week, since this place is a country, it was very quiet and quite pleasant. In front of my grandmother's house is a river. You have to physically meet her unless it is against your tradition and or culture to meet. That is hard to proof. You should try to meet her to avoid RFE. Good luck on your journey.

NVC would send a letter to the sponsor. Next a package would be forwarded to the embssy in Manilla. You need to start organizing your documents asap. I love the Manilla embassy on Rosas blvd. Iwas there last year with my spouse for the interview. We wre out in 2 hrs.

You cannot get married in Ecuador with a K1. The marriage must take place in the USA. There are no exceptions to this rule. If you do, you would run into some problems.

Really? I'm really confused now, because on the instructions for the I-129f, it says

"Notice to Those Making Payment by Check. If you send us a check, it will be converted into an electronic funds transfer (EFT). This means we will copy your check and use the account information on it to electronically debit your account for the amount of the check. The debit from your account will usually take 24 hours, and will be shown on your regular account statement. You will not receive your original check back. We will destroy your original check, but we will keep a copy of it. If the EFT cannot be processed for technical reasons, you authorize us to process the copy in place of your original check. If the EFT cannot be completed because of insufficient funds, we may try to make the transfer up to two times."

He's blaming himself because I told him to send it through UPS or some other mail carrier with a tracking number, and he sent it regular mail :|


You are 100% correct. It is always good to send documents to any Government agency via certified or registered mail. That way, you can tract when it is delivered and who signed for it.

I encountered the same issue. Wait till she gets her 2 year conditional green card and then have another non legal marriage in Columbia. For the purposes of K1 and to file your adjustment of status, the legal marriage must take place here within 90 days of her arrival in the US.[/b]

I think you would need more than that. Do you have Western Union or Xoom.com money transfer receipts? How about pictures of you two together? Our evidence was put in a portfolio format. We had lots of evidence. There was no doubt in the eyes of the Consular Officer that interviewed us. I was at the American Embassy in Roxas Blvd with my wife for the interview. The embassy staff are courteous and professional.

She must go home. The law is very clear. Anyone that comes here on a K-1 visa must get married within 90 days of arrival .

What it means when it says she can stay on an I-130; that is for a couple who, for whatever reason could not marry in the 90 days (death in the family, illness, ect.) but still wants to marry. They just couldn't do it in the 90 days becuase of extreme circumstances. She cannot stay here legally unless she marrys the petitioner in 90 days, or petitioner has a good reason they couldn't marry in 90 days, and applys for the I-130.

My name is Molly and I am from Grand Rapids, MI. My fiance, Steve, is from Windsor,ON. We became engaged in Aug,2010. We set a wedding date of Oct.1, 2011, but Im now wondering if we may have jumped the gun on this one. We mailed out I-129 a couple weeks ago and I received notification this week that they have received our application and it has been sent to California to be processed. Ive heard a lot of different answers on the processing time, from 5 months to 12 months. Im not sure what to expect.
Im just wondering what everyone's opinion is. Do you think that a wedding 9 months from now is pushing it?
