I'm also going the route of having a courthouse wedding so that it can fit around the approval of the visa.  Then once we're married and able to stay in the same country, we will start planning a wedding with our family and friends which will probably take place a year or 1.5 years after the courthouse date.  It's just way too much for us to spend money visiting each other this year, file the paperwork, and plan our wedding all at the same time (I think I would explode from stress) so this seemed like a great option.

Thank you both for your great advice!  VJ people are amazingly helpful.  I'll try to contact the airlines and see if I can get a copy of another one or two visits, just to be safe, at least for the interview section.   I think he's visiting in February too so I'll have at least 2 visits for the interview.

My boyfriend is coming to visit me next week and we haven't submitted the I-129F yet so I told him to hold on to his original boarding pass for this trip.  Will that, in addition to the passport stamps and itineraries for previous trips during this past year, be enough primary evidence of having met within the 2 year? I threw out all our previous boarding passes, not thinking I would ever need them.  

 

If not, is there any way to get old boarding passes?  Can I request a copy from the airline? Or is that overkill since we'll already have one.

If we fill out the forms and mail them in the next few weeks, my boyfriend will be here in the US visiting but is leaving on Dec. 8.  Does that mean we would fill out question 15a-h?  I assume we would, but wasn't sure if that was applicable to short visits or if intended for a longer stay in the US.  Thanks!

Baron555, I had thought I had read somewhere on here where people had said they didn't have copies of their boarding passes & called the airlines for a copy, but I must have misunderstood.  Sounds like the passport stamp/itinerary combo will work ok though, so I'm relieved.

Sorry for the frequency with which I'm posting topics here.  I'm running into so many questions!  Maybe this will be helpful for others as well.

 

I have just gotten off the phone with United Airlines.  I asked them for a copy of my boarding pass (the flight was July 6-Oct 1, 2013 - so not all that long ago) because I only have the email itinerary and receipt.  After a few minutes on the phone with them, they said that all they could send me is a receipt/itinerary, which I told them I already had.  They then said that's all they are authorized to do because they can't re-issue boarding passes.  

 

From what I've read, some of you have been successful in requesting the actual boarding pass from the airlines after having lost or thrown away the original.  How did you do it??  Did I just get an unknowledgeable customer service person or does the willingness to send boarding passes vary by airline? 

 

My boyfriend is on a flight here tomorrow so assuming if all goes well we will have 1 official boarding pass to include in the packet.  Will that plus itineraries and passport stamps for 2 previous trips (one for me to UK, one for him to US) be sufficient?  

 

We also have a joint US bank account we opened in March 2013.  Would that be useful as primary evidence?

I would suggest having a co-sponsor lined up just in case she can't get employment in that time frame. Some approvals are going quickly and some take longer, so it's hard to guess when you might be needed to show that she's got employment.  I've been applying to jobs for over a month unsuccessfully (not that that's indicative of employment in the US or anything, just my personal experience) and with a co-sponsor that's one less stressor to deal with.  Good luck!  smile.png

You can open account settings in Fb and click on Download a Copy of your fb data. Thats the easiest way smile.png fb will send you an email with a link to zip folder with all your fb data including chat history.

OK, I think I am understanding a bit better now - the approval notice sure doesn't explain much, thank goodness for these forums on the internet!  So it looks like that approval notice gets sent from the California service center to the National Visa Center, who then sends it to the consulate in Canada, who will then send me a letter in Canada telling me to book my medical and interview once they get it.  Is that correct?

If this is the step 4 notice, then do you know what the dates mean?  There is a 4-month window, starting 3 days ago and going 4 months.  "Notice Type: Approval notice Valid from (4 month window dates given)."  I didn't think there was a time limit on getting an interview and medical done, or is there?

 

What's the National Visa Center?  This notice says to contact the consulate.  They don't give any info about the National Visa Center on the notice, or any directions to call them.

My Fiance and I started the paperwork for a K-1 in August.  We sent the forms, forgot a document, they wrote and asked for it, and we mailed it off to them.  (I'm the one immigrating, I am Canadian and am currently visiting my fiance in the US)

 

Today he received an I-797 in the mail that says it's an "Approval Notice", with a 4-month validity date.  It says it's not a visa, but that a copy of the form has been forwarded to the consulate, and to contact them with questions about visa issuance.  It gives info about how when I enter we have to marry within 90 days.  It doesn't mention any upcoming interviews or medicals or anything.

 

Is it really that easy, am I really approved to get the K-1, or is this just an indicator to contact the consulate for further direction?  It doesn't say that, it says it's an approval notice, and gives actual dates for how long it is valid.

 

If it is a real approval, since I am actually here right now (and they knew that, we put it on our original paperwork that I was currently visiting), could I get the K-1 issued somehow down here and marry before I return home?  I do have to return home, I work in Canada, so travel back and forth will be in my immediate future no matter what (I know that I have to apply for an exit permit if leaving once I have a K-1).

 

Thanks for any help anyone can give in figuring out this notice ... it has a number to call, but considering the office is already closed for the day and the Tea Party plans to shut down the government at midnight, I thought I would see what you guys have to say.  ;-)

We got our NOA2 yesterday.  The Visajourney.com K-1 process page says to call the National Visa Center in 2 weeks, and the consulate some time after that to see if they received our approval, but do I have to make any phone calls?  Won't it just happen on it's own?  

 

If I just hang tight and wait, the consulate will eventually send me the package with info about booking my medical and my interview, right?  And they will send that to me in about 6-8 weeks from now on average, am I correct?

 

I'm not super anxious about the process, so if things will tick along without me making frustrating and futile phone calls I am OK with waiting, and contacting them only if I don't hear anything.  Please let me know though if that will work or if I do need to start making phone calls.

The SSN won't be of much use in the K1 visa process, though you should use it in the appropriate place in the forms. It just won't give you any processing advantage. The savings will be useful, yes, in particular those of the US citizen. At the Embassy stage, when filing the I-134 Affidavit of Support, if your fiancee doesn't meet the income requirements for the poverty guidelines, she can use assets to strengthen her financial means and do without a co-sponsor. This would need to be 5x the difference between her earnings and the poverty guideline to meet. That would just be further proof that you would be financially provided for, so yes, helpful.

 

Hmmm. So it would be beneficial to combine our finances into her bank account, rather than have it split?

The issue with the co-sponsor is that it will act as a back-up, a buffer of sorts, in case they're not happy with your fiancee's employment situation. I would suggest to go ahead and file. Once she gets her job situation stabilized, she can ask for a letter from her employer stating the nature of her job situation (permanent, full time, yearly earnings) and use that plus the most recent pay stubs as proof of current income. IF the newness of her employment status is an issue, then you can resort to the co-sponsor as back-up.

 

Yeah I can imagine that. We would prefer to avoid it altogether, but I guess we could get it figured out "just in case". I think we will doublecheck our I-129F package and prepare it to be sent out in that case. Would it help our case if we have savings in our bank accounts? We have both been relatively frugal for the past few years as we knew money would one day come in handy..

 

Oh and to add to that, I do have an SSN as I worked for my last 6 months in LA. (on campus part time)

Hmmm.. Thank you for your guidance, its nice to hear a story similar to ours. Yeah I know there's the option of a co-sponsor, but we hope to avoid that. She did Work at least 18 months fulltime in the past 2 years, and only quit her job last spring (around the time where I had to return to Denmark), and is now actively searching for a new full-time job. She was above the 125% of HHS poverty line, and the jobs she has been applying to, will put her there as well. She is very qualified for them, but as with any job, its impossible to know the odds of getting them, and no matter how sure we are of her getting one, it is impossible to know if it will happen this week or in 4 months..

 

So I guess to follow up, should we go ahead and start the process without a job at hand? Count on her getting one before the interview, and just in case, have a co-sponsor or two ready and willing to sign?

First post here. I've been a relatively long lurker on this site and forum and have found a lot of help simply from reading around, and consider myself very learned on the matter of this whole process, but there is one thing I need to ask.. With a bit of backstory.

 

My fiancée and I have decided to get married, we were together "officially" (since we first met in person) for over 2 years in Los Angeles, which was over 3 years ago, and we were together even longer before I first came over (study visa at the time), due to family issues I had to return to Denmark back in March, this year, and she came to visit for a month over the summer. We have now decided to start the K1 process, but as she is finishing up her college classes she is not in a fulltime job. (The evidence of our relationship is not a problem by a longshot I'd say)

 

While she is actively searching, we would like to ask that, since there's an estimated process time of 5 months for the CA/LA office, we thought maybe we could start the I-129F process now and count on her getting a job before the interview, instead of waiting a month or two for her to get a job, thus postponing the time where we can be together again..

 

We had discussed marriage before, but we didn't think we would be torn apart, so we weren't in a rush, but I have been away for about 9 months, and havent seen her in the past 4-5 months now (not counting Skype)..

 

But yeah, long story short, can she begin filing the I-129F before she gets a job? And will a job be a problem for us, we are both 24 years old at the time of writing this post, and I know they are more inclined to require proof of support for younger people.. And does anyone have any ideas about minimum monthly salaries?

If you have any evidence of your relationship (from meeting until now) that she doesn't have, make sure to send that.

 

For example:

Photos of you two together (and/or with each other's family)

Copies of old boarding passes of your flight(s) to the U.S.

Copies of the stamps in your passport

Affidavit's of 1 - 3 of your family members, declaring they've met your fiancée

(this is what we sent with our I-129F at the time since we didn't have pictures of us together with our families)

 

The evidence sent with the I-129F can be limited to 3 - 5 of each document type.

These will show that you've met each other in person in the past 2 years.

Right.. Well I kinda just scanned those a while back and sent them as files for her to print, so we don't get a heavier letter/pricier letter from here. (Trying to save what money can be saved)

 

All our photos are digital and she has them, I scanned copies of both boarding passes and stamps for her to have as well.

 

The affidavit does actually sound like a good idea, but will it be taken into consideration at all? Although I do think I have pictures of my family with her, none of her family though.. Maybe except her sister, gotta look into that. We had already prepared 5 pictures to send, all ranging from when we met to now, but I see why it might be a good idea to have a family member included.

There is no obligation to apply for AOS if you have no intention of living in the U.S.  Sometimes, a K-1 visa is the only way to enter the U.S. for a wedding held in the U.S. (for family in the U.S. or whatever reason) if the fiancé is from a non-VWP country and the B1/B2 is not an option.

 

You can have your wedding here in the U.S. and then move to Brazil.  If and when you guys have decided to move to the U.S., you can file for the CR-1/IR-1 Spousal visa right in Brazil through the Direct Consular Filing (DCF) process and continue to live in Brazil until the visa is approved.  One thing to consider is that at the time you file for DCF, you (the USC) have to be a resident of Brazil.  Otherwise, you'll have to file for the spousal visa from within the U.S. The requirement that he not leave the U.S. until AP/AOS is approved is only if you intend to live here right after marrying on the K-1 (but once you do leave, that is it without a new visa of some sort!)

 

Yes unfortunately my fiance was not approved for a tourist visa...so we are seeking for a way for him to come and visit and meet my family.Thank you!

My sister did just that.  They wanted to get married in Brazil but it was so complicated that her then-fiance flew up to the US.  They got married here, he left after a couple of days and applied for her Brazilian 'green card'.    Her visa took about 6 months to process.     They never returned to live here though.  In your case, if/when you're ready to move to the states you need to file a petition - I-130 - for an immigrant visa to be issued for your husband.   You can do the paperwork in Brazil, provided they still have DFC at the time.

I was hoping someone would have an answer to my question. It is really important for me for my fiance to meet my family before we get married. We would like to get married here and then live in Rio. Does us getting married here tie him down to this country? Do we HAVE TO fill out the paper work for the green card soon after or can we worry about that when we decide to come back and live here? Can I process that paper work from abroad? Due to other personal reasons my fiance can not leave Rio for too long and I really want to go back and live out there as well.

For other consulates, yes, the petitioner would need to also fill out their own I-134. Someone that knows about how it works for London should come along and help you out. From what I understand, in London, they only need one sponsor. If your dad will co-sponsor, then he will be the one to provide an I-134 and supporting documentation. You can use a complete copy of the tax return with all forms, schedules, W-2s and/or 1099s, or an IRS tax return transcript.

 

I thought I read that somewhere as well. Confirmation, anyone? 

I'm not gonna take any chances, so I already ordered my transcript, but if I don't need it, it's one less thing to have my parents ship to us from the states (I'm fortunate enough to spend these eager months with my fiancée in the UK).

  • Do I need to fill out an I-134 as well?
  • Do I need to provide proof tax returns?
    • If so, do I need a "copy of tax return," or "transcript of tax return" from the IRS, or will it be sufficient to print off my return from turbotax (or freetaxusa.com in my case)?

We had a wedding in SA but it wasnt legal in the usa so we had to file a fiance visa ...we never got the visa because the interviewer said i should have come to nigeria and met his family and since i never met his family in person just on video call she thought the wedding is a sham ....and the fact he has never dated older women

 

I'm really sorry this happened to you. Is there any way to appeal this? I mean affidavits from various people, pages and pages of emails and chats, pictures and receipts sound like more than enough info to prove you have a relationship. I don't see how its possible to say this seems fishy. Who cares if he's never dated older women, what does that have to do with anything? Again, I'm sorry and I hope that there is a way into finding out if something further can be done in your case, best of luck and keep us posted.

I was very surprised that my wife in China brought tons of evidence of a bonafide relationship, but the interviewer didn't look at anything nor did she ask many questions.  There were just about 5 simple questions from the biography form and she was told she was approved.  I guess it's up to the interviewer and their mood at the time how tough they want to be.

Well it sounds like your wife went prepared which is good. You are right though, its totally up to the discretion of the interviewer. I hope we have the same thing happen to us as was in your case.
