Removing Conditions on Residency General Discussionhow to lift conditions
QUOTE (beverly @ Aug 15 2009, 12:56 AM) <{POST_SNAPBACK}>
Hi everyone. My husband was just approved for 2 year green card.I am just learning about how to remove the conditions.I cant believe we have to do it all again? fingerprints, interview, money, proof of marriage?????WE just had an adjustment of status interview and fingerprints,do we have to do it again? are there more fbi checks? Does the nightmare ever end? wacko.gif

The nightmare ends after your permanent green card which would be good for 10 years if you choose not to be a US citizen. Yes, you would have to file form I-751 to lift conditions, submit some more documents and pay about $540. It is the American way lol. Do not feel bad, I have to do it for my wife in 18 months . After that, we would then file form N-400 for her to become a US citizen and that means more $$$$$. Have a great evening.

OP - When you filed for AOS and submitted the I-864 you were agreeing to be financially responsible for him. It is a good thing that he is looking/trying to work and not collect "public benefits."

Haole - there are shiiiiittttty men/women from all over the world. Don't I recall you ran into one???

Nope! I had a GREAT time in Cebu with the only scammer I ran into. Cost me a couple K but it was worth EVERY centavo. Best 2 weeks I ever had until I met my current wife!!! good.gif

Haole
so is the scammer you ran into a nigerian ?? I dont understand why people like you have to judge all nigerians. There are crazy people and scammer all over the world so i dont think nigeria is the only country where scammer reside. I am from nigeria and i am not a scammer so next time just answer the question and keep your opinion to yourself. thanks you

Thank you. Not all Nigerians are scam artists. There are scammers all over the World..in Africa, Europe, Asia just to mention a few.

That is the latest version. We just mailed our i-751 and we used the current version on the USCIS website. In my professional opinion, you are good to go. Good luck.

Removing Conditions on Residency General DiscussionFee screwup
We just mailed ours in witha check for $590 which is the new fee. Just like others have said, the entire package would be sent to you and all you have to do is to send it back with the correct amount. Good luck.

Hi just submitted my I751 but I made a huge mistake. I filled in all the forms and double checked everything in Dec, but got caught up with the holidays and didn't send it in until Jan. Now for some reason I check the forms and the fee changed! Has anyone else done this and will this impact my I751 extension? Mine expires on 2/10 (yeah I put it off.... my fault).

Something to ease my fears would be helpful.

Thanks

I think you would be ok. You should get a 1 year extension of your green card within 2 weeks of mailing your 1-751 package. We mailed ours out on January 5 and we received our receipt on January 13. In the letter, it stated that your greencard is now extended for 1 year.

It is not the business of USCIS; as long as you are living together and you have adequate evidence of an ongoing relationship. Good luck.

Thank you guys!
We have the lease, joint car leasing document, joint car insurance, health insurance cards, life insurance document, tax document, pictures, joint bank account, joint credit cards, joint internet bills, same address of our driver licenses, same address of mails. Hope that they are enough. Thank you, then we know that we don't need to move to a bigger apartment just for this. I would be a little tough. Thank you and good luck!

Removing Conditions on Residency General DiscussionNO info after sent out I 751 papers for 3 weeks
I am sorry to hear this. You should have received something. 3 weeks is a long time to hear nothing.I hope they did not misplace it. If I were you, I would call on Monday sice you have the proof that it was signed for.

I sent out I751 papers on DEC 17 to Vermont. But i haven't received any info yet, also the checked hasn't been cashed. I check the delivery status, the package was signed by a person. What should I do now? How to follow up?
Pls give me some idea.
Thank you

Removing Conditions on Residency General Discussionfor bio apt--need original ltr or copy OK?
According to USCIS, you must have your original. Schedule an info pass appointment with your local office immediately.

I seem to have misplaced our original biometrics apt letter during our recent move. Will my husband still be accepted at his appointment with a copy of the apt letter?

Removing Conditions on Residency General DiscussionWe're in the Clear
Congratulations.

We were so lucky to get an email today that my husband's green card is in production, his condition to remove status approved, no interview! Wo wooo! Talk about a great Valentines gift! From 2008 to now, he and his 2 children from Brazil are now in the clear..

I had to stop by to share the good news and to thank everyone here at VisaJourney for the invaluable service and support you provide. We had a couple of freak outs (one including them opening the green card package they weren't supposed to touch in Brazil!) and this site has always led us by the hand and reassured us! Thank you all!

Removing Conditions on Residency General Discussionbiometrics experience
The biometrics for my wife was on February 17. Our appointment was for at 9:00 a.m. ;but we got there at 7:00 a.m. The door was opened at 8:00 a.m. Just like in your case, the officials at the Van Nuys, CA support center were very nice and helpful. My wife was done by 8:12 a.m. It was painless. Thank you Van Nuys Support Center officials.

My husband had his biometric appointment in Newark on June 27. Our appointment was for 1pm, but we arrived at 12 or so, and we were out of there before 1pm. Remember your SS card or number because you need it for the form you fill out while there.

Removing Conditions on Residency General DiscussionEvidences & Bankruptcy
A few photos is a good idea. Regarding bankruptsy, I would consult a great immigration attorney. Good luck on your journey.

Hi All,
My conditional green card expires in July,2011. Thus we have to apply for ROC in april. I am collecting all evidences. Here is a approximate list :

1)Joint Bank accounts
2) Joint Tax Returns
3) Company online salary account profile showing us husband and wife
4) NO Joint Ownership of property ( we are stating we cannot as my wife would be decalring bankruptcy and her bad credit may affect me )
5)Joint car insurance
6) NO Joint Credit cards ( we are stating we cannot as my wife would be decalring bankruptcy and her bad credit may affect me )
7) Common address in photo ids
8) Common utility bills ( electricity, water and trash )
9) Joint AAA membership
10) Joint stock holdilting
11) Common Phone bills
12) Joint cable bill
13) We have a small business together
14) Joint membership in cultural organisation
15) Joint Dog registration
16) Hotel receipts and pics of honeymoon.
17) Letters from friends and her daughter.
18) Joint loan for buying a washer.

Here are my questions :

A) Problem is my wife wants to file bankruptcy and if we do that we have to take my name out of the joint cheking account account we have. I can still pay the AOS money from my salary account but then wd`nt seperating my name from the joint account weaken the fact of joint finances ??
What should we do ? Should we wait until I get the 10 yr card or not showing a joint account account wd really affect ( we can explain the situation on he pictthe cover letter though )

B) Regarding pictures : Do we need to show pictures from the time I am here ? means the pictures we showed in the last AOS interview can also be included ? or shd we show only the new pictures we have got for the last two years ?

I would appreciate all responses and advices . Thanks a lot

Removing Conditions on Residency General Discussionfiling i-751 without attorney
It seems like you have everything you need. In my oipinion, you can do it yourself.I suggest that people use attorneys only when they have complex situations. Have a great week.

Hi! my husband and i filed my petition for residency thru an attorney since we weren't sure that time and all that. now its time for me to file i-751 to remove my conditions. initially, we paid our atty $3000 for his professional fee and i remember him telling is its all the way. so now that we gave him our forms he suddenly sent us a bill with a new $500 prof fee for filing my forms. we cant afford it and we were surprised why he's charging us now to file my forms when we thought it was all included before and we thought all the way means till im a complete resident without conditions anymore. but he said he didnt add the fee before due to some cases where the couple didnt file for removal anymore due to divorce etc.

we were wondering if it would be safe if we just submitted the forms ourselves? we have a copy of the forms and our evidences. don't we just mail it to USCIS and its good already? or do we really need our attorney to mail the forms for us and pay him $500 for doing so?

our evidences include: life/health/401k/dental insurances where my husband and stepson are my beneficiary, a joint car insurance, a joint credit card, a joint ownership of a car, 2009 and 2010 joint filed taxes. would this be enough?

please give us an advice on what we should do.

A family friend is trying to file a K1 visa and I was trying to make sure that they are aware of common denial reasons. As a good friend, I wanted to make sure that he does everyting possible to avoid RFE and or AP. RFE and or AP can delay issuance of visa for months. As I was trying to help them, I ran into this great article by a lawyer. I hope some of us here find it helpful. Here is the link

Today we have been able to get a good attorney for our case and he said we should re-file,he is charging $3000 for all..This is reasonable to others my wife had talked to since I got denied.I could see clearly that not all the immigration attorneys are professional and what will be good for us.My wife has come to Africa twice in six months to see me and we are expecting our baby in few months and I was told about the DNA evidence to prove my paternity of the child and for them to know that our relationship is not meant for immigration purpose has the consular officer said...My question is that is it good that we are no longer considering the APPEAL OR THE MOTION TO REOPEN..Also I wanna know if I should wait for the baby to be born before refiling another petition cuz by then we will have the baby's birthcertificate to prove that our marriage being consumated. I think the period of the next interview might be closer as I really feel upset by the refusal of the consular officer who beleived cuz we had a short engagement or how we met online means that our relationship is fraud..I wanna hear your advice on this and whoever that have similar experience

Africa: Sub-SaharanEntry into Nigeria
Yes, you need a visa to enter Nigeria. To get the visa, you will definitely need a letter of invitation. For more information, click on the Embassy Of Nigeria link below.

Have a safe trip.

Yes, you need to get a visa and a letter of invitation. The company I've used before is Travel Document Systems. Also, if you've never had a yellow fever shot you'll need to get one of those. It's also advisable to get anti-malaria medication. You need to start taking it a certain number of days before you go over so plan accordingly!

K-3 Spouse Visa Process & ProceduresShould he need pick me or be smart and save our money..

Our interview is scheduled for April 20, but mu hubby has only visited once. He stayed from Jun 18 2008 to July 27 2008 and we were married during that time. Since then he hasn't visited, but we have kept records of our Yahoo Messenger conversations and we've spent time together online every day. We've also exchanged cards and gifts through mail.

Do we have reason to fear being denied since he hasn't visited, even though we have kept in regular contact with each other?

Also his job and his school is at risk if he go here to pick me and jin me in the interview. He is working as after school tutor ans studying at the same time. He's graduating on june so his prof's are strict. If he pick me due to that reason his willing. But as a wife i feel guilty taking him away of his job and school and puting his career at risk.

If he lose job then how can he support me..

Please help me and give me advice..

He does not have to be at the interview as long as you have all the evidence. I attended my wife's inteview in Manila in July 2008. Between December 07 and June 08 , I visited 3 times. The CO knows that not everyone can do that . Of course it helped alot that I was at the USEM with her for her interview but it was not necessary or required. Our CO was very nice. Our interview lasted about 5 minutes.I love the hotels on Rosas Blvd across the street fromthe USEM.Good luck on your journey.

That really sucks. I've also only sent the tax returns for 2005, 2006, and 2007. I applied for a CR1 for my wife, and if they now require me to add the 2008 papers, that will really mess things up. I currently make well over the poverty guidelines, and I also made over those numbers in 2007. But in 2008 I was out of the country most of the year. Will this ruin things and make me have to get a co-sponsor even though I currently make over the required amount? If I have to get a co-sponsor will I now have to redo all my I-864 papers so that those numbers match too? This sucks!

I mean, had I known that they would pull this, I would have turned my world upside to get my returns done for the interview. I would suggest you do the same, why give them the opportunity to delay things if you can avoid it. She doesn't know what I earned for 2008, so she told my wife that if I didn't make the limit, I would need a co-sponsor. I would seek professional advice or advice from members more familiar here.

Getting your taxes done does not take forever. I jsut finished doing one for a client with 2 W2s, 5 1099 MISC,schedules A, E and C . I efiled it and I should have the acceptance by tonight. It would be ready for his wife's interview at USEM in Manila on April 13. Do not give the Embassies any reason to do this kind of thing to you. I am sure you can get it done. GOOD LUCK.

K-3 Spouse Visa Process & ProceduresVISA DENIED
QUOTE (S&D4EVER @ Mar 23 2009, 04:13 AM) <{POST_SNAPBACK}>
Stephen just called me (6:45am - March 23rd 09) and told me his visa was DENIED? He said they told him our relationship WASN'T bonified, can you imagine! He said the interviewer had the nerve to ask him WHY DIDN'T HE EVER GET MARRIED (because he's 50) before, Stephen replied "because he never met his SOUL MATE until now (meeting me)." He said the interviewer told him that he feel Stephen TOOK ADVANTAGE OF ME (LIKE I DON'T HAVE A FREAKING MIND OF MY OWN TO MAKE MY OWN DECISION).

OK, enough of me ranting ... If I ever needed Vjers, it's NOW, WHAT DO I DO NOW? Do I contact my Congressman (they just opened an office in my town)?

I am sorry to hear this my sister. You need to appeal this decision. Age is just a number and as long as you have the facts to back up your relationship, age should not be a factor. GOOd LUCK.
