I have a divorce decree. It was issued and served today.=)

 

We just expected it before today. So when Marife signed her papers she put the 30th on them and mailed them to me. it's all good, I am just having her send new ones with a new date.

yeah good.. just send a copy of that thing with the court stamp and the initials  .. in my state it is a dissolution, yours is a decree? is that right? .. and you wont need to send the original at any time

Yes I am aware that those are listed on the I-864 requirements,  as is 3 times for assets which is not the case with the I-134 (it asks for 5 times). 

 

Embassies seem to pick and choose what they require with the I-134, "making up the rules as they go along".

Where does it say the car has to be a 2nd vehicle?  I didn't read that anywhere (FYI a car does not have to be sold to access the equity).  Also I did not read anywhere that it states the home equity has to be assessed easily within a year.  Links to government websites for this please.

 

I-134  Neither of your statements are listed.

I am going by the 864 requirements outlined by the state department.. they are much more specific than the 134

A car or home can be used as an asset, just need to show the actual cash value.  ...per the USCIS webpage, it states that property is acceptable, no exceptions are listed.

 

The requirement is 5 times the shortage for a K-1.  ... easily found on the USCIS website.

 

 

For the Philippines, the embassy requires the most recent tax return, W-2 and the petitioner may include pay stubs and employer letter, bank statements if additional assets are in savings.  The requirement is 125%, even with the I-134 for USEM, no exceptions.

the car can be claimed if it is a second vehicle.. home equity can count as long as it can be accessed within one year .. or is there a hidden 134 requirement again ??

yes true.. check with the embassy specifics.. the 134 supporting document is subject to the interviewing officers mood (ok perception.. whatever).. the 864 is the real document.. the 134 is more of a intent to commit.. the 134 requirements are 100% of the poverty guideline, but there is no need to shoot for 100%, you need the 125% for AOS anyway

the 864 is for adjustment of status and will be used after your marriage and concurrent filing with uscis

think of the 134 as a commitment and the 864 as the contract for the commitment

for your tax returns.. use transcripts.. they are free and delivered within 10 days.. copies are fine so you can email them to your fiancée

you don't NEED 3 years, it just helps the interviewer make an educated decision based on historical earnings

So I submitted my k-1 application late February and unfortunately I was never advised to submit proof of my relationship (photos, letter of intent, etc). A lot of the case numbers close to mine have been either approved or received a RFE. Should I be proactive and send this information in now, or should I wait until I receive an RFE? Suggestions? My application is at CSC. Does anyone know an address where this information should be sent? And should I attach a copy of the letter I received from them so that they know my case number? Any help would be appreciated.

How much is all dependent on your embassy. Some of us going through tough embassies so you see we provide everything and the kitchen sink.

 

Best thing to do is look at your countries forum read the interview reviews ask around your forum ad see what others are doing.

 

But a log of communications is not bad for anyone. No not every thing but a few pages showing  this and that and all the other evidence we use.

 

Since you don't have your countries flag up i don't know but Africa, the MENA's Pakistan , Asian countries all are High fraud and tough embassies and lost of good evidence is needed.

 

What may be too much for UK or Canada is just right for a MENA or Nigeria. It;s very common for these embassies to get 10 to 30 lbs of evidence from one couple.

Hello!

 

I was trying to gather information for "proof of ongoing relationship." After reading this forum I see that a lot of people print out things from skype, fb, and viber for proof of ongoing relationship. However it seems like too much to me! Me and my fiance talk everyday, all the time! And not just on skype. We go back and forth from viber, fb, and skype! Also, I use my ipod touch to skype with him, and the screen is too tiny for screen shots and it takes WAY WAY longer to scroll up to previous conversations then on the computer....my mom and his family sees us skype everyday. I don't know if a personal statement from them would help?!?!

 

Any advice on how to provide "easier" and/or a less condenced form of "proof of ongoing relationship"??

 

Also,

I am going to visit him for a month in September and will be providing a copy of my flight itinerary, is this proof as well?

please read the guides and definitely spend a few hours reading threads at the minimum

frontload like crazy for high fraud countries as the others stated

your dilemma about paperwork.. show quality over time, not quantity... you can show a few snippits out of chats over months that will be a few pages long

personal statements are useless

you can write a description of the relationship over time, that is a little more pointed and stick to the facts, not emotions

It came up in the interview, but luckily I had my separation agreement with me to show that we'd actually been separated for 5 years--just hadn't gotten around to the formal divorce til later. So you might get asked about it.

Actually, that's not entirely true.  You can't work in the U.S. -- that's for sure.

 

Working on the internet and doing everything through Canada, on the other hand, is not against the law, as far as I have heard.  It might be best to ask, but since it is not being done in the U.S., I'm pretty sure it's perfectly fine.

 

I disagree. I needed a special visa to work as a journalist writing for Canadian publications, while in the U.S.

so, i'm becoming exceedingly annoyed with all the conflicting/outdated information that i'm reading/finding...

 

does the beneficiary, when going for their interview actually NEED an noa2 from the petitioner? my fiancee never received anything from her local embassy except an email TO ME that told us to pay for the visa and schedule and interview. 

 

does she NEED a letter of employment from me? does it HAVE TO BE an origial, or can i scan and email it to her for her to print? i find a disagreement with this because my W-2 and tax papers should provide sufficient evidence of my employment and assets. 

i don't know how many people that have completed their K-1 process will remain active, but those that do, or know for a fact, please chime in. please chime in. the information i am finding on this website, are inconsistent with what the embassy instructions state:

Once you apply for AOS, she can start school. Thats my understanding.

 

She can also work before obtaining a green card, if she gets a work card.

 

A SS number never (almost) changes, so use the SS number she already has.

 

To travel outside the US, she will need either a green card or permission to leave. Thats very important. If she leaves the US without permission, her AOS petition may be considered abandoned. Then she will not be allowed back.

The K-1 visa is only for the purpose of entering the country to marry you, not school or work. However, once married, you can apply for AOS. Once you have applied for AOS she is in the country legally for other purposes. At that time, you can apply for authorization to work which should be granted quickly. Going to school should be no problem. She can stay in the country until her AOS is fully adjudicated, just dont get a job without the work card. The green card comes much later. I think she can start school once AOS is applied for.

 

In some states, illegal aliens get in state tuition! Dont sweat that. Being in the military makes some things go faster, if you tell them you're military, at least if you're shipping out and need to expedite. It wont hurt to ask to be expedited or other military benefits.

 

I dont know Kiev personally, but I dont think they are required to email those documents to you. If someone is receiving the documents at her mailing address on file, they can scan and email them to you and your fiancee. Then you submit all that is required to the embassy. Some or all of the required docs will be brought to the interview. She may be required to have a medical exam in Ukraine at a certified facility, not Germany, check that out. Make sure she has originals of all the documents you submitted with the I-129f petition. She may need to show them at the interview.

Hello,

 

I am filing out the papers for my k1 visa- but I have two addresses. I am an American and Israeli citizen and I have an address in New Jersey and an address where I live with my fiance in Israel. My fiance and I would like to get married in NJ and move there permanently- but we plan on staying in Israel until that official move after we get the K-1 visa.

 

In question 18 I am writing about how I currently live with my fiance in Israel- but the address I am putting is my New Jersey address. I am really unsure which address is advised to list on the form and how I would list both.

 

On the visa documents am I ment to put my American address or my Israeli address?

 

If you have any knowledge or experience in this regard please share.

It seems that USCIS considers the address of the petitioner on the form I-129f (#2) to be a mailing address. Even though I told USCIS, in a supplemental page, my residence and mailing address, they still mailed my NOA1 to the residence address, where mail is not delivered! I would fill out the I-129f (#2) with my mailing address on the face of the form (which is scanned into the system); and then attach a supplemental page with my residence address, if different. Later in the form (#14) there is a place to enter the intended residence.

There is a tab in the I-129F that gives me headache: 

 

  • If your fiancée's native alphabet uses other than Roman letter, write her name  and address abroad in the native alphabet. 

 

So what does this signify? Im from morocco and my native language is Arabic and the most used language here is  french. My fiancé is american and filling the I-129 F herself. Does this tab mean that she should write my informations in arabic? sleepy.gif  she doesnt know any arabic!!!

Assuming that your fiancee (petitioner) is in the USA, and you are in Morocco, have your fiancee download and fill out the I-129f (except for the signature) the info can be save in that PDF file. Then she emails the filled out form I-129f to you, which you print out and fill in your name and address in Arabic. You then scan and email the completed form back to your fiancee (petitioner), who prints out the form and signs it as an original, to be filed with USCIS.

I would recommend that you verify this with an immigration lawyer so you don't waste time and money on a K1 visa filed too soon.

 

 

Good advice. Some laws of your country may follow you as long long as you're a citizen; just as some laws of the USA follow American citizens, wherever we go. Check it out.

A K-1 visa requires that you be able to marry, in the USA.

 

If the divorce decree (you must provide a certified translation to English) does not limit your ability to marry, and no laws in DR prohibit you from marriage in the USA, you should be ok.

All good advice. I will add that I personally know of successful cases where income tax returns were not filed, because of the income level.

 

Other proof of income was accepted, such as social security income shown by SSA-1099 forms.

 

Use the proof of current miltary pay. If you submit a statement explaning the circumstances, make sure it is signed and dated by the petitioner. Take originals to the interview, to show if asked.

 

At the K-1 level, you must show income (or assets) above 100% of the poverty level; but when you're married, you must show above 125% of the poverty level, for adjustment of status. Consider showing 125%, even at this stage.

 

Having a co-sponsor would help. If your own income/asset profile doesnt meet 125%, ask friends and family about co-sponsoring. They dont need to be rich, they just show income/assets to boost yours.

 

Also search VJ for any possible miltary benefits/waivers regarding proof of support.

Tthe part above the black line, with the asterisk, is just a reminder that any document not in English must include a certified translation into English. 

 

The evidence that they are asking for is below the black line.

[2. "Last Personal Meeting" Evidence of your having met in person within those 2 years before the petition, such as the examples they note.

[If you have not met in person, you must ask for a waiver of the meeting requirement, based on the "Extreme Hardship Waiver" or "Violation of Customs" rules; and show evidence of that.

 

You dont need to show both.

Hello everyone! I hope your journeys are going well! We sent in our DS 230 and are currently waiting for an interview date..it's been 11 days so God willing, hopefully soon!! I just have a quick question..

 

Our co sponsor finally sent me all the documents needed for the interview (when we have it). She had to wait a long time for her employer to do up her statement of employment. I mailed out the documentation to my fiance but i'm scared to death that he may not get it in time. I also sent a set to a friend who will be travelling to Tunisia but she's not sure exactly when yet as she was having some issues. I sent it to my fiance the fastest way possible via USPS..but i've sent stuff the quickest way before and it still took a month to get there..DHL costs wayyyyyyyyyyy too much and i would have had to drive over 30 minutes away to mail it out as that was the closest facility. I made colored copies of everything before i sent it.

 

Our dilemma is: What do we do if he doesn't get it in time? Would it be okay to scan colored copies and email it to him to print out? All have the original signatures, dates, etc. It would just be a copy of the originals. Would it be acceptable for the embassy to have the copies and he could tell them that the original documents are on the way in the meantime? This, of course, is worst case scenario in the event that he WOULDNT get it in time..

 

Any advice would greatly be appreciated!! Thanks so much!

Having the scanned and emailed copies on hand would be better than having nothing. Send the scanned copies to the interviewee, bring them to the interview, present them if asked. I would also make an affidavit, signed and dated, attesting to the validity of the copies and that originals can be presented when available. The case might be placed into administrative processing until the originals are presented; but thats better than a denial. Only present documents thay they ask for.
