Yes I did submit hotel bills, passport and bus tickets and city tours for places we went together. The thing that sucks is that in the city where we lived its extremely difficult to rent an apartment unless you know the person renting it so all that is done in cash and in a very under the table kind of way (its weird, I know) so there's not really official paperwork showing we were renting a place together. I guess there is no real proof. A friend of mine came to Argentina to visit me while I lived there and we took her everywhere, she wrote a worn affidavit and also submitted pictures of all of us together. I hope that is helpful as well.

Thanks guys for responding. Yes our relationship is very real, we met at work while I was living in Argentina and we moved in together. Now I'm back home and we decided to marry. There are pics and proof of us having gone on vacations together and there is nothing at all that should raise any red flags the way I see it. Fingers crossed they'll see we're legit. This is my first post. I filed our I-129F on August 23rd. I've read (googleing around the internet) that an age difference can be a reason for rejection of the application. Of course now i'm worried about it. My fiance is younger than I am and our age difference probably wouldn't be an issue if it was the man who was younger but that's not the case. Does anyone know if age difference matters for any reason?

I'm not sure we have to fill this document anymore due to this update because on the DS-160 online they ask you the same questions :

 

Effective immediately, all K visa applicants are required to complete the DS-160 Online Nonimmigrant Visa Application. The DS-160 replaces forms DS-156, DS-156K, and DS-230.

For K visa cases already in process at a U.S. embassy or consulate, the DS-160 is not required when, prior to October 7, 2013, one of the following situations exist:
  • The K visa applicant is already scheduled for an interview.
  • The K visa applicant has already been interviewed and has been requested to submit additional documentation or is pending administrative processing.
  • The K visa applicant has already submitted a valid, signed, unexpired DS-156, DS-156K and/or DS-230 or received instructions to do so.

I apply for a tourist visa to the U.S. Which was denied me, I said I was going to a church in Texas to preach in it but my intention was to go to Texas to preach in the church because I had an invitation to go and then go to LA to be with my fiancee.
In the interview I did't mention anything about girlfriend in LA, they denied me the visa on the basis that I did not have family relationships that would make me go back to Colombia.
A few months ago my Promised exactly she made the request in a K1 Fiancee visa for me, then I want to know if I would have some kind of problem according to my previous request (was in March this year and my fiance sent the request in April )
Also I would like to know if any problem because my girlfriend is 30 years old and I have 19 years

My fiance and I have recently been approved for our K1 peition. I am the beneficiary. We recently filled out the I 134 form and we got copies of his last 2 years income tax records and about4 of his most recent paystubs. He makes about 30000.00 a year, which is quite a ways above the poverty limit for 2 people. I am wondering if that is enough. I have read that others have gotten copies of bank statements and letters from their employers. Is that required?

each embassy is different on how they view the 134

since you make well in excess of the minimum, just stroll through the 134 instructions and let it ride

transcripts are always easier than tax returns.. they take less than ten days by mail to receive

That is akin to finding and matching up two needles in a very large haystack. There have been some limited reports of success, though, the probability of success is certainly not very high. :thumbs: At least with an RFE notice there is a reference point as to the location of the information-deficient petition at the service center, and a higher likelihood of matching the missing document to the correct petition. :unsure:

so the OP asked for information, you are giving your opinion based on what you have read, I am giving information based on first hand experience.. needle in a haystack yes for sure, but regardless of all the posts here, there is some sort of organized formats, bar codes, and sorting that allows all this information to be funneled into the correct location.. that is why you put it attention to the correct department.. its not like there are a million people working on certain file types in the offices unless of course they are working on DACA files

No you can not. There is no way to match up any subsequent mailings with your case files....until an adjucator opens the files (and send you an RFE) you have to just wait it out.

Hey everyone! So I'm nervous because I submitted the I129-f on October 24, 2013 I sent all proof and documents including satements of Intent to Marry. My fiance' sent me an original statement signed however I sent my intent to marry statement and I know I typed in my signature but I don't remember signing it. Does anyone know if I should expect an RFE? According to the processing time at VSC my application should be processed in the next few days but I am so worried about this statement. I would not want to delay the process I am so desperate to have him here already. I know ALL of you understand PLEASE HELP!!

I don't think you are looking at it incorrectly.. nor am I trying to scare you.. I had something similar, but different and ordered my criminal report from the state just in case which came back clear.

Go forward with your filing .. should be ok.. it's just those types of crimes I know can be scrutinized a little differently

Don't know yet. But still this kind of conviction that I might get is not on the list of the instruction for I-129F, where they ask if I am convicted in one of the following.... I found great website www.avvo.com where you can ask lawer a question and I got 3 responses from lawers and all of them said that this is not the type of conviction that might denied my I-129F. They only look for some serious sexual abuse convictions for the application. It would have been different story if my fiancee had any kind of convictions. It is much more difficult this way. I understand that my trouble doesn't make me a good moral history but anyway I hope everything is gonna be fine.

They never ask to mention anything like that in any form. they only ask convictions from the list they provide in the form. If they asked to mention that anywhere I would have mention. There is no sence to hide anything with USA social system. everything goes on your SS#!

I just graduted from school this year and started working last month for a company where I will be getting paid over the poverty line. During my time in school I was only working part time. From what I have read I know I will have to submit past tax transcripts which I have but don't show much earned because I was a full time student and a part time employee. So with that said....do I have to look for a co-sponsor or can I submit some type of proof (i.e. letter from employer) to prove that this year I will be making what is required.

if you have sufficient income you will be fine with w-2's and a letter from your employer.

it is based on current income and potential future earnings more than anything.

and yes you will have to submit past income verification...easiest is with the transcripts.. they take less than two weeks to receive

Legally, he could take you to court, it doesn't matter if he didn't pay, you have to start the eviction process which usually begins with a 30 day notice of termination. If they don't move out at that time, then you can start the eviction proceedings, which starts with you going to court and filing paperwork. If you didn't do either of these things, then you are not following the law. If you are going to be a landlord, you need to read up on landlord and renter's rights. They may vary from state to state, but generally you have to give notice, and any evictions can only be done with a court order.

 

As far as visas are concerned, I don't think you'd be charged with a felony, so it's probably not a concern. Still, if you have a court date to meet, and you have an interview scheduled at that same time, you would probably want to reschedule.

i am pretty sure this event happened in the k-1 applicant's home country.. just an fyi, so the way things work here in the US do not apply ;)

Ok I'm confused.  Why would the passport which has an incorrect last name be correct over the birth certificate?

what document would she use to enter any country in the world?

this is the one to use to avoid any issues

in addition, you can always write a letter to the reason behind it.. but honestly.. the names are all there, just in different places.. her visa will be attached to the passport.. a visa is what she will eventually apply for .. I would want my visa name to match my passport name when I am asked for that wouldn't you??  ;)

I would think that.  But I would also think the birth certificate would trump the passport.  Wouldn't it?


If it makes any more sense, apparently they didn't want her younger sisters to know she had a different last name then them.  So all this time they told her she had two middle names when in reality on the birth certificate she didn't.

 

And the hyphen isn't even part of the mom's maiden name.  I checked.  Lee is the dad's last name though.


nope the passport would trump the birth cert.. follow passport name throughout all documents and other names used as the birth cert name.. the passport is her official ID now

i saw a sample on the internet and came accross a quetion stating '' have u been denied a US visa before?

it continues that if u answer yes, u may be denied entry at the port of entry and that u should contact ur embassy. must that b a problem cos i was denied an F1(student) visa in 2011 but got a fiance visa this august,

the 1-94 shouldn't apply to you due to your visa type and will be overwritten once you Adjust Status (someone I am sure will correct me if I am wrong on this one)

regarding your concerns on POE, yes it will be NY and no your previous F-1 denial is a non issue.. if it was an issue, it would have been addressed at your interview.

Yeah, it appeared to me that way too. But the VO will most likely be American, not kazakh. 

well that is true, but you filled out said document in question and it is your definition of what they are asking that counts... if that is how your culture is with a definition of a fiancée, that is what counts.. there is no US dictionary they will reference ;)

I think you misunderstand the situation a little bit. I do not even know if we were engaged or not. After he proposed, and I said yes, we started prepare the wedding. We argued a lot and almost broke up. He said, maybe we should not get married so soon, let's wait, we're not ready. It was a heartbreak, but continued dating, I came to US. Now when I ask what we are going to do when I leave, he says "Probably K-1". So I do not even know if we are still engaged, or were engaged after we called it off. 

Also, we have a different definition for "fiance". In our culture, he becomes your fiance (zhenih) shortly before the wedding, like when you've bought rings and wedding dress, had bachelor's party and all ready to be husband and wife in a week, or month at most, and not simply after you say "yes" to his proposal. I realize it is different for American people. So I did not even realize I was lying, at the time of application.  If I was

Nope. I told the truth and sometimes the truth isn't nice. I didn't say anything derogatory towards her but neither did I sit here saying "You poor love" and placate her. She asked a question, I answered it truthfully... which is the purpose of this site.

 

You have only been on these forums for just over a month. If you believe this post is harsh you better start building a thicker skin because my post is almost heart-warming compared to some you see, not to mention what some people go through with USCIS.

 

Also, I suggest you familiarise yourself with the TOS. You are more than welcome to hit the report button if you believe I crossed the TOS in any way. Also, "calling me out" as harsh is detrimental to the OP. If you believe my advice is wrong, of course that's one thing, but if you're simply saying I'm mean, keep it to yourself or PM the OP and tell her to ignore me because I'm a big fat meanie. It detracts from the issue at hand to have bickering like this back and forth.

 

Best of luck with your journey, and yes, the OP should speak to several attorneys but also be wary of any promising the world. Personally I'd just file and see what happens, and hire an attorney if/when needed.

DS-160 says that its for a non-immigrant visa and DS-260 says its for an immigrant visa.  I'm really confused because different web sties give me different answers. I am Canadian and the fiancé of an American, and my visa type is a K1.  We are not married yet....and I am in the process of putting packet 3 together. I filled the DS-160 already and not sure what to do about the DS-260 now. Thank you for any information!!!!

For example, I sent in a scanned print of her letter of intent

I'm instructing her to send the original to me now.

Is there any way to send this to USCIS and have them add it to the case before adjudication?

Mailing it to them including the case receipt #, alien registration #, etc.

 

Or safer to wait until they request it, lest I lose the original?

I'm thinking it's safer to wait for the request...

My fiance is filling out his profile on US Travel Docs (he is scheduled for his K1 visa interview in about 2 weeks).  They ask for the "priority date" and say it can be found on the NOA1.  We are assuming this means they want the "received date" but just wanted to check with others to make sure this is correct.

I would also like help with the affidavit of support. I have the I-134 from my fiance and he is well above the poverty line... Do I still need extra proof that he can support me, eg. Tax returns ans pay stubs? Or will the I-134 be enough on its own?

I'm trying to figure out where it is listed because before learning better, we put Montreal, but as I live in Manitoba, it should actually be Vancouver and I want to make sure they caught this..... so..... where on the NOA2 am I looking?

it states on the NOA2 that is is forwarded to the listed consulate.

WHERE on the NOA2 is the name of that consulate located?

 

"Listed" doesn't mean listed on the NOA2. it means listed with them (as in, what they have on file as your consulate). It doesn't appear anywhere on the NOA2.
